Small Business Procurement Ombudsman Act of 2002

Small and Disadvantaged Business Ombudsman Act - Amends the Small Business Act to require the Administrator of the Small Business Administration to designate a Small and Disadvantaged Business Ombudsman for Procurement, who shall: (1) work with each Federal agency with procurement authority to ensure that small businesses are treated fairly in the procurement process; (2) establish a procedure for receiving comments from small businesses and personnel of the Office of Small and Disadvantaged Business Utilization (Office) of each Federal agency regarding the activities of agencies and prime contractors on Federal procurement contracts for small businesses; and (3) establish a procedure for addressing concerns received with respect to small businesses and Federal procurement contracting. Requires an annual report from the Ombudsman to the congressional small business committees evaluating such activities. Requires each Federal agency to assist the Ombudsman to ensure compliance with Federal procurement goals for small businesses, certain procurement policies, and Federal prime contractor small business subcontracting plans. Requires a Federal agency to submit a goal attainment plan upon failure to meet small business procurement goals. Requires each Office director to: (1) have experience assisting small businesses with Federal procurement; (2) not currently serve as the chief procurement officer of such agency; (3) have no other duties; and (4) attend meetings of the Office of Small and Disadvantaged Business Utilization Council. Establishes such Council. Increases, from the current 23 percent to up to 30 percent for FY 2006 and thereafter, the Federal small business procurement goal.

Revises the formula for determining the amount in an eligible individual's TEUC account. Sets such amount at the lesser of: (1) the total (currently half of the total) amount of regular compensation, including dependents' allowances, payable to the individual during the individual's benefit year; or (2) 26 (currently 13) times the individual's average weekly benefit amount for the benefit year. Increases an individual's account by half (currently all) of the amount originally established in that account if it is exhausted at the time a State is in an extended benefit period.

Peace Corps Charter for the 21st Century Act - Amends the Peace Corps Act to require all recruiting of volunteers to be undertaken solely by the Peace Corps. Conditions the President's authority to detail or assign Peace Corps volunteers to certain Federal and State agencies and other entities upon a determination that such a detail or assignment does not contradict the standing of such volunteers as being independent from foreign policy-making and intelligence collection. Requires the Director of the Peace Corps, before implementing any new initiative, to consult with the Peace Corps National Advisory Council and to report to Congress on: (1) the initiative's objectives and costs, and any impact it may have on existing programs and the safety of volunteers; (2) the status of security procedures in any country in which the Peace Corps operates programs or is considering doing so; (3) student loan forgiveness programs currently available to Peace Corps volunteers; and (4) initiatives the Peace Corps intends to pursue in order to solicit requests from eligible countries where the presence of volunteers would facilitate a greater understanding of the world and of diverse cultures and systems of government, including peoples from countries with substantial Muslim populations. Requires the Director to develop a training program for all Peace Corps volunteers in the education, prevention, and treatment of infectious diseases. Increases Peace Corps volunteer readjustment allowances to $275 a month. Establishes a program to award grants to private nonprofit corporations in the District of Columbia to serve as incubators for returned Peace Corps volunteers seeking to use their knowledge and expertise to undertake community-based projects.

Coastal and Estuarine Land Protection Act - Amends the Coastal Zone Management Act of 1972 to establish a Coastal and Estuarine Land Protection Program to protect the environmental integrity of undeveloped coastal and estuarine areas. Authorizes the Secretary of Commerce to make program grants to coastal States for the purpose of acquiring property interests. Prohibits any more than 75 percent of the grant funding from being derived from Federal sources. Authorizes the Secretary to provide $5 million for a regional watershed protection demonstration project that: (1) leverages land acquisition funding from other Federal conservation or acquisition programs; (2) involves partnerships with Federal, State, and non-governmental entities; (3) creates conservation corridors; (4) protects habitats under imminent threat of development or conversion; (5) provides water quality protection for areas under the National Estuarine Research Reserve program; and (6) provides a model for future regional watershed protection projects. Reserves 15 percent of program funds for acquisitions benefitting the National Estuarine Research Reserve. Specifies that when property is acquired under this program: (1) title will be held by the grant recipient; (2) property will be managed consistent with the purpose of the program; and (3) funds will be returned to the Secretary if the property is sold, exchanged, or divested.

Arming Pilots Against Terrorism and Cabin Defense Act of 2002 - Amends federal law to direct the Under Secretary of Transportation for Security to establish a program to: (1) deputize volunteer qualified pilots of commercial cargo or passenger aircraft as Federal flight deck officers; and (2) provide training, supervision, and equipment for such officers. Authorizes flight deck officers to carry firearms and to use force, including lethal force, when they judge the security of an aircraft is at risk. Shields air carriers from liability for damages in Federal or State court arising out of the actions or omissions of a flight deck officer defending a plane from criminal violence or air piracy. Shields flight deck officers from liability except in cases of gross negligence or willful misconduct. Directs the Under Secretary to prescribe requirements for an air carrier cabin crew training program and its instructors. Shields an air carrier liability for actions or omissions of training instructors or cabin crew in defending an aircraft. Shields training instructors and cabin crew from liability except in cases of gross negligence or willful misconduct. Directs the Under Secretary to form an Aviation Crew Self-Defense Division within the Transportation Security Administration to develop and implement the program for training cabin crew members. Directs the Under Secretary of Transportation for Security to study and report to Congress on whether possession of a nonlethal weapon by a member of an air carrier's cabin crew would aid the flight deck crew in combating air piracy and criminal violence on commercial airlines.

Makes Federal minimum wage requirements applicable to the Commonwealth of the Northern Mariana Islands. Reducing Crime and Terrorism at America's Seaports Act of 2002 - Amends the Tariff Act of 1930 to: (1) increase civil and criminal financial penalties for noncompliance with manifest requirements; and (2) apply them to owners of vehicles as well as operators. Prescribes criminal penalties for intentional falsification of a certificate of origin for exports. Requires persons in charge of land, air, or vessel carriers, including their agents, who must by law present a manifest to transmit certain specified identification and inventory information pursuant to an electronic data interchange system information before lading of cargo or clearance and loading of cargo. Requires shippers of waterborne cargo loading in a U.S. port (including an ocean transportation intermediary that is a nonvessel-operating common carrier) to submit a complete set of shipping documents within 72 hours before vessel departure. Subjects undocumented goods to search, seizure and forfeiture. Directs the Customs Service to develop a uniform system of securing or sealing at loading all containers originating in or destined for the United States. Prescribes a fine and a prison sentence for endangering safety at a seaport by committing an act of violence against a person at such a location or damaging the facilities. Increases penalties for theft from customs and for theft of funds earmarked for payment of customs duties, taxes, or fees. Amends the Arms Export Control Act to extend its exemption from certain prohibitions against transactions with countries supporting international terrorism to any transaction by a U.S. law enforcement agent determined by the President to be essential to U.S. national security interests or relating to an imminent threat of harm to a U.S. person or property (especially undercover investigations into unlawful arms trafficking). Directs the Attorney General to: (1) issue regulations to require carriers and port owners or operators to report certain information about cargo thefts; and (2) create a database for such reports.

Requires the U.S. Agency for International Development (USAID) to develop a comprehensive plan to empower women to protect themselves against the spread of HIV/AIDS. Establishes within the Department of State a presidentially appointed Coordinator of United States Government Activities to Combat HIV/AIDS Globally. Authorizes the United States to participate in the Global Fund to Fight AIDS, Tuberculosis and Malaria and increases financial assistance for vaccine contributions. Authorizes the Secretary of the Treasury to conclude an agreement with the Paris Club of Official Creditors and other specified multilateral development institutions to modify the Enhanced HIPC Initiative with respect to debt cancellation for eligible countries. Authorizes the President to provide assistance and coordination between international organizations for the global prevention, treatment, monitoring, and control of HIV/AIDS, tuberculosis, and malaria. Requires the President to establish a program to demonstrate the feasibility of facilitating services of American health care professionals in sub-Saharan Africa and other parts of the world severely affected by HIV/AIDS, tuberculosis, and malaria. Requires the Secretary of Defense to expand the Department of Defense program of HIV/AIDS prevention educational activities in sub-Saharan African countries. Requires the Administrator of USAID to establish a program of assistance that would demonstrate the feasibility of providing care and treatment to orphans, other children, and young people affected by HIV/AIDS in foreign countries. Sets forth principles for U.S. firms operating in countries affected by the HIV/AIDS pandemic.

Requires the Administrator, giving substantial weight to the recommendations of the majority of the Centers, to select the Center programs of two States from each of ten groups of States for participation in the pilot program. Provides grant limits. Terminates the pilot program four years after disbursement of the first grant. Provides privacy requirements applicable to Centers, a consortium of Centers, or any Center contractor or agent with respect to regulatory compliance assistance provided to small businesses.

Small Business Federal Contractor Safeguard Act - Amends the Small Business Act to modify contract consolidation requirements. Replaces definitions of "bundled contracts" and "bundling of contract requirements" with definitions of "consolidated contract" and "multiple award contract." Prohibits a Federal contracting agency from executing a procurement strategy that includes a consolidated contract valued at more than $2 million unless such strategy: (1) identifies benefits anticipated from consolidation and alternative contracting approaches that would involve a lesser degree of consolidation; and (2) includes a determination that the consolidation is necessary and the benefits justify its use. Provides that a procurement strategy that includes a consolidation valued at more than $5 million shall also: (1) be supported by market research demonstrating that such contract will result in cost savings, quality improvements, reduction in acquisition cycle times, or better terms and conditions; (2) include an assessment of impediments to participation by small businesses as prime contractors that result from such consolidation; (3) specify actions designed to maximize small business participation as subcontractors; and (4) not be justified by savings in administrative or personnel costs unless such savings are substantial in relation to the total cost of the procurement. Allows a small business, if an agency head solicits offers for a consolidated contract, to submit an offer that provides for the use of a particular team of subcontractors. Requires equal evaluation of such an offer.

Predatory Lending Consumer Protection Act of 2002 - Amends the Truth in Lending Act guidelines for certain credit transactions secured by the consumer's principal dwelling (high-cost mortgage). Requires additional disclosures that the consumer is contracting to pay a much higher loan than most people pay. Specifies additional prohibitions against prepayment penalties, except in certain circumstances. Prohibits all balloon payments. Prohibits the terms of a high-cost mortgage from including advance collection of a premium on a single premium basis for specified credit insurance products. Restricts the amount of points and fees which a creditor may finance in connection with a high-cost mortgage. Prohibits certain creditors from financing the prepayment fees or penalties due from the consumer. Prohibits a high-cost mortgage creditor from engaging in specified practices, including requiring arbitration or any other nonjudicial procedure as a method for resolving any controversy or claims arising from the transaction. Declares a consumer's waiver of the right of rescission ineffective if the creditor either advised, or encouraged such waiver, or required it as a precondition for a transaction. Amends the Fair Credit Reporting Act to mandate that each high-cost mortgage creditor (including the successor creditor) report the debtor's complete payment history to certain consumer reporting agencies in accordance with specified regulations.

Revises and expands the terms of membership for the sea grant review panel. Authorizes appropriations for: (1) FY 2004 through 2008; and (2) zebra mussel, oyster, harmful algal bloom, and additional support to the fisheries extension program. Limits the percentage of funds available for administration.

Tax Haven and Abusive Tax Shelter Reform Act of 2002 - Amends the Internal Revenue Code to set forth general and special rules defining economic substance. Doubles the penalty for certain tax accuracy related underpayments. Penalizes the promoter of tax avoidance strategies which have no economic substance in an amount equal to 100 percent of the gross income derived. Modifies provisions concerning penalties for aiding and abetting understatement of tax liability, including adding provisions directed specifically at individuals who advise, represent, or procure certain tax shelters failing to meet legal requirements. Revises provisions concerning the failure to maintain lists of investors in potentially abusive tax shelters to set the penalty for certain violations at 50 percent of gross proceeds. Creates a new penalty, the penalty for failure to include tax shelter information with a return. Requires the registration of certain tax shelters without corporate participants. Requires Americans transferring money or property to a tax haven or to a resident of a tax haven to furnish information with respect to the transfer. Permits exceptions. Imposes a financial penalty where an individual fails to provide the information requested by the Secretary. Reduces certain specified tax benefits with respect to income from identified tax havens. Imposes a financial penalty of $5,000, in addition to any other penalty imposed by law, for failing to keep records or file a required report with respect to any foreign financial agency transaction.

Safe Motherhood Act for Research and Treatment or SMART Mom Act - Amends the Public Health Service Act to direct the Secretary of Health and Human Services, acting through either the Office of Woman's Health, the National Institutes of Health, the National Institute of Child Health and Human Development, or the Centers for Disease Control, to address the health issues of pregnant women. Establishes the Interagency Coordinating Committee on Safe Motherhood to evaluate and coordinate Federal research and information efforts and establish and implement the national Safe Motherhood Campaign. Requires the development and maintenance of a single Internet website. Requires expanded and intensified research activities concerning pregnancy-related illness, injury, and death and the impact of chronic conditions, physical impairments, and mental health problems on the health of women during pregnancy. Requires the establishment of a Maternal Fetal Medicine Unit Network. Awards research and demonstration project grants to address racial/ethnic disparities in pregnancy outcomes. Requires: (1) studies of the quality of maternal health care (from a patient's perspective) and the effects of pregnancy on women's health; and (2) surveillance of pregnancy-related mortality and morbidity data. Amends the Federal Food, Drug, and Cosmetic Act to require the Secretary to address issues concerning certain drugs and medical devices and their appropriate use by or effects on pregnant or lactating women and/or fetuses, through: (1) identification and study; (2) pharmacoepidemiological data bases; (3) biennial review and prioritization (drugs); (4) labeling; and (5) the Women's Health: Take Time to Care (or a new) program.

Native American Small Business Development Act

Native American Small Business Development Act - Amends the Small Business Act to establish within the Small Business Administration (SBA) the Office of Native American Affairs, headed by an Assistant Administrator, to implement SBA programs for the development of business enterprises by Native Americans (American Indians, Alaska Natives, and Native Hawaiians). Requires the Office to assist Native American entrepreneurs to: (1) start, operate, and grow small businesses; (2) develop management and technical skills; (3) seek Federal procurement opportunities; (4) increase Native American employment opportunities; and (5) increase Native American access to capital markets. Requires the SBA to provide financial assistance to tribal governments, tribal colleges, Native Hawaiian organizations, and Alaska Native corporations to create Native American business centers. Requires each business center to conduct five-year projects for business education aid to such entities. Requires each assistance applicant to submit a five-year plan on proposed assistance and training activities. Establishes a four-year pilot program under which the SBA is authorized to award Native American development grants to provide culturally-tailored business development training and related services to Native Americans and Native American small businesses. Establishes a four-year pilot program under which the SBA shall award at least three American Indian Tribal Assistance Center grants to establish joint projects to provide culturally-tailored business development assistance to prospective and current owners of small businesses on or near tribal lands.
