Good Samaritan Remediation of Abandoned Hardrock Mines Act of 2023 This bill promotes the remediation of abandoned hardrock mine sites by Good Samaritans. A Good Samaritan means a person that is (1) not a past or current owner or operator of the abandoned site; (2) had no role in the creation of the historic mine residue; and (3) is not potentially liable under any law for the remediation, treatment, or control of the historic mine residue. The bill requires the Environmental Protection Agency (EPA) to establish a Good Samaritan pilot program. Under the program, the EPA may issue permits to allow Good Samaritans to remediate historic mine residue at abandoned hardrock mine sites without being subject to enforcement or liability under specified environmental laws for past, present, or future releases, threats of releases, or discharges of hazardous substances or other contaminants at or from the abandoned mine site. In addition, the bill establishes a Good Samaritan Mine Remediation Fund for land management agencies that authorize Good Samaritans to conduct remediation projects on federal land.

HHS COVID-19 Origin Transparency Act of 2023 This bill requires the Department of Health and Human Services (HHS) to publish all its information about the COVID-19 outbreak and related research, including previously unreleased information. HHS must report to Congress on any relevant information that it withholds from publication due to security concerns. The bill provides for the rescission of $1 million from HHS for each day it fails to comply with the bill's requirements.

Allowing for Recreational Resources for Outdoor Wellness Act or the ARROW Act This bill authorizes the use of federal elementary and secondary education funds to purchase or use dangerous weapons for sports clubs, teams, training, or related activities provided for students. Current law prohibits the use of these funds to provide any person with a dangerous weapon or training in the use of a dangerous weapon. The bill specifies that this prohibition shall not apply to the use of these funds for sports clubs, teams, training, or related activities provided for students.

This joint resolution nullifies the final rule submitted by the Department of Education titled Improving Income Driven Repayment for the William D. Ford Federal Direct Loan Program and the Federal Family Education Loan (FFEL) Program and published on July 10, 2023. This joint resolution nullifies the final rule issued by U.S. Citizenship and Immigration Services and the Executive Office for Immigration Review titled Circumvention of Lawful Pathways and published on May 16, 2023. The final rule established a rebuttable presumption that a non-U.S. national ( alien under federal law) entering the United States from Mexico without valid entry documents is ineligible for asylum if that individual had traveled through another country to reach the United States but did not apply for asylum or similar protection in that other country.

INvestor Democracy is EXpected Act or the INDEX Act This bill establishes guidelines for passively managed funds (e.g., index funds) that vote shares on behalf of fund investors in proxy shareholder votes. Under the bill, these funds generally must vote shares on a proportional basis according to instructions from fund investors. The bill establishes an exemption for routine matters and matters requiring approval of a majority of outstanding securities. Additionally, the bill establishes a safe harbor from these requirements for investment advisers.

Colorado River Salinity Control Fix Act This bill modifies the Colorado River Basin Salinity Control Act to increase the federal cost share of certain salinity control programs that reduce the salt load in the Colorado River and other waters in the basin.

Strengthening Telehealth and Education for Rural Communities Act of 2023 This bill reauthorizes through FY2028 and modifies the Distance Learning and Telemedicine Loan and Grant Program that is administered by the Department of Agriculture (USDA). The program supports telemedicine and distance learning services in rural areas through telecommunications, computer networks, and other advanced technology by students, teachers, medical professionals, and residents of rural areas. The bill expands the scope of the program to specifically allow the use of program funds for operational expenses associated with telemedicine programs. It also allows the USDA to waive matching fund requirements in certain circumstances and requires USDA to set aside a specific amount of funding allotments for programs that focus on substance use disorder treatment or mental health services.

Improving Care and Access to Nurses Act or the I CAN Act This bill allows other health care providers besides physicians (e.g., nurses) to provide certain services under Medicare and Medicaid. Among other changes, the bill (1) allows a nurse practitioner or physician assistant to fulfill documentation requirements for Medicare coverage of special shoes for diabetic individuals; (2) expedites the ability of physician assistants, nurse practitioners, and clinical nurse specialists to supervise Medicare cardiac, intensive cardiac, and pulmonary rehabilitation programs; and (3) allows nurse practitioners to certify the need for inpatient hospital services under Medicare and Medicaid.

Fair Debt Collection Practices for Servicemembers Act This bill prohibits a debt collector from threatening a service member with a reduction of rank, revocation of their security clearance, or military prosecution in the course of collecting a debt. The Government Accountability Office must report on the impact of this prohibition on the timely delivery of information to service members, military readiness, and national security.

Responsible Wildland Fire Recovery Act This bill authorizes the Department of Agriculture (USDA) to waive certain requirements for matching federal funds in fire recovery projects. Specifically, USDA may waive cost-sharing requirements for projects responding to fires resulting from management activities (e.g., controlled burns) conducted by USDA on National Forest System land.

Interactive Federal Review Act This bill revises the environmental review process for federal-aid highway projects. Specifically, the Department of Transportation (DOT) must encourage recipients of federal highway funding to utilize interactive, digital, cloud-based platforms when carrying out environmental reviews under the National Environmental Policy Act of 1969 (NEPA); select at least 10 federal-aid highway projects to demonstrate the use of interactive, digital, cloud-based platforms in carrying out the environmental impact analysis and community engagement processes under NEPA; and publish technology-neutral best practice guidance to encourage sponsors of projects that receive federal funds from DOT to use an interactive, digital, cloud-based platform in carrying out the environmental impact analysis and community engagement processes required under NEPA.

Lummis-Gillibrand Responsible Financial Innovation Act This bill provides for the regulation of crypto assets. The bill outlines agency jurisdictions over types of crypto assets and ancillary assets. For example, the bill provides that the Commodity Futures Trading Commission (CFTC) has jurisdiction over crypto assets that do not provide their holders with financial interest in a business entity. The bill also establishes consumer protections, including by requiring (1) a crypto asset intermediary to provide proof of possession or control of all its crypto assets, and (2) an annual verification of assets by an independent public accountant. The bill also provides for the establishment of customer protection and market integrity authorities upon approval by the Securities and Exchange Commission (SEC) and the CFTC. In addition, the bill imposes criminal penalties for violations of certain financial recordkeeping requirements involving crypto asset transactions. Further, the Department of the Treasury, the SEC, and the CFTC must assess the compliance of the entities they regulate with anti-money laundering programs and countering the financing of terrorism requirements. Under the bill, any stablecoin must be issued by depository institutions. Institutions must hold 100% of the value of all outstanding stablecoins in reserves and allow stablecoins to be redeemed at par. The bill also provides for the tax treatment of crypto assets, including an exemption from income tax for purchases using digital assets that result in a gain or loss of $200 or less.

Wildland Firefighter Paycheck Protection Act of 2023 This bill establishes specialized pay for federal wildland firefighters. Specifically, the bill provides for a specialized pay schedule for wildland firefighters in the Forest Service and the Department of the Interior. The specialized pay schedule is based on the General Schedule, increased by a specified percentage depending on the position grade (the higher the grade, the lower the percentage adjustment). The bill also provides for specialized premium pay for wildland firefighters who respond to certain prolonged fire incidents (i.e., those that are not contained within 36 hours). It also provides for paid rest and recuperation leave in conjunction with such responses.

Iran Sanctions Relief Review Act This bill restricts the President's authority to unilaterally undertake certain actions with respect to Iran and increases congressional oversight of those actions. Specifically, the President must report to Congress before terminating or waiving sanctions related to Iran or taking a licensing action that significantly alters U.S. foreign policy with respect to Iran. Each report must (1) describe the proposed action and its rationale, and (2) indicate whether or not the action is intended to significantly alter foreign policy concerning Iran. If the intention is to alter that policy, the report must provide additional information about the policy objectives and anticipated effects of the action. After the President submits a report, the bill provides Congress with a 30-day period to review it; this period is extended to 60 days for reports submitted between July 10 and September 7. During this period, Congress may enact a joint resolution approving or disapproving the action. During the review period, the President may not take the action unless Congress passes a joint resolution of approval; if Congress enacts a joint resolution of disapproval, the bill prohibits the President from taking the action. The bill also outlines procedures for the introduction and consideration of these types of joint resolutions.

This resolution addresses constitutional concerns related to Article V of the North Atlantic Treaty, which provides for collective action by NATO members when a member is attacked. Specifically, the resolution expresses that, even if the President determines it is necessary to engage U.S. forces in hostilities in order to meet U.S. obligations under Article V, such action does not supersede the constitutional requirement that Congress declare war or authorize the use of military force prior to the United States engaging in hostilities.

Medicare Multi-Cancer Early Detection Screening Coverage Act This bill allows for Medicare coverage and payment for multi-cancer early detection screening tests that are approved by the Food and Drug Administration and that are used to screen for cancer across many cancer types, if the Centers for Medicare & Medicaid Services determines such coverage is appropriate.

Connect Our Parks Act This bill requires the National Park Service (NPS) to assess locations within the National Park System with the greatest need for broadband internet or cellular service, and to develop a plan for the placement of broadband and cellular infrastructure in parks. In assessing where broadband service is most needed, the NPS must consider the current availability of broadband in housing, lodging, administrative facilities, developed campgrounds, and other areas within each park. In assessing where cellular service is most needed, the NPS must consider locations where the availability of cellular service in a developed area of a park would increase public access to emergency services and traveler information or the communications capabilities of NPS employees. The NPS must complete the assessment within one year of the bill’s enactment. Further, within three years of the bill's enactment, the NPS must develop a plan based on the results of the assessment to install broadband and cellular service infrastructure at locations within the National Park System. In developing the plan, the NPS must consult with affected tribes and local stakeholders. The plan must (1) be technology neutral; (2) provide for infrastructure to be located in previously developed areas or areas zoned for uses that would support infrastructure; and (3) avoid or minimize impacts to cultural and natural resources, the visitor experience, and park viewsheds. The plan must also provide for the use of public-private partnerships for the installation of equipment and provision of broadband or cellular service.

Mandatory Materiality Requirement Act of 2023 This bill requires the Securities and Exchange Commission (SEC) to limit issuer disclosure requirements made in a rulemaking. Specifically, the SEC must provide that an issuer of securities is only required to disclose information in response to a rulemaking if the issuer determines that this information is important to a voting or investment decision regarding the issuer.

Creating Opportunities Now for Necessary and Effective Care Technologies (CONNECT) for Health Act of 2023 or the CONNECT for Health Act of 2023 This bill expands coverage of telehealth services under Medicare. Among other provisions, the bill permanently removes geographic restrictions on originating sites (i.e., the location of the beneficiary) and allows the home of the beneficiary to serve as the originating site for all services; permanently allows federally qualified health centers and rural health clinics to serve as the distant site (i.e., the location of the health care practitioner); and allows the Centers for Medicare & Medicaid Services (CMS) to generally waive coverage restrictions during any public health emergency. Additionally, the CMS must post certain information about the effects of Medicare telehealth services on its website, including information about utilization, costs, and the outcome of services. The CMS must also (1) provide resources to health care professionals about the requirements for furnishing telehealth services under Medicare, including with respect to payment, patient privacy, and support for underserved populations; and (2) ensure certain quality measures are applied to telehealth services.

Noninsured Crop Disaster Assistance Program Enhancement Act of 2023 This bill allows the Noninsured Crop Disaster Assistance Program (NAP) of the Farm Service Agency to provide additional coverage for crops and grasses used for grazing. Specifically, the bill removes an exception that prohibits certain additional coverage for crops and grasses used for grazing. (NAP provides financial assistance to producers of non-insurable crops when natural disasters result in lower yields, crop losses, or prevented crop planting.)

Protecting Americans' Data From Foreign Surveillance Act of 2023 This bill establishes certain export controls on personal data of U.S. nationals and individuals living in the United States. Specifically, the bill directs the Department of Commerce (in coordination with specified federal agencies) to identify categories of personal data that could be exploited by foreign governments or foreign adversaries and harm U.S. national security if exported, reexported, or in-country transferred in a quantity that exceeds the threshold established by Commerce. The bill outlines the requirements for establishing this threshold. Commerce must seek to balance the need to protect personal data from exploitation by foreign governments and foreign adversaries against the likelihood of (1) impacting legitimate business activities, research activities, and other activities that do not harm the national security of the United States; or (2) chilling speech protected by the First Amendment. The bill also requires Commerce to impose appropriate controls on the export, reexport, or in-country transfer of covered personal data, including through interim controls (e.g., informing a person that a license is required). Commerce may not impose a requirement for a license or other authorization pursuant to specified transactions, such as those in which the personal data is encrypted with technology that is certified by the National Institute of Standards and Technology. The bill applies certain export control penalties to officers or employees of an organization who knew or should have known that another employee was directed to illegally export covered personal data in violation of this bill.

This joint resolution nullifies the final rule issued by the Consumer Financial Protection Bureau titled Small Business Lending under the Equal Credit Opportunity Act (Regulation B) and published on May 31, 2023. The rule requires financial institutions to collect and report to the bureau credit application data for small businesses. On July 31, 2023, the U.S. District Court for the Southern District of Texas ordered the bureau not to implement or enforce the rule until a related pending case is resolved.

Direct Capital Access Act or the DCA Act This bill increases the number of daily round-trip flights allowed at Ronald Reagan Washington National Airport (DCA). Specifically, this bill adds 56 new slots at DCA to allow for 28 additional daily round-trip flights. (Airlines flying to and from DCA are subject to slot and perimeter rules set by federal law and regulation. The slot rules determine the total number of flight slots that can be handled in a given time period. In addition, a statutory perimeter rule limits nonstop flights to a 1,250-mile radius unless they are granted an exemption in law.) Current law limits DCA to a maximum of 67 hourly slots for flights both within- and beyond-perimeter; a round-trip flight serving DCA requires two slots (or a slot pair). Of those slots, 40 daily slots are exempt from the perimeter rule. Under the bill's slot increase, operations at DCA may not increase by more than eight flights per hour.

Pay Less at the Pump Act This bill eliminates the excise tax on domestic crude oil and imported petroleum products (known as the petroleum Superfund tax rate) beginning on January 1, 2023. The bill also eliminates the authority for advances to the Hazardous Substance Superfund from the General Fund of the Treasury. Under current law, the petroleum Superfund tax rate imposed is 16.4 cents per barrel (indexed annually for inflation). Amounts collected from this tax are deposited into the Hazardous Substance Superfund, which finances the remediation of certain environmentally contaminated sites. Further, under current law, the authority for advances to be appropriated to the Hazardous Substance Superfund extends through 2032.

This bill directs the U.S. Fish and Wildlife Service (FWS) to remove protections for the gray wolf under the Endangered Species Act of 1973 (ESA). Specifically, the bill requires the FWS to reissue the final rule titled Endangered and Threatened Wildlife and Plants; Removing the Gray Wolf (Canis lupus) From the List of Endangered and Threatened Wildlife and published on November 3, 2020. The rule removed the gray wolf in the lower 48 United States, except for the Mexican wolf ( C. l. baileyi ) subspecies, from the endangered and threatened species list. However, the U.S. District Court for the Northern District of California vacated the rule on February 10, 2022. As a result, the gray wolf reattained the protection status it had prior to the rule's promulgation. The bill also prohibits the reissuance of the rule from being subject to judicial review.

This joint resolution nullifies the Environmental Protection Agency rule relating to Federal "Good Neighbor Plan" for the 2015 Ozone National Ambient Air Quality Standards (88 Fed. Reg. 36654) and published on June 5, 2023. The rule ensures that 23 states meet "Good Neighbor" standards required by the Clean Air Act by reducing pollution that significantly contributes to problems attaining and maintaining health-based air quality standards for ground-level ozone in downwind states.

Tracking Bad Actors Act of 2023 This bill requires federal financial regulators to jointly publish a database of persons convicted or held liable in criminal, civil, or administrative actions regarding financial services that are brought by federal financial regulators, the Department of Justice, certain self-regulating organizations, or state or local agencies that voluntarily submit such information. The Government Accountability Office must report on the database five years after the database is operational.

Promising Pathway Act This bill provides for expedited, provisional approval of drugs for serious or life-threatening diseases or conditions. Specifically, the bill allows for provisional approval of drugs that are used to treat, prevent, or diagnose a serious or life-threatening disease or condition for which premature death is likely without early medical intervention. The Food and Drug Administration (FDA) must evaluate applications within 90 days of receipt. The FDA may approve applications if there is early evidence, including real-world and real-time evidence, of the drug's efficacy, as well as substantial evidence of the drug's safety. Provisional approval is valid for two years and may be renewed for up to eight years. The FDA may withdraw provisional approval in the event of serious adverse health effects. Drug sponsors that receive provisional approval must require all patients receiving the drug to participate in an observational registry, through which the drug sponsor may collect and submit data relating to the drug until it is fully approved. Registries may be operated by the drug sponsor or another entity. The FDA must annually review these registries; sponsors of registries that fail to meet the bill's requirements are subject to civil penalties.

No Free TRIPS Act This bill prohibits the U.S. government from negotiating or concluding any withdrawal from or modification to the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement) without explicit authorization from Congress. The TRIPS Agreement is one of several international agreements that led to the creation of the World Trade Organization (WTO). In October 2020, in response to the COVID-19 pandemic, several WTO members proposed a waiver of some TRIPS obligations, including obligations related to national patent laws.
