Medicare Sequester Relief Act This bill continues to exempt Medicare from sequestration until the end of the public health emergency relating to COVID-19 (i.e., coronavirus disease 2019). (Sequestration is a process of automatic, usually across-the-board spending reductions under which budgetary resources are permanently cancelled to enforce specific budget policy goals.)

Harriet Tubman Bicentennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the legacy of Harriet Tubman as an abolitionist. The Secretary may issue coins under this bill only during the period of January 1, 2024, through December 31, 2024. All surcharges received by Treasury from the sale of such coins must be paid equally to the National Underground Railroad Freedom Center in Cincinnati, Ohio, and The Harriet Tubman Home, Inc. in Auburn, New York, for the purpose of accomplishing and advancing their missions.

PPP Extension Act of 2021 This bill extends the Paycheck Protection Program, established to support small businesses in response to COVID-19 (i.e., coronavirus disease 2019), through June 30, 2021. Currently, the program is set to expire on March 31, 2021. For the final 30 days of the program (i.e., from June 1 until June 30), the Small Business Administration may only process applications submitted prior to June 1, and it may not accept any new loan applications.

Women and Lung Cancer Research and Preventive Services Act of 2021 This bill requires the Department of Health and Human Services to conduct an interagency review of the status of women and lung cancer. The review must report on the status of existing research and current knowledge gaps; identify new opportunities for collaborative research to determine the causes of lung cancer and advance prevention, screening, diagnosis, and treatment; and provide recommendations for a national cancer screening strategy and public education campaign.

Hotspots and Online Technology and Services Procurement for Our Tribes and States Act or the HOTSPOTS Act This bill establishes a two-year pilot program through which the Institute of Museum and Library Services must award grants to states, territories, Indian tribes, and organizations that primarily serve and represent Native Hawaiians to purchase and distribute internet-connected devices to libraries in rural and low-income areas.

Journalism Competition and Preservation Act of 2021 This bill creates a four-year safe harbor from antitrust laws for print, broadcast, or digital news companies to collectively negotiate with online content distributors (e.g., social media companies) regarding the terms on which the news companies' content may be distributed by online content distributors.

Hello Girls Congressional Gold Medal Act of 2021 This bill provides for the award of a single Congressional Gold Medal in honor of the female telephone operators of the Army Signal Corps, commonly known as the Hello Girls , in recognition of their military service, devotion to duty, and 60-year struggle for veterans' benefits and recognition as soldiers.

Developing Responsible Individuals for a Vibrant Economy Act or the DRIVE Safe Act This bill directs the Department of Transportation to promulgate regulations to implement an apprenticeship program for licensed commercial motor vehicle drivers under the age of 21. Under the program, an apprentice must complete two probationary periods that total 400 hours of on-duty time, of which at least 240 hours must be driving time in a commercial motor vehicle. Additionally, the apprentice must be accompanied in the cab of the commercial motor vehicle by an experienced driver. Further, the bill requires all commercial motor vehicles used in the program for training to be equipped with safety technology such as active braking collision mitigation systems and video event capturing systems. An employer shall not knowingly allow, require, permit, or authorize a driver under the age of 21 to operate a commercial motor vehicle unless the driver is participating in, or has completed, an apprenticeship program that meets the requirements set forth in this bill.

Connected Rural Schools Act This bill authorizes counties to use funds from the Secure Rural Schools Program to provide or expand access to (1) broadband services at local schools, or (2) technology and connectivity necessary for students to use digital learning tools outside of a local school campus.

American Jobs in Energy Manufacturing Act of 2021 This bill revises the definition of qualifying advanced energy project for purposes of the tax credit for such project. Specifically, the bill expands the definition to include property designed to produce energy from water, property designed to produce energy conservation technologies, light-, medium-, or heavy-duty electric or fuel cell vehicles, certain hybrid vehicles, and manufacturing facilities designed to reduce greenhouse gas emissions. The definition also includes projects located in a census tract in which a coal mine closed after 1999 and in which a coal-fired electric generating unit was retired after 2009, and provides additional credit allocations for projects to retool, expand, or build new facilities that make or recycle energy-related products, and for projects in communities where coal mines have closed or coal-fired electric units have been retired.

Non-Opioids Prevent Addiction In the Nation Act or the NOPAIN Act This bill temporarily establishes separate payments for certain non-opioid treatments under the Medicare prospective payment system for hospital outpatient department services and the payment system for ambulatory surgical center services. The bill applies to pain management treatments that are able to replace or reduce opioid consumption, as shown through clinical trials or data.

VOCA Fix to Sustain the Crime Victims Fund Act of 2021 This bill adds a new source of revenue for the Crime Victims Fund and makes changes to formula grants supported by the fund. Specifically, the bill directs revenues collected from deferred prosecution and non-prosecution agreements to be deposited into the Crime Victims Fund. Currently, such revenues are deposited into the general fund of the Treasury. Additionally, the bill increases the percentage—from 60% to 75%—of state compensation payments to crime victims in the prior fiscal year used to calculate formula grants for state victim compensation programs. Finally, the bill directs states to waive the matching requirement for recipients of state victim assistance formula grants during and for one year after a pandemic-related national emergency. It also allows states to waive the matching requirement pursuant to a policy established by the state.

This bill requires the Department of Veterans Affairs (VA) to designate one week each year as Buddy Check Week for the purposes of organizing outreach events and educating veterans on how to conduct peer wellness checks. The VA shall ensure that the Veterans Crisis Line has a plan for handling the potential increase in calls that may occur during such week.

Butch Lewis Emergency Pension Plan Relief Act of 2021 This bill modifies the funding rules and provides financial assistance for certain pension plans that are underfunded or insolvent. First, the bill expands the authority of, and provides funding for, the Pension Benefit Guaranty Corporation (PBGC) to provide special partition assistance to a multiemployer pension plan that is insolvent or at risk of insolvency. The bill expands eligibility for partition assistance, provides funding for a plan to reach a projected funded ratio of 80% over a 30-year period, and does not require a plan to repay such assistance. The bill further permits a multiemployer pension plan to elect to retain its funding zone status from the previous year for either (1) the first plan year beginning during the period from March 1, 2020, through February 28, 2021; or (2) the next succeeding plan year, as designated by the plan sponsor. A plan may also extend by five years the funding improvement or rehabilitation period if the plan is designated as in endangered or critical status for a plan year beginning in 2020 or 2021. A plan in critical and declining status may not suspend payment of plan benefits. Additionally, the bill adjusts the minimum funding standards for a multiemployer pension plan to account for investment losses and other losses related to the COVID-19 pandemic and modifies the PBGC guarantee formula to increase the maximum potential benefits under a multiemployer pension plan.

Democracy Is Strengthened by Casting Light On Spending in Elections Act of 2021 or the DISCLOSE Act of 2021 This bill addresses campaign finance, including by expanding the prohibition on campaign spending by foreign nationals, requiring additional disclosures of campaign expenditures, and requiring additional disclosures regarding certain political advertisements. First, the bill prohibits foreign nationals from participating in the decision-making process regarding an election expenditure. Additionally, the bill expands existing foreign money prohibitions to include disbursements for paid web-based or digital communications and federal judicial nomination communications. It also prohibits foreign nationals from contributing to campaigns related to ballot initiatives and referenda. The Federal Election Commission (FEC) must conduct an audit after each federal election cycle to determine the incidence of illicit foreign money. Next, the bill makes it unlawful to establish or use a corporation, company, or other entity with the intent to conceal an election contribution or donation by a foreign national. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both. Covered organizations (e.g., corporations, labor organizations, and political organizations) must, within 24 hours, file reports with the FEC to disclose campaign expenditures of more than $10,000 during an election cycle. Finally, the bill requires organizations to provide additional disclosures regarding political advertisements, including the donors who contributed the most money to that organization in the last year.

Veterans Claim Transparency Act of 2021 This bill requires the Department of Veterans Affairs (VA) to provide the representative of a veteran with an opportunity to review a proposed determination regarding a claim for compensation or benefits before such determination becomes final. The VA must notify the representative in writing that a proposed determination is ready for review and may not make a final determination until the review period has ended. Under the bill, a representative has up to 48 hours to review the proposed determination.

Advancing Uniform Transportation Opportunities for Veterans Act or the AUTO for Veterans Act This bill authorizes the Department of Veterans Affairs (VA) to provide (or assist in providing) an eligible veteran or service member with an additional automobile or other conveyance under the VA automobile allowance and adaptive equipment program. Currently, a veteran or service member with a specified service-connected disability or impairment may not receive more than one automobile or other conveyance under the program. The bill authorizes the additional benefit for such veterans and service members if 10 years have passed since the person last received such benefit.

Emergency Funding for Child Protection Act This bill funds additional grants to states for child abuse or neglect prevention and treatment programs in response to the COVID-19 (i.e., coronavirus disease 2019) pandemic. Specifically, states may use such grants to expand services, provide support to community-based organizations, purchase emergency supplies, and provide temporary direct payments to families caring for children under protective services supervision that are awaiting approval for government assistance, among other uses. The bill does not require states to match funding under these grants. The bill also provides funding to operate and expand the national child abuse hotline.

Continuity for Operators with Necessary Training Required for ATC Contract Towers Act of 2021 or the CONTRACT Act of 2021 This bill exempts certain air traffic controllers from a required reduction in their retirement annuity payment on account of earnings from certain work performed while entitled to such annuity. Under current law, retired Federal Aviation Administration air traffic controllers receive an annuity payment during the period between the mandatory retirement age of 56 and the Social Security minimum age of 62. Such annuity payment is required to be reduced by a certain percentage of any excess earnings during this period. The bill exempts from such reduction in annuity payments an air traffic controller who participates in the Air Traffic Control Contract Program (a public-private partnership for air traffic control services) following mandatory retirement.

Protecting the Right to Organize Act of 20 21 This bill expands various labor protections related to employees' rights to organize and collectively bargain in the workplace. Among other things, it revises the definitions of employee , supervisor , and employer to broaden the scope of individuals covered by the fair labor standards; permits labor organizations to encourage participation of union members in strikes initiated by employees represented by a different labor organization (i.e., secondary strikes); and prohibits employers from bringing claims against unions that conduct such secondary strikes. The bill also allows collective bargaining agreements to require all employees represented by the bargaining unit to contribute fees to the labor organization for the cost of such representation, notwithstanding a state law to the contrary; and expands unfair labor practices to include prohibitions against replacement of, or discrimination against, workers who participate in strikes. The bill makes it an unfair labor practice to require or coerce employees to attend employer meetings designed to discourage union membership and prohibits employers from entering into agreements with employees under which employees waive the right to pursue or a join collective or class-action litigation. Finally, the bill addresses the procedures for union representation elections, modifies the protections against unfair labor practices that result in serious economic harm, and establishes penalties and permits injunctive relief against entities that fail to comply with National Labor Relations Board orders.

Air America Act of 2021 This bill establishes the service of Air America employees as qualifying service for purposes of the Civil Service Retirement System. (Air America was a government-owned airline that provided air transport for certain covert operations in Southeast Asia, including Laos and Vietnam, between 1950 and 1976.) The bill applies to U.S. citizens who were employees of Air America or another affiliated company, as specified, between January 1, 1950 and December 31, 1976. Benefit applications must be filed within two years of the date of enactment of this bill.

Veterans Burn Pits Exposure Recognition Act of 2021 This bill requires the Department of Veterans Affairs (VA) to concede, for the purposes of health care benefits and wartime disability compensation, that a veteran was exposed to certain toxic substances, chemicals, and hazards from burn pits if such veteran served on active duty in a covered location during a specified time frame (unless there is affirmative evidence to establish that the veteran was not exposed during such service). A burn pit is an area used for burning solid waste in open air without equipment. Specifically, the bill covers the following locations and corresponding time periods: Iraq between August 2, 1990, and February 28, 1991, as well as from March 19, 2003, until burn pits are no longer used in this location; Southwest Asia (including Kuwait, Saudi Arabia, Oman, and Qatar) from August 2, 1990, until burn pits are no longer used in these locations; and Afghanistan, Syria, Jordan, Egypt, Lebanon, Yemen, and Djibouti from September 11, 2001, until burn pits are no longer used in these locations. Under the bill, if an exposed veteran submits insufficient evidence to establish a service-connection for purposes of disability compensation, the VA shall provide a medical examination and request a medical opinion regarding a causal link between the disability and a toxin, chemical, or hazard.

Secure Rural Schools Reauthorization Act of 2021 This bill extends through FY2023 payments made to states and eligible counties containing certain federal land under the Secure Rural Schools and Community Self-Determination Act of 2000. The Department of the Interior and the Department of Agriculture shall carry out a pilot program to allow the Chief of the Forest Service or the Director of the Bureau of Land Management to nominate members of resource advisory committees. County funds may be used to provide or expand access to (1) broadband telecommunications services at local schools, or (2) the technology and connectivity necessary for students to use a digital learning tool at or outside of a local school campus. Any county funds that were obligated by a county before October 1, 2017, but are unspent on October 1, 2020, may be used by the county for any authorized use and shall be available for projects initiated after October 1, 2020. No county funds may be used for lobbying activity, regardless of the purpose for which the funds are obligated on or before the enactment of this bill.

EAGLES Act of 2021 This bill reauthorizes the National Threat Assessment Center (NTAC) within the U.S. Secret Service. It reauthorizes the functions of NTAC through FY2025 and expands them to include the establishment of a national program on targeted school violence prevention.

Federal Initiative to Guarantee Health by Targeting Fentanyl Act This bill places fentanyl-related substances as a class into schedule I of the Controlled Substances Act. A schedule I controlled substance is a drug, substance, or chemical that has a high potential for abuse; has no currently accepted medical value; and is subject to regulatory controls and administrative, civil, and criminal penalties under the Controlled Substances Act. Additionally, the bill prohibits the application of a mandatory minimum prison term for certain drug offenses involving fentanyl-related substances.

Emergency Family Stabilization Act This bill establishes a competitive grant program within the Administration for Children and Families (ACF) for family stabilization agencies to provide emergency relief to children, youth, and families experiencing homelessness. These agencies include current ACF grantees or subgrantees, Indian tribes, tribal organizations, Native Hawaiian organizations, and other organizations with expertise providing direct services to those experiencing homelessness. Recipients may use grant funds for, among other purposes, personnel costs, personal protective equipment, and other supplies to mitigate the spread of COVID-19 (i.e., coronavirus disease 2019), as well as payments for security deposits and other housing-related needs. Additionally, the ACF must award the grants based on factors including the need for the services in the area served by the agency and specified allocation and prioritization requirements.

Paycheck Fairness Act This bill addresses wage discrimination on the basis of sex. Specifically, it (1) limits an employer's defense that a pay differential is based on a factor other than sex to only bona fide job-related factors in wage discrimination claims, (2) enhances nonretaliation prohibitions, (3) makes it unlawful to require an employee to sign a contract or waiver prohibiting the employee from disclosing information about the employee's wages, and (4) increases civil penalties for violations of equal pay provisions. Additionally, the Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs must train EEOC employees and other affected parties on wage discrimination. The bill directs the Department of Labor to (1) establish and carry out a grant program for negotiation skills training for girls and women, (2) conduct studies to eliminate pay disparities between men and women, and (3) make available information on wage discrimination to assist the public in understanding and addressing such discrimination. The bill also establishes the Secretary of Labor's National Award for Pay Equity in the Workplace for an employer who has made a substantial effort to eliminate pay disparities between men and women. Finally, the bill requires the EEOC to issue regulations for collecting from employers compensation and other employment data according to the sex, race, and national origin of employees for use in enforcing laws prohibiting pay discrimination.

TRICARE Retiree Protection Act This bill authorizes a covered beneficiary who is enrolled in TRICARE Select to reenroll in TRICARE Select at any time during 2021. Covered beneficiaries are those in the retired category who enrolled in TRICARE Select as of December 31, 2020, but did not establish a monthly enrollment fee payment during the 2020 TRICARE Open Season. A covered beneficiary who reenrolls in TRICARE Select must, at the time of enrollment, pay a portion of the annual enrollment fee and establish a monthly enrollment fee payment for the remaining months of 2021.

COVID-19 Mine Worker Protection Act This bill requires the Department of Labor to promulgate health and safety standards to protect coal miners from occupational exposure to COVID-19 (i.e., coronavirus disease 2019). Labor shall promulgate emergency standards within seven days of this bill's enactment, and such emergency standards shall be in force until permanent standards are established. Labor shall also collect data to track and investigate cases of exposure to COVID-19 among coal miners.

Ensuring Survivor Benefits During COVID-19 Act of 2021 This bill requires the Department of Veterans Affairs to get a medical opinion to determine if a service-connected disability was the principal or contributory cause of death in situations where a veteran's death certificate identifies COVID-19 (i.e., coronavirus disease 2019) as the principal or contributory cause of death, the certificate does not clearly identify any of the veteran's service-connected disabilities as the principal or contributory cause of death, and a claim for dependency and indemnity compensation is filed with respect to the veteran.

End Taxpayer Subsidies for Drug Ads Act This bill prohibits a tax deduction for expenses relating to direct-to-consumer advertising of prescription drugs. Direct-to-consumer advertising is any dissemination, by or on behalf of a sponsor of a prescription drug product, of an advertisement that is in regard to the drug product and primarily targeted to the general public.

New Markets for State-Inspected Meat and Poultry Act of 2021 This bill allows meat and poultry products inspected by State Meat and Poultry Inspection programs to be sold in interstate commerce. Under the inspection programs, the Department of Agriculture Food Safety and Inspection Service allows states that meet certain requirements to inspect meat and poultry. The state-inspected products are currently limited to intrastate commerce, unless a state opts into a separate Cooperative Interstate Shipment Program.

Eliminating a Quantifiably Unjust Application of the Law Act or the EQUAL Act This bill eliminates the federal sentencing disparity between drug offenses involving crack cocaine and powder cocaine. Currently, different threshold quantities of crack cocaine and powder cocaine (e.g., 28 grams of crack cocaine and 500 grams of powder cocaine) trigger the same statutory criminal penalties. This bill eliminates the lower quantity thresholds for crack cocaine offenses. Under the bill, the same threshold quantities of crack cocaine and powder cocaine trigger the same statutory criminal penalties. The change applies to future cases and cases pending on the date of enactment. With respect to past cases, the bill authorizes resentencing of a defendant who was convicted or sentenced for a crack cocaine offense before the date of enactment.

Uyghur Forced Labor Prevention Act This bill imposes importation limits on goods produced using forced labor in the Xinjiang Uyghur Autonomous Region in China and imposes sanctions related to such forced labor. The Department of Homeland Security shall report to Congress a strategy for preventing the importation of goods produced in Xinjiang using forced labor. The strategy must contain certain information, including a list of entities working with the government in Xinjiang to move forced labor or Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups out of Xinjiang. The U.S. Customs and Border Protection shall generally presume that goods produced by these entities are barred from importation into the United States. The bill also expands existing asset- and visa-blocking sanctions related to Xinjiang to cover foreign individuals and entities responsible for serious human rights abuses in connection with forced labor. The Department of State shall report to Congress (1) an assessment of whether human rights abuses committed by China's government against persecuted groups in Xinjiang constitute genocide under U.S. law, and (2) a strategy to enhance international awareness of forced labor in Xinjiang and to address such forced labor.

This joint resolution eliminates the deadline for the ratification of the Equal Rights Amendment, which prohibits discrimination based on sex. The amendment was proposed to the states in House Joint Resolution 208 of the 92nd Congress, as agreed to in the Senate on March 22, 1972. The amendment shall be part of the Constitution whenever ratified by the legislatures of three-fourths of the states.

See Something, Say Something Online Act of 2021 This bill requires an interactive computer service (e.g., a social media company) that detects a suspicious transmission to submit a suspicious transmission activity report (STAR) describing the suspicious transmission. A suspicious transmission is any post, message, comment, tag, or other user-generated content or transmission that commits, facilitates, incites, promotes, or otherwise assists the commission of a major crime. Each STAR must be submitted to the Department of Justice and contain (1) the name, location, and other identification information submitted by the user; (2) the date and nature of the user-generated content or transmission detected for suspicious activity; and (3) any relevant text, information, and metadata related to the suspicious transmission. Any provider of an interactive computer service that fails to report a known suspicious transmission shall not be immune from liability for such transmission and may be held liable as a publisher for the related suspicious transmission.

This resolution honors the memory of U.S. Capitol Police Officer Brian D. Sicknick for sacrificing his life in the line of duty on January 6, 2021, and it calls for justice to be brought to those responsible for the attack on the Capitol and the death of Officer Sicknick.

Robert C. Byrd Mine Safety Protection Act of 2020 This bill revises requirements governing (1) investigations of mine accidents, (2) miners' rights and protections (e.g., whistle-blower rights and protections), (3) mine health and safety standards, (4) underground coal mines, and (5) health and safety training for miners. The Department of Labor, when investigating coal or other mines, must (1) determine why an accident occurred and whether there were violations of law, mandatory health and safety standards, or other requirements; and (2) make recommendations to avoid a recurrence of an accident. The bill expands Labor's enforcement authority, including by requiring Labor to (1) revoke the approval of mine operators' plans or programs based on certain criteria, and (2) order mine operators to withdraw all persons from a mine until Labor approves a new plan. The bill revises civil and criminal penalties, including by subjecting a mine operator who knowingly violates health or safety standards to a felony punishable by up to five years in prison and a $1 million fine. Underground coal mine operators must implement a communication program to brief miners of current mine conditions and install atmospheric monitoring systems. The bill amends the Occupational Safety and Health Act of 1970 to expand its coverage to government employees and increase civil and criminal penalties for violations of the act. The bill also expands whistle-blower rights and protections against retaliation under the act, establishes employee rights with respect to work-related bodily injuries or death, and establishes procedures for correcting serious, willful, or repeated violations of occupational safety and health standards.
