45Q Carbon Capture, Utilization, and Storage Tax Credit Amendments Act of 2020 This bill extends the tax credi for carbon oxide sequestration through 2028 and allows taxpayers an election to receive payments in lieu of the credit and the credit for qualifying advanced coal projects.

Dentist and Optometric Care Access Act of 2019 or the DOC Access Act of 2019 This bill prohibits private health insurance plans from setting rates for items and services, except for dental cleanings, provided by a doctor of optometry, of dental surgery, or of dental medicine for which the plan does not pay a substantial amount. Additionally, an agreement between a plan and such a doctor for limited scope dental or vision benefits may last longer than two years only with the prior acceptance of the doctor for each term extension. Plans also may not restrict such a doctor's choice of laboratories or suppliers. Such doctors may elect to waive the application of the payment amount and choice of laboratories provisions of this bill. The bill establishes a private right of action for a person adversely affected by a violation of this bill. The bill does not supersede state laws regarding health insurers and dental or vision benefit plans.

Accelerating Access to Critical Therapies for ALS Act This bill establishes grant programs to address neurodegenerative diseases, such as amyotrophic lateral sclerosis (also known as ALS or Lou Gehrig's disease), and contains other related provisions. The Department of Health and Human Services (HHS) shall award grants to eligible entities to support research on and facilitate access to investigational drugs that diagnose or treat ALS. The Food and Drug Administration shall award grants to public and private entities to cover the costs of research and development of drugs that diagnose or treat ALS and other severely debilitating neurodegenerative diseases. HHS shall also establish the Collaborative for Neurodegenerative Diseases, which shall support the development and regulatory approval of drugs that address ALS and other rare neurodegenerative diseases.

Protecting Employees from Surprise Taxes Act of 2020 This bill prohibits employers from deferring payment of payroll taxes unless affected employees provide written consent to a deferral. Employers must also provide notice to their employees of the right to provide or withhold written consent and the future tax liability resulting from providing consent to the deferral of such taxes.

Eliminate the Digital Divide Act of 2020 This bill requires the Federal Communications Commission to establish a program to provide funding to states for expanding access to broadband service in unserved areas. States must distribute these funds to certain broadband service providers for projects that offer a low-cost broadband service option for low-income subscribers.

TRICARE Retiree Protection Act This bill authorizes a covered beneficiary who is enrolled in TRICARE Select to reenroll in TRICARE Select at any time during 2021. Covered beneficiaries are those in the retired category who enrolled in TRICARE Select as of December 31, 2020, but did not establish a monthly enrollment fee payment during the 2020 TRICARE Open Season. A covered beneficiary who reenrolls in TRICARE Select must, at the time of enrollment, pay a portion of the annual enrollment fee and establish a monthly enrollment fee payment for the remaining months of 2021.

See Something, Say Something Online Act of 2020 This bill requires an interactive computer service (e.g., a social media company) that detects a suspicious transmission to submit a suspicious transmission activity report (STAR) describing the suspicious transmission. A suspicious transmission is any post, message, comment, tag, or other user-generated content or transmission that commits, facilitates, incites, promotes, or otherwise assists the commission of a major crime. Each STAR must be submitted to the Department of Justice and contain (1) the name, location, and other identification information submitted by the user; (2) the date and nature of the user-generated content or transmission detected for suspicious activity; and (3) any relevant text, information, and metadata related to the suspicious transmission. Any provider of an interactive computer service that fails to report a known suspicious transmission shall not be immune from liability for such transmission and may be held liable as a publisher for the related suspicious transmission.

Improving Medicaid Programs' Response to Overdose Victims and Enhancing Addiction Care Act or the IMPROVE Addiction Care Act This bill establishes additional requirements for state Medicaid drug-use review programs with respect to individuals who experience opioid-related overdoses. Specifically, programs must include protocols that (1) connect individuals who have experienced an opioid-related overdose within the last five years to appropriate treatment; (2) notify providers who prescribe opioids about subsequent fatal overdoses; (3) ensure providers are notified about an individual's history of opioid-use disorder, overdoses, or poisonings; and (4) educate providers about proper prescribing practices for these individuals.

Russian Suspension Agreement Extension Act of 2020 This bill extends limits on the importation of Russian low-enriched uranium, a fuel for nuclear reactors, and contains other related provisions. (These limits stem from a 1992 agreement with Russia to end a Department of Commerce antidumping investigation into Russian uranium imports.) The bill extends these limits, which are currently set to expire in 2020, to 2040. The bill also specifies the maximum amounts of qualifying uranium that may be imported each year for 2021-2040. The Department of Commerce shall (1) administer these import limitations, and (2) periodically review U.S. demand for uranium for nuclear reactors and adjust the limits accordingly. Currently, qualifying uranium imported for the Department of Energy inventory do not count against these limits. The bill eliminates this exception but maintains two other exceptions for uranium imported for use in the initial core of a new reactor or for reprocessing and reexportation.

Air Carrier Worker Support Extension Act of 2020 This bill extends authority for the Department of the Treasury to provide financial assistance to passenger air carriers, cargo air carriers, and contractors of passenger air carriers for the continuation of payment of employee wages, salaries, and benefits. The maximum amounts of financial assistance that may be provided by Treasury for this purpose are $25.5 billion for passenger air carriers, $300 million for cargo air carriers, and $3 billion for contractors . The bill provides specific deadlines and procedures under which Treasury must provide financial assistance to air carriers and contractors. To be eligible for financial assistance, an air carrier or contractor must (1) agree not to reduce pay and benefits or conduct involuntary furloughs until March 31, 2021; and (2) agree, through March 31, 2022, not to repurchase stock, pay dividends, or make other capital distributions. Additionally, Treasury may require carriers that receive assistance to maintain service to points served before March 1, 2020. Such authority terminates on April 1, 2022. The bill limits the maximum allowable compensation of an officer or employee of an air carrier or contractor that receives assistance.

National Prescribed Fire Act of 2020 This bill directs the Department of Agriculture (USDA) and the Department of the Interior to significantly increase the number and size of prescribed fires conducted on federal lands. Before the end of FY2022, Interior and USDA shall each have carried out a minimum of one prescribed fire on each unit of the National Forest System (with exceptions), unit of the National Wildlife Refuge System, unit of the National Park System, and Bureau of Land Management district (1) that includes an area that has a historical low-severity fire regime, has a historical fire-return interval of not more than 35 years, and is larger than 100 acres; and (2) less than half of which was burned by a wildland fire during the previous 10-year period. Interior shall establish a collaborative prescribed fire program to provide financial assistance to eligible entities to conduct prescribed fires in priority landscapes. Interior shall establish an incentive program to encourage the implementation of large, cross-boundary prescribed fires. Interior and USDA shall hire additional employees and provide training to increase the number of skilled and qualified prescribed fire practitioners in the departments and other organizations. To address the public health and safety risk of the expanded use of prescribed fire, USDA and Interior shall conduct research to improve or develop, among other things, cost-effective, and consistent mitigation strategies for communities impacted adversely by smoke from prescribed fire.

Contact Lens Rule Modernization Act This bill (1) requires prescribers of contact lenses to conspicuously post notice that the prescriber is required to provide a copy of the contact lens prescription to the patient, (2) prohibits prescribers from requiring patients to acknowledge a contact lens prescription release in writing or electronically, and (3) prohibits automated telephone calls to verify a prescription.

Veterans' Compensation Cost-of-Living Adjustment Act of 2020 This bill directs the Department of Veterans Affairs to increase, as of December 1, 2020, the rates of veterans' disability compensation, additional compensation for dependents, the clothing allowance for certain disabled veterans, and dependency and indemnity compensation for surviving spouses and children. The percentage increase in benefits shall be the same as the cost-of-living increase for Social Security recipients.

Nonpartisan Postmaster General Act This bill restricts the political activities of the members of the Postal Service Board of Governors, including the Postmaster General and the Deputy Postmaster General. Specifically, the bill (1) prohibits the Postmaster General and the Deputy Postmaster General from taking an active part in political management or political campaigns; (2) prohibits the Board of Governors, the Postmaster General, and the Deputy Postmaster General from holding any political position while in office or soliciting funds for the campaign of a candidate for elected office or for a political party; and (3) restricts nominees for Postmaster General and Deputy Postmaster General to those who have not engaged in political activities in the four years prior to their appointments.

Accelerating Connected Care and Education Support Services on the Internet Act or the ACCESS the Internet Act This bill provides funding to support distance learning and connected care in response to COVID-19. Specifically, the bill provides funds for (1) elementary and secondary school emergency relief grants to purchase internet-connected devices and associated services that support distance learning, (2) a pilot program to award grants for the purchase and distribution of internet-connected devices for libraries in rural and low-income areas, (3) the COVID-19 Telehealth Program of the Federal Communications Commission, and (4) the furnishing of internet-connected devices and associated services to veterans for accessing telehealth services.

Air America Act of 2020 This bill establishes the service of Air America employees as qualifying service for purposes of the Civil Service Retirement System. (Air America was a government-owned airline that provided air transport for certain covert operations in Southeast Asia, including Laos and Vietnam, between 1950 and 1976.) The bill applies to U.S. citizens who were employees of Air America or another affiliated company, as specified, between January 1, 1950 and December 31, 1976. Benefit applications must be filed within two years of the date of enactment of this bill.

Time to Rescue United States Trusts Act of 2020 or the TRUST Act of 2020 This bill establishes congressional rescue committees to develop recommendations and legislation to improve critical social contract programs. A critical social contract program is a federal program for which a federal trust fund is established (e.g., Social Security, Medicare, and federal highway programs), with outlays of at least $20 billion during the year preceding the year in which this bill is enacted, and for which the amount of dedicated federal funds and federal trust fund balances will be inadequate to meet the total amount of outlays of the program that would otherwise be made. Each rescue committee may develop recommendations and legislation to improve the program for which it was established, including by (1) increasing the duration of positive balances of the federal trust fund established for the program, and (2) providing for the solvency of the federal trust fund established for the program during a 75-year period. Congress must use specified expedited legislative procedures to consider legislation that is approved and submitted by the rescue committees.

Business of Insurance Regulatory Reform Act of 2020 This bill revises the authority of the Consumer Financial Protection Bureau (CFPB) over activities regulated by a state insurance regulator. The CFPB may not pursue enforcement against any person regulated by a state insurance regulator and offering a consumer financial product or service, to the extent that person is engaged in the business of insurance. If a person engaged in the business of insurance is regulated by a state insurance regulator but otherwise subject to the CFPB's enforcement authority, the CFPB must construe its authority narrowly.

Save our Stages Act or the SOS Act This bill authorizes the Small Business Administration (SBA) to make grants to eligible live venue operators, producers, promoters, or talent representatives to address the economic effects of the COVID-19 (i.e., coronavirus disease 2019) pandemic on certain live venues. Specifically, the SBA may make (1) an initial grant of up to $12 million dollars to an eligible operator, promoter, producer, or talent representative; and (2) a supplemental grant that is equal to 50% of the initial grant. An initial grant must be used for costs incurred between March 1, 2020, and December 31, 2020, but a supplemental grant may be used for expenses incurred through June 30, 2021. Such grants shall be used for specified expenses such as payroll costs, rent, utilities, and personal protective equipment.

John Lewis Voting Rights Advancement Act This bill establishes new criteria for determining which states and political subdivisions must obtain preclearance before changes to voting practices may take effect. (Preclearance is the process of receiving federal preapproval before making legal changes that would affect voting rights.) In addition, the bill expands voting access on tribal lands.

The Hotspots and Online Technology and Services Procurement for our Tribes and States Act or the HOTSPOTS Act This bill establishes a two-year pilot program through which the Institute of Museum and Library Services must award grants to states, territories, and Indian tribes to purchase and distribute internet-connected devices to libraries in rural and low-income areas.

Crisis Care Improvement and Suicide Prevention Act of 2020 This bill requires states to support evidence-based crisis care services, such as crisis call centers, through the Community Mental Health Services Block Grant. In addition, for each year in which the appropriations for that grant exceed a specified amount, states must expend a certain percentage of their grant allotments on crisis care services.

Advancing Uniform Transportation Opportunities for Veterans Act or the AUTO for Veterans Act This bill authorizes the Department of Veterans Affairs (VA) to provide (or assist in providing) an eligible veteran or service member with an additional automobile or other conveyance under the VA automobile allowance and adaptive equipment program. Currently, a veteran or service member with a specified service-connected disability or impairment may not receive more than one automobile or other conveyance under the program. The bill authorizes the additional benefit for such veterans and service members if 10 years have passed since the person last received such benefit.

Postal Service Emergency Assistance Act This bill provides emergency funding for the U.S. Postal Service (USPS). Specifically, it establishes and makes appropriations to a Postal Service COVID-19 Emergency Fund from which the Department of the Treasury shall transfer up to $25 billion certified by the USPS as necessary to cover lost revenue or operational expenses resulting from the COVID-19 (i.e., coronavirus disease 2019) pandemic. Treasury shall lend the USPS, under the Coronavirus Aid, Relief, and Economic Security (CARES) Act, up to $10 billion at the request of the USPS subject to the terms and conditions of the note purchase agreement between the USPS and the Federal Financing Bank in effect on September 29, 2018. The USPS shall, in coordination with its Board of Governors, develop a plan to ensure the long-term solvency of the USPS.

Ensuring Survivors Benefits during COVID-19 Act of 2020 This bill requires the Department of Veterans Affairs to get a medical opinion to determine if a service-connected disability was the principal or contributory cause of death in situations where a veteran with a service-connected disability dies from COVID-19 (i.e., coronavirus disease 2019), or complications from COVID-19, and the death certificate does not clearly identify the service-connected disability as the principal or contributory cause of death.

Bank on Students Coronavirus Emergency Loan Refinancing Act of 2020 This bill establishes refinancing programs for federal and private student loans. Specifically, it allows certain borrowers to refinance their federal student loans down to lower interest rates, and creates the Federal Direct Refinanced Private Loan to allow certain borrowers to refinance their private student loans.

This resolution expresses the sense of the Senate that the Department of Justice (DOJ) should defend the Patient Protection and Affordable Care Act (PPACA) in ongoing litigation. Currently, DOJ supports the ruling by the U.S. Court of Appeals for the Fifth Circuit that upheld a district court ruling that certain provisions of the PPACA are not severable from the remainder of the Act and therefore that the entire law is invalid. The Fifth Circuit's ruling is currently pending appeal before the U.S. Supreme Court.

Paycheck Protection Small Business Forgiveness Act This bill modifies loan forgiveness under the Paycheck Protection Program established to support small businesses in response to COVID-19 (i.e., coronavirus disease 2019). Specifically, the bill provides for automatic forgiveness of a paycheck protection loan that is not more than $150,000 if the recipient submits a one-page form. Further, it prohibits any enforcement or other action against a lender relating to loan origination, forgiveness, or guarantee based on the lender's reliance on certifications or documentation submitted by a loan applicant or recipient.

CRITICAL Act This bill directs the General Services Administration (GSA), the Environmental Protection Agency (EPA), and the Department of the Interior to take specified actions with respect to electronic recycling and critical mineral extraction. Specifically, the GSA shall establish an electronic recycling program that services each executive agency. The EPA shall (1) establish a program to ensure that electronics collected under the agency recycling program are entered into a certified recycling stream for dismantling and refining by certified entities; (2) ensure that refined critical minerals developed through the certified recycling stream program are retained in the United States for use by industry; and (3) award prizes for the development of E-waste recycling systems, with a goal of increasing the collection of recyclable electronics. Interior shall study and report on critical mineral extraction, evaluating, among other things, the total quantity of recoverable critical minerals from all certified recycling streams, as compared to the total quantity of critical minerals necessary for manufacturing, consumer products, and national defense in the United States.
