This joint resolution nullifies the final rule issued by the National Labor Relations Board titled Standard for Determining Joint Employer Status and published on October 27, 2023. The rule establishes a new joint employer standard for determining whether two employers simultaneously employ a particular employee or employees. Under the rule, an entity may be considered a joint employer of another employer's employees if the two share or codetermine the employees' essential terms and conditions of employment. The rule is currently scheduled to take effect on February 26, 2024.

Iranian Sanctions Enforcement Act of 2023 This bill establishes an Iran Sanctions Enforcement Fund to pay expenses relating to seizures and forfeitures of Iranian property and provides statutory authority for the Export Enforcement Coordination Center, which is in the Department of Homeland Security (DHS) and investigates and prosecutes violations of U.S. export control laws. Specifically, the Iran Sanctions Enforcement Fund may be used to pay (1) investigative costs incurred by a law enforcement agency of DHS or the Department of Justice; (2) expenses related to detention, security, or disposal of seized property; or (3) the costs of contracting associated with the seizure or forfeiture of Iranian property.

This resolution states that the Senate stands with Israel as it defends itself, reaffirms Israel's right to self-defense, and calls on all countries to unequivocally condemn Hamas' war on Israel. The resolution also reaffirms the United States' commitment to Israel's security, supports emergency resupply and certain other types of assistance to Israel, and calls on the United States to lead an international effort to deprive Hamas of Iranian and other sources of funding and lethal assistance. Furthermore, the resolution states that it may not be construed as a declaration of war or an authorization for the use of military force.

Deposit Security Act This bill increases the amount of deposit insurance available to noninterest-bearing transaction accounts through the Federal Deposit Insurance Corporation (FDIC) and the National Credit Union Administration (NCUA). Under current law, deposits are generally insured up to $250,000. Specifically, noninterest-bearing transaction accounts at FDIC-insured depository institutions and at NCUA-insured credit unions must be insured up to $10 million. However, an institution or credit union may opt-out of this insurance during the 30-day period beginning on the date the program starts. In addition, the maximum deposit insurance amount must be adjusted for inflation every two years.

America’s Revegetation and Carbon Sequestration Act of 2024 This bill requires various actions to address revegetation and promote the use of forest products. Among other provisions, the bill requires the Forest Service to continue its experimental forests and ranges network. The bill requires the Department of Labor to develop a career and technical education and training program focused on tree planting and revegetation, tree maintenance, nursery management, or seed collection as part of the Job Corps program. The Department of the Interior must establish a pilot program to establish native trees, shrubs, or grasses on mined land. The bill authorizes the Forest Service to expend funds received from a nonfederal entity as a carbon credit to conduct forest revegetation activity that reduces greenhouse gases. Interior and the Forest Service must jointly develop and implement an action plan to map, treat, and control invasive grasses. The Department of Agriculture (USDA), in coordination with the Department of Energy, must expand research relating to the use of wood for various purposes, including renewable fuel and mass timber. The bill establishes an Office of Technology Transfer in the Forest Service. USDA must establish an innovation voucher pilot program to accelerate product development, demonstration, and commercialization in the forest products sector. The Forest Products Laboratory of the Forest Service must establish a mass timber science and education program. The bill designates, upon acquisition by the United States, approximately 2,693 acres of land within the Monongahela National Forest in West Virginia as the Patsye Crites Forest.

TAP Promotion Act This bill requires that pre-separation counseling under the Transition Assistance Program include a presentation that promotes the benefits available to veterans from the Department of Veterans Affairs (VA). The bill also requires the VA to annually report on the presentation to (1) identify veterans service organizations that participate, (2) provide the number of members of the Armed Forces who attend, and (3) provide any recommendations for changes to the presentation.

Promoting Effective Forest Management Act of 2023 This bill establishes additional requirements for the Forest Service and the Bureau of Land Management to address forest health on public lands. For example, the agencies must establish annual mechanical thinning targets for the National Forest System and public lands, carry out regeneration harvests only in mature forests, develop a strategy to increase the use of livestock grazing to mitigate wildfires, support logging training through apprenticeships, and utilize specified streamlined authorities for environmental review with respect to remedial action in certain vulnerable areas.

This resolution expresses that a lack of sufficient progress by North Atlantic Treaty Organization (NATO) member countries in achieving a minimum of 2% of gross domestic product on defense spending is politically and economically unsustainable. The resolution also (1) commends certain NATO member countries for contributing to 10% or more of NATO's direct funding and programs budget, (2) commends certain NATO member countries for meeting or exceeding their defense spending commitment, and (3) commends certain NATO member countries for contributing significant weapons and equipment to Ukraine.

Good Samaritan Remediation of Abandoned Hardrock Mines Act of 2023 This bill promotes the remediation of abandoned hardrock mine sites by Good Samaritans. A Good Samaritan means a person that is (1) not a past or current owner or operator of the abandoned site; (2) had no role in the creation of the historic mine residue; and (3) is not potentially liable under any law for the remediation, treatment, or control of the historic mine residue. The bill requires the Environmental Protection Agency (EPA) to establish a Good Samaritan pilot program. Under the program, the EPA may issue permits to allow Good Samaritans to remediate historic mine residue at abandoned hardrock mine sites without being subject to enforcement or liability under specified environmental laws for past, present, or future releases, threats of releases, or discharges of hazardous substances or other contaminants at or from the abandoned mine site. In addition, the bill establishes a Good Samaritan Mine Remediation Fund for land management agencies that authorize Good Samaritans to conduct remediation projects on federal land.

FDA Review of Efficacy of EERW Double-Blinds of Opioids Act or the FREED of Opioids Act This bill requires the Food and Drug Administration (FDA) to take certain actions to determine whether to permit the use of a certain methodology for drug clinical trials. Specifically, the FDA must seek to contract with the National Academy of Sciences (NAS) for the NAS to conduct a study on the effectiveness of using enriched enrollment randomized withdrawal methodology in demonstrating the efficacy of opioid drugs in treating chronic pain. The FDA must also convene a meeting of two specified FDA advisory committees to review the NAS study, vote on whether to permit the use of this methodology in drug clinical trials, and review the appropriateness of labeling on approved opioid drugs in relation to this methodology.

Defending Hunters' Education Act of 2023 This bill authorizes the use of federal elementary and secondary education funds to purchase or use dangerous weapons for purposes of providing students with educational enrichment activities and instruction, such as archery, hunter safety education, or culinary arts. Current law prohibits the use of these funds to provide any person with a dangerous weapon or training in the use of a dangerous weapon. The bill specifies that this prohibition shall not apply to the use of these funds for permissible program activities that provide students with educational enrichment activities and instruction, such as archery, hunter safety education, or culinary arts.

Ford Federal Direct Loan Program and the Federal Family Education Loan (FFEL) Program and published on July 10, 2023. The rule creates a new income-driven repayment plan called the Saving on a Valuable Education (SAVE) plan.

Digital Asset Anti-Money Laundering Act of 2023 This bill applies existing anti-money laundering requirements to digital assets providers and facilitators. Specifically, the bill makes digital assets providers and facilitators financial institutions under the Bank Secrecy Act. Under the act, financial institutions must keep records, file disclosures, and report suspicious activity to federal regulators to aid in detecting money laundering and terrorist financing activities. The bill also directs specified federal financial regulators to establish rules regarding digital assets. The Financial Crimes Enforcement Network (FinCEN) must require U.S. persons to report cryptocurrency transactions through foreign accounts of over $10,000. FinCEN must also require digital asset kiosk owners and administrators to submit and update every 90 days the physical addresses of the kiosks. The Department of the Treasury must establish regulations to mitigate risks for financial institutions handling, using, or transacting business with (1) digital asset mixers, privacy coins, and other anonymity-enhancing technologies; and (2) digital assets that have been anonymized by these technologies. Treasury, the Securities and Exchange Commission, and the Commodity Futures Trading Commission must establish risk examination and review processes for their respective anti-money laundering programs.

Budgeting for Opioid Addiction Treatment Act This bill imposes an excise tax on the sale of any active opioid. The tax is equal to one cent per milligram so sold and it is imposed on the manufacturer, producer, or importer of the opioid. The term active opioid means any controlled substance that is opium, an opiate, or any derivative thereof. The bill provides block grants for substance abuse treatment programs. The Department of Health and Human Services must report on the impact of this bill on (1) the retail cost of active opioids; (2) patient access to such opioids, particularly cancer and hospice patients; and (3) the use of tax revenues to improve substance abuse treatment efforts. The report must also make suggestions for improving access to opioids for cancer and hospice patients and substance abuse treatment efforts.

Countering Mexican Transnational Criminal Organizations in Cyberspace Act of 2023 This bill authorizes the Department of Defense to conduct cyber operations in consultation with Mexico to detect and monitor Mexican transnational criminal organizations engaged in illegal activities such as drug smuggling, human trafficking, or weapons trafficking.

Improving Medicaid Programs' Response to Overdose Victims and Enhancing Addiction Care Act or the IMPROVE Addiction Care Act This bill establishes additional requirements for state Medicaid drug-use review programs with respect to individuals who experience opioid-related overdoses. Specifically, programs must include protocols that (1) connect individuals who have experienced an opioid-related overdose within the last 1 to 5 years (as set by the Centers for Medicare & Medicaid Services) to appropriate treatment and recovery services; (2) notify providers who prescribe opioids about subsequent fatal overdoses; (3) ensure providers are notified about an individual's history of opioid-use disorder, overdoses, or poisonings; and (4) educate providers about proper prescribing practices for these individuals.

Taxpayer-Funded Facility Restoration Stewardship Act This bill authorizes departments or organizations within the Department of Defense (DOD) to place an order with any other such department or organization, on a reimbursable basis, for a project for the maintenance and repair of a DOD facility or for a minor military construction project.

Freedom to Vote Act This bill addresses voter registration and voting access, election integrity and security, redistricting, and campaign finance. Specifically, the bill expands voter registration (e.g., automatic and same-day registration) and voting access (e.g., vote-by-mail and early voting). It also limits removing voters from voter rolls. Next, the bill establishes Election Day as a federal holiday. The bill declares that the right of a U.S. citizen to vote in any election for federal office shall not be denied or abridged because that individual has been convicted of a criminal offense unless, at the time of the election, such individual is serving a felony sentence. The bill establishes certain federal criminal offenses related to voting. In particular, the bill establishes a new criminal offense for conduct (or attempted conduct) to corruptly hinder, interfere with, or prevent another person from registering to vote or helping someone register to vote. Additionally, the bill sets forth provisions related to election security, including by requiring states to conduct post-election audits for federal elections. The bill outlines criteria for congressional redistricting and generally prohibits mid-decade redistricting. The bill addresses campaign finance, including by expanding the prohibition on campaign spending by foreign nationals, requiring additional disclosure of campaign-related fundraising and spending, requiring additional disclaimers regarding certain political advertising, and establishing an alternative campaign funding system for certain federal offices.

Achieving Thorough Transparency and Accessibility for Information Navigation on Mental Health Act of 2023 or the ATTAIN Mental Health Act This bill requires the Department of Health and Human Services to establish an online dashboard with information about federal grants relating to mental health and substance use disorders. Among other requirements, the dashboard must be searchable, current, and indicate whether the application period is open or closed. The dashboard must also include information about associated state programs and subgrants.
