Calls upon President-elect Donald J. Trump to: (1) follow the precedent established by prior Presidents and convert his assets to conflict-free holdings, adopt blind trusts, or take other equivalent measures to ensure compliance with the Emoluments Clause of the U.S. Constitution; and (2) not use the powers or opportunities of his position as President-elect or President of the United States for any purpose related to the Trump Organization. Declares that in the absence of such actions or specific authorization by Congress, Congress regards dealings that Donald Trump, as President, may have through his companies with foreign governments or entities owned or controlled by foreign governments to be potential violations of such clause.

Death Gratuity Equity Act of 2016 This bill requires federal agencies to pay a death gratuity of $100,000 per employee for the death of civilian employees resulting from injuries sustained in the line of duty that did not result from natural causes or the employee's serious and willful misconduct. The bill also allows an additional payment of up to $8,800 for funeral and burial expenses. (Currently, funeral and burial payments may not exceed $800 per employee and the combination of payments for death gratuity, funeral, burial, and other compensation and reimbursements may not exceed $10,000 per employee.) The amounts must be adjusted annually for inflation. For tax purposes, a death gratuity payment shall not be considered gross income to the person receiving payment. The death gratuity remains at $100,000 for an employee who dies of injuries incurred in connection with service with an Armed Force in a contingency operation, except that employees who are noncitizens and nonresidents of the United States or Canada, and their dependents, are subject to the Department of Labor's authority to modify payments that are substantially disproportionate to compensation for disability or death payable in similar cases under local laws or customs at the place outside the continental United States or Canada where the employee is working at the time of injury. The bill also allows such death gratuities in connection with such Armed Force service to be paid in addition to any other amounts paid under U.S. law based on the same death. The Foreign Service Act of 1980 is amended to make death gratuities payable to the surviving beneficiaries (currently, dependents) of U.S. Foreign Service employees, or individuals in a special category serving in an uncompensated capacity for that agency in support of a diplomatic mission, who die as a result of injuries sustained in the performance of duty abroad. But the Foreign Service death gratuity is reduced by the amount of any federal civilian employee death gratuity paid under this bill for the same death. Additional amounts are authorized to be appropriated for death gratuity payments under this bill if an agency and the Office of Management and Budget determine that a natural disaster, act of terrorism, or other incident results in the inability of the agency to meet these death gratuity payment requirements. An authorized payment that exceeds the amount available to the agency without additional appropriations may be made only if Congress makes the additional appropriations for that purpose.

No Vote No Recess Resolution Prohibits the Senate, between September 27, 2016, and the end of the 114th Congress, from adjourning, remaining adjourned, or recessing for more than two days and convening solely in a pro forma session unless, by the beginning of the adjournment or the pro forma session, it has taken action on any presidential nomination for a position as a justice of the U.S. Supreme Court by: holding a hearing and a vote on the nomination in the Senate Committee on the Judiciary, and holding a confirmation vote on it in the full Senate. Prescribes procedures for Senate adjournments and recesses during such period. Prohibits the Presiding Officer from entertaining a request to suspend the operation of this resolution by unanimous consent or motion. States that nothing in this resolution shall be construed in a manner that is inconsistent with S. Res. 296 (108th Congress) or any other Senate emergency procedures or practices.

Appalachian Forest National Heritage Area Act of 2016 This bill establishes the Appalachian Forest National Heritage Area to include specified counties in the states of Maryland and West Virginia. The bill designates the Appalachian Forest Heritage Area, Inc., as the local coordinating entity for the area. The bill also requires the Appalachian Forest Heritage Area, Inc., to submit a management plan that provides for the protection, enhancement, and interpretation of cultural, natural, historical, educational, scenic, and recreational resources of the area.

Big Oil Bailout Prevention Unlimited Liability Act of 2016 This bill amends the Oil Pollution Act of 1990 to revise requirements governing the liability of parties that are responsible for oil discharges from offshore facilities into navigable waters or adjoining shorelines. Currently, responsible parties are liable for the total of all removal costs plus $75 million. The bill: (1) removes the cap of $75 million on liability, and (2) makes the responsible parties liable for all covered damages. Covered damages includes damages for: (1) loss of natural resources, property, revenue, or profits; or (2) costs of providing increased public services during or after removal activities, such as fire protection.

Big Oil Bailout Prevention Trust Fund Act of 2016 This bill amends the Internal Revenue Code to eliminate: (1) the $1 billion per incident limitation on expenditures from the Oil Spill Liability Trust Fund for cleanup of oil spills, (2) the $500 million per incident limitation on expenditures from the trust fund for natural resource damage assessments and claims in connection with oil spills, and (3) the limitation on the borrowing authority of the trust fund. The bill also amends the Oil Pollution Act of 1990 to direct the President to promulgate regulations to allow advance payments from the Oil Spill Liability Trust Fund to states and localities to prepare for and mitigate substantial threats from the discharge of oil.

Patsy T. Mink Gender Equity in Education Act of 2016 This bill requires the Department of Education (ED) to establish an Office for Gender Equity to support state and local educational agencies, institutions of higher education, and elementary and secondary schools in fully implementing title IX of the Education Amendments of 1972, which prohibits discrimination on the basis of sex in federally funded education programs or activities. The office may provide grants and perform activities to reduce or prevent discrimination, bias, harassment, or violence based on actual or perceived sex, sexual orientation, gender, gender identity, pregnancy, childbirth, or related medical conditions or stereotypes in all areas of education. The office must: (1) provide technical assistance and annual training to title IX coordinators, and (2) develop a handbook for conducting self-evaluations of title IX compliance. The training must address "compound discrimination" (defined as discrimination based on sex and other characteristics, including race, ethnicity, national origin, disability status, religion, or age). The office may award grants to educational entities and partnerships to: train students, teachers, faculty, and personnel; increase campus resources, facilities, and course offerings; support title IX coordinators in performing outreach, advocacy, and education; identify patterns or systemic problems in title IX compliance; strengthen prevention education and awareness programs; conduct campus climate and victimization surveys; identify gender inequities; and improve data collection and reporting of gender equity indicators from academic assessments, civil rights data, campus data, employment data, attendance and absenteeism data, or title IX coordinator-to-student ratios. ED must coordinate with the Institute of Education Sciences and other federal offices and entities to investigate, identify, and disseminate best practices to: (1) reduce and prevent sex stereotyping, bias, and discrimination in curricula and educational materials; (2) address sex-based harassment and violence on campuses; (3) develop counseling and career guidance training; (4) mitigate implicit bias in teaching and discipline; and (5) address the needs of students who face compound discrimination.

Fair Employment Protection Act of 2016 This bill sets forth employer liability standards to be applied in employee harassment claims under specified provisions of the Civil Rights Act of 1964, the Age Discrimination in Employment Act of 1967, the Americans with Disabilities Act of 1990, the Rehabilitation Act of 1973, the Revised Statutes, the Genetic Information Nondiscrimination Act of 2008, the Government Employee Rights Act of 1991, employment discrimination laws relating to certain executive branch employees, and the Congressional Accountability Act of 1995. The bill declares that employers under such Acts are liable for the acts of any individual whose harassment of an employee has created or continued an unlawful hostile work environment if, at the time of the harassment: (1) such individual was authorized by that employer to undertake or recommend tangible employment actions affecting the employee or to direct the employee's daily work activities, or (2) the negligence of the employer led to the creation or continuation of that hostile work environment (thus modifies the liability standards provided by the Supreme Court in Vance v. Ball State University , which limited the category of supervisors for whom an employer may be held vicariously liable to those individuals who have authority to take tangible employment actions).

Designates June 2016 as National Post-Traumatic Stress Awareness Month and June 27, 2016, as National Post-Traumatic Stress Awareness Day. Supports efforts of the Department of Veterans Affairs (VA) and the Department of Defense, as well as the medical community, to educate members of the Armed Forces, veterans, their families, and the public about the causes, symptoms, and treatment of post-traumatic stress. Welcomes the efforts of the VA's National Center for PTSD (post-traumatic stress disorder) and local Vet Centers to assist veterans suffering from the effects of post-traumatic stress. Encourages Armed Forces commanders to support appropriate treatment of Armed Forces personnel diagnosed with PTSD.

Commends the work of the Department of Education and the Department of Justice to ensure that students have a safe learning environment by working to ensure that schools prevent and respond to discrimination and harassment on the basis of sex, including dating violence, pregnancy, sex-stereotyping, and discrimination based on actual or perceived gender identity. Recognizes that progress must still be made to ensure that no educational institution that receives federal education funding discriminates against any persons because of their sex.

Women's Suffrage Centennial Commission Act This bill establishes a Women's Suffrage Centennial Commission to develop and execute programs and activities to commemorate the centennial of the passage and ratification of the Nineteenth Amendment, which prohibits the federal government and states from denying U.S. citizens the right to vote on account of sex.

Securing Energy Infrastructure Act This bill establishes a two-year pilot program within the Department of Energy's (DOE) national laboratories to identify the security vulnerabilities of certain entities in the energy sector, and research and test technology that can be used to isolate the most critical systems of such entities from cyber-attacks. In addition, DOE must establish a working group to evaluate the technology solutions proposed by the national laboratories and to develop a national cyber strategy to isolate the energy grid from attacks. DOE must also submit a report to Congress describing the results of the pilot program, assessing the feasibility of the techniques considered, and outlining the results of the working group's evaluation.

Arla Harrell Act This bill requires the Department of Veterans Affairs (VA) to reconsider and make a new determination regarding each claim for disability compensation in connection with exposure to mustard gas or lewisite during active military, naval, or air service during World War II that was denied before this bill's enactment. The VA or the Department of Defense (DOD): (1) shall presume that a veteran experienced full-body exposure to mustard gas or lewisite unless proven otherwise; and (2) may not use information contained in the DOD and VA Chemical Biological Warfare Database or any list of known testing sites for mustard gas or lewisite maintained by the VA or DOD as the sole reason for determining that the veteran did not experience such exposure. The VA shall report to Congress every 90 days on reconsidered claims that were denied. The VA and DOD shall jointly establish a policy for processing future claims in connection with such exposure. The bill requires DOD, for purposes of determining whether a site should be added to the list of DOD sites where mustard gas or lewisite testing occurred, to: (1) investigate and assess sites where the Army Corps of Engineers has uncovered evidence of mustard gas or lewisite testing or where more than two veterans submitted claims in connection with exposure that were denied; and (2) report on experiments conducted by DOD during World War II to assess the effects of mustard gas and lewisite. The VA shall: (1) investigate and assess VA actions to reach out to individuals who had been exposed in such experiments, the disability compensation claims that were filed, and the percentage of such claims that were denied; and (2) submit a comprehensive list of each location where such an experiment was conducted.

Merchant Mariners of World War II Congressional Gold Medal Act of 2016 This bill directs the Speaker of the House of Representatives and the President pro tempore of the Senate to award a Congressional Gold Medal to the U.S. merchant mariners of World War II in recognition of their dedicated and vital service during World War II. Expresses the sense of Congress that the American Merchant Marine Museum should make the medal available for display elsewhere, particularly at appropriate locations associated with the U.S. Merchant Marine, giving preference to locations affiliated with it.

Apollo 11 50th Anniversary Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue gold, silver, half-dollar clad, and proof silver coins in recognition and celebration of the 50th anniversary of the first manned landing on the moon. Treasury may issue coins minted under this bill for only a one-year period, beginning January 1, 2019. All sales of these coins shall include a surcharge of $35 per gold coin, $10 per silver coin, $5 per half-dollar clad coin, and $50 per proof silver coin. All of the surcharges received from the sale of such coins shall be paid as follows: one-half to the Smithsonian Institution's National Air and Space Museum's "Destination Moon" exhibit; one-quarter to the Astronauts Memorial Foundation; and one-quarter to the Astronaut Scholarship Foundation, to aid its missions by providing college scholarships for the very best and brightest students pursuing degrees in science, technology, engineering, or mathematics.

Law Enforcement Officers Equity Act This bill expands the definition of "law enforcement officer" under provisions of the Federal Employees Retirement System (FERS) and the Civil Service Retirement System (CSRS) to include: (1) federal employees not otherwise covered whose duties include the investigation or apprehension of suspected or convicted criminals and who are authorized to carry a firearm; (2) Internal Revenue Service employees whose duties are primarily the collection of delinquent taxes and the securing of delinquent returns; (3) U.S. Postal Inspection Service employees; (4) Department of Veterans Affairs police officers; and (5) certain U.S. Customs and Border Protection employees who are seized-property specialists with duties relating to custody, management, and disposition of seized and forfeited property. Service performed by an incumbent (an individual appointed before enactment of this bill to a position that is considered to be a law enforcement officer under FERS and the CSRS only by virtue of the expanded definition in this bill) on or after enactment of this bill shall be treated as service performed as a law enforcement officer. Service performed by an incumbent before enactment of this bill shall be treated for federal retirement purposes as service performed as such an officer only if a written election is submitted to the Office of Personnel Management within five years after enactment of this bill or before separation from service, whichever is earlier. An incumbent who makes an election before enactment of this bill may pay a deposit into the Civil Service Retirement and Disability Fund to cover prior service. Nothing under current law respecting mandatory separation from government service under CSRS or FERS shall cause the mandatory separation of an officer during the three-year period beginning on the enactment of this bill.

Therapeutic Fraud Prevention Act of 2016 This bill prohibits sexual orientation or gender identity conversion therapy from being provided in exchange for monetary compensation. It bars advertisements for such therapy that claim to: (1) change an individual's sexual orientation or gender identity, (2) eliminate or reduce sexual or romantic attractions or feelings toward individuals of the same gender, or (3) be harmless or without risk. These prohibitions are inapplicable to practices or treatments that do not seek to change sexual orientation or gender identity if they provide: (1) assistance to an individual undergoing a gender transition; or (2) acceptance, support, and understanding of clients or facilitation of clients' coping, social support, and identity exploration and development, including sexual orientation-neutral interventions to prevent or address unlawful conduct or unsafe sexual practices. The Federal Trade Commission and states are provided authority to enforce against violations.

Atlantic Seismic Airgun Protection Act This bill amends the Outer Continental Shelf Lands Act to prohibit conducting geological or geophysical activities in support of oil or gas exploration and development on the Atlantic Outer Continental Shelf. The geological and geophysical activities are described in a final programmatic environmental impact statement by the Bureau of Ocean Energy Management entitled "Atlantic OCS Proposed Geological and Geophysical Activities, Mid-Atlantic and South Atlantic Planning Areas."

Testing, Removal, and Updated Evaluations of Lead Everywhere in America for Dramatic Enhancements that Restore Safety to Homes, Infrastructure, and Pipes Act of 2016 or the True LEADership Act of 2016 This bill directs the Environmental Protection Agency (EPA) to establish grant programs to assist communities and states fund projects that reduce lead in drinking water. The bill establishes a mandatory reporting requirement for states to report elevated levels of lead in children's blood to the Centers for Disease Control and Prevention. The bill amends the Safe Drinking Water Act to direct the EPA to promulgate lead and copper pipe regulations that would set household action levels for lead and copper in drinking water. The EPA must develop a process to protect and improve the drinking water of minority, tribal, and low-income communities. Additionally, the EPA must establish a voluntary school and child care lead testing grant program. The bill creates a new tax credit for homeowners to invest in eliminating lead hazards. Additionally, the bill revises how the Department of Housing and Urban Development deals with lead in homes. The EPA must establish a grant program to accelerate the testing, deployment and commercialization of new drinking water technologies. The Federal Emergency Management Agency (FEMA) is authorized to provide funding from its disaster relief fund in response to a major incident of lead contamination in drinking water. The bill creates a grant program for local educational agencies to assist children that have been affected by lead poisoning.

Expresses the sense of the Senate that the United States should: support policies that create safe and decent jobs in developing countries, support policies that reduce gender-based violence and other forms of discrimination at work, encourage the development of an International Labour Conference Convention to address gender-based violence at work, promote labor rights in trade agreements and enforce the right of women and other workers to join unions, and encourage U.S. companies with international supply chains and U.S. procurement agencies to ensure that their products are produced in workplaces that work to end gender-based workplace violence and respect the rights of women workers.

STEM Opportunities Act of 2016 This bill directs the Office of Science and Technology Policy to establish a STEM Inclusion Interagency Working Group which shall focus on the creation of a more diverse and inclusive STEM (science, technology, engineering, and mathematics) workforce. The National Science Foundation (NSF) shall strengthen the goals and activities of the ADVANCE (Increasing the Participation and Advancement of Women in Academic Science and Engineering Careers) program to focus on increasing the recruitment, retention, and success of all women in STEM, including minorities and persons with disabilities. The NSF shall: award a grant for the establishment of at least one Center for Excellence for Inclusion in STEM; collect institution-level data on the demographics of STEM faculty at different types of institutions of higher education; award grants to institutions of higher education (or their consortia) to implement or expand evidence-based reforms for recruiting, retaining, and advancing students, fellows, trainees, and faculty from underrepresented groups in STEM; and administer three specified Presidential Awards for Excellence in Science, Mathematics, and Engineering Mentoring to recognize annually outstanding mentoring in STEM fields in primary, secondary, and higher education.
