Stopping Unlawful Negative Machine Impacts through National Evaluation Act This bill makes an entity that uses artificial intelligence (AI) to make or inform decisions liable for violations of civil rights laws caused by those decisions in the same manner and to the same extent as if the entity made the decision without using AI. Additionally, the bill establishes a temporary program within the National Institute of Technology and Standards to evaluate AI systems for bias and discrimination on the basis of race, sex, age, and other protected characteristics and assist in mitigating those effects. The program terminates on December 31, 2028.

International Competition for American Jobs Act This bill modifies provisions relating to the taxation of foreign entities. Among other provisions, the bill makes permanent the look-thru rule for controlled foreign corporations (CFCs). (A look-thru rule provides that dividends, interest, rents and royalties that one CFC receives or accrues from a related CFC are not treated as foreign personal holding company income); modifies the tax deduction for foreign-derived intangible income and global intangible low-taxed income; modifies the base erosion minimum tax (10% minimum tax imposed to prevent corporations operating in the United States from avoiding tax liability by shifting profits out of the United States); modifies tax rules allocating certain tax deductions for purposes of the foreign tax credit limitation; restores the limitation on the attribution of stock ownership for purposes of applying constructive ownership rules; and includes specified amounts in the gross income of CFC shareholders.

Facial, Accountability, Clarity, and Efficiency in Technology Act or the FACE IT Act This bill establishes requirements with respect to the federal use of facial recognition technology. For example, the National Institute for Standards and Technology and the Department of Homeland Security must develop minimum accuracy requirements specific to each federal agency for use in cases of facial recognition technology in the government.

Platform Accountability and Transparency Act This bill increases access to the data of large technology platforms (i.e., platforms with at least 50 million unique monthly users in the United States) in order to facilitate research concerning activities on those platforms, particularly by requiring platforms to disclose data to researchers who participate in a research program jointly established by the National Science Foundation and the Federal Trade Commission.

IRS Customer Service and Transformation Act of 2022 This bill requires the Internal Revenue Service (IRS) to submit an initial plan to Congress to address how it intends to meet customer service and technology modernization and related objectives. The IRS must submit semiannual updates to the plan, indicate progress made in implementing the plan, and any changes or challenges in implementing the plan. The bill requires the Government Accountability Office in each calendar year after 2022 and before 2032, to report to specified congressional committees on various matters relating to the IRS, including the progress of the IRS in meeting its objectives and on technology modernization. The bill sets forth customer service objectives that the IRS must accomplish not later than January 1, 2025. It must make available to the public not later than January 1, 2026, certain electronic forms and filing procedures. Finally, the National Taxpayer Advocate is authorized to appoint counsel in the Office of the Taxpayer Advocate to report directly to the National Taxpayer Advocate.

This bill authorizes the Science and Technology Directorate to extend, during FY2023 and under certain circumstances, liability protections that apply if qualified anti-terrorism technologies are deployed in defense against, in response to, or for recovery from an act of terrorism.

STOP Act 2.0 This bill directs the Government Accountability Office to evaluate the implementation of a 2018 law that requires increased shipment-tracking responsibilities and coordination between the U.S. Postal Service and U.S. Customs and Border Protection regarding international shipments of controlled substances (e.g., fentanyl).

Compressed Gas Cylinder Safety and Oversight Improvements Act of 2022 This bill expands requirements for foreign manufacturers of cylinders used for transporting hazardous materials in the United States (e.g., compressed gas cylinders). Current regulations require foreign manufacturers to apply for approval from the Pipeline and Hazardous Materials Safety Administration for testing such cylinders outside of the United States. For example, the bill requires that, to obtain an approval, manufacturers must answer in their applications specified questions, including whether the manufacturer is or has been subject to various civil or criminal penalties. The bill limits an approval to one year; however, the administration may extend an approval for five years if the manufacturer meets certain requirements.

Great Lakes Authority Act of 2022 This bill establishes a Great Lakes Authority to support economic growth and workforce development, water infrastructure, transportation infrastructure, broadband access, lead abatement, and other initiatives in the Great Lakes region (i.e., Indiana, Michigan, Wisconsin, and parts of Ohio and Illinois). The authority must be composed of a cochairperson appointed by the President, a state cochairperson, and the governor of each Great Lakes region state that elects to participate in the authority.

United States Foundation for International Conservation Act of 2022 This bill requires the Department of State to establish a foundation to provide grants for projects to manage protected and conserved areas in low- and middle-income countries with high levels of biological diversity or species and ecosystems of significant importance. Recipients of grants from this foundation must secure outside funding to match, at minimum, the amount of the grant.

Eliminating Discrimination And Creating Corridors to Expand Student Success Act of 2022 or the ED ACCESS Act of 2022 This bill repeals the prohibition against granting the American Opportunity Tax Credit to students with federal or state felony drug convictions.

Trafficking Survivors Relief Act of 2022 This bill establishes a process to vacate convictions and expunge arrest records for certain criminal offenses committed by victims of human trafficking that directly result from or relate to having been a trafficking victim. It defines the offenses eligible to be vacated or expunged and sets forth procedures for filing a motion. The Government Accountability Office must assess the impact of this process, including the number of human trafficking survivors who file motions to vacate convictions or expunge records. The bill permits certain grants for legal representation to be used to seek post-conviction relief. Finally, the bill creates a rebuttable presumption that a defendant committed certain offenses under duress if the defendant establishes that he or she was a victim of human trafficking at the time of the offense.

IRS Funding Accountability Act This bill delays for a 60-day period funding for the Internal Revenue Service (IRS) enforcement activities enacted by the Inflation Reduction Act (except for eliminating return processing backlogs and reducing call wait times) until an annual spending plan for such activities is submitted to the congressional tax and appropriation committees. Congress may enact a joint resolution of disapproval of the spending plan before the end of the 60-day period requiring the IRS to submit a new spending plan. The IRS and the Department of the Treasury must make quarterly reports to the committees on expenditures for enforcement activities. The bill requires reductions in appropriations to the IRS for any failure to submit required reports.

Healthcare Enrollment Reform Modernization and Navigation Act This bill establishes and otherwise modifies requirements relating to coordinated coverage between employer health insurance and Medicare. Specifically, the bill prohibits employer-sponsored health plans for certain smaller employers from reducing benefits for employees who are eligible for Medicare but have not yet enrolled.

Non-Recognition of Russian Annexation of Ukrainian Territory Act This bill prohibits any federal agency from taking any action or extending any assistance that recognizes or implies recognition of Russia's sovereignty over any internationally recognized territory of Ukraine, including its airspace and territorial waters.

Securing Open Source Software Act of 2022 This bill sets forth the duties of the Cybersecurity and Infrastructure Security Agency (CISA) regarding open source software security. Open source software means software for which the human-readable source code is made available to the public for use, study, re-use, modification, enhancement, and re-distribution. Specifically, CISA must perform outreach and engagement to bolster the security of open source software; support federal efforts to strengthen the security of such software; coordinate with nonfederal entities on efforts to ensure the long-term security of such software; serve as a public point of contact regarding the security of such software for nonfederal entities; and support federal and nonfederal supply chain security efforts by encouraging efforts to bolster open source security. CISA must (1) publicly publish a framework, incorporating government, industry, and open source software community frameworks and best practices, for assessing the risk of open source software components; and (2) update the framework at least annually. The bill provides for a critical infrastructure assessment study and pilot assessment. CISA's Cybersecurity Advisory Committee may establish a software security subcommittee, including open source software security. The Office of Management and Budget, in coordination with CISA, the Office of the National Cyber Director, and the General Services Administration, shall issue guidance on the responsibilities of the chief information officers at specified agencies regarding open source software.

Invent Here, Make Here for Homeland Security Act This bill restricts the manufacture abroad of products invented using funding provided by the Department of Homeland Security (DHS). Specifically, the bill prohibits a firm or nonprofit organization which receives title to any subject invention developed under a funding agreement with DHS from granting to any person the exclusive right to use or sell such invention unless that person agrees that any products embodying, or produced through the use of, such invention will be manufactured substantially in the United States. The bill authorizes waivers of this prohibition in certain instances, but prohibits waivers for products that will be manufactured substantially in a country of concern, including North Korea, China, Russia, and Iran.

Improving Medicare Patients with RNHCI Options to Vaccinate Easily Act or the IMPROVE Act This bill specifies that individuals who elect to receive services in religious nonmedical health care institutions (RNHCIs) may receive COVID-19 vaccines under Medicare. Specifically, an individual's receipt of a COVID-19 vaccine does not revoke the individual's election to receive services in RNHCIs under Medicare; an individual who's election was revoked due to the receipt of a COVID-19 vaccine prior to the bill's date of enactment may immediately reelect to receive services in RNHCIs under Medicare.

Border Patrol Enhancement Act This bill addresses various issues related to U.S. Border Patrol staffing. For example, the bill (1) establishes the Border Patrol Reserve; (2) establishes for the U.S. Border Patrol an authorized personnel level of 20,500 agents, which may be adjusted by the Department of Homeland Security; (3) requires the U.S. Border Patrol to complete a personnel requirements determination model; and (4) provides for higher minimum pay rates for agents.

This bill excludes certain persons from being considered a broker for tax reporting purposes. Under current law, the transfer of digital assets from a broker to a nonbroker requires the broker to file a return beginning on January 1, 2024. The bill provides that a broker does not include any person solely engaged in the business of (1) validating distributed ledger transactions, or (2) selling hardware or software for which the sole function is to permit access to digital assets on a distributed ledger.

Buckeye National Scenic Trail Feasibility Study Act of 2022 This bill requires the study of the feasibility of designating the Buckeye Trail as a national scenic trail. The Buckeye Trail is a system of trails creating a loop extending approximately 1,454 miles from Lake Erie to the Ohio River, through the farmland of northwest Ohio, the hills of Appalachia, the Black Hand sandstone cliffs of the Hocking Hills region, and the Bluegrass region of southwest Ohio.

Investing in Kids' Mental Health Now Act of 2022 This bill temporarily increases the payment rate for pediatric mental, emotional, and behavioral health services, including telehealth services, under Medicaid. The Centers for Medicare & Medicaid Services must issue guidance on how states may expand such services through provider flexibilities and other regulatory pathways.

Safeguarding the Homeland from the Threats Posed by Unmanned Aircraft Systems Act of 2022 This bill provides statutory authority for the Department of Homeland Security (DHS) and the Department of Justice (DOJ) to authorize their personnel to act to detect, identify, monitor, track, and mitigate a credible threat that an unmanned aircraft system (i.e., drone) poses to the safety or security of certain facilities or assets. For example, DHS and DOJ may carry out a pilot program to evaluate the potential benefits of state, local, tribal, and territorial law enforcement agencies taking actions to mitigate credible unmanned aircraft system threats. Additionally, DHS and DOJ must coordinate with the Federal Aviation Administration before carrying out any action authorized by the bill to ensure the action does not adversely impact or interfere with safe airport operations, navigation, air traffic services, or the safe and efficient operation of the national airspace system.

DHS Joint Task Forces Reauthorization Act of 2022 This bill reauthorizes through FY2024 the authority of the Department of Homeland Security to establish joint task forces. The bill also modifies various reporting and oversight requirements related to such joint task forces.

Lake Erie Water Quality Protection Act This bill requires the U.S. Army Corps of Engineers to prioritize implementation of dredged material management plans for federally authorized harbors in Ohio. Plans must limit open-lake disposal of dredged material and maximize its beneficial use.

Comprehensive Care for Dual Eligible Individuals Act This bill provides states with the option to establish a separate health care program for individuals who are dually eligible for Medicare and Medicaid. Programs must provide a core package of covered benefits to address the individualized medical, behavioral, long-term care, and social needs of enrollees, including all basic Medicare and Medicaid benefits. States may receive federal matching payments in accordance with a specified formula; the bill provides funds for the Federal Coordinated Health Care Office to implement the bill.

Quantum Computing Cybersecurity Preparedness Act This bill addresses the migration of executive agencies information technology systems to post-quantum cryptography. Post-quantum cryptography is encryption strong enough to resist attacks from quantum computers developed in the future. Not later than one year after the National Institutes of Standards and Technology has issued post-quantum cryptography standards, the Office of Management and Budget (OMB) shall begin to prioritize the migration of agency information technology systems to post-quantum cryptography. Not later than one year after the date of the enactment of this bill, the OMB shall submit to Congress a report on a strategy to address the risk posed by the vulnerabilities of agency information technology systems to the potential capability of a quantum computer; the funding necessary to secure such information technology systems from the threat posed by adversarial access to quantum computers; and a description of federal coordination efforts to develop standards for post-quantum cryptography, including any federal Information Processing Standards.

Benjamin Berell Ferencz Congressional Gold Medal Act This bill provides for the award of a Congressional Gold Medal to Benjamin Berell Ferencz in recognition of his service to the United States and the international community during the post-World War II Nuremberg trials and his lifelong advocacy for international criminal justice and the rule of law.

This resolution condemns Russia for committing acts of genocide against the Ukrainian people. Electoral Count Reform and Presidential Transition Improvement Act of 2022 This bill revises the process of casting and counting electoral votes for presidential elections. The bill also revises provisions related to the presidential transition process. The bill specifies that the choice of electors must occur in accordance with the laws of the state enacted prior to election day. Additionally, the bill identifies each state's governor (unless otherwise identified in the laws or constitution of a state in effect on election day) as responsible for submitting the certificate of ascertainment identifying the state's electors. Further, the bill provides for expedited judicial review for any action brought by an aggrieved presidential or vice-presidential candidate arising under the U.S. Constitution or U.S. laws with respect to the issuance or transmission of such a certificate. The bill revises the framework for the joint session of Congress to count electoral votes and make a formal declaration of which candidates have been elected President and Vice President. Among other changes, the bill (1) specifies that the role of the Vice President during the joint session shall be ministerial in nature, and (2) raises the objection threshold in Congress to at least one-fifth of the duly chosen and sworn members of both the House of Representatives and the Senate. The bill also revises the presidential transition process, including to (1) allow more than one candidate to receive federal transition resources under certain circumstances, and (2) require additional reporting by the General Services Administration.

Enhanced Election Security and Protection Act This bill makes various changes related to federal elections. Among other elements, the bill (1) reauthorizes through FY2027 the Election Assistance Commission, (2) increases penalties related to crimes against federally protected voting activities, and (3) requires the U.S. Postal Service to take certain actions related to federal election mail.

Extension of Authority to Acquire Innovative Commercial Items Act of 2022 This bill extends the pilot program for authority to acquire innovative commercial items using general solicitation procedures through FY2027. The bill raises the maximum value of a contract under the program from $10 million to $25 million.
