Preserving Choice in Vehicle Purchases Act of 2025 This bill modifies the waiver process under the Clean Air Act related to state emission control standards for new motor vehicles (or new motor vehicle engines). Under current law, states are preempted from adopting or enforcing emission control standards for new motor vehicles (or new motor vehicle engines) unless the Environmental Protection Agency (EPA) provides a waiver authorizing a state to adopt such standards if certain requirements are met. The bill provides that state standards that directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines are not eligible for waivers. The bill also prohibits the EPA from determining that any state standards amended after the bill's enactment are within the scope of an existing waiver. Additionally, the bill requires the EPA to revoke waivers granted between January 1, 2022, and the date of enactment of this bill if the standards directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines.

Security and Oversight for International Landholdings Act of 2025 or the SOIL Act of 2025 This bill establishes and expands requirements for reviewing and disclosing transactions regarding foreign investments in agricultural land. The Committee on Foreign Investment in the United States (CFIUS) must review certain investments in agricultural land held by a person (i.e., individual or entity) that is a national of, or subject to the jurisdiction of, a country (1) designated as a nonmarket economy, or (2) identified as posing a risk to the national security of the United States. Under current law, CFIUS reviews the national security implications of certain foreign investments in U.S. businesses or real estate, including critical infrastructure or technologies. CFIUS must also review certain real estate acquisitions or transfers of an interest, other than a security, for nonresidential properties that are located within 50 miles of a military installation. The bill also prohibits federal assistance, including subsidies, from being provided to a person for an agricultural real estate holding which is owned by any of the foreign persons specified above. The bill requires any foreign person who enters into a leasing agreement for agricultural land that is longer than five years to report the lease to the Department of Agriculture (USDA). Current requirements only apply to agriculture land acquired or transferred. Further, USDA must prepare and make publicly available an annual report describing agricultural land holdings by foreign persons, including specific information related to foreign persons from China and Russia.

Protect Our Military Families' 2nd Amendment Rights Act This bill broadens the scope of allowable firearms transactions involving active-duty service members and their spouses. Specifically, the bill allows a licensed gun dealer, importer, or manufacturer to sell or ship a firearm or ammunition to the spouse of a member of the Armed Forces on active duty outside the United States. Current law already allows a licensed dealer, importer, or manufacturer to sell or ship a firearm or ammunition to a member of the Armed Forces on active duty outside the United States. The bill also specifies that, for purposes of federal firearms laws, a member of the Armed Forces on active duty, or his or her spouse, is a resident of the state in which (1) the member or spouse maintains legal residence, (2) the permanent duty station of the member is located, and (3) the member maintains a home from which he or she commutes to the permanent duty station.

Traveler's Gun Rights Act This bill broadens the scope of allowable firearms transactions involving active duty servicemembers and their spouses and individuals who do not have a residence in any state. Currently, federal firearms laws generally prohibit a federal firearms licensee (e.g., a gun dealer) from selling or delivering a firearm to an individual whose state of residence is different than the state where the licensee's place of business is located. This bill defines the term state of residence as the state in which an individual is present with an intention of making a home. In the case of an individual who does not have a physical residence in any state, the term state of residence means the address of the individual's private mailbox or post office box. In the case of a member of the Armed Forces on active duty, or his or her spouse, the term state of residence means (1) the state in which the member's permanent duty station is located, and (2) the state where the member maintains a place of abode from which he or she commutes to the permanent duty station.

Break Up Suspicious Transactions of Fentanyl Act or the BUST FENTANYL Act This bill revives a requirement for the President to identify foreign opioid traffickers and extends opioid trafficking sanctions to new categories of foreign persons (individuals and entities) whose actions support such trafficking. Specifically, the bill revives through 2030 a requirement that the President annually submit a report to Congress identifying foreign opioid traffickers. (For those listed in the report, the President must select certain sanctions to impose on them, such as bans on loans, foreign exchange transactions, and property transactions.) The bill also specifies that such reports must prioritize the identification of Chinese nationals and entities involved in the shipment of fentanyl, fentanyl-related chemicals, and fentanyl manufacturing equipment to Mexico or any other country involved in the production of fentanyl trafficked to the United States. The bill extends such foreign opioid trafficker sanctions to additional categories of foreign persons, including those that have knowingly (1) engaged in significant activities or financial transactions that materially contributed to opioid trafficking; or (2) provided financial, material, or technological support for such activities or transactions. The bill also authorizes the President to impose these sanctions on foreign government entities, including government owned or controlled financial institutions, that are involved in activities that contribute to opioid trafficking. Additionally, the President may impose property-blocking sanctions on senior officials of these foreign government entities who knowingly facilitate such activities.

No Bailout for Sanctuary Cities Act This bill makes a state or political subdivision of a state ineligible for any federal funds that the jurisdiction intends to use to benefit non-U.S. nationals (i.e., aliens under federal law) who are unlawfully present if the jurisdiction withholds information about citizenship or immigration status or does not cooperate with immigration detainers. Specifically, such funds are denied to any jurisdiction that has a law, policy, or practice that prohibits or restricts any government entity from maintaining, sending, or receiving information regarding the citizenship or immigration status of any individual; exchanging information regarding an individual's citizenship or immigration status with a federal, state, or local government entity; complying with a valid immigration detainer from the Department of Homeland Security (DHS); or notifying DHS about an individual's release from custody. The funding restriction does not apply to a law, policy, or practice that only applies to an individual who comes forward as a victim of or a witness to a criminal offense. DHS must annually provide to specified congressional committees a list of jurisdictions that have failed to comply with a DHS detainer or have failed to notify DHS of an individual’s release. The funding restriction begins 60 days after the bill's enactment or on the first day of the fiscal year following the bill's enactment, whichever is earlier.

Critical Mineral Consistency Act of 2025 This bill modifies the Energy Act of 2020 to expand the definition of critical minerals used by the U.S. Geological Survey (USGS) to include critical materials designated by the Department of Energy (DOE). It also directs USGS to update its list within 45 days of DOE adding a mineral, element, substance, or material to its critical materials list. Thus, the bill requires the lists to be treated consistently and makes critical materials eligible for the same benefits (e.g., financing support or clean energy tax credits) provided to critical minerals. By way of background, DOE's critical materials list contains certain materials that are essential for energy, including those on the critical minerals list of the USGS. The USGS's list, which contains certain minerals that are essential to the nation's economic or national security, is currently not required to include the materials on DOE's list.

Broadband Grant Tax Treatment Act This bill excludes from gross income (for federal tax purposes) certain grants received for broadband deployment. As background, contributions of capital to a corporation generally are not taxable income. However, under an exception enacted in 2017 by the Tax Cuts and Jobs Act, grants from a government or civic organization are not contributions to capital and, thus, treated as taxable income. Prior to the Tax Cuts and Jobs Act, the Internal Revenue Service (IRS) considered certain grants from a government or civic organization contributions of capital and, thus, not taxable income. The bill specifically excludes from gross income grants received for broadband deployment from the National Telecommunications and Information Administration (NTIA) Broadband Equity, Access, and Deployment Program; NTIA State Digital Equity Capacity Grant Program; NTIA Digital Equity Competitive Grant Program; NTIA Enabling Middle Mile Broadband Infrastructure Program; Department of Agriculture ReConnect Program; Coronavirus State and Local Fiscal Recovery Funds and the Coronavirus Capital Projects Fund; and NTIA Tribal Broadband Connectivity Program and the Broadband Infrastructure Program. The bill also requires the IRS to issue guidance on the exclusion from gross income of such grants. The bill applies to funds received in tax years ending after March 11, 2021.

Combating Illicit Xylazine Act This bill regulates xylazine under the Controlled Substances Act (CSA). Xylazine, also known as tranq , is a nonopioid sedative and pain reliever that is approved for use in animals. Recently, the Drug Enforcement Administration (DEA) has reported an increase in trafficking of fentanyl mixed with xylazine. This bill adds xylazine, including its salts, isomers, and salts of isomers, to schedule III of the CSA. Schedule III controlled substances, including anabolic steroids, buprenorphine, and ketamine, have less potential for abuse than a schedule I or II substance, have a currently accepted medical use, and have low or moderate risk of dependence if abused. Under the bill, manufacturing, distributing, or dispensing xylazine, or possessing with intent to manufacture, distribute, or dispense xylazine for illicit use is subject to criminal penalties under the CSA. The bill also requires xylazine transactions to be tracked in the drug reporting system maintained by the DEA. The bill exempts from registration under the CSA persons and entities that possess xylazine (1) lawfully dispensed by a veterinarian or pharmacy and (2) for an animal or for use in certain animal-control or wildlife programs. The bill also exempts xylazine manufacturers from the CSA's physical security requirements. Finally, the bill requires the DEA, in coordination with the Department of Health and Human Services (HHS), to provide Congress with a report on how the agencies previously determined whether xylazine should be a controlled substance, including the full text of HHS's recommendations to the DEA for scheduling xylazine.

Mining Regulatory Clarity Act This bill allows mining operators to use federal lands for activities ancillary to mining, such as waste disposal, regardless of whether those lands contain mineral deposits valuable enough to be mined (mineral validity). It also establishes the Abandoned Hardrock Mine Fund. The bill addresses a 2022 decision in the U.S. Court of Appeals for the Ninth Circuit related to the Rosemont Copper Mine in Arizona (commonly known as the Rosemont decision , described further in CRS Report R48166 ). The court held that mining claims are only allowed where mineral validity has been established and that mill site claims are more appropriate means for establishing a mining waste disposal site under the Mining Act. The bill allows a mining operator to (1) locate and include within its plan of operations as many mill site claims (e.g., areas for waste rock disposal) as are reasonably necessary for its operations, and (2) use or occupy public land in accordance with an approved plan of operations. Additionally, the bill requires any revenue generated from fees for such mill site claims to be deposited into the Abandoned Hardrock Mine Fund. The Department of the Interior must use the fund for certain abandoned hardrock mine reclamation activities.
