Preventing Animal Cruelty and Torture Act or the PACT Act This bill revises and expands criminal provisions with respect to animal crushing. It retains existing criminal offenses that prohibit knowingly creating or distributing an animal crush video using interstate commerce. The bill also adds a new provision to criminalize an intentional act of animal crushing. A violator is subject to criminal penalties—a fine, a prison term of up to seven years, or both. It provides additional exceptions for conduct, or a video of conduct, including conduct that is (1) medical or scientific research, (2) necessary to protect the life or property of a person, (3) performed as part of euthanizing an animal, or (4) unintentional.

Climate Change Education Act This bill declares that the evidence for human-induced climate change is overwhelming and undeniable. The National Oceanic and Atmospheric Administration (NOAA) must establish a Climate Change Education Program to increase the climate literacy of the United States by broadening the understanding of human-induced climate change, including possible consequences and potential solutions; apply the latest scientific and technological discoveries to provide learning opportunities to people of all ages; and help people understand and promote implementation of new technologies, programs, and incentives related to climate change, climate adaptation and mitigation, and climate resilience. NOAA must also establish a grant program for climate change education.

Emergency Relief for Federal Contractors Act of 2019 This bill allows penalty-free distributions up to $30,000 in a taxable year from tax-exempt retirement plans to certain federal contractors and District of Columbia employees made during a federal government shutdown.

Native American Suicide Prevention Act of 2019 This bill requires a state or state-designated entity that receives support from the Substance Abuse and Mental Health Services Administration for development and implementation of a statewide youth suicide early intervention and prevention strategy to agree to collaborate with each of the state's federally recognized Indian tribes, tribal organizations, urban Indian organizations, and Native Hawaiian health care systems regarding the strategy.

Family and Medical Insurance Leave Act or the FAMILY Act This bill establishes the Office of Paid Family and Medical Leave within the Social Security Administration. The bill entitles every individual to a family and medical leave insurance (FMLI) benefit payment for a specified benefit period and prescribes a formula for determining the individual's monthly benefit amount. An FMLI benefit payment shall be coordinated with any periodic benefits received under a state or local temporary disability insurance or family leave program. The bill amends the Internal Revenue Code to impose a tax on employers, employees, and self-employed individuals to fund FMLI benefits. It also establishes the Federal Family and Medical Leave Insurance Trust Fund to hold tax revenues.

Employer Participation in Repayment Act of 2019 This bill expands the tax exclusion for employer-provided educational assistance to include payments of qualified education loans by an employer to either an employee or a lender.

Office of Rural Broadband Act This bill establishes the Office of Rural Broadband to help coordinate federal efforts and resources to develop rural telecommunications systems and to track broadband subscription rates in rural areas.

Keep Americans Safe Act This bill establishes a new criminal offense for the import, sale, manufacture, transfer, or possession of a large capacity ammunition feeding device (LCAFD). The bill does not prohibit certain conduct with respect to an LCAFD, including the following: importation, sale, manufacture, transfer, or possession related to certain law enforcement efforts, or authorized tests or experiments; importation, sale, transfer, or possession related to securing nuclear materials; and possession by a retired law enforcement officer. The bill permits continued possession of, but prohibits sale or transfer of, a grandfathered LCAFD. Newly manufactured LCAFDs must display serial number identification and the date of manufacture. Additionally, the bill allows a state or local government to use Edward Byrne Memorial Justice Assistance Grant Program funds to compensate individuals who surrender an LCAFD under a buy-back program.

Veterans Medical Marijuana Safe Harbor Act This bill provides guidance related to veterans and medical marijuana that shall be effective for five years. Specifically, the bill authorizes (1) a veteran to use, possess, or transport medical marijuana in accordance with applicable state or Native American tribal law; (2) a Department of Veterans Affairs (VA) physician to discuss with a veteran the use of medical marijuana as a treatment if the physician is in a state or on tribal land that authorizes such treatment; or (3) a VA physician to recommend, complete forms for, or register veterans for participation in a medical marijuana treatment program in accordance with applicable state or tribal law. The bill requires the VA to report on (1) the effects of medical marijuana on veterans in pain; and (2) the relationship between state-approved medical marijuana treatment programs, program access, and opioid abuse reduction.

Transit Worker and Pedestrian Protection Act This bill requires grant recipients under the public transportation safety program who operate a fixed route bus service to (1) develop a risk reduction program for bus operations to improve safety by reducing the number and rates of accidents, injuries, assaults on bus operators, and fatalities; (2) submit the program to the Department of Transportation (DOT) for review and approval; and (3) implement the approved program. DOT shall require grant recipients who operates a rail fixed guideway public transportation system that is not subject to regulation by the Federal Railroad Administration to (1) develop a risk reduction program for assaults on rail workers to improve safety by reducing the number and severity of assaults on such workers; (2) submit the program to DOT for review and approval; and (3) implement the approved program. A grant recipient shall report to DOT any information on each assault on a transit worker for inclusion in the National Transit Database.

Home Health Payment Innovation Act of 2019 This bill makes a series of changes relating to payment and coverage of home health services under Medicare and Medicare Advantage (MA). Specifically, the bill allows the home-confinement requirement (also known as the homebound requirement) for home health services to be waived under Medicare and MA. Currently, as a condition of eligibility for such services, a physician must certify that an individual has difficulty leaving home without assistance (e.g., a wheelchair, special transportation, or help from another person) due to an illness or injury. The bill also alters the payment methodology under the Medicare prospective payment system for home health services, including by eliminating the requirement that such methodology include certain behavioral assumptions regarding the implementation of specified changes to units of payment and case-mix adjustment factors.

Autism Collaboration, Accountability, Research, Education, and Support Act of 2019 or the Autism CARES Act of 2019 This bill reauthorizes through FY2024 and revises several programs and activities relating to autism spectrum disorder (ASD). Among other things, the bill reauthorizes provisions relating to (1) expanded ASD research at the National Institutes of Health; (2) ASD education, early detection, and intervention activities supported by the Health Resources and Services Administration; and (3) the Interagency Autism Coordinating Committee. The bill also generally revises the scope of such programs and activities to encompass ASD individuals of all ages, rather than only youth.

Supreme Court Ethics Act This bill establishes a new statutory requirement for the Judicial Conference of the United States (Judicial Conference) to issue a judicial code of conduct for judges and justices of U.S. courts (including Justices of the Supreme Court). Currently, the Judicial Conference issues a code of conduct for judges of U.S. courts (but not for Justices of the Supreme Court).

This bill prohibits (1) an individual serving as a member of the Armed Forces from being involuntarily separated from the Armed Forces, or denied reenlistment or continuation in service, solely on the basis of the member's gender identity; and (2) an individual from being denied initial enlistment, commissioning, or other accession into the Armed Forces solely on such basis.

Global Health, Empowerment and Rights Act This bill establishes that a foreign nongovernmental organization shall not be disqualified from receiving certain U.S. international development assistance solely because the organization provides medical services using non-U.S. government funds if the medical services are legal in both the United States and the country in which they are being provided. Such foreign organizations shall not be subject to requirements relating to their use of non-U.S. funds for advocacy or lobbying activities, other than those that apply to U.S. nongovernmental organizations. Current U.S. policy prohibits various foreign assistance from going to a foreign nongovernmental organization unless it agrees to not perform or actively promote abortions.

America's Natural Treasures of Immeasurable Quality Unite, Inspire, and Together Improve the Economies of States Act or the ANTIQUITIES Act This bill provides for the administration of certain National Monuments and the designation of certain lands in New Mexico and Nevada as wilderness. This bill directs the National Park Service, Bureau of Land Management (BLM), U.S. Fish and Wildlife Service, Forest Service, and National Oceanic and Atmospheric Administration to administer each specified national monument in accordance with (1) the one or more presidential proclamations that apply to the monument, (2) any Act of Congress enacted before December 4, 2017, that provides for an adjustment to the boundary or administration of such monument, and (3) this bill. The bill establishes the National Monument Enhancement Fund to furnish funding (1) to such federal agencies to develop management plans for their national monuments that were designated under current federal law, (2) for federal acquisition and development of certain land and other areas, and (3) to develop and enhance recreational infrastructure on such designated lands. The bill designates specified BLM lands within the Organ Mountains-Desert Peaks and Rio Grande del Norte National Monuments in New Mexico and in the Gold Butte National Conservation Area in Nevada as wilderness and as components of the National Wilderness Preservation System. The Department of the Interior shall manage approximately 100 acres of BLM land in New Mexico identified as Lookout Peak Communication Site in a manner that preserves the character of the land for future inclusion in the National Wilderness Preservation System.

Craft Beverage Modernization and Tax Reform Act of 2019 This bill modifies the tax treatment of certain alcoholic beverages to exclude the aging period from the production period for beer, wine, or distilled spirits for purposes of determining whether a taxpayer can expense, rather than capitalize, interest costs paid or incurred during the production period; reduce excise tax rates on beer and distilled spirits; permit the transfer of beer between bonded facilities without payment of tax; increase the amount of the small wine producer tax credit and expand the categories of producers covered by such credit; allow an adjustment to the producer credit for hard cider; and modify the alcohol content limitations that apply to certain wines for tax purposes. The Department of the Treasury must amend applicable regulations with respect to the use of wholesome products suitable for human consumption in the production of fermented beverages. The bill also increases funding for the Alcohol and Tobacco Tax and Trade Bureau.

Census Improving Data and Enhanced Accuracy Act or the Census IDEA Act This bill prohibits the Department of Commerce, in the 2020 decennial census of population and each decennial census thereafter, from (1) implementing any major operational design element that has not been researched, studied, and tested for a period of at least three years before the decennial census date; or (2) including on the questionnaire for the census any subject, type of information, or question that was not submitted to Congress. The Government Accountability Office shall determine and report to Congress on whether the subjects, types of information, and questions to be included in that decennial census have been adequately researched, studied, and tested to the same degree as in previous decennial censuses.

Resident Physician Shortage Reduction Act of 2019 This bill increases the number of residency positions eligible for graduate medical education payments under Medicare for qualifying hospitals, with an aggregate increase of 3,000 positions per fiscal year for five years. Of these positions, at least 1,500 per fiscal year must be for residents in a shortage specialty residency program (i.e., a program in a specialty in which baseline physician requirements projections exceed the projected supply of total active physicians, as identified by the Health Resources and Services Administration in a specified report).

Creating and Restoring Equal Access to Equivalent Samples Act of 2019 or the CREATES Act of 2019 This bill generally allows the developer of a drug or biological product, such as a generic or biosimilar version of a drug, to bring a civil action against the license holder of an approved medication if the holder refuses to make available sufficient quantities of the approved medication for the developer's testing. The bill also establishes affirmative defenses to such a civil action. In addition, the bill authorizes drug manufacturers seeking Food and Drug Administration approval for a generic drug to use alternative methods to develop elements assure safe use of a drug.

GEAR UP for Success Act of 2019 This bill reauthorizes through FY2025 and revises the Gaining Early Awareness and Readiness for Undergraduate Programs (GEAR UP). The bill adds metrics for program evaluations and makes other revisions to GEAR UP, including with respect to authorized uses of funds.

Keep Families Together Act This bill limits the separation of families at or near U.S. borders or ports of entry. The Departments of Homeland Security (DHS), Justice, and Health and Human Services shall not separate a child from a parent or legal guardian at a port of entry or within 100 miles of a U.S. border unless a state court terminates the parent or legal guardian's rights; a state child welfare agency or court determines it is in the child's best interests to be removed; or the child is determined to be a trafficking victim or at risk of becoming one, the accompanying adult is most likely not the parent or legal guardian, or the child is in danger of abuse or neglect. An agency may not separate a child from a parent or legal guardian solely to deter migration into the United States or to promote compliance with immigration laws. DHS shall develop (1) training related to the bill's family separation requirements, and (2) guidance for how parents and legal guardians may locate a separated child. DHS shall provide parents and legal guardians periodic status updates about a separated child. The Government Accountability Office shall report to Congress on the criminal prosecution of asylum seekers.

Mental Health Access Improvement Act of 2019 This bill provides for coverage of marriage and family therapist services and mental health counselor services under Medicare. It also excludes such services from the skilled nursing facility prospective payment system, and authorizes marriage and family therapists and mental health counselors to develop discharge plans for post-hospital services.

Increasing Access to Osteoporosis Testing for Medicare Beneficiaries Act of 2019 This bill specifies that certain Medicare payment rules applicable to imaging services shall apply to dual-energy x-ray absorptiometry services used in bone mass scans beginning in 2019. The Centers for Medicare & Medicaid Services must establish national minimum payment amounts for such services.

Fred Korematsu Congressional Gold Medal Act of 2019 This bill requires the President pro tempore of the Senate and the Speaker of the House of Representatives to make arrangements for the posthumous award of a Congressional Gold Medal to Fred Korematsu, in recognition of his contributions to civil rights, his loyalty and patriotism to the United States, and his dedication to justice and equality. The medal shall be given to the Smithsonian Institution and will be available for display and research, and can be loaned, as appropriate, for display elsewhere.

Paycheck Fairness Act This bill addresses wage discrimination on the basis of sex. It amends equal pay provisions of the Fair Labor Standards Act of 1938 to (1) restrict the use of the bona fide factor defense to wage discrimination claims, (2) enhance nonretaliation prohibitions, (3) make it unlawful to require an employee to sign a contract or waiver prohibiting the employee from disclosing information about the employee's wages, and (4) increase civil penalties for violations of equal pay provisions. The Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs shall train EEOC employees and other affected parties on wage discrimination. The bill directs the Department of Labor to: (1) establish and carry out a grant program for negotiation skills training for girls and women, (2) conduct studies to eliminate pay disparities between men and women, and (3) make available information on wage discrimination to assist the public in understanding and addressing such discrimination. The Secretary of Labor's National Award for Pay Equity in the Workplace is established for an employer who has made a substantial effort to eliminate pay disparities between men and women. The bill requires the EEOC to issue regulations for collecting from employers compensation and other employment data according to the sex, race, and national origin of employees for use in enforcing laws prohibiting pay discrimination.

Esther Martinez Native American Languages Programs Reauthorization Act This bill revises a grant program administered by the Administration for Native Americans at the Department of Health and Human Services to preserve Native American languages. The minimum number of enrollees in educational programs funded by grants is reduced from 10 to 5 enrollees in Native American language nests, which provide instruction through the use of a Native American language for children under the age of 7 and their parents. For survival schools, which are programs striving for fluency in a Native American language and proficiency in other academic fields, the minimum number of enrollees is reduced from 15 to 10. The bill increases the maximum duration of grants. The program is reauthorized through FY2024.

Rebuild America's Schools Act of 2019 This bill provides financial assistance in FY2020-FY2029 for long-term improvements to public school facilities by allocating funds to states for school improvements, awarding need-based grants to local education agencies, and restoring school infrastructure tax credit bonds. The bill specifies allowable uses of grant funds, including making major repairs of public school facilities and making public school facilities accessible to disabled individuals. The bill requires local education agencies to adopt certain green practices (environmental standards) and use products made in the United States (Buy America). The Department of Education must establish a clearinghouse to disseminate information to assist schools in initiating, developing, and financing energy efficiency projects, distributed generation projects, and energy retrofitting projects. The bill increases funding through FY2023 for the Impact Aid Construction program under the Elementary and Secondary Education Act of 1965.

Special Envoy to Monitor and Combat Anti-Semitism Act of 2019 This bill establishes the Special Envoy for Monitoring and Combating anti-Semitism as an ambassador-rank official, appointed by the President, by and with the advice and consent of the Senate, who leads the Office to Monitor and Combat anti-Semitism within the Department of State. (Under current law, the special envoy is appointed by the Secretary of State.) The President may nominate the special envoy from among State Department officers and employees. The special envoy shall be the primary advisor in the government relating to monitoring and combating anti-Semitism in foreign countries. The individual shall be of recognized distinction in religious freedom, law enforcement, or combating anti-Semitism.

Christa McAuliffe Commemorative Coin Act of 2019 This bill directs the Department of the Treasury to mint and issue not more than 350,000 $1 silver coins in commemoration of Christa McAuliffe, a teacher tragically killed in the Space Shuttle Challenger Disaster. The design of the coins shall bear an image and the name of Christa McAuliffe on the obverse side and a design on the reverse side that depicts the legacy of McAuliffe as a teacher. Treasury may issue the coins from January 1-December 31, 2020. All surcharges received by Treasury from the sale of the coins shall be paid to the FIRST robotics program for the purpose of engaging and inspiring young people, through mentor-based programs, to become leaders in the fields of science, technology, engineering, and mathematics.

Savanna's Act This bill directs the Department of Justice (DOJ) to review, revise, and develop law enforcement and justice protocols to address missing and murdered Indians. The bill requires DOJ to take the following actions: provide training to law enforcement agencies on how to record tribal enrollment for victims in federal databases, develop and implement a strategy to notify citizens of the National Missing and Unidentified Persons System, conduct specific outreach to Indian tribes regarding the ability to publicly enter information through the National Missing and Unidentified Persons System or other non-law enforcement sensitive portal, develop guidelines for response to cases of missing and murdered Indians, provide training and technical assistance to Indian tribes and law enforcement agencies for implementation of the developed guidelines, and report statistics on missing and murdered Indians. Federal law enforcement agencies must modify their guidelines to incorporate the guidelines developed by DOJ. The FBI shall include gender in its annual statistics on missing and unidentified persons published on its website.

Indian Programs Advance Appropriations Act This bill authorizes advance appropriations for several covered appropriations accounts of (1) the Bureau of Indian Affairs and Bureau of Indian Education within the Department of the Interior, and (2) the Indian Health Service within the Department of Health and Human Services. The advance appropriations provide new budget authority that first becomes available for the first fiscal year after the budget year. The covered accounts within the Bureau of Indian Affairs and Bureau of Indian Education include (1) Operation of Indian Programs, (2) Contract Support Costs, and (3) the Indian Guaranteed Loan Program Account. The covered accounts within the Indian Health Service include (1) Indian Health Services, and (2) Contract Support Costs. The bill also requires the President's budget and the supporting documents submitted to Congress to include detailed estimates related to the advance appropriations.

This joint resolution eliminates the deadline for the ratification of the Equal Rights Amendment, which prohibits discrimination based on sex. The amendment was proposed to the states in House Joint Resolution 208 of the 92nd Congress, as agreed to in the Senate on March 22, 1972. The amendment shall be part of the Constitution whenever ratified by the legislatures of three-fourths of the states.

Retired Pay Restoration Act This bill authorizes the receipt of both military retired pay and veterans' disability compensation with respect to any service-connected disability. Under current law, only veterans with service-connected disabilities rated at 50% or more receive both without offset. Individuals who were retired or separated from military service due to a service-connected disability shall be eligible for the full concurrent receipt of both veterans' disability compensation and either military retired pay or combat-related special pay.

Protect DREAMer Confidentiality Act of 2019 This bill directs the Department of Homeland Security (DHS) to prevent disclosing information from applications to the Deferred Action for Childhood Arrivals (DACA) program to U.S. Immigration and Customs Enforcement (ICE) or U.S. Customs and Border Protection (CBP), except to implement the program. Application information may be shared only to identify or prevent fraudulent claims, for particularized national security purposes relating to the applicant, or to investigate or prosecute a felony not related to immigration status. The bill also prohibits DHS from referring any individual with deferred action status to ICE, CBP, the Department of Justice, or any law enforcement agency.

Burn Pits Accountability Act This bill requires the Department of Defense (DOD) and the military departments to evaluate whether each member of the Armed Forces has been (1) based or stationed where an open air burn pit was used to dispose of waste, or (2) exposed to toxic airborne chemicals. Members located where an open burn pit was used or exposed to toxic airborne chemicals must be enrolled in the Airborne Hazards and Open Burn Pit Registry, unless the member elects not to enroll. The evaluations must be included in periodic health assessments, physical exams conducted immediately prior to separation from active duty, and deployment assessments. DOD must share the results of the evaluations with the Department of Veterans Affairs.

VA Medicinal Cannabis Research Act of 2019 This bill requires the Department of Veterans Affairs (VA) to conduct a clinical trial of the effects of medical-grade cannabis on the health outcomes of covered veterans diagnosed with chronic pain, and also those diagnosed with post-traumatic stress disorder. Covered veterans are those who are enrolled in the VA patient enrollment system for hospital care and medical services.

Supporting Veterans in STEM Careers Act This bill addresses the participation of veterans in STEM (science, technology, engineering, and mathematics) fields, including by making veterans eligible for certain National Science Foundation (NSF) programs. The bill directs the NSF to (1) encourage veterans to study and pursue careers in STEM and computer science in coordination with other federal agencies that serve veterans, and (2) submit a plan to Congress for enhancing veterans outreach. The National Science Board shall provide in its annual report on the state of science and engineering in the United States relevant data on veterans in science and engineering careers or education programs. The bill provides for veterans' participation and outreach in (1) the Robert Noyce Teacher Scholarship program to recruit and train mathematics and science teachers, (2) NSF fellowships and masters fellowships for mathematics and science teachers, (3) computer and network security capacity building grants, and (4) traineeship grants leading to a doctorate degree in computer and network security research. The Office of Science and Technology Policy shall establish an interagency working group to coordinate federal programs and policies for transitioning and training veterans and military spouses for STEM careers.

Telephone Robocall Abuse Criminal Enforcement and Deterrence Act or the TRACED Act This bill implements a forfeiture penalty for violations (with or without intent) of the prohibition on certain robocalls. The bill also removes an annual reporting requirement for enforcement relating to unsolicited facsimile advertisements. The bill requires voice service providers to develop call authentication technologies. The Federal Communications Commission (FCC) shall promulgate rules establishing when a provider may block a voice call based on information provided by the call authentication framework, but also must establish a process to permit a calling party adversely affected by the framework to verify the authenticity of their calls. The FCC shall also initiate a rulemaking to help protect a subscriber from receiving unwanted calls or texts from a caller using an unauthenticated number. This bill requires the Department of Justice and the FCC to assemble an interagency working group to study and report to Congress on the enforcement of the prohibition of certain robocalls. Specifically, the working group will look into how to better enforce against robocalls by examining issues like the types of laws, policies, or constraints that could be inhibiting enforcement. Health Insurance Tax Relief Act of 2019 This bill delays reimposition of the annual fee on health insurers until 2022. Under current law, the annual fee for a health insurer is calculated based on the insurer's share of total premiums from the preceding year. The fee is suspended for 2019 (i.e., there is no fee based on premiums from 2018); reimposition is scheduled for 2020.

Fair Compensation for Low-Wage Contractor Employees Act of 2019 This bill appropriates funding to provide compensation to certain employees of contractors who lost pay or leave due to the lapse in appropriations that began on December 22, 2018. Each agency subject to such lapse shall adjust the price of any contract for which the contractor was ordered to suspend, delay, or stop work as a result of the lapse. The agency shall compensate the contractor for reasonable costs incurred to (1) provide compensation, at an employee's standard rate of compensation, to any employee who was furloughed or laid off, or who was not working, who experienced a reduction of hours, or who experienced a reduction in compensation, as a result of the lapse, for the period of the lapse; or (2) restore paid leave taken by any employee during the lapse, if the contractor required employees to use paid leave as a result of the lapse. The maximum amount of weekly compensation of an employee for which an adjustment may be made may not exceed the lesser of the employee's actual weekly compensation or $965.

Raise the Wage Act This bill amends the Fair Labor Standards Act of 1938 to increase the federal minimum wage for regular employees over a 7-year period, for tipped employees, and for newly hired employees who are less than 20 years old. The bill sets forth a schedule of annual increases in the federal minimum wage for individuals with disabilities. The Department of Labor shall no longer issue special certificates for the payment of subminimum wages to such individuals after the final wage increase under this bill for such individuals takes effect. Labor shall provide, upon request, technical assistance and information to employers to: (1) help them transition their practices to comply with wage increases and other requirements under this bill for individuals with disabilities, and (2) ensure continuing employment opportunities for such individuals. The bill eliminates the separate minimum wage requirements for tipped, newly hired, and disabled employees. After a specified period, these employees shall be paid the same minimum wage as regular employees. Labor must publish any increase in the minimum wage in the Federal Register and on its website 60 days before it takes effect.

Merchant Mariners of World War II Congressional Gold Medal Act of 2019 This bill provides for a Congressional Gold Medal to be awarded to the U.S. Merchant Mariners of World War II, in recognition of their service during World War II. Following the award of the medal, it shall be given to the American Merchant Marine Museum, where it shall be available for display and research.

Protecting Domestic Violence and Stalking Victims Act of 2019 This bill expands the categories of persons who are prohibited from receiving or possessing a firearm or ammunition. Specifically, it prohibits firearm sale or transfer to and receipt, possession, shipment, or transport by a person who has been convicted in any court of a misdemeanor crime of stalking.
