Promoting Affordable Childcare for Everyone Act or the PACE Act This bill modifies the tax credit for expenses for household and dependent care services necessary for gainful employment (known as the Child and Dependent Care Tax Credit) to (1) make the credit refundable, (2) increase the rate for the credit, and (3) require the dollar amounts for such credit to be adjusted for inflation after 2019. The bill also increases the amount of employer-provided dependent care assistance which may be excluded from the gross income of an employee and requires the increased exclusion amount to be adjusted for inflation after 2020.

Native American Voting Rights Act of 2019 This bill modifies the voting rights of Native American and Alaska Native voters. Changes made by the bill include the following: expanding the types of facilities that can be used as voter registration agencies, increasing polling site accessibility, providing enforcement power to citizens and attorneys general, requiring approval for actions like moving a polling place, validating certain tribal identification for voting or registering, and expanding requirements for bilingual voting accessibility. The bill also establishes a Native American voting task force grant program for the purpose of increasing voter outreach, education, registration, turnout, and accessibility for Native American communities.

Building Blocks of STEM Act This bill modifies National Science Foundation (NSF) grant programs that support STEM (science, technology, engineering, and mathematics, including computer science) education. The bill instructs the NSF, when awarding grants under the Discovery Research PreK-12 program, to improve the focus of research and development on early childhood education. The bill specifies that NSF grants to increase the participation of underrepresented populations in STEM fields may be used for research into various subjects regarding female students in prekindergarten through elementary school, including the role of teachers and caregivers in encouraging or discouraging participation by such students in STEM activities, and the types of STEM activities that encourage greater participation by such students. The bill specifies that NSF grants to research computer science education and computational thinking may be used to support development and implementation of various tools and models for teaching and learning, including developing and offering gender-inclusive computer science enrichment programs, and acquainting female students in prekindergarten through elementary school with careers in computer science.

Personal Care Products Safety Act This bill authorizes the Food and Drug Administration (FDA) to take various actions with respect to the regulation of cosmetics, such as collecting fees from manufacturers and distributors to fund cosmetics safety activities. The bill also authorizes the FDA to suspend the distribution of products that have a reasonable probability of causing serious adverse health consequences.

Jobs, Not Waste Act of 2019 This bill prohibits the Department of Energy from licensing, planning, developing, or constructing a nuclear waste repository at Yucca Mountain in Nevada until the Office of Management and Budget conducts a study on the economic viability of alternative uses of the site and Congress holds a hearing on the findings. (A nuclear waste repository is a site used for storing high-level radioactive waste and spent nuclear fuel.)

Reproductive Rights are Human Rights Act of 2019 This bill directs the Department of State to include in its annual reports on human rights in countries receiving U.S. development and security assistance a discussion of the status of reproductive rights in each country, including whether a country has adopted and enforced policies to (1) promote access to contraception and accurate family planning information, (2) provide services to ensure safe and healthy pregnancy and childbirth, (3) expand or restrict access to safe abortion services, (4) prevent maternal deaths, and (5) prevent and treat sexually transmitted diseases. For each country, the reports shall also contain (1) data related to maternal deaths, and (2) a description of the nature and extent of discrimination and violence against women and girls in health care settings and the relevant government's response to such actions.

Report and Educate About Campus Hazing Act or the REACH Act This bill requires each institution of higher education (IHE) to (1) provide a comprehensive program to prevent hazing, and (2) report hazing incidents. Hazing means an intentional, knowing, or reckless act committed by a student, or a former student, of an IHE against another student (regardless of that student's willingness to participate), that (1) is connected with an initiation into, an affiliation with, or the maintenance of membership in, an organization that is affiliated with the IHE (e.g., athletic teams); and (2) contributes to a substantial risk of physical injury, mental harm, or degradation or causes physical injury, mental harm or personal degradation. An IHE must disclose hazing incidents that were reported to campus officials in its annual security report.

National Nurse Act of 2019 This bill requires the Department of Health and Human Services to designate the Chief Nurse Officer of the Public Health Service as the National Nurse for Public Health. The position includes the authority to (1) provide leadership and coordination of Public Health Service nursing professional affairs for the Office of the Surgeon General and other agencies of the Public Health Service, (2) conduct outreach and education, and (3) provide guidance and leadership for activities that will increase public safety and emergency preparedness. The National Nurse for Public Health must (1) participate in identification of national health priorities, (2) encourage volunteerism of nurses and strengthen the relationship between government agencies and health-related national organizations, and (3) promote the dissemination of evidence-based practice in educating the public on health promotion and disease prevention activities.

Middle Class Health Benefits Tax Repeal Act of 201 9 This bill repeals the excise tax on employer-sponsored health care coverage for which there is an excess benefit (high-cost plans). The repeal applies to taxable years beginning after December 31, 2019.

Save the Internet Act of 2019 This bill updates the regulatory framework for broadband access. Specifically, the bill repeals a 2017 order adopted by the Federal Communications Commission (FCC) that classifies broadband internet access service as an information service, therefore placing it under Federal Trade Commission authority. The order also expands the public transparency rules and preempts local and state laws that conflict with the regulatory framework. The bill restores a 2015 FCC order, which classifies both mobile and fixed broadband internet access services as telecommunications services, therefore placing the services under FCC authority. Additionally, the bill would create a general conduct standard and restore regulations, including those that prohibit blocking, throttling, and paid prioritization.

Removing Barriers to Colorectal Cancer Screening Act of 2019 This bill waives Medicare coinsurance requirements with respect to colorectal cancer screening tests, regardless of the code billed for a resulting diagnosis or procedure.

Immigration Court Improvement Act of 2019 This bill revises the definition of "immigration judge" by establishing that an immigration judge is judicial by nature, and actions taken while serving in a judicial capacity shall be reviewed under the applicable Code of Judicial Conduct, not any code of attorney behavior. It also establishes that an immigration judge may not be disciplined for good faith legal actions made while hearing and deciding cases. Completion goal systems or efficiency standards imposed on immigration judges may not be used to limit such judges' independent authority or as a reflection of individual judicial performance. The Department of Justice shall (1) establish a transparent judicial complaint process consistent with various professional guidelines, and (2) promulgate regulations governing an immigration judge's contempt authority.

Fair Day in Court for Kids Act of 2019 This bill authorizes the Department of Justice (DOJ) to appoint or provide counsel, at the government's expense, to aliens in removal proceedings and related appeals. An unaccompanied alien child shall be represented by counsel paid for and appointed by the government at every stage of such proceedings. The Department of Homeland Security (DHS) shall provide a complete copy of an alien's immigration file to the alien (or the alien's counsel) within seven days of a notice to appear for an immigration proceeding, and failure to provide the file shall result in a delay in the proceeding. DHS shall provide access to counsel for all detained aliens. The bill authorizes the DOJ to enter into contacts or award grants for providing immigration-related legal services to children. The Executive Office for Immigration Review shall develop model guidelines for representing alien children in immigration proceedings.

Child Trafficking Victims Protection and Welfare Act of 2019 This bill directs the Department of Homeland Security (DHS), in consultation with experts in child development and welfare and pediatric medicine, to develop guidelines for the treatment of children (under age 18 with no permanent immigration status) in the custody of the U.S. Customs and Border Protection (CBP). DHS must provide resources and trained staff to address the needs of such children, including child welfare professionals, at each port of entry and Border Patrol station. The bill imposes various duties on such child welfare professionals, including the duty to report allegations of abuse and ensure DHS compliance with abuse reporting laws. DHS may not remove a child from a parent or legal guardian solely for the purpose of deterring individuals from migrating to the United States or for promoting compliance with the immigration laws. DHS must (1) assign a family unit tracking number to each family member apprehended at the border, (2) allow humanitarian organizations and state and local child welfare agencies to monitor children in detention and conduct unannounced inspections, (3) promulgate regulations establishing basic standards of care for the short-term custody of children by CBP, (4) ensure that children apprehended by CBP receive an interview and screening with a child welfare professional and are provided information about their rights under the immigration laws, and (5) provide each apprehended parent or legal guardian and each child with access to legal counsel.

ABLE Age Adjustment Act This bill increases from 26 to 46 the age threshold for tax-favored ABLE (Achieving a Better Life Experience) accounts. (ABLE accounts are designed to enable individuals with disabilities to save for and pay for disability-related expenses. To establish an account, an individual must have a qualifying impairment that began before the individual attained the age threshold.)

Nuclear Waste Informed Consent Act This bill prohibits the Department of Energy (DOE) from using the Nuclear Waste Fund for certain expenditures involving repositories for disposing of spent nuclear fuel or high-level radioactive waste. Specifically, DOE may not use the fund to pay for disposal in a repository or planning, construction, or operation of a repository unless DOE has entered into an agreement with the state in which the repository is located and with affected local governments and Indian tribes.

"Six Triple Eight" Congressional Gold Medal Act of 2019 This bill directs the Speaker of the House of Representatives and the President pro tempore of the Senate to arrange for the award of a Congressional Gold Medal in honor of the women of the 6888th Central Postal Directory Battalion (commonly known as the "Six Triple Eight") in recognition of their pioneering military service, devotion to duty, and contributions to increase the morale of personnel stationed in the European theater of operations during World War II. The medal shall be given to the Smithsonian Institution and made available for display and research.

PFAS Action Act of 2019 This bill requires the Environmental Protection Agency to designate all perfluoroalkyl and polyfluoroalkyl substances as hazardous substances within one year of enactment of this bill.

Washington, D.C. Admission Act This bill provides for admission into the United States of the state of Washington, Douglass Commonwealth, composed of most of the territory of the District of Columbia. The commonwealth shall be admitted to the Union on an equal footing with the other states. The Mayor of the District of Columbia shall issue a proclamation for the first elections to Congress of two Senators and one Representative of the commonwealth. The bill applies current District laws to the commonwealth and continues pending judicial proceedings. The commonwealth (1) shall consist of all District territory, with specified exclusions for federal buildings and monuments, including the principal federal monuments, the White House, the Capitol Building, the U.S. Supreme Court Building, and the federal executive, legislative, and judicial office buildings located adjacent to the Mall and the Capitol Building; and (2) may not impose taxes on federal property except as Congress permits. The bill maintains (1) the District as the seat of the federal government, and (2) the federal government's authority over military lands and specified other property. The bill provides for expedited consideration of a joint resolution repealing the 23rd Amendment to the Constitution, which provides for the appointment of electors of the President and Vice President.

Military Widow's Tax Elimination Act of 2019 This bill modifies the Department of Defense's Survivor Benefit Plan and how it operates in relation to other benefits. The plan currently provides a monthly annuity (based on a percentage of a service member's retirement pay) to an eligible beneficiary upon the death of the service member. Currently, if a surviving spouse is also entitled to dependency and indemnity compensation, the annuity paid under the plan will be reduced. The bill repeals certain provisions that require the offset of the plan annuity from amounts paid in dependency and indemnity compensation. Under current law, upon the request of the surviving spouse, the military branch concerned is authorized to pay an annuity to the service member's dependent children instead of to the surviving spouse. The bill restores the annuity to an eligible spouse who previously elected to transfer payment to a dependent child.

Forced Arbitration Injustice Repeal Act This bill prohibits a predispute arbitration agreement from being valid or enforceable if it requires arbitration of an employment, consumer, antitrust, or civil rights dispute.

Mobile Workforce State Income Tax Simplification Act of 201 9 This bill prohibits the wages or other remuneration earned by an employee who performs employment duties in more than one state from being subject to income tax in any state other than (1) the state of the employee's residence, and (2) the state within which the employee is present and performing employment duties for more than 30 days during the calendar year. The bill exempts employers from state income tax withholding and information reporting requirements for employees not subject to income tax in the state under this bill. For the purposes of determining penalties related to an employer's state income tax withholding or reporting requirements, an employer may rely on an employee's annual determination of the time expected to be spent working in a state in the absence of fraud or collusion by such employee. For the purposes of this bill, the term "employee" excludes professional athletes; professional entertainers; production employees who perform services in connection with certain film, television, or other commercial video productions; and public figures who are persons of prominence who perform services for wages or other remuneration on a per-event basis.

Burial Rights for America’s Veterans’ Efforts Act of 2019 or the BRAVE Act of 2019 This bill increases the amounts payable through the Department of Veterans Affairs (VA) for (1) burial and funeral expenses of veterans, and (2) such expenses in connection with a veteran's death due to a service-connected disability. The VA shall also increase such amounts each fiscal year to account for inflation.

Do No Harm Act This bill prohibits the application of the Religious Freedom Restoration Act of 1993 (RFRA) to specified federal laws or the implementation of such laws. Currently, RFRA prohibits the government from substantially burdening a person's exercise of religion even if the burden results from a rule of general applicability, except in furtherance of a compelling governmental interest when using the least restrictive means. Under the bill, RFRA is inapplicable to laws or the implementation of laws that protect against discrimination or the promotion of equal opportunity (e.g., the Civil Rights Act of 1964); require employers to provide wages, other compensation, or benefits, including leave; protect collective activity in the workplace; protect against child labor, abuse, or exploitation; or provide for access to, information about, referrals for, provision of, or coverage for, any health care item or service. The bill prevents RFRA from being used to deny (1) goods or services the government has contracted, granted, or made an agreement to provide to a beneficiary; or (2) a person's full and equal enjoyment of a government-provided good, service, benefit, facility, privilege, advantage, or accommodation. In order for a person to assert a RFRA claim or defense in a judicial proceeding, the government must be a party to the proceeding.

ALS Disability Insurance Access Act of 2019 This bill eliminates the five-month waiting period for disability benefits under the Old Age, Survivors, and Disability Insurance program for individuals with amyotrophic lateral sclerosis (a progressive neurodegenerative disease, also known as Lou Gehrig's disease, that affects nerve cells in the brain and spinal cord). Under current law, individuals must wait five months after becoming disabled before their disability insurance benefit payments may begin.

Hidden Figures Congressional Gold Medal Act This bill requires the Speaker of the House of Representatives and President pro tempore of the Senate to arrange for the presentation of one Congressional Gold Medal to Katherine Johnson, in recognition of her service to the United States as a mathematician; one Congressional Gold Medal to Dr. Christine Darden, for her service to the United States as an aeronautical engineer; two Congressional Gold Medals in commemoration of the lives of Dorothy Vaughan and Mary Jackson, in recognition of their service to the United States during the Space Race; and one gold medal in recognition of all the women who served as computers, mathematicians, and engineers at the National Advisory Committee for Aeronautics and the National Aeronautics and Space Administration (NASA) between the 1930s and the 1970s.

Prevent Government Shutdowns Act of 2019 This bill provides continuing appropriations to prevent a government shutdown if any of the appropriations bills for a fiscal year have not been enacted before the fiscal year begins and continuing appropriations are not in effect. The bill also limits official travel, congressional recesses or adjournments, and the consideration of legislation that is unrelated to appropriations after the beginning of a fiscal year if all of the regular appropriations bills for the year have not been enacted.

Fairness for Korean DMZ Veterans Act of 2019 This bill extends the presumption of service-connection for certain diseases associated with herbicide (e.g., Agent Orange) exposure to veterans who served in or near the Korean Demilitarized Zone between September 1, 1967, and August 31, 1971. Under a presumption of service-connection, specific disabilities or diseases diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded.

Child Care for Working Families Act This bill provides funds and otherwise revises certain child care and early learning programs for low- to moderate-income families. Specifically, the bill provides funds for the Child Care and Development Block Grant program and reestablishes it as a child care and development assistance program. It also allocates program funds for states to provide services and supports to infants, toddlers, and children with disabilities. Further, it revises the program to require each state to, among other things create a tiered and transparent system for measuring the quality of child care providers, which must include evidence-based standards and payment rates that are based on a certain cost estimation model; assure that copayments are based on a sliding scale and that no family receiving assistance pays more than 7% of their household income on child care; and use quality child care amounts for certain activities, such as improving the supply of child care providers who provide care to infants, toddlers, and children with disabilities (e.g., professional development). It also provides funds and establishes grants for states to create preschool programs for low- to moderate-income children between the ages of three and five years. Finally, the Department of Health and Human Services must make grants to Head Start agencies to (1) provide children with access to full-school-year and full-school-day services, (2) provide access to additional service hours for migrant and seasonal agencies, or (3) enhance the quality of existing services.

Breast Cancer Patient Equity Act This bill provides for Medicare coverage of custom fabricated breast prostheses following the surgical removal of the breast (i.e., a mastectomy), including replacements of such prostheses. Currently, Medicare covers surgically implanted breast prostheses, as well as some external breast prostheses (e.g., post-surgical bras).

Voting Rights Advancement Act of 2019 This bill establishes new criteria for determining which states and political subdivisions must obtain preclearance before changes to voting practices may take effect. (Preclearance is the process of receiving federal preapproval before making legal changes that would affect voting rights.) In addition, the bill expands voting access on tribal lands.

Ensuring Lasting Smiles Act This bill requires private health insurance plans to cover diagnosis and treatment services for congenital anomalies and birth defects, such as reconstructive services and prosthetics. Coverage must include services that functionally improve, repair, or restore any body part that is medically necessary for normal bodily functions or appearance, as determined by the treating physician.

Never Forget the Heroes: Permanent Authorization of the September 11th Victim Compensation Fund Act This bill funds through FY2090 the September 11th Victim Compensation Fund of 2001. Additionally, the bill modifies the Victim Compensation Fund (VCF): to allow claims to be filed until October 2089, to require VCF policies and procedures to be reassessed at least once every five years (currently, at least once annually), to require claimants to be paid for the amount by which a claim was reduced on the basis of insufficient funding, to remove the cap on noneconomic damages in certain circumstances, and to adjust the annual limit on economic loss compensation for inflation.

Hire Student Veterans Act This bill allows a work opportunity tax credit for hiring a veteran attending an educational institution using educational assistance provided under certain programs administered by the Department of Defense or the Department of Veterans Affairs. It also modifies the minimum employment period required for veterans who qualify for the credit under this bill.

Restore Our Parks Act This bill (1) establishes the National Park Service Legacy Restoration Fund, and (2) requires 50% of all energy development revenues for FY2019-FY2023 to be deposited into such fund. Amounts deposited in the fund must not exceed $1.3 billion for any fiscal year and must be used for meeting the priority deferred maintenance needs of the National Park Service.

Let Everyone Get Involved in Opportunities for National Service Act or the LEGION Act This bill authorizes The American Legion to expand membership eligibility to include veterans and servicemembers who served during times that were not designated periods of war. Currently, only veterans and servicemembers who served during periods of time specified by Congress are eligible to join The American Legion.

Social Security Fairness Act This bill repeals provisions that reduce Social Security benefits for individuals who receive other benefits, such as a pension from a state or local government job. The bill eliminates the government pension offset , which in various instances reduces Social Security survivors' benefits for spouses, widows, and widowers who also receives government pensions of their own. The bill also eliminates the windfall elimination provision , which in some instances reduces Social Security benefits for individuals who also receive a pension or disability benefit from an employer that did not withhold Social Security taxes.

Lymphedema Treatment Act This bill includes certain lymphedema compression treatment items as covered durable medical equipment under Medicare. (Lymphedema is a condition of localized fluid retention and tissue swelling that is caused when the lymphatic system is damaged or blocked.)

Living Donor Protection Act of 2019 This bill prohibits discrimination based on an individual's status as a living organ donor in the offering, issuance, cancellation, coverage, price, or any other condition of a life-insurance policy, disability-insurance policy, or long-term-care insurance policy. The bill also specifically includes recovery from organ-donation surgery as a serious health condition that entitles covered private-sector and federal civil-service employees to medical leave. The Department of Health and Human Services must update public-service announcements, websites, and other media regarding live organ donation to educate the public on the benefits of live organ donation and on access to insurance for living organ donors.

Korematsu-Takai Civil Liberties Protection Act of 2019 This bill modifies the detention authority of the United States. Specifically, it prohibits detention or imprisonment based solely on an actual or perceived protected characteristic of an individual. A protected characteristic includes each of the following: race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, and any additional characteristic that the Department of Justice determines to be a protected characteristic.

State Public Option Act This bill allows residents who are not already eligible for Medicaid and not concurrently enrolled in other health insurance coverage to buy into a state Medicaid plan beginning January 1, 2020, at the option of the state. State Medicaid programs may set premiums and cost-sharing requirements for such coverage in accordance with specified limitations. The bill also (1) provides the enhanced Federal Medical Assistance Percentage (FMAP) to every state that expands Medicaid coverage for individuals who are newly eligible under the Patient Protection and Affordable Care Act, regardless of when such expansion takes place; and (2) requires state Medicaid programs to cover comprehensive reproductive health care services, including abortion services.
