Commends the people of Iraq on the January 2005 elections, and congratulates the new members of the Transitional National Assembly and the leaders of the provincial and regional governments. Urges the new leadership of Iraq to move forward with drafting the constitution, upholding the law, and holding a referendum on the new constitution. Honors the sacrifices made for freedom by the people of Iraq. Commends the Iraqi security forces and the U.S. Armed Forces and Coalition forces who ensured the elections could be conducted in a relatively safe and credible manner. Condemns all acts of violence and intimidation by members of the former Iraqi regime, insurgents, and other extremists and terrorists. Declares that it is in the interest of the people of Iraq, the Middle East, the United States, and the international community that Iraq transitions to a democratic state and serves as a catalyst for regional peace and stability. Calls on the international community, particularly Arab states, countries with predominantly Muslim populations, and all North Atlantic Treaty Organization (NATO) members, to provide military and police personnel to train Iraqi security forces and to otherwise assist in Iraq's political and economic development. Encourages the newly-elected transitional government of Iraq to ensure that all Iraqis, including members of the Sunni community, are represented in the Constitution-writing process and in the new Iraqi cabinet.

Declares that the Senate: (1) apologizes to the victims and survivors of lynching for its failure to enact anti-lynching legislation; (2) expresses its deepest sympathies and most solemn regrets to the descendants of such victims whose ancestors were deprived of life, human dignity, and the constitutional protections accorded all other U.S. citizens; and (3) remembers the history of lynching, to ensure that these personal tragedies will be neither forgotten nor repeated.

Secure Rural Schools and Community Self-Determination Reauthorization Act of 2005 - Amends the Secure Rural Schools and Community Self-Determination Act of 2000 to extend the Act through FY2013. Revises requirements regarding the merchantable material contracting pilot program. Requires counties participating in county projects to submit a specified notification for each project for which the participating county obligated county funds. Provides for the review of such notifications.

Essential Air Service Preservation Act of 2005 - Amends Federal transportation law to repeal the mandate for the Essential Air Service local participation program (a pilot program under which up to ten designated essential air service communities located near hub airports shall assume ten percent of their essential air service subsidy costs for a four-year period).

Broadcast Decency Enforcement Act of 2005 - Amends the Communications Act of 1934 to provide that, if the violator of the terms and conditions of any Federal Communications Commission (FCC) license, permit, or certificate is either a broadcast station licensee or permittee or an applicant for a broadcast license, permit, or certificate, and such violator is determined by the FCC to have broadcast obscene, indecent, or profane language, the amount of forfeiture penalty shall not exceed $325,000 for each violation or day of such violation, to a maximum of $3 million for any single act or failure to act.

Tariff Relief Assistance for Developing Economies Act of 2005 (TRADE Act of 2005) - Authorizes the President to designate Afghanistan, Bangladesh, Bhutan, Cambodia, Kiribati, Lao People's Democratic Republic, Maldives, Nepal, Samoa, Solomon Islands, Timor-Leste (East Timor), Tuvalu, Vanuatu, Yemen, and Sri Lanka or their successor political entities (TRADE Act of 2005 countries) as beneficiary TRADE Act of 2005 countries eligible to receive duty-free treatment for certain articles that are the growth, product, or manufacture of such countries, if after receiving the advice of the International Trade Commission (ITC) the President determines that such articles are not import-sensitive in the context of imports from such countries. Conditions such designation upon eligibility requirements of the African Growth and Opportunity Act (AGOA) and the Trade Act of 1974. Prescribes the rule of origin for the articles for the duty-free treatment. Applies duty-free treatment, without any quantitative limitations, granted to textile and apparel articles under AGOA to articles imported directly into the U.S. customs territory from a beneficiary TRADE Act of 2005 country if their assembly meets specified U.S. origin requirements. Grants AGOA preferential treatment for apparel articles assembled in one or more beneficiary TRADE Act of 2005 countries or such former countries, or both, from regional fabric from yarn originating either in the United States or one or more of such countries. Establishes: (1) limitations on such preferential treatment; and (2) special rules for apparel articles wholly assembled in one or more beneficiary TRADE Act of 2005 countries or former beneficiary countries, or both, regardless of the country of origin of the yarn or fabric used to make such articles; and (3) applicable percentages of such benefits.

Family Opportunity Act of 2005 or Dylan Lee James Act - Amends title XIX (Medicaid) of the Social Security Act (SSA) to give States the option of allowing families of disabled children to purchase Medicaid coverage for such children. Authorizes the Secretary of Health and Human Services to conduct demonstration projects under which up to ten States are awarded grants, on a competitive basis, to test the effectiveness in improving or maintaining a child's functional level and cost-effectiveness of providing coverage of home and community-based alternatives to psychiatric resident treatment for children enrolled in the Medicaid program. Amends SSA title V (Maternal and Child Health Services) to make appropriations to the Secretary for special projects of regional and national significance for development and support of family-to-family health information centers. Amends SSA title XIX to provide for the restoration of Medicaid eligibility to certain SSI (Supplemental Security Income) (SSA title XVI) beneficiaries under age 21.

Gang Prevention and Effective Deterrence Act of 2005 - Amends the Federal criminal code to prohibit various criminal street gang-related offenses, including participating in a criminal street gang by committing a predicate crime in furtherance of the activities of such gang, to gain entrance to or to maintain or increase position in the gang, or for the gang's benefit. Amends: (1) the Controlled Substances Act to prohibit murder and other violent crimes committed during and in relation to a drug trafficking crime; and (2) the Violent Crime Control and Law Enforcement Act of 1994 to authorize the use of grants by the Attorney General to fund technology and training for prosecutors and to create and expand witness and victim protection programs. Authorizes the Attorney General to: (1) designate high intensity interstate gang activity areas; and (2) expand the Project Safe Neighborhoods program. Prohibits traveling in, or causing another to travel in, interstate or foreign commerce with intent that one or more murders be committed in violation of State or Federal law. Expands the scope of predicate crimes for authorization of interception of wire, oral, and electronic communications to cover violations relating to criminal street gangs. Modifies code provisions regarding the treatment of Federal juvenile offenders. Amends the Federal judicial code to direct the U.S. Sentencing Commission to promulgate and distribute guidelines for use by a court in determining the sentence to be imposed in a criminal case if the defendant committed the offense as a juvenile, and is tried as an adult.

Veterans Benefits Outreach Act of 2005 - Requires the Secretary of Veterans Affairs to prepare an annual plan for outreach activities of the Department of Veterans Affairs that addresses plans for: (1) identifying veterans who are not enrolled or registered for benefits or services with the Department; and (2) informing veterans and their dependents of modifications to benefits and services, including eligibility for medical and nursing care and services. Directs the Secretary, in developing such plan, to incorporate recommendations for the improvement of veterans outreach and awareness activities included in a report submitted to Congress by the Secretary pursuant to the Veterans Benefits Improvement Act of 2004.

Class Action Fairness Act of 2005 - Amends the Federal judicial code to specify the calculation of contingent and other attorney's fees in proposed class action settlements that provide for the award of coupons to class members. Prohibits a Federal district court from approving: (1) a proposed coupon settlement absent a finding that the settlement is fair, reasonable, and adequate; (2) a proposed settlement involving payments to class counsel that would result in a net monetary loss to class members, absent a finding that the loss is substantially outweighed by nonmonetary benefits; or (3) a proposed settlement that provides greater sums to some class members solely because they are closer geographically to the court. Specifies requirements for notices of proposed settlements. Grants district courts original jurisdiction of any civil action in which the matter in controversy exceeds $5 million, exclusive of interest and costs, and is between citizens of different States, or citizens of a State and a foreign State or its citizens or subjects. Lists those factors pursuant to which a district court may decline to exercise jurisdiction over a class action, and specifies those circumstances in which a district court must decline jurisdiction. Sets forth provisions governing the removal of interstate class actions to Federal district court and the review on appeal of remand orders. Directs the Judicial Conference of the United States to report on class action settlements, incorporating recommendations for best court practices to ensure fairness for class members and appropriate fees for counsel.

Constitutional Amendment - Marriage Protection Amendment - Declares that: (1) marriage in the United States shall consist only of the union of a man and a woman; and (2) neither the U.S. Constitution nor the constitution of any state shall be construed to require that marriage or the legal incidents of marriage be conferred upon any other union.

Amends Federal aviation law to prohibit the Administrator of the Federal Aviation Administration, solely by reason of a person's age if the person has not attained his or her Social Security retirement age, from: (1) denying, deferring as to, or failing to renew for any such person an airman or medical certificate for the operation of a commercial aircraft; (2) imposing restrictions or limitations on an airman or medical certificate following initial or periodic competency or medical testing which has the same age discriminatory effect on the person; or (3) requiring an air carrier to terminate the employment of, or not to employ, or to take any other action having the same age discriminatory effect on, such person as a pilot of an aircraft. Declares that such requirements shall not provide the basis for a claim of seniority made under any labor bargaining agreement in effect between the pilots and an air carrier by any pilot seeking re-employment by an air carrier following the pilot's previous termination or cessation of employment.

Unborn Child Pain Awareness Act of 2005 - Amends the Public Health Service Act to require an abortion provider, before beginning any abortion of a pain-capable unborn child (defined as an unborn child who has reached a probable stage of development of 20 weeks after fertilization), to: (1) make a specified statement to the pregnant woman that Congress has determined that there is substantial evidence that the process will cause the unborn child pain, and that the mother has the option of having pain-reducing drugs administered directly to the child; (2) provide to the woman an Unborn Child Pain Awareness Brochure (unless she waives receipt) and an Unborn Child Pain Awareness Decision Form; and (3) obtain on the form the woman's signature and her explicit request for or refusal of the administration of drugs to the child. Creates an exception for certified medical emergencies. Establishes penalties for willfully failing to comply with this Act, including civil penalties, medical license suspension, or both. Authorizes: (1) specified officials to bring suit in federal court; and (2) private rights of action by a parent or guardian of a woman who is an unemancipated minor. Requires each state and state medical licensing authority to promulgate procedures for the revocation or suspension of a provider's license upon a court finding that the provider has violated this Act. Subjects a state that fails to implement such procedures to loss of Medicaid funding.

Directs the Secretary of Defense to permit any former member of the armed forces who is entitled to compensation for a service-connected disability rated total by the Secretary of Veterans Affairs to travel on military aircraft to the same extent as retired members of the armed forces.

Child Custody Protection Act - Amends the federal criminal code to prohibit transporting a minor across a state line to obtain an abortion (deems such transporting to be a de facto abridgment of the right of a parent under any law in the minor’s state of residence that requires parental involvement in the minor’s abortion decision). Makes an exception for an abortion necessary to save the life of the minor. Protects from prosecution or civil liability the minor or the minor’s parents for violations of this Act. Makes it an affirmative defense to a prosecution or civil action under this Act that a defendant reasonably believed that before the minor obtained the abortion, the required parental consent or notification or judicial authorization took place. Authorizes any parent who suffers harm from a violation of this Act to seek relief in a civil action. Defines "parent" to include a guardian, legal custodian, or person standing in loco parentis.

Protecting America in the War on Terror Act of 2005 - Biopreparedness Act of 2005 - Sets forth provisions concerning bioterrorism preparedness and defense, including provisions: (1) extending the patent terms for certain countermeasure products; (2) exempting meetings between the Secretary of Health and Human Services and parties developing priority countermeasures from antitrust laws; (3) establishing the Commission on Countermeasure and Vaccine Regulation; (4) prohibiting a State from establishing requirements different from certain Federal food and drug laws; (5) allowing tax credits for vaccine and countermeasures manufacturing and research; and (6) requiring procedures for inspecting imported live animals. Increases the death gratuity payable to survivors upon the combat-related death of a member of the Armed Forces. Increases the maximum life insurance payable for a member of the uniformed service or a veteran. Homeland Security Technology Improvement Act of 2005 - Amends the Homeland Security Act of 2002 to provide for the transfer of certain counterterrorism technologies, equipment, and information to State and local law enforcement agencies. Sets forth provisions regarding information sharing among Federal agencies and between Federal agencies and State and local governments. Prohibits certain acts relating to national and maritime security, including: (1) acts of destruction on passenger vessels; (2) resisting the boarding of vessels authorized by Federal law; (3) placing a device or substance that is likely to destroy or damage a vessel or its cargo; (4) discharging or releasing any dangerous substance with the intent to endanger human life, health, or welfare; (5) knowingly and willfully transporting an explosive device, biological agent, chemical weapon, radioactive or nuclear material, or terrorist aboard a vessel; and (6) offering or receiving anything of value to commit or aid terrorism or fraud affecting any secure or restricted area or seaport.

Marriage, Opportunity, Relief, and Empowerment Act of 2005 or the MORE Act - Makes permanent specified provisions of the Economic Growth and Tax Relief Reconciliation Act of 2001 relating to tax benefits for children and marriage penalty relief. Personal Responsibility and Individual Development for Everyone Act or the PRIDE Act - Amends the Social Security Act to: (1) revise the program of grants to States for temporary aid to needy families (TANF) to, among other things, extend the authority for family assistance grants, promote family employment and self-sufficiency programs, and establish a responsible fatherhood program; (2) extend the authority for the sexual abstinence education program; (3) revise child support enforcement requirements; (4) extend the authority for approving certain child welfare demonstration projects; and (5) extend the Transitional Medical Assistance Program (TMA). CARE Act of 2005 - Amends the Internal Revenue Code provisions relating to charitable giving, including to: (1) allow nonitemizing taxpayers to claim a tax deduction for charitable contributions; (2) permit tax-free distributions from individual retirement accounts (IRAs) for charitable purposes; and (3) allow individual taxpayers to claim a tax deduction for contributions of food and book inventories. Revises various disclosure and oversight requirements relating to tax-exempt organizations. Restores and increases funding for the Social Services Block Grant Program. Savings for Working Families Act of 2005 - Allows certain low income individuals to establish individual development accounts for accumulating assets for homeownership, education, business startup and other purposes. Allows an investment tax credit for contributions to an individual development account. Authorizes the Secretary of Health and Human Services, the Corporation for National and Community Service, the Attorney General, and the Secretary of Housing and Urban Development to award grants to and enter into cooperative agreements with nongovernmental organizations to assist nonprofit community-based organizations in delivering social services. Requires the Secretary of Health and Human Services to contract for an evaluation of maternity group homes under the Runaway and Homeless Youth Act.

Jobs and Growth Tax Relief Act of 2005 - Makes permanent: (1) reductions in individual income tax rates enacted by the Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA); (2) reductions in individual capital gains and dividends tax rates enacted by the Jobs and Growth Tax Relief Reconciliation Act of 2003; and (3) the repeal of the estate and generation-skipping transfer taxes and reductions of the gift tax enacted by EGTRAA.

Expresses: (1) sympathy for the victims and families of the earthquake and tsunami that struck communities throughout Southeast Asia, South Asia, and Eastern Africa on December 26, 2004; and (2) gratitude and respect for the work of all aid and relief personnel, including U.S. military personnel. Supports President George W. Bush's pledge of $350,000,000 in direct financial assistance, and additional indirect assistance, through the dispatch of U.S. military assets and personnel and through substantial voluntary and annual contributions to international organizations and bodies. Commends the ongoing international relief effort. Recognizes that U.S. Government assistance will be greatly supplemented by private U.S. donations and volunteers. Supports the long-term U.S. commitment to provide financial aid and other assistance to the impacted region.

Winters and the men of "Easy Company" for their actions to ensure control over Utah Beach at Normandy, France, during World War II, and commends the heroism and bravery shown by Lieutenant Winters. Acknowledges the historical achievements of Lieutenant Winters and his men in assuring the success of the Allied Normandy Campaign begun on June 6, 1944 (D-Day). Disabled Veterans Transition Assistance Act of 2004 - Requires the Secretary of Defense to carry out a program to provide a support system for members of the Armed Forces who incur severe disabilities on or after September 11, 2001, including a system of advocacy and follow-up to assist those members to transition from military service to the civilian community. Requires the Secretary to designate an executive agent to carry out the program throughout the Department of Defense and, in cooperation with the Secretary of Homeland Security, for members of the Coast Guard with severe disabilities.

Clinical Research Act of 2004 - Requires the Director of the National Institutes of Health to award clinical research support grants to eligible academic health centers to: (1) defray the costs of unfunded Federal requirements for the protection of human research costs; and (2) support activities leading to innovative ways to meets such requirements in an efficient and cost-effective manner. Requires that health centers receive a proportionate share of the total grant money awarded based on the amount invested by the grantee in clinical research compared to the total clinical research investment of all grantees. Allows the Director to award clinical research infrastructure grants to eligible academic health centers for: (1) necessary infrastructure to facilitate the transfer of new understandings of disease mechanisms gained in the laboratory into the development of new methodologies for diagnosis, therapy, and prevention; (2) the initial testing of human subjects; and (3) addressing obstacles impeding the expeditious application of new science, including a lack of up-to-date information technology systems and a shortage of willing participants. Allows the Secretary of Health and Human Services to make up to five grants to eligible academic health centers to form partnerships between the centers involved and health care providers for carrying out clinical human subject research to demonstrate how academic research centers may collaborate with the practicing health care community in such research.

Small Business Tax Equalization and Compliance Act of 2004 - Amends the Internal Revenue Code to extend the tax credit for social security taxes paid for employee cash tips to employers of cosmetologists. Requires employers of cosmetologists to report income and tips of their cosmetologist employees and to provide income and tip information to self-employed cosmetologists to whom they pay more than $600 in the taxable year. Imposes similar reporting requirements upon individuals who rent chairs to cosmetologists. Requires such employers to provide their cosmetologist employees and self-employed cosmetologists with information on the tax and tip reporting obligations of employees and self-employed individuals.

Delaware Water Gap National Recreation Area Natural Gas Pipeline Enlargement Act - Authorizes the Secretary of the Interior to grant the Columbia Gas Transmission Corporation an easement to enlarge the diameter of a specified pipeline from 14 inches to not more than 20 inches, consistent with the recreational values and protection of the resources of the Delaware Water Gap National Recreation Area in Pennsylvania. Authorizes the Superintendent of the Recreation Area to issue a permit to the Corporation for the use of the Recreation Area for temporary construction and staging areas required for the construction of the enlarged pipeline. Requires the Corporation to comply with all requirements for certification by the Federal Energy Regulatory Commission that are necessary to permit the increase in pipeline size. Prohibits the Secretary from granting additional increases in the diameter of, or easements for, the pipeline within the boundary of the Recreation Area after the date of enactment of this Act.

Special Olympics Sport and Empowerment Act of 2004 - Authorizes the Secretaries of Education, of State, and of Health and Human Services to award grants to, or enter into contracts or cooperative agreements with, Special Olympics for specified education, international, and health activities, including ones promoting Special Olympics and a greater understanding of contributions to society by individuals with intellectual disabilities both within and outside of the United States.

Healthy Marriages and Responsible Fatherhood Act of 2004 - Amends part A (Temporary Assistance for Needy Families) (TANF) of title IV of the Social Security Act to revise the TANF program. Repeals the bonus to States for reduction in illegitmacy ratio, replacing it with healthy marriage promotion grants. Amends SSA title IV to add a new part C (Responible Fatherhood Program) under which the Secretary of Health and Human Services shall award grants to States to conduct demonstration programs promoting responsible fatherhood. Provides for: (1) a National Clearinghouse for responsible fatherhood programs to assist States and communities in efforts to promote and support marriage and responsible fatherhood; and (2) block grants to States to encourage media campaigns to produce broadcast advertisements that promote the formation and maintance of healthy two-parent married families, strengthen fragile families, and promote responsible fatherhood. Adds funding under TANF for research, demonstrations, and technical assistance. Rescinds funds for bonuses to reward high performance States. Provides for extending: (1) the TANF program through March 15, 2005; and (2) the National Random Sample study through March 31, 2005.

Good Samaritan Volunteer Firefighter Assistance Act of 2004 - Provides that a person (including any governmental or other entity) who donates fire control or fire rescue equipment to a volunteer fire company shall not be liable for personal injuries, property damage or loss, or death proximately caused by the equipment after the donation. Waives such liability protection if: (1) the person's act or omission proximately causing the injury, damage, loss, or death constitutes gross negligence or intentional misconduct; or (2) the person is the manufacturer of such equipment. Preempts State laws to the extent they are inconsistent with this Act, with the exception of those that provide additional protection from liability.

Second Chance Act of 2004: Community Safety Through Recidivism Prevention or Second Chance Act of 2004 - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to reauthorize, rewrite, and expand provisions regarding adult and juvenile offender reentry demonstration projects, including by authorizing funds to: (1) provide structured post-release housing and transitional housing; (2) facilitate specified collaboration to promote the employment of people released from prison; and (3) establish or expand the use of reentry courts. Sets forth grant priorities and requirements, including that each State or local government recipient establish a Reentry Task Force or other relevant convening authority. Authorizes the Attorney General to make a grant to provide for the establishment of a National Adult and Juvenile Offender Reentry Resource Center. Directs the Attorney General to establish an interagency task force on Federal programs and activities relating to offender reentry. Authorizes the National Institute of Justice and the Bureau of Justice Statistics to conduct research on offender reentry. Directs: (1) the Secretary of Health and Human Services to review the role of State child protective services at the time of arrest and to establish services for the preservation of families impacted by the incarceration of a family member; and (2) the Secretary of Labor to implement a program to educate employers about existing incentives to the hiring of former prisoners and to make grants to community-based organizations to provide mentoring and other transitional services essential to reintegrating ex-offenders and incarcerated persons into society.

Condemns the terrorist attack on September 1, 2004, at School No. 1, located in Beslan, North Ossetia, Russian Federation. Expresses condolences to the Russian people and in particular to those families who lost loved ones in the Beslan school tragedy. Commends the efforts of the Federal Government to provide humanitarian and medical assistance to the people of the Russian Federation.

Declares that the steel import licensing and monitoring program established by the Secretaries of the Treasury and of Commerce shall remain in effect and be established by the Secretary of Commerce as a permanent program. Requires the Secretaries to expand the program to include specified iron and steel, and articles of iron and steel. Requires release of the import and licensing data made available to the public as part of this program, based upon classifications at the tenth digit level of the Harmonized Schedule of the United States. Grants the Secretaries authority to maintain the program and to expand it as necessary and appropriate in accordance with this Act.

America Saving for Personal Investment, Retirement, and Education Act of 2004, or the ASPIRE Act of 2004 - Establishes a KIDS Account Fund (KIDS) in the Treasury. Establishes within the KIDS Account Fund a Kids Investment and Development Savings Account (KIDS Account). Provides that a U.S. citizen born after December 31, 2005, and under 18 years of age, whose modified adjusted gross income is below the applicable national median adjusted gross income amount, is eligible to contribute to such account and to receive a matching Federal contribution. Establishes the KIDS Account Fund Board to establish a default investment program under which, in a manner similar to a lifecycle investment program, sums in each KIDS Account are allocated to investment funds in the KIDS Account Fund based on the amount of time before the account holder attains the age of 18. Subjects the Board to the same statutory composition requirements, duties, and responsibilities as the Federal Retirement Thrift Investment Board. Instructs the Secretary of the Treasury, in coordination with the Financial Literacy and Education Commission, to develop programs to promote the financial literacy of account holders of KIDS Accounts.

Christopher Kangas Fallen Firefighter Apprentice Act - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to expand the definition of "firefighter" for purposes of death benefit provisions to include fire department members regardless of age, status as an apprentice or trainee, or related duty restrictions. Makes this Act applicable to deaths and injuries which occur on or after May 4, 2002.
