Requires the National Aeronautics and Space Administration (NASA) to comply with the provision under the heading Exploration in the Science Appropriations Act, 2010 (title III of division B of the Consolidated Appropriations Act, 2010) relating to a prohibition on the use of funds for termination or elimination of any programs, projects, or activities of the architecture of NASA's Constellation Program. Bars use of the provisions of the Anti-Deficiency Act as a basis for terminating or eliminating any contracts, programs, projects, or activities of the Program. Requires the Comptroller General to submit a report on the Program to Congress. Requires such report to set forth a description and assessment of the contracts, programs, projects, and activities of the Program, if any, that are contrary to law or are experiencing waste, fraud, or abuse. Instructs the Administrator of NASA to ensure shuttle launch capability, including by not terminating any contractor support that will limit or impair the launching of, at a minimum, the payloads manifested for the shuttle.

Alabama Black Belt National Heritage Area Act - Establishes the Alabama Black Belt National Heritage Area in Alabama. (Describes the Black Belt area as a region in the lower-central portion of Alabama that sustains an abundance of natural resources, historical sites, cultural diversity, and recreational activities shaped by its fertile black soil.) Designates the Center for the Study of the Black Belt at the University of West Alabama as the local coordinating entity for the Heritage Area, requires the Center to submit a management plan for the Heritage Area, and sets forth procedures for the approval or disapproval of such plan.

Constitutional Amendment - Prohibits, except in time of a congressionally declared war, federal fiscal year expenditures from exceeding: (1) federal revenues for that fiscal year, except revenue received from the issuance of bonds, notes, or other obligations of the United States; and (2) 20% of the gross national product for the preceding calendar year. Authorizes suspension of these prohibitions by concurrent resolution approved by a three-fifths vote of each chamber.

Amends the Emergency Economic Stabilization Act of 2008 (EESA) to prohibit any entity in receipt of financial assistance under the Trouble Asset Relief Program (TARP) (or any other program enacted by the Secretary under EESA authorities) from providing any direct or indirect assistance to, funding, promoting, or in any way contributing to the activities of the Association of Community Organizations for Reform Now (ACORN) or an ACORN-related affiliate. Exempts from this prohibition any entity that has repaid all outstanding amounts of TARP or related financial assistance.

Protect Taxpayers From ACORN Act - Prohibits any federal contract, grant, cooperative agreement, or other form of agreement from being awarded to, any federal funds in any other form from being provided to, or any federal employee or contractor from promoting, the Association of Community Organizations for Reform Now (ACORN) and any ACORN-related affiliate. Requires the Federal Acquisition Regulatory Council to amend the Federal Acquisition Regulation to carry out provisions of this Act relating to contracts.

Defense Production Act Reauthorization of 2009 - Amends the Defense Production Act of 1950 (the Act) to reauthorize through FY2014 specified provisions of the Act. Amends the Act to: (1) require standards and procedures by which contracts and orders priorities allocations are used to promote the national defense under both emergency and nonemergency conditions; (2) remove a limitation on the authority of the President to engage in the production of energy other than synthetic fuel; and (3) repeal the requirement that the President identify critical components and technology items for each item on the Critical Items List. Authorizes the President to: (1) allow a guaranteeing agency to guarantee private loans in support of production capabilities or supplies determined necessary to create, maintain, expedite, expand, protect, or restore production and deliveries or services essential to the national defense; (2) provide for loans to private businesses for activities which reduce current or projected shortfalls of industrial resources, critical technology items, or materials essential for the national defense; and (3) take certain actions to create, maintain, protect, expand, or restore domestic industrial base capabilities necessary for the national defense. Establishes in the Treasury the Defense Production Act Fund to carry out such authorities. Extends from two to five years the maximum period of voluntary agreements and plans of action entered into by business and industry leaders to help provide for the defense of the United States through the development of preparedness programs and the expansion of productive capacity and supply beyond the levels needed to meet essential civilian demand. Establishes the Defense Production Act Committee to advise the President on the effective use of authority under the Act by the departments, agencies, and independent establishments of the federal government to which the President has delegated authority. Requires an annual report from the President to the congressional finance committees on the impact of offsets on U.S. defense preparedness, industrial competitiveness, employment, and trade.

Improving Access to Clinical Trials Act of 2009 - Amends title XVI (Supplemental Security Income) (SSI) of the Social Security Act (SSA) to exclude from income for SSI eligibility purposes any compensation in the amount of the first $2,000 per year received by an individual for participation in clinical trials involving research and testing of treatments for rare diseases or conditions. Amends SSA title XIX (Medicaid) to make a similar exclusion from income of such compensation for the purposes of eligibility under the Medicaid program. Directs the Comptroller General to study and report to Congress on the impact of this Act on enrollment of individuals who receive SSI benefits in clinical trials for rare diseases or conditions.

Appalachian Development Highway System Completion Act of 2009 - Authorizes appropriations out of the Highway Trust Fund (other than the Mass Transit Account) for FY2010-FY2015 for the Appalachian development highway system program. Directs the Secretary of Transportation to apportion such funds among the appropriate states to complete construction of the Appalachian development highway system. Authorizes states of the system to loan apportioned amounts between themselves.

Disaster State Housing Recovery Act of 2009 - Amends the American Recovery and Reinvestment Tax Act of 2009 with respect to grants for 2009 to a state housing credit agency for low-income housing projects in lieu of low-income housing credit allocations. Revises the formula for determining a state's low-income housing grant election amount to reflect any increase in the state housing credit ceiling for 2009 attributable to any such ceiling returned to the state in 2009 by reason of the additional low-income housing credit dollar amounts allocated by the state housing credit agency to buildings located in the Gulf Opportunity (GO) Zone (including the Hurricanes Katrina and Ike disaster areas in Alabama, Louisiana, or Mississippi). Requires application of the additional low-income housing credit amount for the GO Zone in the 2009 grant election formula without regard to certain special rules for small timber producers.

Child Custody Protection Act - Amends the federal criminal code to prohibit transporting a minor child across a state line to obtain an abortion (deems such transporting to be a de facto abridgment of the right of a parent under any law in the minor’s state of residence that requires parental involvement in the minor’s abortion decision). Makes an exception for an abortion necessary to safe the life of the minor. Makes it an affirmative defense to a prosecution or civil action under this Act that a defendant reasonably believed that before the minor obtained the abortion, the required parental consent or notification or judicial authorization took place. Imposes a fine and/or prison term of up to one year on anyone who has committed an act of incest with a minor and knowingly transports such minor across a state line to obtain an abortion.

Arthritis Prevention, Control, and Cure Act of 2009 - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS): (1) to develop and implement a National Arthritis Action Plan; and (2) acting through the Director of the Centers for Disease Control and Prevention (CDC), to conduct, support, and promote the coordination of arthritis and other rheumatic diseases research. Requires the Secretary to award grants to: (1) support arthritis-specific research projects at the Centers for Prevention Research by the CDC; (2) support state comprehensive arthritis control and prevention programs and public health surveillance, prevention, and control activities; and (3) assist in the implementation of a national strategy for arthritis control and prevention. Requires the Secretary to coordinate a national education and outreach program on arthritis and other rheumatic diseases. Requires the Secretary to establish an Arthritis and Rheumatic Diseases Interagency Coordinating Committee to: (1) improve coordination of federal research activities related to arthritis and rheumatic diseases; and (2) convene a summit to provide a detailed overview of such current federal research. Requires the Director of the National Institutes of Health (NIH) to expand and intensify juvenile arthritis research. Allows the Secretary, acting through the Director of the CDC, to award grants to support juvenile arthritis data collection. Requires the Secretary, acting through the Director of the CDC, to support the development of a National Juvenile Arthritis Patient Registry. Requires the Secretary to promote and support pediatric rheumatology training, including by allowing the Secretary to establish a loan repayment program. Requires the Comptroller General to conduct a study on the economic impact of arthritis in the workplace.

National Language Act of 2009 - Requires: (1) English to be the national language of the federal government; and (2) the federal government to preserve and enhance the role of English as the national language. Provides that no person has a right, entitlement, or claim to have the federal government act, communicate, perform or provide services, or provide materials in any language other than English, unless specifically provided by statute. Makes the English language version of a government form issued in a language other than English the sole authority for legal purposes. Declares that this Act does not prohibit the use of a language other than English.

Simplified, Manageable, And Responsible Tax Act or the SMART Act - Amends the Internal Revenue Code to replace the marginal income tax rates with a single rate of 17% on individual taxable income. Redefines "taxable income" to mean the amount by which wages, retirement distributions, and unemployment compensation exceed the standard deduction. Increases the basic standard deduction and includes an additional standard deduction for dependents. Includes in taxable income the taxable income of each dependent child under the age of 14. Replaces the current tax on corporations with a tax on every person engaged in a business activity equal to 17% of the business taxable income of such person. Makes the person engaged in the business activity liable for the tax, whether or not such person is an individual, a partnership, or a corporation. Imposes a tax of 17% on the value of excludable compensation provided during the year by an employer for the benefit of employees. Makes the employer liable for the tax. Repeals pension plan rules relating to : (1) non-discrimination; (2) contribution limits; and (3) restrictions on distributions. Revises rules relating to transfers of excess pension assets. Repeals: (1) the alternative minimum tax; (2) all income tax credits; (3) estate, gift, and generation-skipping transfer taxes; and (4) income tax provisions, except certain provisions relating to retirement distributions and tax-exempt organizations. Declares it not in order in the House of Representatives or the Senate, unless waived or suspended by a three-fifths vote, to consider any legislation that increases or adds an income tax rate, reduces the standard deduction, or provides any exclusion, deduction, credit, or other benefit that reduces federal revenues.

Condemns all forms of anti-Semitism and rejects attempts to rationalize anti-Jewish hatred or attacks as a justifiable expression of disaffection over political events in the Middle East or elsewhere. Decries the comparison of Jews to Nazis perpetrating a Holocaust or genocide as a pernicious form of anti-Semitism. Calls on leaders to speak out against manifestations of anti-Semitism that have entered the Middle East debate. Reaffirms support for the mandate of the Special Envoy to Monitor and Combat Anti-Semitism. Urges the Secretary of State to maintain the fight against anti-Semitism as a U.S. foreign policy priority.

No Cost Stimulus Act of 2009 - Deems the Draft Proposed Outer Continental Shelf Oil and Gas Leasing Program 2010-2015 issued by the Secretary of the Interior approved as a final oil and gas leasing program under the Outer Continental Shelf Lands Act (OCSLA). Deems the Secretary to have issued a final environmental impact statement for the program under the National Environmental Policy Act of 1969 (NEPA). Directs the Secretary to conduct a lease sale in each outer Continental Shelf (OCS) planning area for which there is a commercial interest in purchasing federal oil and gas production leases. Authorizes the Secretary to conduct commercial lease sales of federally-owned resources to: (1) produce renewable energy; or (2) cultivate marine organisms in their natural habitat. Amends OCSLA to direct the Secretary to develop: (1) a plan to address streamlining the process of making payments to states; and (2) a procedure to provide expedited funding to projects. Amends the Submerged Lands Act to extend from three geographical miles to 12 nautical miles a coastal state's allowable seaward boundary. Authorizes the leasing of land within the 1002 Coastal Plain Area of Alaska to any person qualified to obtain a lease for deposits of oil and gas under the Mineral Leasing Act. Prescribes procedures for lease sales and grants of leases. Directs the Secretary to administer the leasing program, with respect to Coastal Plain environmental protection, according to the No Significant Adverse Effect Standard. Establishes the Coastal Plain Local Government Impact Aid Assistance Fund to finance local government impact aid and community service assistance. Establishes an Arctic National Wildlife Refuge (ANWR) Alternative Energy Trust Fund. Amends the Oil Shale, Tar Sands, and Other Strategic Unconventional Fuels Act of 2005 to require the Secretary to conduct related lease sales in any state during any period for which there is sufficient support and interest in the state in the development of tar sands and oil shale resources. Amends the Atomic Energy Act of 1954 to repeal the requirement of 30 days' public notice before a hearing on each application for a construction permit for a new new nuclear power plant. Grants the U.S. District Court for the District of Columbia exclusive jurisdiction to hear all causes and claims arising from any covered project of federal land leasing for exploitation of oil, natural gas, or any other source or form of energy. Amends NEPA to require completion and review of environmental impact statements within 270 days after their commencement or the action concerned shall be considered a final agency action with no significant environmental impact. Amends the Clean Air Act to declare that carbon dioxide, methane from agriculture or livestock, or water vapor are not air pollutants. Amends the Endangered Species Act of 1973 (ESA) to require the Secretary concerned, upon the declaration of an emergency by a state governor, for the duration of the emergency, to exempt from the prohibition against taking, and against adverse modification of critical habitat, any action reasonably necessary to avoid or ameliorate the impact of the emergency, including the operation of any water supply or flood control project by a federal agency. Prohibits consideration of the impact of greenhouse gas on any species of fish or wildlife or plant for any purpose in the implementation of the ESA.

Directs the Secretary of the military department concerned to provide uncharged leave or a monetary benefit to any member or former member of the Armed Forces who, on any day beginning on January 19, 2007, and ending on the date of implementation of the Post-Deployment/Mobilization Respite Absence program, would have qualified for a day of administrative absence under such program had it been in effect. Makes such benefit: (1) an amount not to exceed $200 for each day, in the case of a former member; and (2) either one day of administrative absence or an amount not to exceed $200, in the case of a current member. Excludes from such benefit any members discharged or released under other than honorable conditions. Sets at 40 the maximum number of days for which such benefit may be provided.

Retired Pay Restoration Act of 2009 - Allows the receipt of both military retired pay and veterans' disability compensation with respect to any service-connected disability (under current law, only a disability rated at 50% or more). Makes eligible for the full concurrent receipt of both veterans' disability compensation and either military retired pay or combat-related special pay those individuals who were retired or separated from military service due to a service-connected disability.

Federal and Military Retiree Health Care Equity Act - Amends the Internal Revenue Code to permit: (1) federal civilian and military retirees to pay Federal Employees Health Benefits Program (FEHBP) and TRICARE supplemental premiums on a pretax basis (i.e., exclude premiums from gross income); and (2) a tax deduction (available to itemizers and nonitemizers) for TRICARE supplemental premiums or enrollment fees. Directs the Director of the Office of Personnel Management (OPM) and the Secretary of Defense to ensure that the option of paying FEHBP and TRICARE supplemental premiums on a pretax basis is available to federal civilian and military retirees for the first open enrollment period beginning not less than 90 days after the enactment of this Act.

Military Spouses Residency Relief Act - Amends the Servicemembers Civil Relief Act to prohibit, for purposes of voting for a federal, state, or local office, deeming a person to have lost a residence or domicile in a state, acquired a residence or domicile in any other state, or become a resident in or of any other state solely because the person is absent from a state because the person is accompanying the person's spouse who is absent from the state in compliance with military or naval orders. Prohibits a servicemember's spouse from either losing or acquiring a residence or domicile for purposes of taxation because of being absent or present in any U.S. tax jurisdiction solely to be with the servicemember in compliance with the servicemember's military orders if the residence or domicile is the same for the servicemember and the spouse. Prohibits a spouse's income from being considered income earned in a tax jurisdiction if the spouse is not a resident or domiciliary of such jurisdiction when the spouse is in that jurisdiction solely to be with a servicemember serving under military orders. Suspends land rights residency requirements for spouses accompanying servicemembers serving under military orders.

Secret Ballot Protection Act of 2009 - Amends the National Labor Relations Act to make it an unfair labor practice for: (1) an employer to recognize or bargain collectively with a labor organization that has not been selected by a majority of the employees in a secret ballot election conducted by the National Labor Relations Board; and (2) a labor organization to cause or attempt to cause an employer to recognize or bargain collectively with a representative that has not been selected in such manner.

National Monuments Act of 2009 - Requires the President to obtain congressional approval of proposed national monuments situated upon land owned or controlled by the federal government and certify compliance with the National Environmental Policy Act of 1969 prior to declaring national monuments. Bars the Secretary of the Interior from implementing any restrictions on the public use of a national monument until the expiration of an appropriate review period providing for public input and congressional approval.

Five-Star Generals Commemorative Coin Act - Directs the Secretary of the Treasury ( Secretary) to mint and issue $5 gold coins, $1 Silver Coins, and half dollar clad coins in recognition and celebration of the Five-Star Generals' attendance and graduation from the Command and General Staff College (CGSC). Requires the design of such coins to include the portraits of Generals George C. Marshall, Douglas MacArthur, Dwight D. Eisenhower, Henry "Hap" Arnold, and Omar N. Bradley. Restricts the issuance of such coins to calendar 2013. Requires specified surcharges in the sale of such coins, which shall be paid promptly to the CGSC Foundation to help finance its support of the College.

Supplemental Anti-Fraud Enforcement for our Market Act or the SAFE Markets Act - Authorizes: (1) the Director of the Federal Bureau of Investigation (FBI) to hire an additional 500 agents who shall be dedicated to investigating violations of the law relating to the U.S. financial markets; (2) the Attorney General to hire an additional 50 Assistant United States Attorneys who shall be dedicated to prosecuting such violations; and (3) the Securities and Exchange Commission (SEC) to hire 100 additional enforcement staff members who shall be dedicated to prosecuting such violations.

Amends the Emergency Economic Stabilization Act to revise the process for exercising the authority of the Secretary of the Treasury to make purchases of troubled assets in any amount in excess of the $350 billion previously obligated. Changes the Joint Resolution of Disapproval, regarding the exercise of such authority, to a Joint Resolution of Approval. Prohibits the Secretary, that is, from exercising any authority to make any such purchases unless within 15 calendar days after Congress receives a report of the Secretary's plan to exercise the authority, a joint resolution approving the plan is enacted into law.

Amends the Emergency Economic Stabilization Act to revise the limitation on the Secretary of the Treasury's authority to purchase troubled assets through the Troubled Assets Relief Program (TARP). Changes the Joint Resolution of Disapproval, regarding authority to purchase troubled assets, to a Joint Resolution of Approval. Prohibits the Secretary, that is, from exercising any authority to make any such purchases with regard to any TARP amount authorized, and unobligated as of November 14, 2008, unless within 15 calendar days after Congress receives a report of the Secretary's plan to exercise such authority, a joint resolution approving the plan is enacted into law.

Designates September 2008 as National Prostate Cancer Awareness Month. Declares that the federal government has a responsibility to: (1) raise awareness about prostate cancer screening and treatment; (2) increase funding for prostate cancer research; and (3) improve access to, and the quality of, health care services for detecting and treating prostate cancer.
