The plan must mitigate vulnerabilities to active pharmaceutical ingredient supply chains and reduce dependence on active pharmaceutical ingredients from foreign sources.

Synthetic Biology and Active Pharmaceutical Ingredients Act This bill requires the Department of Defense (DOD) to establish a pilot program to support domestic manufacturing of critical pharmaceutical ingredients and their components through certain novel technology. Specifically, DOD must establish a three-year program that uses technology involving synthetic biology to support domestic manufacturing of pharmaceutical ingredients and related incorporated materials that (1) are not available in a sufficient quantity or quality domestically, and (2) are strategically important to the United States.  

To direct the Secretary of Defense to submit to Congress a report on Department of Defense restrictions on the employment of former Department employees by certain countries.

Customs Trade Partnership Against Terrorism Pilot Program Act of 2023 or the CTPAT Pilot Program Act of 2023 This bill requires the Department of Homeland Security to carry out a pilot program that assesses whether allowing certain entities to participate in the Customs Trade Partnership Against Terrorism (CTPAT) would enhance port security, combat terrorism, prevent supply chain security breaches, or otherwise satisfy the goals of CTPAT. Such entities are (1) non-asset-based third-party logistics providers that arrange international freight transportation and are licensed or bonded by specified federal agencies; or (2) asset-based third-party logistics providers that facilitate cross-border activity, are licensed or bonded by specified federal agencies, and execute logistics services using their own warehousing assets and resources. The bill requires the Government Accountability Office to report on the effectiveness of CTPAT.

RAPID Reserve Act

Rolling Active Pharmaceutical Ingredient and Drug Reserve Act or the RAPID Reserve Act This bill requires the Department of Health and Human Services to contract with drug manufacturers to ensure adequate supplies of critical drugs that have vulnerable supply chains. (Under the bill, drugs are considered critical if they are likely to be needed during a public health emergency or if a shortage would pose a significant threat to the health care system or at-risk populations.) Contracted drug manufacturers must agree to (1) maintain at least a 6-month reserve of the active ingredient in a critical drug and of the finished product and to regularly replenish these reserves, (2) produce the ingredient and drug in a manner and quantity as specified in the contract, and (3) agree to transfer portions of the reserve, if necessary, to other manufacturers to meet manufacturing needs and allow HHS to control the allocation of reserves in the event of a public health emergency or other threat. HHS must publish a list of critical drugs and issue guidance on the criteria for determining this list and awarding contracts. HHS must give preference to domestic manufacturers for contracts.  In addition, the Government Accountability Office must report on the capacity of domestic manufacturing with respect to critical drugs, including the ability to manufacture different dosage forms and drugs with various characteristics.

Specifically, the bill applies to those individuals who were confirmed between December 5, 2023, and December 31, 2023. The bill requires DOD to provide pay and benefits associated with the appointment retroactive to the later of (1) the date that is 30 days after the date on which the nomination was placed on the Executive Calendar of the Senate, or (2) the date on which the individual would have been appointed but for the suspension of Senate confirmation of appointments.

Innovative Feed Enhancement and Economic Development Act of 2023 or the Innovative FEED Act of 2023 This bill provides for the regulation of zootechnical animal food substances as food additives. The bill defines  zootechnical animal food substance  as a substance that is added to the food or drinking water of animals and that affects only the animal's gastrointestinal tract, with the intended purpose of affecting the byproducts of the animal's digestion, reducing foodborne pathogens, or altering the animal's gastrointestinal biome. The definition does not include substances that are used to treat or prevent diseases in animals, hormones, or active ingredients of animal drugs. Labels for zootechnical animal food substances must include a disclaimer that the substance may not be used to treat or prevent diseases in animals.

Specialty Crops Reporting on Opportunities and Promotion Act of 2023 or the Specialty CROP Act of 2023 This bill expands the annual reporting requirements for the Technical Assistance for Specialty Crops program to require the Department of Agriculture (USDA) to provide specific information on the competitiveness of U.S. exports of specialty crops. Specifically, the bill modifies the requirements for a congressionally mandated annual report on U.S. specialty crop trade issues to require USDA to report specific information on acts, policies, and practices of foreign countries that constitute significant barriers to, or distortions of, U.S. exports of specialty crops. Further, USDA must consult with the Office of the United States Trade Representative (USTR) on the report. Before preparing the report, USDA, in coordination with the USTR, must seek comments from the public and the Agricultural Technical Advisory Committee for Trade in Fruits and Vegetables. Under the bill, USDA must submit the report to Congress in an unclassified form, but may include a classified annex. The unclassified portion of the report must be publicly available.

Weather Research and Forecasting Innovation Reauthorization Act of 2023 or the Weather Act Reauthorization Act of 2023 This bill reauthorizes, revises, and establishes several programs related to weather forecasting, monitoring, and research.  For example, the bill reauthorizes through FY2028 programs that are administered by the Office of Oceanic and Atmospheric Research in the National Oceanic and Atmospheric Administration (NOAA), including the U.S. Weather Research Program. It also provides statutory authority for NOAA's Verification of the Origins of Rotation in Tornadoes Experiment (known as VORTEX-USA). The bill also requires NOAA to establish programs that support weather forecasting technology, including improvements to radar accuracy, weather forecasting in underserved areas, and coastal flooding forecasting. NOAA must also contract with the private sector to obtain weather-related data and establish a pilot program to test the compatibility of this data with NOAA infrastructure.  In addition, NOAA must improve weather-related communication systems, including those related to hazardous weather events, through system upgrades that use more modern technology (e.g., cloud-based services) and that allow for expanded coverage (e.g., in rural areas). Finally, NOAA must administer programs that support weather forecasting for agricultural and water management, including pilot programs to improve precipitation forecasts in the western and central states and a soil moisture monitoring network.

Safe Schools Improvement Act This bill requires states to direct their local educational agencies (LEAs) to establish policies that prevent and prohibit bullying and harassment of elementary and secondary school students. In particular, these policies must prohibit bullying and harassment based on race, color, national origin, sex (including sexual orientation and gender identity), sex characteristics (including intersex traits), disability, or religion. Further, LEAs must provide (1) students, parents, and educational professionals with annual notice of the conduct prohibited in their disciplinary policies; (2) students and parents with grievance procedures that target such conduct; and (3) the public with annual data on the incidence and frequency of that conduct at the school and LEA level. The Department of Education must conduct and report on an independent biennial evaluation of programs and policies to combat bullying and harassment in elementary and secondary schools. The National Center for Education Statistics must collect state data to determine the incidence and frequency of the conduct prohibited by LEA disciplinary policies.

Federal Retirement Fairness Act

Federal Retirement Fairness Act This bill modifies the federal civilian service that is creditable service under the Federal Employees Retirement System (FERS). Specifically, it expands the nondeduction service that may be creditable under FERS. Nondeduction service is federal service where an employee's pay is not subject to retirement deductions (e.g., service under a temporary appointment). Currently, nondeduction service performed before January 1, 1989, is creditable under FERS so long as a deposit is made into the retirement fund to cover the period of nondeduction service. This bill allows nondeduction service performed on or after January 1, 1989, to be creditable under FERS so long as a deposit is made into the retirement fund.

Transportation Security Screening Modernization Act This bill directs the Transportation Security Administration (TSA) to streamline the process for individuals applying for or renewing enrollment in multiple security threat assessment (STA) programs, in particular the Transportation Worker Identification Credential (TWIC) and the Hazardous Materials Endorsement (HME) programs. Among other things, the TSA must permit an individual to enroll at a TSA-authorized enrollment center once and use the application, as well as information generated by TSA’s vetting, to enroll in any other programs; permit an individual to enroll in more than one STA program at the same time for a single fee that is less than the combined fee for applying to the same programs separately; provide for a streamlined and expeditious renewal process; and provide states the expiration dates for each individual’s STA to ensure commercial driver's licenses include an individual's current HME status. Additionally, the TSA must publish on its website information relating to the streamlining of the enrollment system. If the TSA determines it is necessary to implement these changes through rulemaking, the bill provides for an expedited rulemaking process.
