Provides funding under the 2001 Emergency Supplemental Appropriations Act for Recovery from and Response to Terrorist Attacks on the United States for specified Federal agencies and programs to improve the U.S. response to bioterrorism, including funds for : (1) the Centers for Disease Control and Prevention for multiple programs; (2) grants to hospitals; (3) smallpox vaccine purchase and administration; (4) National Institutes of Health laboratory security; (5) disaster response teams within the Department of Health and Human Services; (6) National Institute of Allergy and Infectious Diseases; (7) the National Pharmaceutical Stockpile; (8) training for workplace bioterrorism response; (9) the Food and Drug Administration for food safety inspection capacity; and (10) the Department of Agriculture for food safety inspection and research facility upgrade.

Medicare Appeals, Regulatory, and Contracting Improvement Act of 2001 - Amends part D (Miscellaneous) of title XVIII (Medicare) of the Social Security Act (SSA) with respect to: (1) timelines for publication of final regulations and compliance with substantive changes after notice; (2) timeframes for the completion of the record in the appeals process; (3) contracts with Medicare administrative contractors for determining payment amounts, making payments, and providing certain provider services; (4) coordination of funding for education of service providers; and (5) standardization of random prepayment review and recovery of overpayments from Medicare administrative contractors. Grants a one-year delay in the lock-in procedures for Medicare+Choice plans under SSA title XVIII part C. Provides a temporary moratorium on the requirement that home health agencies collect Outcome and Assessment Information Set (OASIS) data from non-Medicare patients.

Class Action Fairness Act of 2001 - Establishes a consumer class action bill of rights, including provision for: (1) judicial review and approval of noncash settlements; (2) protection against loss by class members because of payments to class counsel; (3) a prohibition against court approval of a proposed settlement providing for greater payments to class members because they are located in closer geographic proximity to the court; (4) a prohibition against court approval of a proposed settlement providing for payment of a greater share of the award to a class representative serving on behalf of a class; (5) standardized settlement notification information; and (6) specific requirements regarding proposed settlement notifications to Federal and State officials. Grants the district courts original jurisdiction of any civil action in which the matter in controversy exceeds $2 million, exclusive of interest and costs, and is a class action in which any member of a class of plaintiffs is: (1) a citizen of a State different from any defendant; (2) a foreign state or a citizen or subject of a foreign state and any defendant is a citizen of a State; or (3) a citizen of a State and any defendant is a foreign state or a citizen or subject of a foreign state. Lists exceptions, such as where a class action brought by shareholders solely involves a claim concerning a covered security or relating to the internal governance of a corporation. Sets forth procedures for removal of interstate class actions to U.S. district court and for review of orders remanding class actions to State courts. Directs the Judicial Conference of the United States to report to the Senate and House Judiciary Committees on class action settlements.

Medicare Physician Payment Fairness Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to set the conversion factor (update) for payments under the Medicare physician fee schedule for 2002 at 0.9 percent less than the conversion factor for 2001. Declares that this conversion factor and a specified update adjustment factor for a year after 2002 shall be applied as if this Act had not been in effect. Directs the Medicare Payment Advisory Commission (MEDPAC) to study and report to Congress on replacing the use of the sustainable growth rate as a factor in determining the update for such payments with a factor that more fully accounts for changes in the unit costs of providing physicians' services.

American Travel Industry Stabilization Act - Directs the President to issue Federal credit instruments, amounting in the aggregate up to $5 billion, to compensate eligible travel-related businesses that were injured by the Government shutdown of the airline industry following the terrorist attacks on the United States that occurred on September 11, 2001. Requires the Air Transportation Stabilization Board to review and make recommendations to the President with respect to applications for such instruments. Sets forth certain Board and instrument requirements.

Freedom Consolidation Act of 2001 - Reaffirms support for continued enlargement of the North Atlantic Treaty Organization (NATO) Alliance. Designates Slovakia for participation in the Partnership for Peace and eligible to receive certain security assistance under the NATO Participation Act of 1994. Authorizes specified amounts of security assistance for FY 2002 for Estonia, Latvia, Lithuania, Slovakia, Slovenia, Bulgaria, and Romania.

Farm and Ranch Equity Act of 2001 - Amends specified Acts to extend and revise agricultural and related programs with respect to: (1) commodities and price supports; (2) conservation; (3) agricultural trade; (4) nutrition; (5) agricultural credit; (6) rural development; (7) agricultural research, extension, and education; (8) forestry; (9) energy; and (10) agricultural security.

Department of National Homeland Security Act of 2001 - Establishes the Department of National Homeland Security. Includes the Secretary of National Homeland Security as a cabinet level position with membership on the National Security Council. Requires the Secretary to: (1) plan, coordinate, and integrate Government activities relating to homeland security, including border security and emergency preparedness, and act as a focal point regarding natural and manmade crises and emergency planning; (2) work with State and local governments and executive agencies in protecting U.S. homeland security and support State officials through the use of regional offices; (3) provide overall planning guidance to such agencies regarding homeland security; (4) conduct exercise and training programs for department employees and establish command and control procedures for security contingencies, including those that require the substantial military support; and (5) annually develop a Federal response plan for homeland security and emergency preparedness. Transfers to the Agency the authorities, functions, personnel, and assets of the Federal Emergency Management Agency, the U.S. Customs Service, the Border Patrol of the Immigration and Naturalization Service, the U.S. Coast Guard, the Critical Infrastructure Assurance Office and the Institute of Information Infrastructure Protection of the Department of Commerce, and the National Infrastructure Protection Center and the National Domestic Preparedness Office of the Federal Bureau of Investigation. Establishes within the Department: (1) separate Directorates of Prevention, Critical Infrastructure Protection, and Emergency Preparedness and Response; and (2) an Office of Science and Technology to advise the Secretary with regard to research and development efforts and priorities for such directorates. Requires the Secretary to establish mechanisms for the sharing of information and intelligence with U.S. and international intelligence entities.

Montgomery GI Bill Improvements Act of 2001 - Amends Federal basic educational assistance provisions (the Montgomery GI Bill) to eliminate the pay reduction currently required of service members as a precondition to eligibility for benefits Permits certain service members to transfer their entitlement to benefits to their spouses or dependent children. Extends the period after discharge during which former service members may utilize their benefits. Increases benefits available to members of the Selected Reserve called to active duty as part of a contingency operation.

Declares that, in the quest to identify, locate, and bring to justice the perpetrators and sponsors of the September 11, 2001, terrorist attacks on the United States, the civil rights and liberties of all Americans, including Sikh-Americans, should be protected. Expresses sorrow for the deaths and injuries suffered by first responders who participated in evacuating and rescuing the innocent people after the terrorist attacks on the World Trade Center and the Pentagon on September 11, 2001, and sympathy to their families and loved ones. Honors and commends such first responders. Encourages: (1) the President to issue a proclamation calling upon the people of the United States to pay respect to the first responder community for their service in the aftermath of the terrorist attacks and their continuing efforts to save lives; and (2) all levels of government to continue to work together to effectively coordinate emergency preparedness by providing the infrastructure, funding, and interagency communication and cooperation necessary to ensure that if an attack occurs, first responders will be as prepared as possible to respond effectively.

Oil Region National Heritage Area Act - Establishes the Oil Region National Heritage Area in Pennsylvania. Requires the Secretary of the Interior, acting through the Director of the National Park Service, to enter into a compact with the Oil Heritage Region, Inc. (the management entity for the Area) to carry out this Act. Bars the use of funds under this Act to acquire real property. Directs the Secretary, in cooperation with the Historic American Building Survey and the Historic American Engineering Record, to conduct studies to document the industrial, engineering, building, and architectural history of the Area. Limits the Federal assistance match to 50 percent of any activity's total cost.

Requires the Director of the Bureau of Justice Assistance to pay (within 30 days of employing agency certification) death or permanent disability benefits to qualified beneficiaries of public safety officers who were killed or who suffered a catastrophic injury as a direct and proximate result of a personal injury sustained in the line of duty in connection with the rescue or recovery efforts related to the terrorist attacks of September 11, 2001.

Emergency Aviation Security Act of 2001 - Directs the Administrator of the Federal Aviation Administration to implement a sky marshal program that: (1) provides for random deployment of sky marshals on domestic commercial air passenger flights and international flights on American carriers into or out of the United States; (2) provides background and fitness checks for, and appropriate training, supervision, and equipment of, sky marshals; and (3) requires commercial air carriers to provide seating for a sky marshal on any selected air passenger flight without regard to the availability of seats on such flight. Authorizes the Administrator to impose a fee of not more than $1.00 per domestic flight segment to carry out such program.

Condemns the terrorists who attacked the United States on September 11, 2001, as well as their sponsors. Extends condolences to the victims and their families and commends the heroic actions of the rescue workers, volunteers, and State and local officials who responded. Declares that the United States is entitled under international law to respond to these attacks. Expresses: (1) thanks to those foreign leaders and individuals who have expressed solidarity with the United States in the aftermath of the attacks and asks them to continue to stand with the United States in the war against international terrorism; (2) a commitment to support increased resources in the war to eradicate terrorism; and (3) support for the determination of the President to bring to justice and punish the perpetrators of these attacks and their sponsors. Declares September 12, 2001, to be a National Day of Unity and Mourning.

Middle East Peace Compliance Act of 2001 - Imposes specified sanctions with respect to the Palestine Liberation Organization (PLO) or the Palestinian Authority if the President determines that such entities have not substantially complied with certain commitments made with Israel. Authorizes the President to waive such sanctions in the U.S. national security interest.

Koby Mandell Justice for American Victims of Terrorism Act of 2001 - Directs the Attorney General to establish within the Department of Justice an office to: (1) monitor acts of international terrorism alleged to have been committed by Palestinians or individuals acting on behalf of Palestinian organizations; (2) collect and offer rewards for information against individuals alleged to have committed such acts; (3) negotiate with the Palestinian Authority or related entities to obtain financial compensation for U.S. nationals or their families injured or killed by such terrorist acts; (4) establish and implement alternative methods to apprehend, indict, prosecute, and convict individuals who commit such acts; (5) contact victims' families and provide updates on the progress to apprehend, indict, prosecute, and convict the individuals who commit such acts; and (6) provide for the permanent stationing of an appropriate number of U.S. officials in Israel, in territory administered by Israel and by the Palestinian Authority, and elsewhere.

Persian Gulf War POW/MIA Accountability Act of 2001 - Amends the Bring Them Home Alive Act of 2000 to direct the Attorney General to grant refugee status in the United States to any alien (and parent, spouse, or child thereof) who: (1) is a national of Iraq or a nation of the Greater Middle East Region; and (2) personally delivers into the custody of the United States Government a living American Persian Gulf War POW/MIA. Includes Iraq, Kuwait, and any other country of the Greater Middle East Region among the countries to which the International Broadcasting Bureau is required to broadcast information that promotes such refugee program.

Family Planning State Empowerment Act of 2001 - Amends title XIX (Medicaid) of the Social Security Act (SSA) to give States the option to elect to: (1) make available family planning services and supplies furnished to eligible individuals of child-bearing age to any individual whose family income does not exceed the greater of 185 percent of the income official poverty line applicable to a family of the size involved or the specified eligibility income level; and (2) extend the postpartum period for provision of family planning services and supplies.

Refugee Protection Act of 2001 - Amends the Immigration and Nationality Act with respect to refugee provisions to limit summary inspection procedures to emergency migration situations in which numbers of arriving aliens substantially exceed inspection capacities. Grants the Attorney General sole authority to make such determination, which shall last 90 days unless extended after consultation with the appropriate congressional committees. Revises provisions respecting inspection of aliens seeking U.S. admission, including requiring: (1) an alien to be informed of certain rights prior to removal or withdrawal of his or her admission application, and (2) review of a removal order by an immigration judge, with the right of the alien to personally appear and be represented (at his or her expense). Exempts from expedited removal procedures certain Western Hemisphere nationals or unaccompanied children. Revises the procedure used to determine whether an applicant for asylum has a credible fear of persecution. Eliminates certain: (1) limitations on judicial review of exclusion orders or asylum claims; (2) time limits on asylum applications; (3) numerical limitations on asylee adjustments; and (4) numerical limitations on population control-related refugee admissions. Makes certain mandatory asylee detention provisions discretionary. Directs the Attorney General to: (1) develop alternatives to detention of asylum seekers, including supervised shelters and noninstitutional settings for minors; (2) enter into contracts with nongovernmental agencies for alternative detention programs; and (3) establish a National Legal Orientation Support and Training Center. Requires asylum seekers not eligible for parole or alternative detention to be detained only in Immigration and Naturalization Service or approved facilities.

Medicaid Community-Based Attendant Services and Supports Act of 2001 - Amends title XIX (Medicaid) of the Social Security Act (SSA) to mandate State Medicaid plan coverage of community-based attendant services and supports for described Medicaid-eligible individuals. Outlines provisions for: (1) an enhanced Federal medical assistance percentage for ongoing activities of early coverage States that enhance and promote the use of community-based attendant services and supports; and (2) increased Federal financial participation for certain expenditures incurred by the State for the provision of community-based attendant services and supports. Directs the Secretary of Health and Human Services to: (1) award grants to eligible States which have established a Consumer Task Force to assist the State in its development of real choice systems change initiatives; and (2) conduct a demonstration project for the purpose of evaluating service coordination and cost-sharing approaches with respect to the provision of community-based services and supports to non-elderly dually eligible individuals.

Employment Non-Discrimination Act of 2001 - Prohibits employment discrimination on the basis of sexual orientation by covered entities (including employment agencies, labor organizations, and training programs). Prohibits related retaliation and coercion. Declares this Act inapplicable to the provision of employee benefits for the benefit of an employee's domestic partner. Prohibits the Equal Employment Opportunity Commission from: (1) collecting statistics on sexual orientation from covered entities; and (2) compelling covered entities to collect such statistics. Prohibits: (1) quotas and preferential treatment; and (2) an order or consent decree for a violation of this Act that includes a quota or preferential treatment. Declares this Act inapplicable to: (1) religious organizations; (2) the relationship between the United States and members of the armed forces; or (3) laws creating special rights or preferences for veterans. Prohibits the imposition of affirmative action for a violation of this Act. Disallows State immunity. Makes the United States or a State liable for remedies to the same extent as under the Civil Rights Act of 1964.

United States Independent Film and Television Production Incentive Act of 2001 - Amends the Internal Revenue Code to establish a tax credit for 25 percent of up to the first $25,000 of qualified wages paid or incurred by an employer with respect to employees in any qualified U.S. independent film and television production during a taxable year. Increases the credit to 35 percent if the production is located in an area eligible for designation as a low-income community or eligible for designation by the Delta Regional Authority as a distressed county or isolated area of distress.

Breast Cancer Research Stamp Act of 2001 - Amends Federal postal law to provide that any limitation in the Semipostal Authorization Act relating to whether more than one semipostal (a postage stamp issued by the U.S. Postal Service, at a premium, in order to help provide funding for a national public interest) may be offered for sale at the same time, shall not apply to the breast cancer research special stamps issued by the U.S. Postal Service. Extends the Service's authority to issue such stamps through July 29, 2008. Revises the differential amount of the special rate of postage for the breast cancer research stamp to not less than 15 percent of the regular first-class rate (currently, not to exceed 25 percent of first-class). Requires the special rate to be evenly divisible by five.

Amends the Fair Labor Standards Act of 1938 to exempt from certain child labor restrictions the employment, inside or outside of businesses where machinery is used to process wood products, of individuals between ages 14 and 18 who are exempt, by statute or judicial order, from compulsory school attendance beyond the eighth grade. Permits such youth employment if the individual: (1) is supervised by an adult relative or by an adult member of the same religious sect or division; (2) does not operate or assist in the operation of power-driven woodworking machines; (3) is protected from wood particles or other flying debris within the workplace by a barrier appropriate to such potential hazard or by maintaining a sufficient distance from machinery in operation; and (4) is required to use personal protective equipment to prevent exposure to excessive levels of noise and sawdust.

Railroad Track Modernization Act of 2001 - Amends Federal rail transportation law to direct the Secretary of Transportation to establish a program of capital grants to class II and class III railroads (or with the concurrence of such railroads, to a State or local government) to rehabilitate, preserve, or improve railroad track (including roadbed, bridges, and related track structures) used primarily for freight transportation to a standard ensuring that it can be operated safely and efficiently and accommodate 286,000 pound rail cars. Authorizes the Secretary to also make grants to supplement direct loans or loan guarantees (including for paying credit risk premiums, lowering rates of interest, or providing for a holiday on principal payments) for projects primarily benefitting non-class I freight railroad carriers. Sets forth certain employee protection and prevailing wage requirements with respect to projects financed by such grants. Directs the Secretary to study and report to Congress on such projects to determine the public interest benefits associated with the light density railroad networks in the States and their contribution to a multimodal transportation system.

Designates the month of September as National Prostate Cancer Awareness Month. Declares that the Federal Government has a responsibility to: (1) raise awareness about the importance of screening methods and treatment of prostate cancer; (2) increase research funding that is commensurate with the burden of the disease so that the causes of, and improved screening, treatments, and a cure for, prostate cancer may be discovered; and (3) continue to consider ways for improving access to, and the quality of, health care services for detecting and treating prostate cancer.

Solid Waste Interstate Transportation and Local Authority Act of 2001 - Amends the Solid Waste Disposal Act to prohibit a landfill or incinerator (facility) from receiving out-of-State municipal solid waste (MSW) for disposal or incineration unless the waste is received pursuant to a new or existing host community agreement or an exemption from this prohibition. Authorizes States to establish limits on the amount of out-of-State waste received annually for disposal at each facility and affected local governments to limit the amount received at a particular facility pursuant to an exemption. Prohibits State limits from conflicting with permits or host community agreements that set higher (or no) limits. Allows a State to: (1) provide that it will deny or refuse to renew a permit for the construction or operation of a facility (or a major modification thereto); (2) require that a permit issued for a new facility or an expansion include an annual limitation of not less than 20 percent on the total quantity of out-of-State MSW relative to the total waste received by the facility; (3) limit the amount of out-of-State MSW received annually at each facility to the amount received during 1995 if the State has enacted a comprehensive, statewide recycling program; and (4) impose cost recovery surcharges Requires owners or operators to annually report to Governors of the States in which the facilities are located the amount of out-of-State waste received during the preceding year. Requires the General Accounting Office to report annually on unauthorized disposal incidents. Authorizes States and political subdivisions to exercise flow control authority for municipal solid waste and recyclables, directing such waste and materials to particular waste management or recyclables facilities designated as of a specified suspension date. Prohibits a State or political subdivision from requiring any person to transport materials to any active portion of a MSW landfill unit if contamination of such portion is a basis for listing on the National Priorities List, unless the person has been indemnified. Imposes limitations on the use of revenues derived from the exercise of flow control authority. Lists additional conditions under which flow control authority may be exercised. Prohibits recovery of damages or costs in a claim against a State or local government, or official or employee thereof, based on the exercise of flow control authority on or before May 16, 1994.

Department of Veterans Affairs Nurse Recruitment and Retention Enhancement Act of 2001 - Amends the Department of Veterans Affairs employee incentive scholarship program to: (1) repeal a provision requiring commencement of participation in the program prior to December 31, 2001; (2) reduce from two years to one the required period of continuous Department employment for program participation; (3) revise scholarship amounts; and (4) increase from three to six years the number of school years for which a scholarship may be paid while limiting the total payment to the cost of three years of full-time coursework. Repeals a provision terminating on December 31, 2001, the education debt reduction program. Increases the maximum debt reduction amount under such program and allows the annual adjustment of such amount. Allows the Secretary of Veterans Affairs, until December 31, 2001, to expand the number of individuals eligible under such program. Authorizes additional pay for Saturday duty for health care professionals in the Department's Veterans Health Administration (VHA). Allows unused sick leave to be included in the annuity computation for VHA registered nurses. Directs the Secretary to: (1) evaluate the efficacy of the Department's nurse managed health care clinics; (2) establish a nationwide policy on the staffing of Department medical facilities; (3) report on the use of authorities for retaining experienced nurses; and (4) report on mandatory overtime required of licensed nurses and nurse assistants providing direct patient care.

Expresses the sense of the Senate that: (1) all Americans should keep abused and neglected children in their thoughts and prayers; (2) all Americans should seek to break the cycle of abuse and neglect and to give these children hope for the future; (3) the faith community, nonprofit organizations, and volunteers across America should recommit themselves and mobilize their resources to assist these children; and (4) the Senate supports the goals and ideas of the Day of Hope, (April 3, 2002) and commends Childhelp USA for its efforts on behalf of abused and neglected children everywhere.

Dairy Consumers and Producers Protection Act of 2001 - Amends the Agricultural Market Transition Act to include Maryland, New Jersey, New York, and Pennsylvania within the Northeast Interstate Dairy Compact. Eliminates: (1) the Compact's termination date; and (2) certain restrictive authority respecting non-Compact milk. States that only Ohio may join such Compact. Eliminates and revises specified provisions regarding Compact implementation, duration, restricting authority, and Commodity Credit Corporation compensation. States that Congress consents to the Southern Dairy Compact entered into by Alabama, Arkansas, Georgia, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Oklahoma, North Carolina, South Carolina, Tennessee, Virginia, and West Virginia. States that only Florida, Nebraska, and Texas may join such Compact. Limits price regulatory authority to Class I fluid milk unless otherwise consented to by the Congress. Provides for Commodity Credit Corporation compensation. Sets forth the Southern Dairy Compact. States that Congress consents to: (1) the Pacific Northwest Dairy Compact proposed for California, Oregon, and Washington; and (2) the Intermountain Dairy Compact proposed for Colorado, Nevada, and Utah. Limits price regulatory authority to Class I fluid milk. Provides for Corporation compensation. States that such Compacts shall be the same as the Southern Dairy Compact with specified differences.

States that the Senate: (1) recognizes the tragedy of the AIDS pandemic in human terms, as well as its economic, political and social effects; (2) supports the formation of a Global AIDS and Health Fund, and urges the Administration to encourage other nations to contribute; (3) calls for financial and other assistance from the United States, other nations, and international and private organizations; and (4) urges international assistance programs to emphasize science-based best practices and prevention the context of comprehensive care and treatment.

Bear Protection Act of 2001 - Prohibits any person from: (1) importing bear viscera into, or exporting it from, the United States; or (2) selling bear viscera, bartering, offering it for sale or barter, or purchasing, possessing, transporting, delivering, or receiving it in interstate or foreign commerce. Subjects persons who violate such prohibitions to specified penalties. Waives such prohibition for wildlife law enforcement purposes where a valid permit has been issued. Requires the Secretary of the Interior to continue discussions concerning trade in bear viscera with the appropriate representatives of Parties to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) and with other representatives of countries that are not party to CITES which are determined to be the leading importers, exporters, or consumers of such products, in order to establish coordinated efforts with such countries to protect bears. Declares that nothing in this Act shall affect State regulation of bear population or the lawful hunting of bears under State law.

Increases, for FY 2002 through 2004, the rates of veterans' basic educational assistance. Prohibits any rate increase during such period based on adjustments to the Consumer Price Index.
