Designates the Clinical Center of the National Institutes of Health located in Montgomery County, Maryland, as the Warren Grant Magnuson Clinical Center of the National Institutes of Health. Directs the Committee on Rules and Administration to place appropriate markers or inscriptions at suitable locations within such center to commemorate and designate such building.

Amends the Refugee Education Assistance Act of 1980 to repeal the provision providing for the accompanying transfer of appropriations with any transfer of refugee responsibilities from the Federal Emergency Management Administration to other Federal agencies.

Extends the tributes of the Senate to the members of the United States Air Force who participated, including Sergeant Davis Livingston who died and those members who were injured, in the voluntary mission at the Titan II missile site near Damascus, Arkansas.

Establishes the United States Holocaust Memorial Council which shall: (1) provide and encourage appropriate ways for the Nation to observe the Days of Remembrance to commemorate the holocaust; (2) plan, erect, and oversee the operation of a memorial museum to the victims of the holocaust; and (3) plan for carrying out the recommendations of the report submitted to the President on September 27, 1979, by the President's Commission on the Holocaust. Authorizes the Council to receive public land in the District of Columbia on which it may erect the memorial. Terminates the Council's authority to construct a memorial if the erection of the memorial has not commenced within five years of enactment of this Act and sufficient funds to ensure completion of the memorial have not been certified to be available. Authorizes appropriations to carry out this Act.

Amends the Tobacco Inspection Act to permit the Secretary of Agriculture to: (1) require each tobacco grower to specify through which warehouse or person such grower intends to market tobacco; (2) issue marketing schedules allocating available sales opportunities to specified warehouses or persons; (3) prohibit unfair methods of competition involving the sale and purchase of grower's tobacco; (4) provide a method for making containers used in marketing tobacco uniform; and (5) require periodic reports and recordkeeping from persons in the tobacco industry describing the amount of tobacco planted, harvested, processed, sold, and purchased. Requires such information to be kept confidential. Establishes forfeitures for specified violations of the marketing schedule. Vests jurisdiction to review forfeiture rulings of the Secretary in the U.S. district courts.

Federal Government Fiscal Responsibility Act of 1980 - Requires the Comptroller General of the United States, after consultation with specified congressional committees, to issue regulations describing the actions which constitute unnecessary spending at the end of a fiscal year by a Government office, as such term is defined in this Act. Directs the head of each Government office to take such actions as necessary to eliminate unnecessary spending. Authorizes the office head to provide awards to employees who help to eliminate unnecessary spending. Directs each office head to submit to Congress an annual report describing the savings of that office during the preceding fiscal year. Requires the Comptroller General, by April 1 of each fiscal year, to conduct random selective audits of at least 15 Government offices to determine whether such offices have engaged in substantial unnecessary spending during the preceding fiscal year. Directs the Congress to recognize by appropriate resolution each office which has achieved savings during a fiscal year. Requires each committee of the Senate and the House of Representatives having legislative jurisdiction over a program carried out by a Government office, when reporting legislation to authorize the enactment of new budget authority for such program for a fiscal year: (1) to authorize new budget authority for a program which achieved savings in the preceding year in an amount which at least equals the amount of budget authority authorized in the preceding year plus the savings during such year, except under specified circumstances; and (2) to authorize the enactment of new budget authority for a program which engaged in unnecessary spending during the preceding year in an amount not exceeding the amount of budget authority authorized in the preceding year reduced by the amount of unnecessary spending. Directs the Committees on Appropriations of each House to report legislation providing new budget authority in accordance with such authorization guidelines. Requires the amount of such new budget authority to be adjusted to reflect changes during the preceding year in the Consumer Price Index beginning with the second fiscal year after the enactment of this Act.

Provides for the use and distribution of the award granted by the Indian Claims Commission to the Seminole Nation as it existed in Florida on September 18, 1823. Directs the chief trial judge of the United States Court of Claims to report to the Congress findings of fact and a recommendation as to what constitutes a fair, just, and equitable division of the award between the Seminole Indians of Florida and the Seminole Indians of Oklahoma. Makes such recommendation binding on the Secretary of the Interior at the end of the 60-day period following its submission if neither House of Congress adopts a resolution to the contrary. Provides for the allocation of the total share of the award of the Seminole Indians of Florida among the Seminole Indian Tribe of Florida, the Miccosukee Tribe of Indians of Florida, and those Indians in Florida possessing at least one-fourth degree of Florida Seminole blood who have not shared in the claims of any other tribe.

Expresses the sense of Congress that human rights concerns should be given serious attention at the Madrid meeting to review such Act. Declares that any new measures should be balanced among all sections of the Final Act. Directs the U.S. delegation to seek another review meeting within two years.

Lee Metcalf Fair Employment Relations Resolution - Title I: Fair Employment Relations Board - Establishes as an office of the Senate, the Senate Fair Employment Relations Board to: (1) establish and publish policies and guidelines for the implementation and enforcement of rule XLII of the Standing Rules of the Senate; (2) supervise the actions of the Director and the operations of the Senate Fair Employment Relations Office; and (3) hear and determine complaints. Title II: Senate Fair Employment Relations Office - Establishes as an office of the Senate, the Senate Fair Employment Relations Office which shall develop procedures to implement the policies of the Board, gather information relating to Senate employment practices, and review procedures for the hearing and settling of complaints. Title III: Complaints of Violations of Equal Employment Opportunity - Provides for counseling and assistance through the Office, to any individual who believes that he or she has been discriminated against in violation of rule XLII. Sets forth the procedure for filing informal complaints based on employment discrimination, and for the informal settlement of such claims. Sets forth the procedure for filing formal complaints, and for conducting hearings on such claims. Provides for an appeal to the Senate Select Committee on Ethics of an adverse decision or order of the Board. Sets forth remedies available to individuals who have been discriminated against in violation of rule XLII. Title IV: Amendments to Standing Rules of the Senate - Amends rule XLII of the Standing Rules of the Senate, relating to employment practices, to provide that any complaint of violation of such rule be heard and settled by the Senate Fair Employment Relations Board in accordance with provisions of this Act.

Amends the Home Energy Assistance Act of 1980 to require that the allotment of home energy grant funds be based on the number of heating and cooling degree days (currently, the number of heating degree days squared) multiplied by the number of low-income households. Authorizes States to make grants to eligible households to meet the rising costs of cooling.

Amends the Congressional Budget Act of 1974 to prohibit total budget outlays for any fiscal year after fiscal year 1980 from exceeding the total budget outlays for the preceding fiscal year by a greater percentage than the percentage increase in the gross national product in the preceding calendar year. Reduces further the permissible total budget outlays by percentages based upon the inflation rate and Federal grants to State and local governments. Permits: (1) an increase in the permissible total budget outlays if both Houses of Congress agree by a three-fourths vote; and (2) emergency outlays to be authorized if the President has declared an emergency and both Houses agree by a two-thirds vote. Prohibits requiring State or local governments to perform additional functions without compensation for necessary costs incurred in connection with such functions. Requires such compensation to have been authorized and included as a part of the permissible total budget outlays. Requires concurrent resolutions on the budget to include the estimated amount of grants to State and local governments, in the aggregate and as a fraction of total budget outlays, and any changes. Amends the Budget and Accounting Act, 1921, to require the Budget to be prepared in compliance with this Act. Directs the President to take necessary action to assure continuing compliance with this Act.

Declares that it is in the best interest of both such countries to convene a parliamentary and scholarly conference to commemorate and evaluate such treaty. Farm Labor Contractor Registration Act Amendments of 1980 - Amends the Farm Labor Contractor Registration Act of 1963 to revise the definition of "farm labor contractor" to: (1) broaden specified exclusions from such definition (thus broadening certain exemptions from coverage under such Act); and (2) exclude from such definition (and such coverage) any nonprofit or cooperative association of farmers, growers, ranchers, duly incorporated under appropriate State laws, and operated solely for the mutual benefit of the members thereof, and any full-time or regular employee of such association or cooperative who engages in such activity solely for such employer. Adds other definitions relating to such revisions. Revises the definition of "agricultural employment" to specify that listed activities take place on a farm or ranch. Limits the definition of "migrant worker" to only those workers who cannot regularly return to their domicile each day after working hours, or who are transported from and to their domicile each workday by the person who recruits, solicits, hires, or furnishes such worker for agricultural employment on a farm or ranch owned or operated by another person.

Expresses the sense of the Senate that the inclusion of a separate agenda item on Palestinian women presents an intrusion of political issues into the Mid-Decade Conference for women. Declares that the U.S. delegation to the Conference should be instructed to oppose any resolutions which do not relate directly to the goals of the Conference.

Deplores the Soviet violations with respect to Afghanistan. Joins calls for the withdrawal of Soviet troops from Afghanistan. Supports the imposition of penalties on the Soviet Union for its aggression. Urges continued action to draw attention to the Soviet violations and to prevent further Soviet incursions.

Authorizes the Secretary of Commerce to make loans from the fisheries loan fund, established under the Fish and Wildlife Act of 1956, during the period beginning on the date of enactment of this Act and ending at the close of fiscal year 1983, to assist obligors to avoid default on obligations issued with respect to the construction, reconstruction, reconditioning, or purchase of fishing vessels. Authorizes the Secretary to set terms and conditions for such loans, taking into account specified considerations.

Appellate Court Reorganization Act of 1980 - Divides the current United States Court of Appeals for the Fifth Circuit into the following two circuits: (1) the Fifth Circuit, composed of the States of Louisiana, Mississippi, and Texas, and consisting of 14 judges; and (2) the Eleventh Circuit, composed of the States of Alabama, the Canal Zone, Florida, Georgia, and consisting of 12 judges. (The current Fifth Circuit consists of all six States and has 26 judges.) Designates Atlanta, Georgia, the headquarters of the Eleventh Circuit and New Orleans, Louisiana, headquarters of the Fifth Circuit. Makes this Act effective October 1, 1980.

Fishery Conservation and Management Act Amendments of 1980 - Amends the Fishery Conservation and Management Act of 1976 to revise the criteria to be used by the Secretary of State and the Secretary of Commerce in determining the allocation among foreign nations of the total allowable level of foreign fishing. Requires the Secretary of Commerce to establish a program under which a United States observer shall, to the extent practicable, be stationed aboard each foreign fishing vessel which is within the fishery conservation zone and engaged in fishing or accepting United States harvested fish through transfer at sea. Requires such observers, while aboard foreign fishing vessels, to carry out such scientific and other functions as the Secretary deems necessary. Requires the Secretary to impose, with respect to each foreign fishing vessel for which a permit is issued under such Act, a surcharge in an amount sufficient to cover all the costs of providing a United States observer aboard that vessel. Establishes in the Treasury of the United States the Foreign Fishing Observer Fund to be available to the Secretary as a revolving fund for the purpose of carrying out this Act. Requires all surcharges collected by the Secretary to be deposited into such fund. Requires the Secretary, in determining the level of the fees to be paid to the Secretary by the owner or operator of any foreign fishing vessel for which a permit is issued, to ensure that such fees, at a minimum, fully recover all the direct and indirect conservation and management, research, enforcement, and administrative costs resulting from foreign fishing in the fishery conservation zone. Includes the Northern Mariana Islands within the coverage of such Act. Includes the Northern Mariana Islands within the Western Pacific Fishery Management Council. Increases to 13 the number of voting members on such Council of which eight shall be appointed by the Secretary of Commerce. Requires the Secretary of the department in which the Coast Guard is operating to cause the vessel M/V Olwol, owned by the government of the Trust Territory of the Pacific Islands and in the custody of the government of the Northern Mariana Islands, to be documented as a vessel of the United States. Authorizes the Secretary of the department in which the Coast Guard is operating to prescribe by regulation the manner in which perishable seized fish may be sold.

Trade Procedures Simplification Act of 1980 - Requires the Attorney General, in consultation with other Federal agency heads, to determine whether: (1) U.S. business conduct and arrangements to expand exports in various countries conflict with basic antitrust principles; and (2) a more liberal enforcement policy for overseas activities would impede implementation of the antitrust laws. Directs the Attorney General to identify conduct and arrangements associated with particular types of export sales which the Attorney General determines would not warrant prosecution under the antitrust laws. Sets forth the procedures for describing such permissible conduct and disclosing such descriptions. Authorizes the Secretary of Commerce to intervene in such suits and to provide legal assistance to exporters. Prohibits prosecution under the antitrust laws of exporters who: (1) have notified the Attorney General of their intention to engage in such designated permissible conduct; or (2) receive an approval, or no objection, from the Attorney General concerning proposed transactions. Requires the Attorney General and the Secretary of Commerce to report to Congress concerning implementation of this Act.

Authorizes the President to present a gold-plated medal, on behalf of the Congress, to those athletes selected through the Olympic trial process to be members of the United States Summer Olympic Team of 1980. Directs the Secretary of the Treasury to cause to be struck 650 such medals with suitable emblems. Declares that such medals are national medals and that funds to carry out this Act shall be made available under the Amateur Sports Act of 1978.

Veterans' Disability Compensation and Survivors' Benefits Amendments of 1980 - Title I: Veterans' Disability Compensation Benefits - Increases the rates of veterans' compensation for: (1) wartime disability compensation; (2) additional compensation for dependents; and (3) clothing allowances paid to certain disabled veterans. Title II: Survivors' Dependency and Indemnity Compensation Benefits - Increases the rates of veterans' dependency and indemnity compensation for: (1) a surviving spouse; (2) surviving children; and (3) supplemental children's benefits. Title III: Miscellaneous Provisions - Extends the authority for the Veterans' Administration regional office in the Republic of the Philippines until September 30, 1985. Sets forth procedures for: (1) retroactive payments for additional children entitled to dependency and indemnity compensation; and (2) reducing payments to a dependent child who has attained the age of 18 and is attending an educational institution, and whose parent is receiving compensation payments as a surviving spouse. Provides for pension payments to a hospitalized veteran having neither spouse nor child if such veteran is readmitted within six months of a period of care. Title IV: Effective Date - States that the amendments made by this Act shall take effect on October 1, 1980.
