Great Lakes Legacy Act of 2008 - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to include among activities that the Great Lakes National Program Office is authorized to carry out for the remediation of sediment contamination in areas of concern: (1) demonstration or pilot projects that use innovative approaches, technologies, or techniques for the remediation of sediment contamination; and (2) activities to restore aquatic habitat after remediation. Authorizes the Administrator of the Environmental Protection Agency (EPA) to provide additional consideration to projects that are funded by potentially responsible parties (individuals or entities that may be liable under federal or state environmental remediation laws with respect to a project carried out under such Act) and determined to be of greater environmental significance than competing proposals. Revises provisions concerning the nonfederal share of the costs of such projects. Authorizes the Administrator, Acting through the Program Office, to enter into agreements with nonfederal sponsors to implement projects under which such sponsors may pay in advance their share of the project costs and receive reimbursement for such costs from the Administrator. Requires the Administrator to implement a public information and participation program relating to the remediation of contaminated sediment in areas of concern in the United States. Authorizes appropriations for FY2009-FY2013 for: (1) such remediation; (2) the public information and participation program; and (3) research on the development and use of innovative approaches, technologies, and techniques for such remediation.

American Energy Production Act of 2008 - Amends the Outer Continental Shelf Lands Act to permit projected lines of states adjacent to the subsoil and seabed of the outer Continental Shelf to be used for oil and gas preleasing and leasing activities. Authorizes the governor of a state with a new producing area within the offshore administrative boundaries beyond the submerged land of the state to petition the Secretary of Energy to make new producing areas available for oil and gas leasing. Sets forth a lease sales program for oil and gas development within the Coastal Plain of the Arctic National Wildlife Refuge. Prescribes environmental protection procedures for the Coastal Plain. Requires Alaska to establish in its state treasury the Coastal Plain Local Government Impact Aid Assistance Fund to assist designated Alaska entities impacted by the oil and gas exploration and production. Prohibits exportation of oil or gas produced under this Act. Prescribes a refinery permitting process. Suspends petroleum acquisition for the Strategic Petroleum Reserve (SPR). Amends the Clean Air Act to include renewable biomass within its purview. Sets forth an advanced battery manufacturing incentive program. Instructs the Assistant Administrator of the Office of Research and Development of the Environmental Protection Agency to implement a research and development program for adding materials to biofuels to make them more compatible with infrastructure used to store and deliver petroleum-based fuels. Instructs the Secretary of Energy to study and report to Congress on: (1) the feasibility of increasing consumption in the United States of ethanol-blended gasoline with specified levels of ethanol; and (2) specified diesel vehicle attributes. Clean Coal-Derived Fuels for Energy Security Act of 2008 - Directs the President to promulgate regulations to ensure that covered fuel introduced into commerce in the United States on an annual average basis contains a specified volume and percentage of clean coal-derived fuel. Amends the Department of the Interior, Environment, and Related Agencies Appropriations Act, 2008 to repeal the prohibition against final regulations for commercial oil shale leasing program on public land. Amends the Energy Independence and Security Act of 2007 to repeal the prohibition against federal agency contracts for procurement of alternative or synthetic fuel. Authorizes the Department of Defense to enter into multiyear contracts to purchase synthetic fuels.

Fair Pay Act of 2008 - Amends the Civil Rights Act of 1964 to declare that an unlawful employment practice occurs when the aggrieved person knew or should have known that the person was affected by the discriminatory compensation decision or other practice involved. Applies that amendment to claims of compensation discrimination under the Americans with Disabilities Act of 1990 and the Rehabilitation Act of 1973. Amends the Age Discrimination in Employment Act of 1967 to declare that an unlawful practice occurs when the aggrieved person knew or should have known that the person was affected by the discriminatory compensation decision or other practice involved.

Beach Protection Act of 2008 - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to include among eligible grant activities the development and implementation of programs for source tracking, sanitary surveys, and prevention efforts to address the identified sources of beach water pollution. Authorizes appropriations for such grants for FY2008-FY2013. Requires grant recipients to identify: (1) the use of a rapid testing method; (2) measures for communication within 24 hours of the results of a water sample concerning pollutants to specified officials and all state agencies with authority to require the prevention or treatment of the sources of beach water pollution; (3) measures to develop and implement a beach water pollution source identification and tracking program for the coastal recreation waters that are not meeting applicable water quality standards for pathogens; (4) a publicly accessible and searchable global information system database with information updated within 24 hours of its availability, organized by beach and with defined standards, sampling plan, monitoring protocols, sampling results, and number and cause of beach closing and advisory days; and (5) measures to ensure that closures or advisories are made or issued within 24 hours after a state government determines that its coastal recreation waters are not meeting applicable water quality standards for pathogens. Requires the Environmental Protection Agency (EPA) Administrator to: (1) publish a revised list of rapid testing methods; and (2) validate such methods no later than two years after this Act's enactment and periodically thereafter. Sets forth provisions requiring: (1) a review by the Administrator of state and local compliance with statutory and regulatory requirements and grant conditions; (2) corrective actions by such governments not in compliance; and (3) a review by the Comptroller General of such compliance review and corrective action. Amends the Beaches Environmental Assessment and Coastal Health Act of 2000 to authorize appropriations to carry out such Act through FY2013.

Condemns the violence in Tibet and calls for restraint by the government of the People's Republic of China (PRC) and the people of Tibet. Calls for: (1) a dialogue between the government of China and the Dalai Lama on religious and cultural autonomy for Tibet within China; and (2) release of peaceful protesters. Calls on the PRC to: (1) respect the right of the people of Tibet to speak of the Dalai Lama and possess his photograph; (2) respect basic human rights; (3) allow international journalists free access to China; and (4) provide a full accounting of the March 2008 protests in Tibet. Calls on the Department of State to fully implement the Tibetan Policy Act of 2002. Urges that the agreement permitting the PRC to open further diplomatic missions in the United States should be contingent upon establishment of a U.S. government office in Lhasa, Tibet.

Protecting America's Homeowners Act of 2008 - Amends the Internal Revenue Code to extend through January 1, 2011, the temporary exclusion from gross income of the discharge of an indebtedness for a qualified principal residence. Declares invalid, throughout a specified moratorium period, the terms of any home mortgage loan that requires a consumer to pay a prepayment penalty for paying all or part of the outstanding principal before its contractual due date. Directs the Neighborhood Reinvestment Corporation (NRC) to continue to award to counseling intermediaries and State Housing Finance Agencies certain funds previously designated for mortgage foreclosure mitigation activities in states and areas with high rates of mortgage foreclosures or defaults. Appropriates additional funds for FY2008 for: (1) NRC foreclosure mitigation activities; and (2) state and local governmental redevelopment of abandoned and foreclosed homes. Sets forth across-the-board 0.25 percent rescissions in non-defense, non-homeland-security discretionary spending for FY2009. Amends the Truth In Lending Act to require additional creditor disclosures concerning mortgage loans. Requires the annual percentage rate (APR) applicable to credit secured by an interest in real property to include settlement costs. Amends the Federal National Mortgage Association Charter Act and the Federal Home Loan Mortgage Association Charter Act to provide that securities issued by the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Association (Freddie Mac) are not exempt from registration requirements under the Securities Act of 1933 (thus requiring registration of such securities). Sets a limit upon aggregate annual registration fees paid by specified entities that do not include a registered investment company. Establishes in the Securities and Exchange Commission (SEC) a Financial Counseling and Foreclosure Prevention Fund to provide assistance to the NRC to make grants to certain federally approved counseling intermediaries for mortgage foreclosure mitigation assistance to states and areas with high rates of defaults and foreclosures.

Pregnant Women Health and Safety Act - Subjects any physician who knowingly performs an abortion in violation of this Act to fines and/or imprisonment. Requires a physician who performs an abortion to: (1) have admitting privileges at a local hospital; and (2) notify the patient of the location of the hospital where the patient can receive follow-up care by the physician if complications arise. Provides for an exception for an abortion that is necessary to save the life of a mother whose life is endangered by a physical disorder, physical illness, or physical injury, including a life-endangering physical condition caused by or arising from the pregnancy itself. Prohibits a woman upon whom an abortion is performed from being prosecuted for conspiracy to violate this Act. Requires each abortion clinic that receives federal funds or assistance to: (1) be licensed by the state; and (2) be in compliance with the requirements for ambulatory surgery centers under title XVIII (Medicare) of the Social Security Act, except for the requirement of a certificate of public need. Allows a state board of health to waive the application of certain structural requirements for licensing purposes.

Clean Boating Act of 2008 - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to provide that no permit shall be required by the Administrator of the Environmental Protection Agency (EPA) under the national pollutant discharge elimination system for the discharge from a recreational vessel of graywater, bilge water, cooling water, weather deck runoff, oil water separator effluent, or effluent from properly functioning marine engines or for any other discharge that is incidental to the normal operation of such vessel. Defines a "recreational vessel" as any vessel that is leased, rented, or chartered to a person for that person's pleasure or that is manufactured or used primarily for pleasure, excluding vessels that are subject to Coast Guard inspection and that are engaged in commercial use or that carry paying passengers. Requires the Administrator to: (1) develop management practices for recreational vessels to mitigate the adverse impacts on U.S. waters of discharges incidental to normal vessel operation (excluding sewage) in any case in which the Administrator determines that the use of those practices is reasonable and practicable; and (2) promulgate federal standards of performance (which may distinguish among vessel types) for each discharge for which such a management practice is developed. Requires the Secretary of the department in which the Coast Guard is operating to promulgate regulations governing the design, construction, installation, and use of management practices for recreational vessels as necessary to meet such standards. Prohibits the owner or operator of a recreational vessel from operating in U.S. waters if such owner or operator is not using applicable management practices in compliance with such regulations.

Workforce Innovation in Regional Economic Development Act of 2008 - Amends the Workforce Investment Act of 1998 to provide for: (1) preparation and approval of state Workforce Innovation in Regional Economic Development (WIRED) plans for carrying out certain workforce development activities; (2) the integration of workforce development programs and community and economic development programs included as part of an approved plan; and (3) the award of supplementary grants to entities to implement approved WIRED plans and to states to carry out WIRED activities.

Code Talkers Recognition Act of 2008 - Directs the Speaker of the House of Representatives and the President pro tempore of the Senate to arrange for the award of gold medals in recognition of the service of Native American code talkers of specified Indian tribes. Defines "code talker" as a Native American who served in the Armed Forces during a foreign conflict and who participated in miliatary communications using a native language. Requires the Secretary of the Treasury, in consultation with the Secretary of Defense and Indian tribes, to identify Native American code talkers eligible for a gold medal.

Biennial Budgeting and Appropriations Act - Amends the Congressional Budget Act of 1974 to require: (1) biennial (currently, annual) budget resolutions; (2) biennial appropriations Acts; and (3) biennial government strategic and performance plans. Defines the budget biennium as the two consecutive fiscal years beginning on October 1 of any odd-numbered year. Requires the Director of the Office of Management and Budget (OMB) to: (1) determine the impact and feasibility of changing the definition of a fiscal year and the budget process based on that definition to a two-year fiscal period with a biennial budget process based on such period; and (2) report the findings to the House and Senate Budget Committees.

Paul D. Wellstone Muscular Dystrophy Community Assistance, Research, and Education Amendments of 2008 - Amends the Public Health Service Act to designate centers of excellence for research on various forms of muscular dystrophy as Paul D. Wellstone Muscular Dystrophy Cooperative Research Centers. Requires the Muscular Dystrophy Interagency Coordinating Committee to give special consideration to enhancing the clinical research infrastructure required to test emerging therapies for the various forms of muscular dystrophy. Requires the Secretary of Health and Human Services to ensure that any data on patients that is collected as part of the Muscular Dystrophy Surveillance, Tracking and Research Network (MD STARnet) is regularly updated to reflect changes in patient condition over time. Requires the Director of the Centers for Disease Control and Prevention (CDC) to: (1) report to the appropriate congressional committees on MD STARnet and data collection; and (2) make publicly available prospective health outcome data on the health and survival of people with muscular dystrophy. Requires the Director of CDC, in carrying out a program to provide information and education on muscular dystrophy to health professionals and the general public, to: (1) partner with leaders in the muscular dystrophy patient community; and (2) widely disseminate the Duchenne-Becker muscular dystrophy care considerations. Requires the Director of the Agency for Healthcare Research and Quality to: (1) evaluate the available scientific evidence to develop and issue an initial set of care considerations for Duchenne-Becker muscular dystrophy and provide ongoing review and updates where appropriate; and (2) replicate the same systematic review methodology used to develop such care considerations as a model for other muscular dystrophies.

Delays until April 1, 2009, implementation of proposed changes to payment rules under title XIX (Medicaid) of the Social Security Act for case management and targeted case management services. Prohibits the Secretary of Health and Human Services, before such date, from taking any action to restrict coverage or payment under Medicaid if such action is more restrictive than the administrative action, policy, or practice that applies to coverage of, or payment for, such services under Medicaid on December 3, 2007. Makes null and void any such action taken by the Secretary between December 4, 2007, and March 31, 2009, that is based in whole or in part on such interim final rule.

United States Army Commemorative Coin Act of 2008 - Instructs the Secretary of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half dollar clad coins as numismatic items emblematic of the traditions, history, and heritage of the U.S. Army, and its role in American society from the Colonial period to today. Requires the design for such coins to contain motifs that honor specifically the American soldier of both today and yesterday, in wartime and in peace, consistent with the traditions and heritage of the U.S. Army, the mission and goals of the National Museum of the U.S. Army, and the missions and goals of the Army Historical Foundation. Restricts coin issuance to the one-year period beginning on January 1, 2011. Requires all surcharges from coin sales to be promptly paid by the Secretary to the Foundation to help finance the National Museum of the U.S. Army.

Amends the Internal Revenue Code to: (1) increase from 30 to 50% the rate of the special depreciation allowance (bonus depreciation) for certain business equipment and assets placed in service in 2008; and (2) allow a corporation to elect to increase its alternative minimum tax credit by its bonus depreciation amount in lieu of applying such allowance.

Child Custody Protection Act - Amends the federal criminal code to prohibit transporting a minor child across a state line to obtain an abortion (deems such transporting to be a de facto abridgment of the right of a parent under any law in the minor’s state of residence that requires parental involvement in the minor’s abortion decision). Makes an exception for an abortion necessary to safe the life of the minor. Makes it an affirmative defense to a prosecution or civil action under this Act that a defendant: (1) reasonably believed that before the minor obtained the abortion, the required parental consent or notification or judicial authorization took place; or (2) was presented with documentation showing that a court waived parental notification requirements or authorized the minor's abortion. Defines "abortion" as the termination of a pregnancy with an intention other than to increase the probability of a live birth, preserve the life or health of the child after live birth, terminate an ectopic pregnancy, or remove a dead unborn child who died as the result of a spontaneous abortion, accidental trauma, or a criminal assault on the pregnant female or her unborn child. Imposes a fine and/or prison term of up to one year on anyone who has committed an act of incest with a minor and knowingly transports such minor across a state line to obtain an abortion.

Santa Fe 400th Anniversary Commemorative Coin Act of 2007 - Instructs the Secretary of the Treasury to issue $5 gold coins and $1 silver coins emblematic of the settlement of Santa Fe, New Mexico, the oldest capital city in the United States. Permits issuance of such coins only during calendar 2010. Requires the Secretary to pay 50% of surcharges received from such coin sales to: (1) the Santa Fe 400th Anniversary Committee, Inc.; and (2) the Secretary of the Interior to sustain the ongoing mission of preserving Santa Fe, including educational programs, infrastructure and archaeological research activities, and other programs to support commemoration of the 400th anniversary of Santa Fe.

Cytology Proficiency Improvement Act of 2007 - Amends the Public Health Service Act to require the Secretary of Health and Human Services to revise national quality assurance standards to assure consistent performance by laboratories of valid and reliable cytology services, to include requirements that each clinical laboratory: (1) ensure that all individuals involved in screening and interpreting cytological preparations participate annually in an approved continuing medical education program in gynecologic cytology that provides each participant with gynecologic cytological preparations designed to improve locator, recognition, and interpretive skills; (2) maintain a record of program results; (3) require the laboratory director to consider such results and other performance metrics in reviewing the performance of individuals involved in screening and interpreting cytological preparations; and (4) submit the continuing education program results for each individual and plans for corrective action or remedial training in a timely manner to the laboratory's accrediting organization for purposes of review and ongoing monitoring. Requires the Secretary to terminate individual proficiency testing that was in effect before enactment of this Act.
