Building Chips in America Act of 2023 This bill modifies and limits the review of certain semiconductor (i.e., microchip) projects under the National Environmental Policy Act of 1969 (NEPA) and the National Historic Preservation Act (NHPA). Specifically, the bill exempts from NEPA and NHPA specified semiconductor projects that receive financial assistance under the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021. Next, the bill allows the Department of Commerce to serve as the lead agency for the review of a semiconductor project that receives such financial assistance but is not exempted from review under NEPA. A single environmental document and joint record of decision must be prepared for a semiconductor project. In completing the environmental review, Commerce may adopt a prior study or decision under certain circumstances. The bill also allows a state to assume the responsibility of an environmental review under NEPA for a semiconductor project. Iran Sanctions Relief Review Act This bill restricts the President's authority to unilaterally undertake certain actions with respect to Iran and increases congressional oversight of those actions. Specifically, the President must report to Congress before terminating or waiving sanctions related to Iran or taking a licensing action that significantly alters U.S. foreign policy with respect to Iran. Each report must (1) describe the proposed action and its rationale, and (2) indicate whether or not the action is intended to significantly alter foreign policy concerning Iran. If the intention is to alter that policy, the report must provide additional information about the policy objectives and anticipated effects of the action. After the President submits a report, the bill provides Congress with a 30-day period to review it; this period is extended to 60 days for reports submitted between July 10 and September 7. During this period, Congress may enact a joint resolution approving or disapproving the action. During the review period, the President may not take the action unless Congress passes a joint resolution of approval; if Congress enacts a joint resolution of disapproval, the bill prohibits the President from taking the action. The bill also outlines procedures for the introduction and consideration of these types of joint resolutions.

This resolution recognizes that the COVID-19 pandemic and increased tensions between the United States and China have exposed vulnerabilities due to overreliance by the United States and other countries on supply chains based in China. The resolution emphasizes that nearshoring in Latin America and the Caribbean has the potential to contribute to the economic security of the United States while advancing the post-pandemic economic recovery of countries in the Western Hemisphere. Nearshoring is the practice of moving a business or supplier to a nearby country, as opposed to a more distant one. The resolution encourages the U.S. Agency for International Development and the U.S. International Development Finance Corporation to support initiatives likely to relocate global supply chains to the Western Hemisphere. The resolution also calls for governments in Latin America and the Caribbean to increase opportunities for nearshoring in the region. Finally, the resolution urges the Department of State to prioritize efforts to advance nearshoring in Latin America and the Caribbean.

The bill also directs the President to seek to establish, with foreign partners, an international mechanism to provide compensation to Ukraine using the Ukraine Support Fund and Russian sovereign assets confiscated by foreign partners. Leveling the Playing Field 2.0 Act This bill addresses unfair trade practices by making various changes to U.S. antidumping and countervailing duty law. Antidumping provides relief to U.S industries and workers that are materially injured or threatened with injury due to imports of like products sold in the U.S. market at less than fair value, while countervailing duty provides such relief from imports of products subsidized by a foreign government or public entity. Specifically, the bill establishes a process for successive antidumping and countervailing duty investigations. Successive investigations may be concurrent (an ongoing investigation of the same product) or recently completed (not more than two years before the date of the initiation of the successive investigation). Further, the bill establishes a time line for the Department of Commerce to issue determinations in successive investigations. Among other provisions, the bill authorizes Commerce to apply countervailing duty law to subsidies provided by a foreign government or public entity to a company operating in a third country, use another method for calculating the cost of production in specific circumstances, and require importers to provide a certification that the imported merchandise is not subject to an antidumping or countervailing duty order. Additionally, the bill statutorily establishes procedures for Commerce to conduct circumvention inquiries, including by specifying the deadlines for preliminary and final determinations. The bill also provides statutory authority for Commerce to investigate currency undervaluation as a countervailable subsidy.

AM Radio for Every Vehicle Act of 2023 This bill requires the Department of Transportation (DOT) to issue a rule that requires all new motor vehicles to have devices that can access AM broadcast stations installed as standard equipment. (AM broadcast stations are often used to deliver emergency alerts and news and entertainment programming; some newer vehicles do not include AM equipment.) Protecting Taxpayers and Victims of Unemployment Fraud Act This bill addresses overpayments of unemployment insurance (UI) benefits, including by providing incentives for states to investigate and recover these funds. Specifically, the bill allows a state to retain 25% of any funds recovered from fraudulent overpayments of certain UI benefits that were provided during the COVID-19 pandemic. These retained funds must be used for specified program integrity measures, such as modernizing UI systems and information technology and hiring fraud investigators. The bill allows a state to retain up to 5% of (1) any UI overpayment it recovers, except where the overpayment is due to state agency error; and (2) any unpaid employer contributions that the state recovers, if the state certifies that it has enacted certain fraud detection measures. A state must use the retained funds for specified purposes, such as deterring, detecting, and preventing improper payments. Additionally, the bill extends from 3 to 10 years the time during which states must recover overpayments of pandemic UI benefits through benefit offsets. The bill also extends from 5 to 10 years the statute of limitations for federal criminal charges or civil enforcement actions related to UI fraud.
