Eligible recipients may use funding for operating costs associated with projects that improve public transportation service for transit-dependent populations and support increased transit ridership (e.g., service expansion, information technology enhancements, and workforce development). The bill requires DOT to apportion the funding so that recipients receive funds that are proportional to their share of operating costs. The bill also provides for an increased federal cost share for operating assistance for projects or programs carried out in areas of persistent poverty or underserved communities. DOT must set up a multimodal access measurement interface for public agencies to aid transit agencies in determining and reporting on access to jobs and essential services. A grant recipient must also (1) report specific information to the FTA for inclusion in the National Transit Database, and (2) survey transit riders and non-riding residents regarding transit service improvements. Maintaining and Enhancing Hydroelectricity and River Restoration Act of 2023 This bill establishes a new investment tax credit in the amount of 30% of the basis of any hydropower improvement property. The bill defines hydropower improvement property as property that adds or improves fish passage at a qualified dam; maintains or improves the quality of the water retained or released by a qualified dam; promotes downstream sediment transport and habitat maintenance; upgrades, repairs, or reconstructs a qualified dam to meet safety and security standards; improves public uses of, and access to, public waterways impacted by a qualified dam; removes an obsolete river obstruction; or places into service an approved remote dam. Further, written approval for hydropower improvement property must be obtained from the Federal Energy Regulatory Commission or state or local officials prior to January 1, 2032. The bill also allows an election to claim the investment tax credit for qualified progress expenses for some types of hydropower improvement property in advance of such property being placed into service. Any investment tax credit amount claimed for qualified progress expenses reduces the amount of the investment tax credit that may be claimed once the hydropower improvement property is placed into service. The bill authorizes certain entities, including tax-exempt and governmental entities, to treat the investment tax credit for hydropower improvement property as a payment of tax and receive a refund of any overpayment (also known as elective pay). The bill establishes transition rules for employment-based visas such as (1) reserving a percentage of EB-2 (workers with advanced degrees or exceptional ability) and EB-3 (skilled and other workers) visas for individuals not from the two countries with the largest number of recipients of such visas, and (2) allotting a number of visas for professional nurses and physical therapists. The bill imposes additional requirements for H-1B visas, such as prohibiting (1) an employer from advertising that a position is limited to H-1B applicants or that H-1B applicants are preferred, and (2) certain employers from having more than half of their employees as nonimmigrant visa workers. The Department of Labor shall create a publicly available website where an employer seeking an H-1B visa must post information about the open position. The bill also expands Labor's authority to investigate H-1B applications for fraud or misrepresentations. The bill also prohibits H-1B or H-3 (trainee or special education exchange) visas for nationals of a foreign adversary country for employment in any matter vital to U.S. national interests. Farmers Feeding America Act of 2023 This bill reauthorizes The Emergency Food Assistance Program (TEFAP), increases funding for the program, and provides additional delivery options for geographically isolated states (i.e., Hawaii, Alaska, Puerto Rico, the Northern Mariana Islands, the U.S. Virgin Islands, and Guam). TEFAP is a federal program that helps supplement the diets of people with low income by providing them with emergency food assistance at no cost. Through TEFAP, the Department of Agriculture (USDA) purchases a variety of commodities and makes those food products (e.g., canned, frozen, dried, and fresh fruits and vegetables, eggs, meat, dairy, and whole-grain and enriched grain products) available to state distributing agencies. The bill increases funding for purchasing commodities under the program. Further, the bill directs USDA to coordinate with geographically isolated states to (1) establish alternative delivery options for allocated commodities, and (2) allow for the states to order commodities through the USDA Department of Defense Fresh Fruit and Vegetable Program. USDA may also provide geographically isolated states the ability to directly purchase domestically grown food in lieu of receiving a portion of the commodities. Under this option, USDA may distribute as cash to the state up to 20% of the cash value of the commodities that are allocated to the state under TEFAP. Further, USDA may consider additional factors beyond lowest price in determining winning bids for contracts for fresh produce packages (including product variety and transportation distance).
