Determination of NEPA Adequacy Streamlining Act This bill requires the Department of Agriculture and the Department of the Interior to use a previously completed environmental assessment or environmental impact statement required under the National Environmental Policy Act of 1969 for a proposed transmission, pipeline, or renewable energy facility project if the proposed project is substantially the same as one addressed in the previous assessment or statement.

Innovative Agricultural Technology Act of 2022 This bill directs the Department of Agriculture (USDA) to establish the Innovative Agricultural Technology Pilot Program to enable certain U.S. citizens and corporations to test agricultural technologies without complying with applicable laws or regulations, subject to market access limits. Additionally, USDA must (1) establish an online program that educates agricultural producers about using distributed ledger technology in agricultural production, and (2) conduct a study to identify potential applications for distributed ledger technology in agricultural operations.

Puerto Rico Nutrition Assistance Fairness Act of 2022 This bill sets out a process to enable Puerto Rico to participate as a state in the Supplemental Nutrition Assistance Program (SNAP). Under current law, a state receives SNAP funding based on the number of participating households in the state whereas Puerto Rico receives a block grant to fund its nutrition assistance program. The bill requires Puerto Rico to submit to the Department of Agriculture (USDA) a plan of operation to transition away from the consolidated block grant program to SNAP. USDA must provide appropriate training and technical assistance to enable Puerto Rico to formulate such plan.

Protecting Access for Hunters and Anglers Act of 2022 This bill bars the Department of the Interior and the Department of Agriculture from prohibiting or regulating the use of lead ammunition or tackle on federal land or water that is under the jurisdiction of such departments and made available for hunting or fishing. The bill makes exceptions for specified existing regulations and where the applicable department determines that a decline in wildlife population at the specific unit of federal land or water is primarily caused by the use of lead in ammunition or tackle, based on the field data from such unit, and the state approves the regulations.

Strategy and Investment in Rural Housing Preservation Act of 2022 This bill provides assistance to rural, multifamily rental-housing projects and tenants. Specifically, the bill provides statutory authority for a Department of Agriculture (USDA) program that supports the preservation and revitalization of affordable housing projects that are financed with USDA loans. Further, the bill makes changes to certain USDA rental assistance programs including by authorizing the USDA to provide rural housing vouchers for low-income households (including those not receiving rental assistance) residing in certain properties financed with or insured by USDA loans. The USDA must also report on preserving the affordability of rental projects financed by USDA loans for low-income families.

Trucking Regulations Unduly Constricting Known Service-providers Act of 2022 or the TRUCKS Act of 2022 This bill revises requirements for obtaining a commercial driver's license. The bill allows states to exempt employees in certain agriculture-related industries and employees of state, local, and tribal governmental entities from entry-level driver training requirements to obtain a commercial driver's license. Additionally, a state may issue restricted commercial driver's licenses to owners and employees of certain small businesses, including those that employ not more than nine employees who hold a commercial driver's license as of the date on which the restricted commercial driver's license is issued.

Small and Homestead Independent Producers Act of 2022 This bill provides authority for small cultivators of marijuana and small manufacturers of marijuana products to ship and sell the marijuana or marijuana products using the U.S. Postal Service or a private or commercial interstate carrier. Specifically, marijuana or a marijuana product may be shipped or sold to individuals within a state or another state in which the possession of it is lawful by such individuals. The bill takes effect on the date on which marijuana is removed from the list of scheduled substances under the Controlled Substances Act and federal criminal penalties for an individual who manufactures, distributes, or possesses marijuana, are eliminated.

Paperwork Reduction for Farmers and H-2A Modernization Act This bill expands the H-2A (temporary agricultural worker) visa program to cover additional types of labor, makes various changes to the program, and provides a safe harbor for errors in nonimmigrant worker visa applications in certain instances. The bill makes H-2A visas available to an alien providing temporary labor that falls within the federal government classification categories for (1) grounds maintenance workers; (2) farming, fishing, and forestry occupations; or (3) forest, conservation, and logging workers. The bill authorizes joint employers to file a joint petition for an H-2A alien. The bill allows (1) employers seeking to rehire an H-2A worker to submit a simplified petition, and (2) employers seeking to hire H-2A workers for different time periods during a fiscal year to submit a single petition for such workers. The Department of Labor shall establish an electronic filing and appeals system for H-2A petitions. U.S. Citizenship and Immigration Services (USCIS) shall communicate electronically with an H-2A employer when USCIS requests evidence from the employer, if the employer asks to do so. An employer who uses a third-party service to apply for a nonimmigrant worker visa shall not be civilly or criminally liable for errors in the application if the employer reasonably believed that the application was accurate and complied with statutory requirements.

Home Internet Accessibility Act This bill requires the Government Accountability Office (GAO) to report on broadband internet capacity in housing that is supported by the Department of Housing and Urban Development (HUD) or the Department of Agriculture. In its report, the GAO must identify such housing that lacks broadband capacity and estimate the costs and time frame necessary to provide broadband capacity in such housing. Additionally, HUD must develop a plan for retrofitting such housing to provide the capacity for broadband internet.

Farmers Market and Food Bank Local Revitalization Act of 2022 This bill provides for increased support for farmers' markets. The bill extends through FY2028, expands eligibility for, and increases benefits under the Senior Farmers' Market Nutrition Program. The bill extends through FY2025 and increases benefits under the Women, Infants, and Children Farmers' Market Nutrition Program. The Department of Agriculture (USDA) must make loans, loan guarantees, and grants to public agencies and nonprofit organizations for the construction of new farmers markets or the improvement or rehabilitation of existing farmers markets. Additionally, the bill requires USDA to establish a pilot grant program in which food banks may voluntarily contract with their local farmers for them to grow produce for food bank programs to promote local procurement of produce.

Promoting Agriculture Safeguards and Security Act of 2022 or the PASS Act of 2022 This bill establishes requirements to address the national security risk to the agricultural sector of the United States. Specifically, the bill prohibits persons who are acting on behalf of China, Russia, Iran, or North Korea from purchasing or investing in U.S. agricultural land and companies. The President may waive this prohibition, on a case-by-case basis, if the President determines that the waiver is vital to U.S. national security interests. The bill also places the Secretary of Agriculture on the Committee on Foreign Investment in the United States (CFIUS) and requires CFIUS to review certain transactions involving investments by foreign persons in the U.S. agricultural sector. Additionally, the Department of Agriculture must report on the risks that foreign purchases of U.S. businesses engaged in agriculture pose to the agricultural sector of the United States.

Spotted Wing Abatement Trust Act of 2022 or the SWAT Act of 2022 This bill directs the Animal and Plant Health Inspection Service to establish a fund for research relating to, and activities to mitigate the negative effects of, spotted wing drosophila. Securing America's Land from Foreign Interference Act This bill requires the President to take actions as necessary to prohibit members of the Chinese Communist Party (CCP) (or foreign individuals or entities acting on behalf of the CCP) from purchasing real estate located in the United States. The bill also modifies an existing civil penalty for failing to satisfy a reporting requirement relating to a foreign individual or entity that acquires or transfers an interest in U.S. agricultural land. Under this bill, the civil penalty for failing to report the required information to the Department of Agriculture must be at least 10% of the fair market value of the relevant interest in agricultural land.

Expanding Local Meat Processing Act of 2022 This bill directs the Department of Agriculture to revise its regulations to allow certain packers to hold an ownership interest in, finance, or participate in the management or operation of a market agency selling livestock on a commission basis. The bill applies to packers that have a cumulative slaughter capacity of (1) less than 2,000 animal per day or 700,000 animals per year with respect to cattle or sheep, and (2) less than 10,000 animals per day or 3 million animals per year with respect to hogs.

WIC Healthy Beginnings Act of 202 2 This bill requires the Department of Agriculture (USDA) to make available online certain information about solicitations for infant formula bids under the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC). Under current law, state agencies must control infant formula costs in the WIC program through competitive bidding for infant formula rebate contracts. The bill requires state WIC agencies to provide USDA with a description of open solicitations for these competitive bids that includes the title of the solicitation, the state agency administering the solicitation, and other relevant information for the USDA to publish online.

Guaranteeing Robust Agricultural Independence and Nutrition for America Act or the GRAIN for America Act This bill establishes a one-year moratorium on the enrollment of land in the Conservation Reserve Program, with a specified exception for land that is already subject to a contract under the program. It also prohibits the Department of Agriculture from enrolling prime farmland in the program. Additionally, the bill allows a participant who has entered into a contract under the program to terminate the contract at any time during the one-year period preceding the date on which the contact would expire.

Improving Newborn Formula Access for a Nutritious Tomorrow Act of 2022 or the INFANT Act of 2022 This bill revises the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC) to require state agencies that use a competitive bidding system for infant formula contracts to award such contracts to at least two manufacturers. Additionally, it prohibits states from contracting more than 70% of their WIC infant formula from one manufacturer within a year.

Lake Winnibigoshish Land Exchange Act of 2022 This bill requires the exchange of certain federal lands in the Chippewa National Forest in Minnesota. The bill directs the Department of Agriculture (USDA), if Big Winnie Land and Timber, LLC, (BWLT) offers to convey identified nonfederal land to the United States, to (1) accept the offer and convey to BWLT all right, title, and interest of the United States in and to the federal land; and (2) accept from BWLT all right, title, and interest of BWLT in and to the nonfederal land. The exchange shall be for equal value or the values shall be equalized by a cash payment, subject to an exception. The land acquired by USDA shall be added to and managed as part of Chippewa National Forest.

Young Farmer Success Act This bill makes certain farmers or ranchers eligible for student loan forgiveness under the Public Service Loan Forgiveness (PSLF) program. Under the PSLF program, the Department of Education must cancel the balance of interest and principal due on a borrower's Federal Direct Loans after the borrower makes 120 monthly loan payments while employed in a public service job. This bill broadens the definition of public service job to include a full-time job engaged in farm work as an employee or manager of a qualified farm or ranch.

Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2023 This bill provides FY2023 appropriations for the Department of Agriculture (USDA), the Food and Drug Administration, and related agencies. The bill provides appropriations to USDA for agricultural programs, including the Office of the Secretary, Executive Operations, the Office of Civil Rights, the Economic Research Service, the National Agricultural Statistics Service, the Agricultural Research Service, the National Institute of Food and Agriculture, the Animal and Plant Health Inspection Service, the Agricultural Marketing Service, and the Food Safety and Inspection Service. The bill also provides appropriations to USDA for farm production and conservation programs, including the Farm Production and Conservation Business Center, the Farm Service Agency, the Risk Management Agency, and the Natural Resources Conservation Service. The bill provides appropriations to the Federal Crop Insurance Corporation Fund and the Commodity Credit Corporation Fund. For USDA rural development programs, the bill includes appropriations for Rural Development Salaries and Expenses, the Rural Housing Service, the Rural Business-Cooperative Service, and the Rural Utilities Service. The bill provides appropriations to the Food and Nutrition Service for Child Nutrition Programs; the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC); the Supplemental Nutrition Assistance Program (SNAP); the Commodity Assistance Program; and Nutrition Programs Administration. The bill provides appropriations to the Foreign Agricultural Service for (1) Food for Peace Title II Grants, and (2) McGovern-Dole International Food for Education and Child Nutrition Program Grants. The bill also provides appropriations for (1) the Food and Drug Administration, and (2) the Farm Credit Administration. Additionally, the bill sets forth requirements and restrictions for using funds provided by this and other appropriations acts.

Farmland Security Act of 2022 This bill requires the Department of Agriculture (USDA) to submit to Congress an annual report on foreign investments in agricultural land in the United States, including a description of the impact that foreign ownership of agricultural land has on family farms, rural communities, and the domestic food supply. Conservation Opportunity and Voluntary Environment Resilience Program Act or the COVER Act This bill directs the Department of Agriculture to establish a Good Steward Cover Crop Program to provide producers additional premium subsidies when they plant cover crops. Additionally, the Federal Crop Insurance Corporation must carry out a pilot program under which a producer who uses innovative soil health practices may receive additional premium subsidies on multi-peril crop insurance.

Tribal Nutrition Improvement Act of 2022 This bill expands access to free and reduced school meals in tribal areas. Specifically, the bill makes a child who is an enrolled member (or who has one or more parents who are enrolled members) of an Indian tribe categorically eligible for free school breakfasts or lunches. Additionally, the bill allows the Department of Agriculture (USDA) to adjust reimbursement rates for breakfasts, lunches, suppers, and supplements served in Bureau-funded schools and elementary and secondary schools on or near an Indian reservation. The bill also directs USDA to establish a pilot program to award grants to 10 tribal entities for operating and implementing the National School Lunch Program, the School Breakfast Program, the Summer Food Service Program, and the Child and Adult Care Food Program in Bureau-funded schools and elementary and secondary schools on or near an Indian reservation.
