Tribal Nutrition Improvement Act of 2022

Tribal Nutrition Improvement Act of 2022 This bill expands access to free and reduced school meals in tribal areas. Specifically, the bill makes a child who is an enrolled member (or who has one or more parents who are enrolled members) of an Indian tribe categorically eligible for free school breakfasts or lunches. Additionally, the bill allows the Department of Agriculture (USDA) to adjust reimbursement rates for breakfasts, lunches, suppers, and supplements served in Bureau-funded schools and elementary and secondary schools on or near an Indian reservation. The bill also directs USDA to establish a pilot program to award grants to 10 tribal entities for operating and implementing the National School Lunch Program, the School Breakfast Program, the Summer Food Service Program, and the Child and Adult Care Food Program in Bureau-funded schools and elementary and secondary schools on or near an Indian reservation.

To amend the Agricultural Act of 2014 to provide emergency relief to producers of livestock with herds adversely affected by Mexican gray wolves, and for other purposes.

Housing Inspections Accountability Act

Specifically, such agencies (which include the Departments of Agriculture, Commerce, and Transportation, and the Environmental Protection Agency) must identity functions that duplicate the functions of other specified agencies; calculate the annual cost of such duplicative functions; and analyze solutions for eliminating such duplicative functions, including identifying which agency is best suited to have sole responsibility for such functions. Such agencies must jointly submit a consolidated report to Congress on the results.

Public Land Search and Rescue Act of 2022

Public Land Search and Rescue Act of 2022 This bill directs the Department of Justice (DOJ) to establish a program to allocate resources to remote search and rescue activities conducted on lands under the jurisdiction of the Department of Agriculture or the Department of the Interior. DOJ may award a grant under the program to a state or a political subdivision to (1) purchase equipment and gear necessary for remote search and rescue activities, (2) reimburse such an eligible recipient for the cost of maintenance and repair of remote search and rescue equipment owned or leased by the recipient, and (3) reimburse state and local agencies responsible for remote search and rescue activities. DOJ must prioritize an application from an eligible recipient who serves an area with a high ratio of visitors to residents. The federal share of assistance under the program shall be 75% of the cost of an eligible project.

Wholesale Produce Market Review Act

Wholesale Produce Market Review Act This bill directs the Department of Agriculture (USDA) to submit to Congress a report on supply chain shortfalls at (1) the five largest wholesale produce markets by annual sales and amount of goods moved for the preceding four calendar years, and (2) a representative sample of eight wholesale produce markets that are not among the largest wholesale produce markets. The report must contain (1) an analysis of the supply chain shortfalls in each wholesale produce market, including the state of repair of infrastructure; (2) a description of any actions USDA recommends be taken as a result of the analysis; (3) recommendations for wholesale produce market owners and operators, and state and local entities, to improve the identified supply chain shortfalls; and (4) proposals for legislative actions and funding needed to improve the supply chain shortfalls.

Further, the bill requires CFIUS to review certain agriculture-related transactions, including those related to biotechnology. The bill also prohibits persons who are acting on behalf of a prohibited country (i.e., China, Russia, Iran, or North Korea) from carrying out any merger, acquisition, or takeover that could result in foreign control of a U.S. agricultural company.

Stop Wrongs to Our Kids' Educational Meals (W.O.K.E.) Act of 2022 This bill repeals Executive Order 13988, titled Preventing and Combating Discrimination on the Basis of Gender Identity or Sexual Orientation , that directs federal agencies to review all policies that implement non-discrimination protections on the basis of sex and extend such protections to the categories of gender identity and sexual orientation. The bill also prohibits the Department of Agriculture from requiring state or local agencies, program operators, or sponsors that participate in the school meal programs to (1) investigate allegations of discrimination based on gender identity or sexual orientation, or (2) update non-discrimination policies and signage to include prohibitions against discrimination based on gender identity or sexual orientation.

Fairness for Farm Workers Act

Fairness for Farm Workers Act This bill extends overtime pay protections to agricultural workers. The bill requires employers, beginning in 2023, to compensate agricultural workers for hours worked in excess of their regular hours (i.e., 55 hours in 2023, 50 hours in 2024, 45 hours in 2025, and 40 hours in 2026) at not less than one and one-half times the employee's regular rate. For employers with 25 or fewer employees, the overtime pay requirements begin in 2026. These overtime pay requirements do not apply, as under current law, to employees who are the parent, spouse, child, or other member of the employer's immediate family. The bill also repeals the exemption from overtime pay requirements for employers in various agriculture-related industries, including certain small farms, irrigation projects, sugar processing, and cotton ginning and compressing.

Katimiîn and Ameekyáaraam Sacred Lands Act

Katimiîn and Ameekyáaraam Sacred Lands Act This bill takes approximately 1,031 acres of specified lands in Siskiyou and Humboldt Counties, California, into trust for the benefit of the Karuk Tribe. Land taken into trust may be used for traditional and customary uses for the benefit of the tribe. Additionally, the land taken into trust must allow for continued access by the Forest Service for managing the component of the National Wild and Scenic Rivers System that flows through the land. The Department of Agriculture must enter into a memorandum of understanding with the tribe to establish mutual goals for the protection and enhancement of the river values of such component. Further, the bill prohibits gaming on the land taken into trust.

Keep Kids Fed Act of 2022 This bill provides funding for and makes changes to school meal programs and the Child and Adult Care Food Program (CACFP). It also rescinds certain funds provided under the American Rescue Plan Act of 2021; the Consolidated Appropriations Act, 2021; and the Coronavirus Aid, Relief, and Economic Security Act (CARES Act). Specifically, the bill increases the reimbursement rate for school lunches by 40 cents and for school breakfasts by 15 cents for the school year beginning in July 2022. Further, the bill changes income eligibility for school meal programs for the school year beginning in July 2022. The bill extends the authority of the Department of Agriculture (USDA) to waive certain requirements for the school meal programs and the CACFP to address COVID-19, including by extending authority through September 30, 2022, for USDA to grant waivers related to summer food service programs. The bill authorizes USDA to establish a nationwide waiver of statutory and regulatory requirements under child nutrition programs for the 2022-2023 school year. Additionally, the bill increase the reimbursement rate for meals and snacks under the CACFP by 10 cents for the school year beginning in July 2022. Further, the bill increases the reimbursement of tier II family or group day care homes to tier I amounts for the 2022-2023 school year. The bill rescinds certain funding provided to USDA, the Department of Education, and the Small Business Administration.

Let's Get to Work Act of 2022 This bill modifies and expands work requirements under the Supplemental Nutrition Assistance Program (SNAP), including by repealing the temporary suspension of work requirements due to COVID-19 that allowed participants who would have lost eligibility due to such requirements to continue to receive SNAP benefits. The bill also establishes work requirements for families residing in public housing and participating in low-income housing assistance programs by applying SNAP work requirements to such programs.

Advancing Tribal Parity on Public Land Act This bill addresses tribal interests in the disposal and management of public land. Specifically, the bill prohibits the federal government from disposing of public land or National Forest System land unless the Department of the Interior or the Department of Agriculture (USDA) determines, through consultation with any interested Indian tribe, that such disposal would not impact the rights and interests of any interested tribe and would not impair access to a reservation. Interested Indian tribe means an Indian tribe with (1) historic, precontact, cultural, or religious connection to a cultural site located on the tract of public land; (2) a former reservation located on the tract of public land; or (3) treaty rights or other reserved rights associated with the tract of public land. Interior and USDA must, prior to conducting a sale of a tract of public land, notify all tribes of the availability of land for sale. Further, Interior and USDA must sell the tract of land to an interested Indian tribe that submits a bid at fair market value. Land acquired by an interested tribe shall be taken into trust by Interior for the benefit of the tribe. Additionally, the bill revises various public land provisions, including to (1) add the interests of tribes to the list of considerations for land exchanges, and (2) authorize tribes to acquire land for recreational and other public purposes. The bill also requires each public land advisory board to include at least one representative of an interested Indian tribe.

Fire Recovery Improvement Act

Fire Recovery Improvement Act This bill authorizes the Natural Resources Conservation Service of the Department of Agriculture to address post-wildfire flooding in certain communities adjacent to or downstream from Forest System land. Specifically, the service may carry out watershed protection and flood prevention measures to address the effects of flooding in communities that are (1) located on land not under the jurisdiction of the Forest Service, and (2) threatened by post-wildfire flooding due to a post-wildfire burn scar on adjacent or upstream Forest Service lands. Upon receiving an independent hydraulic study that shows that severe and repetitive flooding is likely in such communities, the service may also carry out activities to mitigate potential effects of that flooding.

FORESTS Act of 2022

Fire Department Repayment Act of 2022

Fire Department Repayment Act of 2022 This bill requires standard operating procedures for reciprocal fire suppression cost share agreements. The Departments of Agriculture, the Interior, Homeland Security, and Defense shall establish standard operating procedures relating to fire suppression cost share agreements established under the Reciprocal Fire Protection Act; and with respect to each agreement in operation on one year after enactment of this bill, review each agreement and modify it as necessary to comply with the standard operating procedures. The standard operating procedures shall include a requirement that each fire suppression cost share agreement be aligned with each of the cooperative fire protection agreements applicable to the entity subject to such fire suppression cost share agreement. The standard operating procedures shall also include a requirement that the departments, to the maximum extent practicable, complete reviews, including second-level reviews of a fire suppression cost share agreement, as soon as practicable after a wildfire related to the area covered by such cost share agreement is contained; and a requirement that in completing such reviews, the department concerned consults with state and local fire suppression organizations.

Healthy Drinking Water Affordability Act or the Healthy H2O Act This bill directs the Department of Agriculture to establish a clean drinking water program to provide grants for water quality testing and for the purchase, installation, and maintenance of point-of use and point-of-entry water filtration systems that remove or significantly reduce contaminants in drinking water. Grants may be given to rural end users (such as homeowners), nonprofit organizations, and government entities.

Protecting Infants from Formula Shortages Act of 2022 This bill imposes requirements on manufacturers of infant formula and medical foods for individuals with inborn errors of metabolism. A manufacturer of such a food must notify the Food and Drug Administration (FDA) of any circumstance that is likely to lead to a meaningful disruption of the U.S. supply of the food, including a discontinuance or interruption of manufacturing. The manufacturer must submit the notification at least six months prior to the cause of the disruption or, if that is not possible, as soon as practicable. The FDA must provide the Department of Agriculture and appropriate organizations information about the cause of the disruption. The FDA must inform a person (an individual or entity) of their failure to comply with these notification requirements. If the failure continues for a certain time period, the person shall be subject to fines, imprisonment, or both. During a public health emergency, the FDA may impose additional conditions for such notifications and designate additional categories of food that are subject to the notification requirements. The bill also requires each manufacturer of such a food to develop and maintain a redundancy risk management plan that identifies and evaluates risks for each manufacturing establishment for the food.

Safe at Home Act of 2022 This bill requires the Department of Housing and Urban Development and the Department of Agriculture to issue regulations concerning inspections of federally assisted housing. In particular, the departments must jointly (1) review state and federal requirements for inspecting housing to ensure safety, habitability, and other aspects of housing quality; (2) identify the most stringent requirements; and (3) issue regulations to apply the identified requirements to certain housing programs administered by the departments.
