Secure Artificial Intelligence Act of 2024 or the Secure A.I. Act of 2024 This bill directs federal agencies to establish mechanisms to manage security and safety risks related to the use of artificial intelligence (AI). Specifically, the bill directs the National Institute of Standards and Technology (NIST) and the Cybersecurity and Infrastructure Agency (CISA) to develop a database to track AI-related safety and security incidents. The agencies must enable individuals and entities to confidentially share information about incidents that pose an increased risk of harm to people or property or unauthorized access to and manipulation of AI platforms. In determining which incidents warrant inclusion in the database, NIST must prioritize those that involve critical infrastructure or widely used AI systems, and incidents that could significantly impact the American people or economy. Employers may not retaliate against employees for their involvement in reporting an AI incident or any investigation that follows. The bill also directs the National Security Agency to establish an AI Security Center to foster AI security research and develop guidance for the prevention and mitigation of counter-AI. Under the bill, counter-AI means unauthorized efforts to extract information from or manipulate an AI system. Finally, NIST and CISA are directed to incorporate AI vulnerabilities into specified federal databases. NIST must convene a multi-stakeholder group to evaluate existing voluntary reporting standards for AI security vulnerabilities and CISA must convene a group to consider best practices for addressing AI-related risks to the supply chain.

Federal Improvement in Technology Procurement Act or the FIT Procurement Act This bill addresses various issues related to federal procurement policy and the federal acquisition workforce. For example, the bill requires the Federal Acquisition Institute (FAI) to establish a pilot program to consider incorporating experiential learning into the Federal Credentials Program, the Federal Acquisition Certification-Contracting Officer’s Representative Program, and the Federal Acquisition Certification for Program and Project Managers Program; FAI to provide information and communications technology acquisition training for certain acquisition workforce members; the General Services Administration to assume responsibility from the Office of Management and Budget for developing and implementing an artificial intelligence training program for certain acquisition workforce members; the Office of Federal Procurement Policy (OFPP) to issue guidance to increase competition among eligible firms, including specifying means to validate non-government past performance references and using evaluation methods other than past performance when appropriate; and the OFPP to implement regulatory and other non-legislative actions, based on input from the Chief Acquisition Officers Council and the public, to remove barriers to entry for small businesses seeking to participate in federal government procurement. The bill also increases the simplified acquisition threshold from $250,000 to $500,000 and the micro purchase threshold from $10,000 to $25,000. (The federal government uses less complex procedures for the purchase of property and services valued below the simplified acquisition threshold. Purchases below the micro purchase threshold generally do not require soliciting competitive quotations if the contracting officer considers the price to be reasonable.)

Producing Advanced Technologies for Homeland Security Act or the PATHS Act This bill extends through FY2027 the other transaction authority (OTA) of the Department of Homeland Security (DHS) to enter into other transactions to carry out research and prototype projects when the use of contracts, grants, and cooperative agreements is not feasible or appropriate. (Agreements under OTA are exempt from the Federal Acquisition Regulations.) DHS must notify Congress within 72 hours of using or extending OTA for research projects related to artificial intelligence technology and must offer to brief Congress on the rationale for such a decision. The bill also lowers from $4 million to $1 million the minimum value of contract awards that DHS must publicly report on its website.

Department of Energy AI Act This bill establishes programs related to artificial intelligence (AI) research and security at the Department of Energy (DOE) and provides statutory authority for certain related, existing programs. Specifically, the bill provides statutory authority for DOE’s Frontiers in AI for Science, Security, and Technology program, through which DOE must research advanced AI capabilities for DOE missions. As part of the program, DOE must hire and train at least 500 new researchers. DOE must also carry out a program to evaluate and mitigate security risks associated with AI use. Further, DOE must select national laboratories at which to establish at least eight multidisciplinary AI research and development centers. DOE must establish a program to improve federal permitting processes for energy-related projects, including critical materials projects using AI. Further, DOE must assess and report on the growth of computing data centers, the associated electrical power load, and related risks and national security impacts. DOE must also assess counterintelligence risks posed by certain individuals who have requested access to national laboratories. Specifically, the assessment must address individuals from certain countries of risk who are not employed by DOE or a national laboratory and who have requested access to the premises, information, or technology of a national laboratory. The bill also provides statutory authority for DOE’s Office of Critical and Emerging Technologies. Finally, the Federal Energy Regulatory Commission must initiate a rulemaking related to the use of computing technologies by public utility transmission providers for interconnection request queue management.
