National Security Council Modernization Act of 2021 This bill expands the scope and modifies the membership of the National Security Council. Specifically, the council must advise the President with respect to the integration of biodefense policies in addition to the currently required policies (e.g., domestic policy). The bill adds to the membership of the council the Secretary of Health and Human Services, the Director of National Intelligence, and the Chairman of the Joint Chiefs of Staff.

Recognizing the victims of the Port Chicago explosion of July 17, 1944, the 77th anniversary of the greatest homeland loss of life of World War II, and exonerating the 50 African-American sailors unjustly court-martialed by the Navy.

This concurrent resolution recognizes the service and sacrifice of those who served and perished in California at Port Chicago Naval Magazine during World War II. The concurrent resolution also exonerates the 50 Port Chicago sailors convicted of the charge of mutiny against the United States and all other charges brought against them after the July 17, 1944, explosion that killed 320. It upgrades the general and summary discharges of the Port Chicago sailors to honorable discharges.

Veterans Entrepreneurship Act of 2021

Veterans Entrepreneurship Act of 2021 This bill requires the Small Business Administration to carry out a pilot program assessing the feasibility and advisability of making grants to eligible veterans to start or acquire a small business concern, a franchise business enterprise, or any other appropriate category of business enterprise. Eligible veterans are those veterans or members of the Armed Forces who (1) are currently retiring or separating from the Armed Forces or have been honorably discharged from active duty, (2) have completed a specified minimum period of active duty, and (3) are entitled to certain educational assistance programs. Grant recipients must complete an entrepreneurship readiness program and prepare a business plan, and they may use grant funds for purposes such as purchasing goods or services, funding a project that is directed toward economic development objectives, and acquiring a business enterprise.

Department of Defense Appropriations Act, 2022

Department of Defense Appropriations Act, 2022 This bill provides FY2022 appropriations to the Department of Defense (DOD) for military activities. (The bill excludes military construction, military family housing, civil works projects of the Army Corps of Engineers, and nuclear warheads, which are all considered in other appropriations bills.) Within the DOD budget, the bill provides appropriations for Military Personnel; Operation and Maintenance; Procurement; Research, Development, Test and Evaluation; and Revolving and Management Funds. The bill provides appropriations for Other Department of Defense Programs, including the Defense Health Program, Chemical Agents and Munitions Destruction, Drug Interdiction and Counter-Drug Activities, and the Office of the Inspector General. In addition, the bill provides appropriations for Related Agencies, including (1) the Central Intelligence Agency Retirement and Disability System Fund, and (2) the Intelligence Community Management Account. The bill also sets forth requirements and restrictions for using funds provided by this and other appropriations acts.

Department of Defense Climate Resiliency and Readiness Act

Department of Defense Climate Resiliency and Readiness Act This bill requires the Department of Defense (DOD) to address climate resiliency and energy and resource efficiency. Each DOD contract for the procurement of property or services entered into on or after October 1, 2021, must include specified information related to energy consumption and energy sources. When deciding whether to enter into a contract, DOD must consider whether the contractor verifiably produces as much renewable energy as the total energy it consumes and whether there is any order against the contractor for a violation of an environmental law or regulation. Among other elements, the bill requires DOD to achieve aggregate net zero energy in use of energy by non-operational sources by December 31, 2031; DOD to give preference to contractors and small businesses that use green manufacturing technology; DOD to administer the Energy and Climate Resiliency Fund established by the bill; DOD and the military departments to consider climate change risks when making strategic decisions related to any military installation; DOD and other relevant federal agencies to incorporate climate change into the National Defense Strategy, the National Military Strategy, and DOD's operational plans; and DOD to conduct a program of research, development, and demonstration of hybrid microgrid systems and electric grid energy storage. The Government Accountability Office must report on the individual and aggregate uses of DOD's authority to give preference to contractors that use green manufacturing technology and small businesses that verifiably use green manufacturing technology or operate with net zero energy.

Candidates Afforded Dignity, Equality and Training (CADET) Act of 2021

Candidates Afforded Dignity, Equality and Training (CADET) Act of 2021 This bill requires the Departments of Defense, Homeland Security, and Transportation to prescribe regulations ensuring that the parental guardianship rights of cadets and midshipmen attending military service academies are protected consistent with individual and academic responsibilities. Cadets and midshipmen with dependents must establish a family care plan with appropriate academy leadership. Pregnant cadets and midshipmen must be provided with, at minimum, the options to (1) take leave from the military service academy for up to one year, (2) fully release from the military service academy and any related obligations, and (3) enlist in active-duty service. Males fathering a child while enrolled at a military service academy must not be required to give up parental rights and must not acquire any benefits or leave considerations as a result of fathering a child, with certain exceptions (e.g., leave to attend the birth).

Military Housing Oversight and Service Member Protection Act

Military Housing Oversight and Service Member Protection Act This bill modifies various provisions related to the contracting and provision of privatized military housing. Among other requirements, DOD must establish formal written requirements and guidance for entering into and renewing contracts related to the acquisition and improvement of military housing, employ a sufficient number of independent housing inspectors with appropriate certifications to conduct inspections without notice to landlords, provide oversight to ensure that maintenance for such housing units is completed in accordance with applicable health and building codes, publish the financial details of each contract for the management of housing units, and ensure all military medical treatment facilities screen members of the armed forces or their family members who have resided in unsafe housing units. The bill also extends legal protections afforded to tenants located in a jurisdiction surrounding a military instillation to tenants residing in housing located on a military installation, establishes a presumption of service-connection for certain conditions that are determined to be associated with residing in privatized military housing, provides Department of Veterans Affairs health care for conditions associated with residing in privatized military housing to a family member of a veteran (including a child in utero) during a specified time period, and prohibits specified individuals from owning interest in an entity that owns or manages privatized military housing. DOD is authorized to modify any contract entered into regarding privatized military housing to conform to changes made by this bill.

A bill to direct the Joint Committee of Congress on the Library to replace the bust of Roger Brooke Taney in the Old Supreme Court Chamber of the Capitol with a bust of Thurgood Marshall to be obtained by the Joint Committee of Congress on the Library and to remove certain statues from areas of the Capitol which are accessible to the public, to remove all statues of individuals who voluntarily served the Confederate States of America from display in the Capitol, and for other purposes.

This bill provides for the removal of certain statues and busts from display in the Capitol. The bill directs the Joint Committee on the Library to remove the bust of Roger Brooke Taney in the Old Supreme Court chamber of the Capitol and replace it with a bust of Thurgood Marshall. The committee must remove the statues of Charles Brantley Aycock, John Caldwell Calhoun, and James Paul Clarke and the bust of John Cabell Breckinridge from areas of the Capitol accessible to the public. The Architect of the Capitol (AOC) must store the statues and bust until it arranges their return to the states that provided them. Additionally, the bill prohibits the display of statues in National Statuary Hall of persons who served as officers or voluntarily with the Confederate States of America or of the military forces or government of a state while it was in rebellion against the United States; requires the AOC to identify such statues and arrange for their transfer and delivery from the Capitol to the Smithsonian Institution; requires the Smithsonian to follow its preexisting policies and procedures regarding the storage and display of such transferred statues; requires each statue to be returned to the providing state, including its ownership, if the state requests and agrees to pay any transportation-related costs; and permits a state that has a statue removed to replace the statue.

Access to Infertility Treatment and Care Act

Access to Infertility Treatment and Care Act This bill requires private health insurance plans to cover (1) specified infertility treatments (e.g., in vitro fertilization), if the plan also covers obstetrical services; and (2) fertility preservation services for individuals who undergo medically necessary treatment that may cause impairment of fertility. Private health insurance plans must apply cost sharing for such services that does not exceed the amount for similar services covered by the plan. Further, plans are prohibited from (1) providing incentives for plan holders to forego infertility treatment, or (2) reducing the reimbursement rate to providers of such treatments. The bill also extends infertility treatment and fertility preservation coverage to Medicaid enrollees, federal employees, members of the military, and veterans.

Preventing Terrorism from Hitting America's Streets Act This bill requires the National Counterterrorism Center to report to Congress an assessment of any increased risk of terrorism in the United States due to the withdrawal of U.S. Armed Forces from Afghanistan, including the potential for Afghanistan to be used as a base of operations for international terrorism. The report shall also describe illicit activities carried out along the U.S. southern border by non-state actors or adversarial countries.

SHIELD Act

Securing the Homeland from International Entrants with Life-threatening Diseases Act or the SHIELD Act This bill suspends for one year the admission and parole into the United States of certain categories of individuals who are from or were recently in a country that fails to meet certain criteria related to COVID-19. This restriction applies to certain individuals entering the United States from Mexico or Canada through a port of entry or U.S. Border Patrol station and (1) whose country of origin has not been categorized by the Centers for Disease Control and Prevention as a low-risk country for COVID-19, or (2) who was in such a country at any time in the 30 days before arriving in the United States. The bill exempts certain individuals from this restriction, including U.S. citizens and lawful permanent residents, members of the Armed Forces, and persons from a foreign country who arrive at a designated port of entry with valid travel documents. The Department of Homeland Security shall transport barred individuals to a foreign location, such as an individual's country of origin, to the extent practicable.

BEST for Vets Act of 2021

Better Examiner Standards and Transparency for Veterans Act of 2021 or the BEST for Vets Act of 2021 This bill provides that only health care professionals who are licensed and not barred from practice may furnish medical disability examinations under the Department of Veterans Affairs pilot program related to using contract physicians for disability examinations. Health care professionals include physicians, physician assistants, nurse practitioners, audiologists, and psychologists.

To extend the pilot program on partnership agreements to construct new facilities for the Department of Veterans Affairs, and for other purposes.

Reducing Barriers for Military Voters Act

Reducing Barriers for Military Voters Act This bill requires the Department of Defense (DOD) to develop a plan for providing end-to-end electronic voting services (e.g., services for registering to vote and returning a ballot) in participating states for absent uniformed service members who are deployed or mobilized in locations with limited or no postal service. Specifically, DOD must develop the plan by consulting with state and local election officials. Further, the plan must include (1) methods to ensure that voters have the opportunity to verify that their ballots are received and tabulated, (2) methods to generate a verifiable and auditable vote trail, and (3) an assessment of whether commercially available technologies may be used to carry out the plan. DOD must implement the plan for a trial group of voters in participating states for the 2024 federal elections. The plan must be implemented for all voters in participating states for the 2026 federal elections and subsequent years.

Improving Worker Safety in Contracting Act of 2021

Improving Worker Safety in Contracting Act of 2021 This bill requires the Department of Defense (DOD) to develop and provide annual training and guidance to acquisition officials, contracting officers, and current and potential contractors. Such training must include information regarding (1) the authorities and requirements of DOD officials to consider workplace safety and health information in the pre-award, award, and contract performance phases of the contracting process; and (2) the availability of relevant contractor safety information on the Occupational Health and Safety Administration website. The Government Accountability Office must submit a report to DOD and Congress on the health and safety records of DOD contractors. DOD must develop a system for assigning safety performance ratings for its contracts in industries that have relatively high rates of occupational injuries (e.g., manufacturing). Beginning in FY2023, DOD contracting officials must (1) assess contractor safety performance at the time of contract completion in industries that have relatively high rates of occupational injuries, and (2) consider information about prospective contractors' records of safety performance as a factor in awarding contracts in industries that have relatively high rates of occupational injuries.

Repatriate Our Patriots Act

Repatriate Our Patriots Act This bill protects certain veterans of the Armed Forces from removal from the United States and provides such veterans with an expedited procedure for naturalization. The bill applies to special veterans , defined as persons who served in the active Armed Forces who were (1) honorably discharged or released; (2) not convicted of various crimes, including voluntary manslaughter, murder, rape, or terrorism; and (3) not a child abuser or pedophile. Special veterans shall not be removed from the United States, and the Department of Homeland Security (DHS) shall cancel any pending removal proceedings or orders against any such veterans. DHS shall establish a program to permit such veterans who were already removed from the United States to return to as an alien with permanent residence status. Special veterans shall be naturalized upon filing an application, paying the relevant fees, and taking an oath of allegiance. DHS shall take steps to ensure such naturalization applications are pending for no longer than 90 days.

This bill bars individuals affiliated with the Chinese military from entering the United States on visas for students (F visa) or work-and-study exchange (J visa). The President shall publish a list identifying research, engineering, and scientific institutions affiliated with or funded by China's People's Liberation Army. Aliens who are or were previously employed, sponsored, or funded by any institution on the list shall be subject to the bar. When a Chinese national applies for an F or J visa for an academic field related to an item on the Commerce Control List (a list of items subject to export controls), the consular officer handling the application shall request a special background check on the applicant.

Chaplains Memorial Preservation Act

Chaplains Memorial Preservation Act This bill authorizes the National Conference on Ministry to the Armed Forces (NCMAF) to update and make corrections to certain memorials in Arlington National Cemetery in Virginia. Specifically, NCMAF may update the memorial to Protestant chaplains with a granite, marble or other stone base to host the bronze plaque of the memorial; add another plaque to such base that includes the name of each chaplain who died while on active duty since the original memorial was placed; make updates and corrections to the memorials to Catholic chaplains and Jewish chaplains as needed; and make other updates as needed. Additionally, NCMAF is authorized to verify the names of chaplains with their respective military branch for memorialization in Arlington National Cemetery.

The bill provides appropriations to the Department of Defense (DOD) for military construction for the Army; the Navy and Marine Corps; the Air Force; Defense-wide agencies and activities; the Army and Air National Guard; and the Army, Navy, and Air Force Reserves. The bill also provides appropriations to DOD for the North Atlantic Treaty Organization (NATO) Security Investment Program; the Base Closure Account; Construction and Operation and Maintenance of Family Housing for the Army, the Navy and Marine Corps, the Air Force, and Defense-wide agencies and activities; the Family Housing Improvement Fund; and the Military Unaccompanied Housing Improvement Fund. Within the VA budget, the bill provides appropriations for the Veterans Benefits Administration, the Veterans Health Administration, the National Cemetery Administration, and Departmental Administration. The bill provides appropriations for related agencies and programs, including the American Battle Monuments Commission, the U.S. Court of Appeals for Veterans Claims, Cemeterial Expenses of the Army, and the Armed Forces Retirement Home. The bill also sets forth requirements and restrictions for using funds provided by this and other appropriations acts.

Separation of Powers Restoration Act

Separation of Powers Restoration Act This bill restricts the scope of presidential orders. A presidential order means any executive order, presidential proclamation, or presidential directive, as well as any other presidential or executive action issued under the authority of the President or other federal officer or employee that purports to effect standards and norms outside of the executive branch. Specifically, the bill limits the application of a presidential order to the executive branch unless the order is issued pursuant to certain presidential powers under the Constitution or statutory authority. The bill further specifies that the President may not issue an order under a ratified or unratified treaty (or bilateral or multilateral agreement) if the treaty (1) violates constitutional protections for rights retained by the people or powers reserved to the states, or (2) delegates power to a foreign government or international body absent constitutional authority. When issuing a presidential order, the President must cite to the applicable constitutional or statutory authority. A presidential order without this citation is invalid. Members of Congress, nonfederal government officials, and aggrieved persons may challenge an order's validity on the basis that it exceeds the President's constitutional or statutory authority. The bill also repeals the War Powers Resolution (a joint resolution that outlines procedures for Congress and the President to participate in decisions to send Armed Forces into hostilities) and terminates emergency authorities available to the President and other federal officers and employees for responding to a declared national emergency.

Fair COLA for Seniors Act of 2021

Military PFAS Testing Disclosure Act

Military PFAS Testing Disclosure Act This bill requires the Department of Defense (DOD) to immediately publicly disclose the results of any testing for perfluoroalkyl or polyfluoroalkyl substances, commonly referred to as PFAS, conducted on or at specified sites (i.e., areas surrounding DOD military installations in the United States, formerly used defense sites, and state-owned facilities of the National Guard). DOD must also disclose the expected timing and location of any planned testing for PFAS conducted at the specified sites. DOD may satisfy the disclosure requirements by publishing the information, data sets, and results relating to the testing on a publicly available DOD website or in the Federal Register. Prior to conducting any testing for PFAS, DOD must provide notice in writing to (1) the managers of the public water system and the publicly owned treatment works serving the areas located immediately adjacent to the military installation being tested, (2) the municipal government serving the areas located immediately adjacent to the military installation being tested, and (3) all Restoration Advisory Board members for the military installation where the testing is to occur. DOD must test for any PFAS for which a method of measurement in drinking water has been validated by the Environmental Protection Agency.

PFAS Exposure Assessment and Documentation Act This bill requires the Department of Defense (DOD) to include in various health evaluations an assessment of whether a member of the Armed Forces has been exposed to perfluoroalkyl or polyfluoroalkyl substances, commonly referred to as PFAS. Specifically, the bill requires DOD to ensure that any periodic health assessment, physical assessment for recently separated members, pre-deployment medical examination, post-deployment medical examination, and post-deployment health reassessment provided to a member of the Armed Forces includes an evaluation of whether the member has been exposed to PFAS or was based or stationed at a military installation with a known or suspected release of PFAS during the period the member was there. If any of the evaluations result in a positive determination of potential exposure to PFAS, DOD must provide blood testing during the evaluation to be included in the member's health record. DOD must pay for blood testing to determine and document potential exposure to PFAS for former members of the Armed Forces or family members of such members who lived at a location identified by DOD as having a known or suspected PFAS release during the time the individuals lived there. DOD must share results of the evaluations with the Department of Veterans Affairs and establish a registry of members of the Armed Forces who have been exposed to, or suspected to have been exposed to, PFAS. Members may elect to be excluded from the registry.

Supporting Disabled National Guardsmen Act This bill provides disability pay and medical care for members of the National Guard who were physically disabled as a result of state active duty. State active duty includes training or other duty in service to the governor of a state for which the member is not entitled to federal pay, but excludes required drills and field exercises. The bill expands eligibility for Department of Defense retired pay to such members who are physically disabled as a result of state active duty after September 23, 1996. Such pay must be reduced if it is determined to duplicate any other federal or state benefit to such members based on disability. The bill also makes such members eligible for hospital care and medical services from the Department of Veterans Affairs (VA) to treat the disability and any illness or condition arising from the disability. The VA may provide reimbursement for hospital care or medical services provided to such members only after a member or the provider of care has exhausted (without success) all claims and remedies reasonably available against a third party.

ICBM Act

Investing in Commonsense Ballistic Missiles Act of 2021 or the ICBM Act This bill addresses the transfer and use of funds intended for defense programs. Specifically, the bill prohibits defense funds in FY2022-FY2031 from being obligated or expended for the ground-based strategic deterrent program or the W87-1 warhead modification program. The Department of Defense (DOD) must transfer the unobligated balances intended for its ground-based strategic deterrent program to the Department of the Air Force. DOD must carry out a life extension program of Minuteman III intercontinental ballistic missiles to extend the life of such missiles to 2040. DOD must ensure the program incorporates new and necessary technologies that could also be incorporated in the future ground-based strategic deterrent program. Additionally, the program must use nondestructive testing methods and technologies similar to those used by the Navy for Trident II D5 submarine launched ballistic missiles to reduce destructive testing.

Audit the Pentagon Act of 2021

Audit the Pentagon Act of 2021 This bill requires defense spending reductions during any fiscal year after FY2022 where the Comptroller of the Department of Defense (DOD) fails to certify that a department, agency, or other element of DOD has achieved an unqualified opinion on its full financial statements. The amount of any reductions must be deposited in the General Fund of the Department of the Treasury and must be available for deficit reduction. The bill excludes from any reductions accounts related to military personnel, reserve personnel, National Guard personnel, and the Defense Health Program. The President may waive a reduction if the President certifies that a reduction would negatively affect (1) national security or members of the Armed Forces who are deployed in combat zones, or (2) the Defense Health Program account.
