Ending Qualified Immunity Act This bill eliminates the defense of qualified immunity in certain civil actions for deprivation of rights. Qualified immunity is a judicially created doctrine that protects government officials from being held personally liable for constitutional violations. The bill provides that, under the statute allowing a civil action alleging deprivation of rights under color of state law, it shall not be a defense to any such action that, at the time of the deprivation, (1) the defendant was acting in good faith or believed that his or her conduct was lawful; (2) the rights, privileges, or immunities secured by the Constitution and laws were not clearly established; or (3) the state of the law was such that the defendant could not reasonably have been expected to know whether his or her conduct was lawful.

Do No Harm Act

Do No Harm Act This bill prohibits the application of the Religious Freedom Restoration Act of 1993 (RFRA) to specified federal laws or the implementation of such laws. Currently, RFRA prohibits the government from substantially burdening a person's exercise of religion even if the burden results from a rule of general applicability, except in furtherance of a compelling governmental interest when using the least restrictive means. Under the bill, RFRA is inapplicable to laws or the implementation of laws that protect against discrimination or require the promotion of equal opportunity (e.g., the Civil Rights Act of 1964); require employers to provide wages, other compensation, or benefits, including leave; protect collective activity in the workplace; protect against child labor, abuse, or exploitation; or provide for access to, information about, referrals for, provision of, or coverage for any health care item or service. The bill prevents RFRA from being used to deny (1) goods or services the government has agreed to provide to a beneficiary of or participant in a program or activity funded by a government contract, grant, agreement, or other award; or (2) a person's full and equal enjoyment of a government-provided good, service, benefit, facility, privilege, advantage, or accommodation. In order for a person to assert a RFRA claim or defense in a judicial proceeding, the government must be a party to the proceeding.

Veterans Medical Marijuana Safe Harbor Act.

Veterans Medical Marijuana Safe Harbor Act This bill authorizes activities related to medical marijuana use by veterans and provides for research on medical marijuana use by veterans. Specifically, the bill authorizes (1) a veteran to use, possess, or transport medical marijuana in accordance with applicable state or Native American tribal law; (2) a Department of Veterans Affairs (VA) physician to discuss with a veteran the use of medical marijuana as a treatment if the physician is in a state or on tribal land that authorizes such treatment; or (3) a VA physician to recommend, complete forms for, or register veterans for participation in a medical marijuana treatment program in accordance with applicable state or tribal law. These authorizations expire after five years. The bill also requires the VA to report on (1) the use of medical marijuana by veterans to manage pain and to treat diseases and disorders (e.g., post-traumatic stress disorder); and (2) the relationship between state-approved medical marijuana treatment programs, program access, and opioid use and misuse reduction.

Specifically, the bill waives the requirement that a veteran must have received VA care within the 24-month period preceding the furnishing of emergency treatment if the veteran receives such emergency treatment within the 60-day period following their enrollment in the VA health care system.

Pay Our Coast Guard Parity Act of 2023

Pay Our Coast Guard Parity Act of 2023 This bill provides continuing appropriations to the Coast Guard for pay and benefits when there is a Coast Guard-specific funding lapse. Under the bill, a  Coast Guard-specific funding lapse occurs when (1) a bill providing appropriations for the Coast Guard for a fiscal year has not been enacted before the beginning of that fiscal year, and no joint resolution providing continuing appropriations for the Coast Guard is in effect; and (2) a bill providing appropriations for the Department of Defense (DOD) for the fiscal year has been enacted before the beginning of the fiscal year, or a joint resolution providing continuing appropriation for DOD is in effect.  If a Coast Guard-specific funding lapse occurs, the bill provides appropriations to the Coast Guard for pay and allowances for military members of the Coast Guard who perform active service or inactive-duty training; pay and benefits for certain civilian employees and contract employees; the payment of a death gratuity; payments for travel related to funerals, the dignified transfer of remains, and unit memorial services; and the temporary continuation of the basic allowance for housing for dependents of members of the Coast Guard dying on active duty. The bill generally provides the appropriations to the Coast Guard until the earlier of the enactment of specified Coast Guard appropriations legislation, the termination of the availability of appropriations for DOD, or two weeks after the beginning of the Coast Guard-specific funding lapse.

This joint resolution proposes a constitutional amendment prohibiting total outlays for a fiscal year from exceeding total receipts for that fiscal year unless Congress authorizes the excess by a three-fifths roll call vote of each chamber. The prohibition excludes outlays for repayment of debt principal and receipts derived from borrowing. The amendment requires a three-fifths roll call vote of each chamber to increase the public debt limit. It prohibits a bill to increase revenue from becoming law unless it has been approved by a majority roll call vote of each chamber. The amendment also requires the President to submit an annual budget in which total outlays do not exceed total receipts. Congress may waive these requirements due to a declaration of war or a military conflict that causes an imminent and serious military threat to national security.

China Technology Transfer Control Act of 2023 This bill controls exports of certain national interest technology and intellectual property to China. Specifically, covered technology or intellectual property includes items that (1) would contribute significantly to the Chinese military to the detriment of U.S. national security, (2) are included in a designated list of product components compiled by the U.S. Trade Representative (USTR), or (3) are used by China to violate human rights or religious liberties. The President must control exports to China of any covered technology or intellectual property. Further, the President must sanction (1) a foreign person who sells to China or purchases from China any covered item, and (2) a Chinese person who knowingly uses a covered item provided to them in violation of U.S. export control law. In addition to a specified list of industries subject to the bill, the USTR must identify certain products from China that either receive designated support from the Chinese government or are used by China to violate human rights or religious liberties.

This bill establishes a pilot program for deploying economic response teams that provide emergency technical assistance and support to a partner country subjected to the threat or use of coercive economic measures by a U.S. adversary. These teams also play a liaison role between the legitimate government of a partner country and the U.S. government. To deploy a team, the President must declare, and notify Congress of, a coercive economic emergency (i.e., an unusual and extraordinary economic coercive threat to a partner country made by a U.S. adversary). The initial deployment may last for up to 180 days; the President may extend a deployment by submitting to Congress a justification for the extension in the interest of national security. The pilot program shall terminate on December 31, 2026.

The registry is for individuals who may have been exposed to toxic airborne chemicals and fumes caused by open burn pits (areas used for burning solid waste in open air without equipment) while deployed in certain locations (e.g., Afghanistan or Iraq). Specifically, the bill authorizes a designee of a registered individual or an immediate family member to update the registry with the cause of death of the individual.

The bill also requires the Department of the Treasury to submit a sanctions strategy that could be used in response to any coercive action by China, including a Chinese invasion of Taiwan, to (1) limit the ability of China's military to acquire petroleum and military materiel, (2) diminish the ability of the Chinese industrial base to replenish defense articles, and (3) inhibit China's ability to evade sanctions. The strategy must identify specific sanctions-related tools that may be effective in responding to coercive action. The Department of Commerce must submit a report that (1) identifies critical sectors of the U.S. economy that are strategic vulnerabilities that could be exploited by the Chinese Communist Party because the sector in question relies on Chinese trade or inputs, and (2) makes recommendations to reduce such vulnerabilities.

Electronic Health Record Program Restructure, Enhance, Strengthen, and Empower Technology Act of 2023 or the EHR Program RESET Act of 2023 This bill establishes within the Veterans Health Administration a program to modernize the electronic health record and other relevant health information technology systems of the Department of Veterans Affairs (VA). The bill also establishes the Electronic Health Record and Health Information Technology Modernization Program Management Office and a position of Deputy Chief Information Officer for Electronic Health Record and Health Information Technology to implement the program. The VA must exceed or meet certain standards at its facilities that are using the Oracle Cerner product before it may initiate new deployments of the product. The bill requires additional information to be included in the quarterly updates on the Electronic Health Record Modernization Program, such as data on retention, morale, and turnover at sites using the new electronic health record. Within 275 days after the enactment of this bill, the VA must terminate all of its contracts with Oracle Cerner for training and change management related to electronic health record modernization and cease to issue task orders for such activities from Oracle Cerner or its subcontractors. The VA must designate one senior official (GS-15 or higher) as the lead negotiator on all current and future contracts relating to the new electronic health record. The Chief Acquisition Officer of the VA must contract with an entity to independently verify and validate the modernization efforts of certain VA programs (e.g., the Electronic Health Record Modernization Program).

Servicemembers and Veterans Empowerment and Support Act of 2023 This bill modifies and implements policies and procedures related to Department of Veterans Affairs (VA) health care and benefits for veterans who have experienced military sexual trauma (MST), which is generally defined as physical assault of a sexual nature, battery of a sexual nature, or sexual harassment that occurred while the veteran was serving in the military. In the case of any veteran who claims that a covered mental health condition (e.g., post-traumatic stress disorder) based on MST was incurred or aggravated by active service, the VA must consider (1) a diagnosis of the condition by a mental health professional, (2) a medically proven link between current symptoms and MST, and (3) credible supporting evidence that MST occurred. The VA may not deny a veteran's claim of compensation for a covered mental health condition based on MST without first (1) advising the veteran that nonmilitary evidence and behavioral evidence may constitute credible corroborating evidence, and (2) allowing the veteran an opportunity to furnish the corroborating evidence or advise the VA of potential sources of such evidence. The Veterans Benefits Administration must conduct an annual special focus review on the accuracy of the processing of claims for disability compensation for disabilities relating to MST. Additionally, the bill (1) expands access to mental health care at VA facilities for survivors of MST, and (2) requires the Government Accountability Office to report on access to such care for MST survivors.

Dental Care for Veterans Act This bill expands eligibility for veterans for dental care provided by the Department of Veterans Affairs (VA). Specifically, the bill makes all veterans who are enrolled in the VA health care system eligible for VA-provided dental services. Currently, only veterans who have a service-connected dental issue or meet other narrow criteria are eligible for certain dental services. The bill phases in eligibility over four years based upon existing eligibility, degree of service-connected disability or other disability, prisoner of war status, award of a Purple Heart, financial need, or VA health care eligibility.

Panama Canal Zone Veterans Act of 2023

Panama Canal Zone Veterans Act of 2023 This bill establishes a presumption of service-connection for specified conditions associated with active duty service in or near the Panama Canal Zone (zone) from January 1, 1958, through the latter of December 31, 1999, or the date on which the last service member departed from duty in the zone. Under a presumption of service-connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded. The presumption of service-connection applies to illnesses listed in the bill (e.g., Hodgkin's disease) or those that (1) have a positive association with exposure to an herbicide agent that is known or presumed to be associated with service in the zone during the specified time period, and (2) become manifest in a veteran who served in the zone during the specified time period and was exposed to an herbicide agent during such service. The Department of Veterans Affairs must prescribe regulations providing for a presumption of service-connection whenever there is a determination that a positive association exists between the exposure to an herbicide agent known or presumed to be associated with service in or near the zone and the occurrence of an illness in humans.

Veterans Early Treatment for Chronic Ailment Resurgence through Examinations Act of 2023 or the VET CARE Act of 2023 This bill addresses dental care programs for veterans. Specifically, the bill authorizes the Department of Veterans Affairs (VA) to furnish administrative support to a dental care provider that provides services to a veteran that would not be covered by VA benefits. The bill also requires the VA to implement a pilot program to provide free outpatient dental services and treatment, and related dental appliances, to eligible veterans. Eligible veterans are those who are (1) enrolled in the VA health care system but are not eligible for VA dental care, (2) not receiving regular periodontal care, (3) between 40 and 70 years old, and (4) diagnosed with type 2 diabetes.
