Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2008 - Subjects Iran to specified economic sanctions, including import and export prohibitions. Subjects a U.S. person to penalties for violations of certain sanctions committed by a subsidiary established by such person outside of the United States that would be subject to prohibitions if committed inside the United States or by a U.S. person. Authorizes appropriations for the Department of the Treasury's Office of Terrorism and Financial Intelligence and for the Financial Crimes Enforcement Network. Urges the President to impose sanctions on the Central Bank of Iran and any other Iranian banks engaged in the support of terrorist groups. Authorizes a state or local government to adopt and enforce measures to divest its assets from, or prohibit investment of assets in, persons that have direct or indirect investments in Iran's energy sector of more than $20 million. Amends the Investment Company Act of 1940 to shield any registered investment company from civil, criminal, or administrative action based upon its divesting from, or avoiding investing in, securities issued by companies with such investments in the energy sector of Iran. Requires the Director of National Intelligence to report to the Secretary of Commerce, the Secretary of State, the Secretary of the Treasury, and appropriate congressional committees on all countries of concern with respect to the transshipment, reexportation, or diversion of certain export controlled items to Iran. Requires the Secretary of Commerce to designate a country as a Destination of Possible Diversion Concern if appropriate to carry out activities to strengthen that country's export control systems. Requires the United States to initiate such activities on a government-to-government basis. Defines a Destination of Diversion Concern as any country whose government is directly involved in the transshipment, reexportation, or diversion of U.S.-originating controlled items to unverifiable end users or to Iran, or that has failed to adequately strengthen its export control systems. Requires a license to export to a country designated a Destination of Diversion Concern controlled items that could contribute to Iran's obtaining nuclear, biological, or chemical weapons, or its support for acts of international terrorism. Requires the Director to report to the appropriate congressional committees on: (1) any country that may be transshipping, reexporting, or diverting controlled items to a country other than Iran if such other country is seeking to obtain nuclear, biological, or chemical weapons, defense technologies, components for improvised explosive devices (IEDs), or other defense items, or provides support for acts of international terrorism; and (2) the feasibility and advisability of including such countries in the system for designating countries as Destinations of Possible Diversion Concern and Destinations of Diversion Concern.

Veterans Disability Benefits Claims Modernization Act of 2008 - Revises or adds provisions relating to the disability compensation system of the Department of Veterans Affairs (VA) to: (1) establish in the Veterans Benefits Administration (VBA) an Office of Survivors Assistance to provide assistance to veterans' survivors and dependents regarding VA benefits and services; (2) require a study on adjusting the schedule for rating veterans' disabilities; (3) establish the Advisory Committee on Disability Compensation; (4) require a study on the employee work credit system of the VBA; (5) require a study on the VBA's work management system; (6) require the certification and training of VBA employees responsible for processing claims; (7) require an annual independent assessment of the VBA's quality assurance program; (8) provide for the expedited VBA treatment of fully developed claims and a checklist for individuals submitting incomplete claims; (9) require a study of the VBA's need to employ additional medical professionals to act as a medical reference for employees handling claims; (10) provide for the assignment of partial disability ratings to certain veterans; (11) require a review and revision of VBA use of information technology; and (12) allow a claim beneficiary to be substituted as a claimant in the case of the death of a veteran claimant while a claim is awaiting adjudication or appeal. Requires the Chief Judge of the U.S. Court of Appeals for Veterans Claims to report annually to the congressional veterans' committees on the Court's workload. Revises provisions concerning the jurisdiction and finality of decisions of the Court.

Servicemembers Access to Justice Act of 2008 - Waives a state's sovereign immunity with respect to the enforcement of uniformed services members' employment or reemployment rights or benefits under the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA). Makes unenforceable agreements between an employer and employee requiring arbitration of disputes arising under USERRA. Provides exceptions. Requires the validity and enforceability of such an agreement to be determined by a court (as opposed to the arbitrator). Provides increased liquidated damages, and authorizes punitive damages, against state or private employer violations of USERRA. Provides a right to a jury trial in such cases. Requires (under current law, authorizes) the award of attorney fees in actions to enforce USERRA. Defines "successor in interest" for USERRA purposes. Prohibits: (1) any statute of limitations from applying to USERRA proceedings; and (2) wage discrimination against members covered under USERRA. Requires (under current law, authorizes) a court to use equitable relief, including injunctions and restraining orders when appropriate, for USERRA violations.

Export Control Improvements Act - Securing Exports Through Coordination and Technology Act - Amends the Foreign Relations Authorization Act, Fiscal Year 2003 to revise filing requirements under the Automated Export System (AES). Requires carriers obliged to file Shipper's Export Declarations to file them through AES (either directly or through intermediaries) before items are exported from any U.S. port, unless the Secretary of Commerce grants an exception. (Under current law such a filing may be made after departure of the carrier from the port or place of exportation or transportation.) Defines "intermediary" as a freight forwarder, a non-vessel operating common carrier, or an ATA (Admission Temporaire/Temporary Admission) Carnet and its service providers. Sets forth requirements regarding conferences and seminars to educate exporters about U.S. export laws and the AES. Authorizes the Secretary to: (1) register persons to file information in the AES; and (2) revoke, suspend, or deny a registration. Provides for administrative and judicial appeal of registration revocations, suspensions, or denials. Requires the Secretary of Commerce to issue regulations to ensure that the AES will identify filings with respect to exports that would violate U.S. export control laws or trade sanctions regulations. Export Enforcement Act of 2008 - Amends the Export Administration Act of 1979 to modify enforcement mechanisms under the Act. Subjects to forfeiture any tangible items lawfully seized by U.S. designated officers or employees. Specifies the use of funds made available for undercover investigation operations by the Office of Export Enforcement. Authorizes the Secretary of Commerce, without fiscal year limitations, to expend funds transferred to, paid to, received by, or made available to the Bureau of Industry and Security of the Department of Commerce as a reimbursement. Recognizes United Arab Emirates' efforts with respect to the diversion of dual-use items to prohibited destinations. Requires the Secretary of Commerce to: (1) create a designation of a country as a "country of diversion concern" with respect to the illegal transshipment of dual-use items; and (2) impose additional restrictions on exports of such items to a country of diversion concern. Directs the Comptroller General to conduct, and report to the appropriate congressional committees on, an audit of the Validated End-User program operated by the Department of Commerce. Requires the President to report to Congress on transfers of U.S. military sensitive technology to countries and entities of concern.

Enable Divestment from Sudan and Iran Act of 2008 - Amends the Internal Revenue Code to promote the divestment of investments in Iran or the Sudan by pemitting the deferral of tax on any gain from the sale of securities in any business that is engaged in certain discouraged activities in Iran or the Sudan if the holder of such securities purchases replacement securities from a business not engaged in such discouraged activities. Includes as discouraged activities in Iran: (1) the sale of munitions to the Iranian government; (2) loans aggregating more than $20 million to the Iranian government; (3) investments of over $20 million in the Iranian energy sector; or (4) conducting business with or making charitable donations to any Iranian person designated as a terrorist. Defines "Sudan discouraged activity" as an investment in any business operation described in the Sudan Accountability and Divestment Act of 2007 (e.g., businesses engaged in power production activities, mineral extraction activities, oil-related activities, or the production of military equipment). Requires the Secretary of the Treasury to publish and update every six months a list of business entities engaging in any Sudan or Iran discouraged activities.

Electronic Employment Eligibility Verification and Illegal Immigration Control Act of 2008 - Amends the Immigration and Nationality Act to direct the Secretary of Homeland Security to establish a toll-free telephone- or electronic media-based employment eligibility verification system. Requires such system to: (1) provide verification or tentative non-verification of an individual's identity and employment eligibility within three days of an inquiry; and (2) provide, in the case of tentative non-verification, a secondary process for final verification or non-verification within 10 days. Provides that: (1) the Commissioner of Social Security shall develop a process for comparing names and social security numbers against appropriate databases in response to employer inquiries; and (2) the Secretary shall develop a process for comparing names and alien identification or authorization numbers and shall investigate uses of the same social security number that suggest fraud. Limits verification system-related individual relief to procedures under the Federal Tort Claims Act. Prohibits class actions. Immunizes from civil or criminal liability a person or entity who takes action in good faith reliance on verification system information. Sets forth employer verification requirements with respect to an affirmative defense to liability for employment of unauthorized workers, including revision of attestation and retention of verification form provisions. Places limits on the collection and use of data from the verification system. Expands the employment eligibility verification system to include: (1) previously hired individuals; and (2) recruitment and referral. Provides for: (1) voluntary employer verification utilizing such system two years after enactment of this Act for previously hired individuals; (2) mandatory employer verification three years after enactment of this Act by federal, state, and local governments, and the military for employees not verified under such system working at federal, state or local government buildings, military bases, nuclear energy sites, weapons sites, airports, or critical infrastructure sites; and (3) mandatory employer verification six years after enactment of this Act for all employees not previously verified under such system. Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to extend the E-Verify program (formerly the basic pilot program) until two years after enactment of this Act. Applies employment eligibility verification requirements to labor service agencies. Revises civil and criminal penalty provisions. Establishes in the Treasury the Employment Verification Compensation Fund. Directs the Secretary to establish a publicly available contractor database. Requires the Commissioner to report to Congress on Social Security card-based verification, including requirements for: (1) durable and machine-readable cards; (2) a unified database that specifies work authorizations; and (3) employer verification of new hires using the new Social Security cards and an electronic mechanism to seek verification. Authorizes the Commissioner (subject to limits) to carry out verification responsibilities under this Act. Prohibits funds from the Federal Old-Age and Survivors Insurance Trust Fund or the Federal Disability Insurance Trust Fund from being used to carry out such responsibilities. Sets forth other reporting requirements by the Secretary and the Commissioner.

Limitations on Interrogation Techniques Act of 2008 - Prohibits any individual in the custody or control of personnel of an element of the intelligence community or contractor or subcontractor thereof, regardless of nationality or physical location, from being subject to the following interrogation techniques: (1) forcing the individual to be naked, perform sexual acts, or pose in a sexual manner; (2) placing hoods or sacks over the head of the individual or using duct tape over the eyes; (3) applying beatings, electrical shock, burns, or similar forms of physical pain; (4) using the technique known as waterboarding; (5) using military working dogs; (6) inducing hypothermia or heat injury; (7) conducting mock executions; or (8) depriving the individual of adequate food, water, or medical care.

United States Olympic Committee Paralympic Program Act of 2008 - Authorizes the Secretary of Veterans Affairs to make grants to the U.S. Olympic Committee (USOC) to plan, develop, manage, and implement the Paralympic Program for disabled veterans and disabled members of the Armed Forces. Directs the USOC to use a grant to recruit, support, encourage, schedule, facilitate, supervise, and implement paralympic instruction, participation, and competition activities, training and technical assistance, and coordination, program development, and other specified activities for veterans and members of the Armed Forces with physical disabilities. Sets forth outreach, coordination, application, and memorandum of understanding requirements. Establishes in the Department of Veterans Affairs (VA) an Office of National Veterans Sports Programs and Special Events to establish, carry out, and provide for VA sponsorship of and participation by disabled veterans in qualifying programs and events. Authorizes the Office Director to provide a monthly assistance allowance to a disabled veteran invited by the USOC to compete for, or selected for, the Paralympic Team. Requires the Secretary to direct the Under Secretary for Health of the VA to: (1) make available recreational and physical therapists and other medical staff to facilitate veteran participation in sporting events conducted under the auspices of the USOC; (2) allow such personnel to participate in the USOC Paralympic Program without requiring the use of personal leave; and (3) support other similar activities or events.

Terminates the pre-stabilization rating: (1) when a veteran receives a permanent disability rating based on the Department of Veterans Affairs (VA) schedule for rating disabilities; or (2) 365 days after the veteran's last separation or release from active duty. Allows the Secretary, when appropriate, to extend the pre-stabilization rating beyond such date.

Healing Our Nation's Heroes Act of 2008 - Establishes a commission on veterans and members of the Armed Forces (members) with post-traumatic stress disorder (PTSD), traumatic brain injury (TBI), or other mental health disorders caused by military service. Requires the commission to: (1) oversee the monitoring and treatment of veterans and members with such disorders; and (2) conduct a study of the long-term adverse consequences of such disorders for such veterans and members. Authorizes the Secretary of Veterans Affairs (Secretary) to carry out a program, to be known as the Heroes-to-Healers Program, to assist veterans and members separating from service to: (1) obtain certification as mental health care providers; and (2) find employment with federal, state, and local agencies and nongovernmental organizations that provide mental health care to members, veterans, and their families. Requires participants, following certification, to work for at least five years in such mental health care capacity, but authorizes the Secretary to waive such requirement when considered appropriate. Authorizes the Secretary of Education to pay a bonus of up to $10,000 to a Program participant who agrees to such service. Authorizes the Secretary of Education to establish a program to award grants to encourage state and local mental health agencies and other entities to establish, expand, or enhance mental health provider recruitment and retention efforts. Requires participants who receive training through the program to serve at a high-need medical facility or agency for at least three years.

Services, Education, and Rehabilitation for Veterans Act or the SERV Act - Requires the Director of the Office of National Drug Control Policy to delegate to the Department of Justice (DOJ) the authority to administer the veteran's treatment courts program established by this Act. Authorizes the Attorney General to make grants to states and other entities: (1) to develop, implement, or enhance veteran's treatment courts or to expand operational drug courts to serve veterans; and (2) for programs that involve continuing judicial supervision over nonviolent offenders with substance abuse or mental health problems who have served in the U.S. military. Requires such programs to include mandatory periodic testing for the use of drugs, substance abuse and mental health treatment, opportunities for diversion, probation, or supervised release, and programmatic, offender management, and aftercare services. Directs the National Drug Court Institute to conduct national training programs for state and local communities to improve the professional skills of drug court practitioners and provide comprehensive technical assistance to adult, juvenile, and family dependency drug courts.

FDA Food Safety Modernization Act - Amends the Federal Food, Drug, and Cosmetic Act to expand the authority of the Secretary of Health and Human Services (the Secretary) to regulate food, including by authorizing the Secretary to: (1) suspend the registration of a food facility; and (2) order a cessation on distribution or recall of food. Directs the Secretary to allocate resources based on the risk profile of food facilities or food. Requires the Secretary and the Secretary of Agriculture to prepare a National Agriculture and Food Defense Strategy. Requires the Administrator of the Environmental Protection Agency (EPA) to assist state, local, and tribal governments in preparing for, assessing, decontaminating, and recovering from an agriculture or food emergency. Requires the Secretary to: (1) assess fees on domestic food facilities and food importers; (2) promulgate regulations on sanitary transportation practices for food; and (3) develop a policy to manage the risk of food allergy and anaphylaxis in schools and early childhood education programs. Directs the Secretary to: (1) recognize accreditation bodies that accredit food testing laboratories; and (2) improve the capabilities to track and trace raw agricultural commodities. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to enhance foodborne illness surveillance systems. Provides for: (1) foreign supplier verification programs; (2) a voluntary qualified importer program; and (3) the inspection of foreign facilities registered to import food.

Enemy Combatant Detention Review Act of 2008 - Amends the federal judicial code to grant the U.S. District Court for the District of Columbia exclusive jurisdiction of, and make it the exclusive venue for consideration of, all habeas corpus applications by or on behalf of any enemy combatant held at Guantanamo Bay, Cuba, who is neither a U.S. citizen nor a lawful permanent resident (covered individual) that are pending on or filed on or after the enactment of this Act. Prescribes related procedures, including restrictions on oral testimony. Stays any such application until all Military Commission proceedings regarding the covered individual have been resolved. Requires release of a covered individual, for whom the District Court grants a writ application and orders release, into the custody of the Secretary of Homeland Security for transfer to the individual's country of citizenship or another country.

Guaranteed Benefits for Our Troops Act - Directs the Secretary of the military department concerned to provide uncharged leave or a monetary benefit to any member or former member of the Armed Forces who, on any day beginning on January 19, 2007, and ending on the date of implementation of the Post-Deployment/Mobilization Respite Absence program, would have qualified for a day of administrative absence under such program had it been in effect. Makes such benefit: (1) an amount not to exceed $200 for each day, in the case of a former member; and (2) either one day of administrative absence or an amount not to exceed $200, in the case of a current member. Excludes from such benefit any members discharged or released under other than honorable conditions. Sets at 40 the maximum number of days for which such benefit may be provided.

Health Security for All Americans Act of 2008

Health Security for All Americans Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act regarding: (1) the physician payment update; (2) geographic cost-of-practice indices (GPCI) floors; (3) annual physical examinations; (4) the Medicare-dependent hospital (MDH) program; (5) the inpatient hospital payment adjustment for low-volume hospitals; and (6) proportional representation of rural area interests on the Medicare Payment Advisory Commission (MEDPAC). Directs the Secretary of Health and Human Services to conduct a national public information campaign on initial preventive physical examinations for Medicare beneficiaries. Amends the Employee Retirement Income Security Act of 1974 (ERISA) with respect to rules governing enhanced marketplace pools for small business health plans. Amends the Public Health Service Act to add a new title XXX (Health Care Insurance Marketplace Modernization) under which the Secretary shall promulgate regulations establishing minimum standards for health insurance premium variations and model small group rating rules. Provides for affordable plans and the harmonization of health insurance standards. Amends the Internal Revenue Code to allow a tax deduction for the qualified health insurance costs of individuals. Amends veterans benefits law to allow an enrolled veteran to elect to receive covered health services through a non-Department of Veterans Affairs (VA) facility. Authorizes VA pharmacies to dispense medications to veterans on private practitioner prescriptions. Authorizes the Secretary to carry out a program of child care assistance for individuals pursuing advanced nursing degrees. Amends the Higher Education Act of 1965 to authorize the Secretary to award grants to partnerships of accredited nursing schools and hospitals or health facilities to establish projects to enable a hospital or health facility to retain its staff of experienced nurses while having these individuals become, through an accelerated nursing education program, faculty members of an accredited nursing school. Directs the Secretary to award grants to institutions of higher education that offer: (1) a Registered Nurse (RN) nursing program at the baccalaureate or associate degree level to enable the program to expand its faculty and facilities to accommodate additional RN nursing program students; or (2) a graduate-level nursing program to accommodate advanced practice degrees for RNs or to accommodate students enrolled in a graduate-level nursing program to provide teachers of nursing students. Authorizes the Secretary of Defense to carry out programs to increase the number of nurses within the armed forces. Prescribes requirements for determination of the effective date of active duty for members of a reserve component of the armed forces.

Drill Offshore to Pay Less Act - Declares without force or effect for any area of the Outer Continental Shelf (OCS) more than 50 miles off the Virginia coast all federal prohibitions against the expenditure of appropriated funds to conduct oil and natural gas leasing and preleasing activities. Revokes all withdrawls from leasing of federal OCS submerged lands more than 50 miles off the Virginia coast. Prohibits the availability of any area of the OCS off the Virginia coast for leasing for exploration for, or the development or production of, oil or natural gas unless the Governor of Virginia, with the concurrence of the Virginia legislature, has requested the Secretary of the Interior to make such area available. Requires the Secretary of the Interior to take necessary action to ensure that oil and gas exploration, development, and production activities under federal leases of areas off the Virginia coast will result in no significant adverse effect on fish and wildlife, their habitat, subsistence resources, and the environment. Provides for allocation of oil and gas lease revenues under this Act. Prohibits any person from engaging in any exploration, development, or production of oil or natural gas off the Virginia coast that would conflict with any military operation, as determined by the Secretary of Defense.

Makes individuals eligible for such bonus for qualifying service of less than 90 days if the individual: (1) dies of injuries incurred in connection with such service; or (2) is evacuated from a theater of combat due to an injury incurred in connection with such service.

Enemy Combatant Detention Review Act of 2008 - Amends the federal judicial code to grant the U.S. District Court for the District of Columbia exclusive jurisdiction of, and make it the exclusive venue for consideration of, all habeas corpus applications by or on behalf of any enemy combatant held at Guantanamo Bay, Cuba, who is neither a U.S. citizen nor a lawful permanent resident (covered individual) that are pending on or filed on or after the enactment of this Act. Prescribes related procedures, including restrictions on oral testimony. Stays any such application until all Military Commission proceedings regarding the covered individual have been resolved. Requires release of a covered individual, for whom the District Court grants a writ of habeas corpus and orders release, into the custody of the Secretary of Homeland Security for transfer to the individual's country of citizenship or another country.

Prohibits the Secretary from making payments for travel performed by a special mode unless it is: (1) medically required and previously authorized; or (2) in connection with a medical emergency of such a nature that delay would have been hazardous to the person's life or health. Eliminates required deductions in connection with travel under the program. Allows such payments in connection with all veterans and family members eligible for examination, treatment, care, rehabilitation, or counseling through the VA.

Requires any VA facility designated as a voter registration agency to: (1) provide information relating to the opportunity to request an absentee ballot; (2) make available absentee ballot applications and absentee ballots upon request, as well as assistance in completing them; and (3) work with local election officials to ensure the proper delivery of such applications and ballots. Directs the Secretary to permit a meaningful opportunity for nonpartisan organizations to provide voter registration information and assistance at VA facilities. Prohibits the Secretary from banning any election administration official, whether state or local, party-affiliated or non-party affiliated, or elected or appointed, from providing nonpartisan voting information to veterans at any VA facility. Directs the Secretary to provide reasonable access to VA facilities to state and local election officials for the purpose of providing nonpartisan voter registration services to individuals.
