United States Transportation Command Infrastructure Assessment Act of 2018

United States Transportation Command Infrastructure Assessment Act of 2018 This bill requires the United States Transportation Command, in coordination with the Department of Transportation (DOT), to make available to congressional Appropriations, Armed Services, and Transportation committees a description and assessment of the condition of the defense transportation sector functions, systems, assets, and dependencies as they relate to supporting Department of Defense operational capabilities and assets, including any related Transportation Engineering Agency Infrastructure Assessments. In coordination with DOT, the Command shall identify and submit to those committees consolidated and prioritized resource requirements for transportation infrastructure at the same time the President submits to Congress the budget for the next fiscal year.

A concurrent resolution commemorating the 75th anniversary of Lockheed Martin Skunk Works and the significant contributions of the Skunk Works to the national security of the United States.

International Human Rights Defense Act of 2018

International Human Rights Defense Act of 2018 This bill establishes in the Department of State a permanent Special Envoy for the Human Rights of LGBTI (lesbian, gay, bisexual, transgender, or intersex) Peoples who shall serve as the principal State Department advisor regarding human rights for LGBTI people and represent the United States in diplomatic matters relevant to the human rights of LGBTI people. The special envoy shall periodically provide Congress with a U.S. global strategy to prevent and respond to criminalization, discrimination, and violence against LGBTI people. The State Department and the U.S. Agency for International Development may provide assistance to prevent and respond to such activities against LGBTI people. The Foreign Assistance Act of 1961 is amended to require that annual country reports on human rights practices include information on criminalization, discrimination, and violence based on sexual orientation and gender identity.

Family Member Access to Burn Pit Registry Act

Family Member Access to Burn Pit Registry Act This bill amends the Dignified Burial and Other Veterans' Benefits Improvement Act of 2012 to allow a family member to participate in the Department of Veterans Affairs Airborne Hazards and Open Burn Pit Registry on behalf of a deceased veteran or service member. (The registry is a database designed to allow certain veterans and service members to report deployment exposures to airborne hazards such as smoke from waste disposal burn pits, oil-well fires, or pollution, as well as other exposures and health concerns.)

Migratory Bird Framework and Hunting Opportunities for Veterans Act This bill amends the Migratory Bird Treaty Act to revise requirements for hunting ducks, mergansers, and coots. Specifically, the bill establishes January 31 of each year as the closing date of the hunting season for ducks, mergansers, and coots. In addition, the bill extends the hunting season for those birds by an extra weekend for youths, veterans, and members of the Armed Forces on active duty. The Department of the Interior may not decrease the length of the hunting season or bag limit, as compared to the 2017-2018 hunting season, in the Atlantic, Mississippi, Central, or Pacific flyway.

DOD must establish a board to support the consortium. The board shall: (1) award grants to consortium members for quantum information research, (2) assist with ongoing research, and (3) facilitate partnerships between consortium members.

Ending the Monopoly of Power Over Workplace Harassment through Education and Reporting Act - Part 2 or the EMPOWER Act - Part 2 This bill amends the Internal Revenue Code to modify the tax treatment of expenses and payments related to workplace harassment and employment discrimination. The bill prohibits a tax deduction for amounts paid or incurred by the taxpayer: pursuant to any judgment or award in litigation related to workplace harassment, including sexual harassment; for expenses and attorney's fees in connection with the litigation resulting in the judgment or award (other than expenses or fees paid by the workplace harassment plaintiff or claimant); or for insurance covering the defense or liability of the underlying claims in the litigation. The bill also: (1) excludes from gross income amounts received in connection with a judgment, award, or settlement related to workplace harassment, including sexual harassment or other unlawful discrimination; and (2) limits the taxation of and the application of the alternative minimum tax to compensation received under a settlement or judgment for employment discrimination.

John S. McCain National Defense Authorization Act for Fiscal Year 2019

John S. McCain National Defense Authorization Act for Fiscal Year 2019 This bill authorizes FY2019 appropriations and sets forth policies regarding the military activities of the Department of Defense (DOD), military construction, and the national security programs of the Department of Energy (DOE). It does not provide budget authority, which is provided in subsequent appropriations legislation. The bill authorizes appropriations to DOD for: Procurement; Research, Development, Test, and Evaluation; Operation and Maintenance; Cooperative Threat Reduction; Working Capital Funds; Chemical Agents and Munitions Destruction; Defense-Wide Drug Interdiction and Counter-Drug Activities; the Defense Inspector General; the Armed Forces Retirement Home; and the Defense Health Program. This bill also authorizes appropriations for Overseas Contingency Operations (OCO), which are exempt from limits on discretionary spending. OCO appropriations authorized in the bill support base budget requirements as well as OCO activities. The bill authorizes the FY2019 personnel strengths for active duty and reserve forces and sets forth policies regarding military personnel; compensation and other personnel benefits; health care; acquisition policy and management; DOD organization and management; civilian personnel matters; matters relating to foreign nations; and strategic programs, cyber, and intelligence matters. Foreign Investment Risk Review Modernization Act of 2018 The bill addresses shifting threats to national security and the Committee on Foreign Investment in the United States. Military Construction Authorization Act for Fiscal Year 2019 The bill authorizes appropriations and sets forth policies regarding military construction for the Army, Navy, Air Force, and defense agencies, the North Atlantic Treaty Organization Security Investment Program, and Guard and Reserve Forces facilities. The bill authorizes appropriations for base realignment and closure (BRAC) activities and prohibits an additional BRAC round. The bill also authorizes appropriations and sets forth policies for DOE national security programs, including the National Nuclear Security Administration.

Bill Mulder and Ryan Larkin Posttraumatic Growth Act This bill directs the Department of Veterans Affairs (VA) to conduct a two-year pilot program to study the effectiveness of nonprofit post-traumatic growth programs to determine: (1) the outcomes of such programs in contrast to traditional models of mental health care, (2) the possible integration of such nonprofit programs into VA mental health care programs, and (3) the budgetary impact of such integration. Veterans who are at risk of suicide and not participating in traditional mental health treatment are eligible for such program.

Second, the bill makes available any asset of a terrorist party seized or frozen under the Foreign Narcotics Kingpin Designation Act for the satisfaction of court-awarded judgments against the terrorist party. Third, it allows federal courts to exercise personal jurisdiction over a foreign non-state defendant that accepts benefits from the United States (e.g., foreign assistance).

Women Veterans Access to Quality Care Act of 2018

Women Veterans Access to Quality Care Act of 2017 This bill directs the Department of Veterans Affairs (VA) to: (1) establish standards to ensure that all VA medical facilities have the structural characteristics necessary to adequately meet the gender-specific health care needs of veterans at such facilities, including privacy, safety, and dignity; (2) integrate such standards into its prioritization methodology with respect to requests for funding major medical facility projects and major medical facility leases; and (3) report on such standards, including regarding the facilities that fail to meet such standards and the costs of projects and leases required to meet them. The VA shall: (1) establish policies for environment of care inspections at VA medical centers, which shall include an alignment of inspection requirements with the women's health handbook of the Veterans Health Administration; and (2) certify that such policies have been finalized and disseminated to such centers. The VA shall: (1) use health outcomes for women veterans furnished health care by the the VA in evaluating the performance of VA medical center directors, (2) publish on its website information on such performance and on health outcomes for women veterans for each VA medical facility, (3) ensure that every VA medical center has a full-time obstetrician-gynecologist, and (4) carry out a pilot program to increase the number of residency program positions and graduate medical education positions for obstetrician-gynecologists at VA medical facilities in at least three Veterans Integrated Service Networks. The VA must develop procedures to share information that includes military service and separation data, personal email addresses and telephone numbers, and mailing addresses of veterans with state veterans agencies in electronic format as a means of facilitating the furnishing of assistance and benefits to such veterans. A veteran may elect to prevent his or her information from being shared. The bill requires the VA to carry out an examination of whether VA medical centers are able to meet the health care needs of women veterans.

Integrated Missile Defense Act of 2018 This bill addresses U.S. missile defense capabilities in response to nuclear threats from North Korea under the regime of Kim Jong-un. It urges or directs the Missile Defense Agency to accelerate the fielding of 20 additional ground-based interceptors with Redesigned Kill Vehicles (RKVs) at Missile Field 4 at Fort Greely, Alaska, and mate the RKVs with the newest booster technology; ensure the development and deployment of persistent space-based sensor architecture; plan a fully interoperable and integrated air and missile defense architecture; accelerate its hypersonic missile defense program and deploy such program in conjunction with a persistent space-based missile defense sensor program; seek to establish missile defense capabilities with allies and trusted partners of the United States; and pursue an increasingly rigorous testing regime and prioritize discrimination capabilities to improve missile defense effectiveness against current and future threats from countries hostile to the United States. .

Aeronautics Innovation Act This bill reauthorizes through FY2023 the National Aeronautics and Space Administration (NASA) Aeronautics Research Mission Directorate. The bill expresses the sense of Congress that developing high-risk, precompetitive aerospace technologies for which there is not yet a profit rationale is a fundamental NASA role and states that it is U.S. policy to maintain world leadership in military and civilian aeronautical science and technology, global air power projection, and industrial leadership. NASA shall: ensure continuing support for the Aeronautics Strategic Implementation Plan to support the future needs of aviation communities, establish a national policy for aeronautics research to maintain U.S. superiority in air capabilities and aviation industrial leadership, establish a low-boom supersonic aircraft program to demonstrate supersonic aircraft designs and technologies to reduce sonic boom noise levels, establish a new series of experimental planes (X-planes) to demonstrate aircraft vehicle and propulsion concepts and technologies, continue support of unmanned aircraft (drone) system development, and establish the 21st Century Aeronautics Capabilities Initiative to ensure that it possesses the infrastructure capabilities and tools necessary to conduct flight demonstration projects across the range of NASA aeronautics interests.

The term "joint electromagnetic spectrum operations" means those activities consisting of electronic warfare and joint electromagnetic spectrum management operations used to exploit, attack, protect, and manage the electromagnetic operational environment to achieve a military commander's objectives. DOD shall: (1) conduct an assessment of required joint electromagnetic spectrum operations capabilities and capacity based on a review of all level 3 and level 4 contingency plans, and (2) submit to the congressional defense committees a report on its readiness with respect to joint electromagnetic spectrum operations.

Veterans Serving Veterans Act of 2018

Veterans Serving Veterans Act of 2018 This bill amends the VA Choice and Quality Employment Act to name the Department of Veterans Affairs (VA) recruiting database the Departments of Defense and Veterans Affairs Recruitment Database and require that it includes for each vacant position: the military occupational specialty or skill corresponding to the VA position, and each qualified U.S. Armed Forces active-duty member who may be recruited to fill the position. The database shall include the following for each qualified member of the Armed Forces: name, contact information, expected discharge date, and military occupational specialty. An individual may elect in writing to not be included in the database. The VA shall implement direct hiring and appointment procedures for vacant database positions and may authorize relocation bonuses. The VA shall train and certify veterans who served as basic health care technicians in the Armed Forces to work as VA intermediate care technicians.

Constitutional Consideration for Use of Force Resolution This bill sets forth new authorities for the use of force by U.S. Armed Forces in Iraq, Afghanistan, or additional countries against the Taliban, al Qaeda, and the Islamic State in Iraq and the Levant (ISIL), and any new non-state organizations or forces. The bill also repeals the separate authorizations for the use of military force by the United States with respect to the September 11, 2001, terrorist attacks and the war in Iraq.

Department of Defense Service Dog Training Therapy Act This bill requires the Defense Health Agency of the Department of Defense (DOD) to carry out a program under which members of the Armed Forces with post-traumatic stress disorder or other post-deployment mental health conditions train service dogs for veterans with disabilities. DOD shall carry out the program in a manner that ensures that such training is a form of therapy that addresses such post-traumatic stress disorder or other post-deployment mental health conditions.

Vietnam-Era Veterans Hepatitis C Testing Enhancement Act of 2018 This bill directs the Department of Veterans Affairs (VA) to carry out a one-year pilot program to make hepatitis C testing available to certain veterans at events organized by veterans service organizations. To be eligible, a veteran must have served in the active military, naval, or air service between February 28, 1961, and May 7, 1975, and must have been discharged or released under conditions other than dishonorable. The program shall be carried out in two rural and three urban Veterans Integrated Service Networks (regional VA health care administrative areas). The VA shall expand the program to all networks if at least 350,000 veterans are tested for hepatitis C by the program's termination date.

Defend Against Russian Disinformation and Aggression Act This bill amends the State Department Basic Authorities Act establish within the Department of State a Coordinator for Sanctions Policy who shall oversee the diplomatic aspects of U.S. and U.N. sanctions enforcement. The Department of Defense shall seek to conduct more North Atlantic Treaty Organization naval exercises to defend Europe and deter Russian aggression. The bill sets forth reporting requirements with respect to: (1) federal cyber countermeasures, and (2) Russian government-linked corruption.

This bill prohibits the obligation or expenditure of funds to transfer an F-35 aircraft or related intellectual property or technical data to a foreign country unless the Department of Defense certifies to Congress that such country is not: (1) degrading North Atlantic Treaty Organization (NATO) interoperability or member country security or exposing NATO assets to hostile actors; (2) seeking to import or purchase defense articles from a U.S.-sanctioned foreign country; or (3) wrongfully or unlawfully detaining U.S. citizens.

Do No Harm Act

Do No Harm Act This bill makes the Religious Freedom Restoration Act of 1993 (RFRA) inapplicable to federal laws (or implementations of laws) that: protect against discrimination or the promotion of equal opportunity, including the Civil Rights Act of 1964, the Americans with Disabilities Act, the Family Medical Leave Act, Executive Order 11246 (concerning equal employment opportunity), the Violence Against Women Act, and the Department of Housing and Urban Development's (HUD's) rules entitled "Equal Access to Housing in HUD Programs Regardless of Sexual Orientation or Gender Identity"; require employers to provide wages, other compensation, or benefits, including leave; protect collective activity in the workplace; protect against child labor, abuse, or exploitation; or provide for access to, information about, referrals for, provision of, or coverage for, any health care item or service. Under current law, RFRA prohibits the government from substantially burdening a person's exercise of religion even if the burden results from a rule of general applicability, except in furtherance of a compelling governmental interest when using the least restrictive means. The bill makes RFRA inapplicable to: (1) terms requiring goods, services, functions, or activities to be performed or provided to beneficiaries of government contracts, grants, cooperative agreements, or awards; or (2) denials of a person's full and equal enjoyment of a government-provided good, service, benefit, facility, privilege, advantage, or accommodation. To assert a RFRA claim or defense in a judicial proceeding, the government must be a party to the proceeding.

Better Military Housing Act of 2018

Better Military Housing Act of 2018 This bill requires the Department of Defense (DOD) to revise requirements for the monitoring and oversight of, and reporting for, the Military Housing Privatization Initiative (MHPI). Specifically, the bill requires DOD to use consistent measures for assessing the financial condition of MHPI projects and to assess the future sustainability of such projects relative to the goal of providing quality housing to members of the Armed Forces.

VA MISSION Act of 2018

VA Maintaining Internal Systems and Strengthening Integrated Outside Networks Act of 2018 or VA MISSION Act of 2018 This bill consolidates Department of Veterans Affairs (VA) community care programs, revises other VA health care programs and facilities provisions, and makes appropriations for veterans care. The bill establishes the Veterans Community Care Program to furnish hospital care, medical services, and extended care services through certain non-VA providers to veterans who are enrolled in the VA health care system or otherwise entitled to VA care. The VA may enter agreements with non-VA providers to furnish veterans with care that is otherwise not feasibly available. The VA shall: (1) establish standards for VA health care quality and for non-VA care in areas of VA expertise, (2) prohibit rehiring previously-removed VA providers, (3) provide prompt payment to providers, and (4) establish opioid prescribing practices for non-VA providers. The Veterans Choice Program is terminated after one year. The bill establishes the Center for Innovation for Care and Payment. The VA may: (1) provide care for the live donor of a transplant for a veteran, and (2) carry out a Specialty Education Loan Repayment Program and other actions to recruit health care professionals. The VA family caregiver program is expanded. The Office of Management and Budget shall review each enhanced-use facility lease. The bill establishes pilot programs for medical scribes, mobile deployment teams for underserved facilities, and graduate medical education. The bill extends VA pension reductions for Medicare-covered veterans in nursing homes.
