Community and Rural Medical Residency Preservation Act of 2005 - Amends title XVIII (Medicare) of the Social Security Act with respect to the counting of time spent in outpatient settings by full-time-equivalent residents in approved medical residency training programs, for purposes of indirect medical education and direct graduate medical education payments. Defines all, or substantially all, of the costs for the training program in that nonhospital setting as the residents' stipends and benefits and other costs, if any, as determined by the training hospital and the entity (wholly owned or operated by the hospital) operating the nonhospital setting. Declares that the hospital is not required to pay the entity any amounts other than those determined by the hospital and the entity in order for the hospital to be considered to have incurred all, or substantially all, of the costs for the training program in that setting.

DREAM Act of 2005

Development, Relief, and Education for Alien Minors Act of 2005 or the DREAM Act of 2005 - Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to repeal the denial of an unlawful alien's eligibility for higher education benefits based on state residence unless a U.S. national is similarly eligible without regard to such state residence. Authorizes the Secretary of Homeland Security to cancel the removal of, and adjust to conditional permanent resident status, an alien who: (1) entered the United States prior to his or her sixteenth birthday, and has been present in the United States for at least five years immediately preceding enactment of this Act; (2) is a person of good moral character; (3) is not inadmissible or deportable under specified grounds of the Immigration and Nationality Act; (4) at the time of application, has been admitted to an institution of higher education, or has earned a high school or equivalent diploma; and (5) from the age of 16 and older, has never been under a final order of exclusion, deportation, or removal. Sets forth the conditions for conditional permanent resident status, including: (1) termination of status for violation of this Act; and (2) removal of conditional status to permanent status. Authorizes an alien who has satisfied the appropriate requirements prior to enactment of this Act to petition the Secretary for conditional permanent resident status. Sets forth provisions respecting: (1) exclusive jurisdiction; (2) penalties for false application statements; (3) confidentiality; (4) fee prohibitions; (5) higher education assistance; and (6) a Government Accountability Office (GAO) report respecting the number of aliens adjusted under this Act.

Occupational Safety Partnership Act

Occupational Safety Partnership Act - Amends the Occupational Safety and Health Act of 1970 (OSHA) to direct the Secretary of Labor to establish a program that qualifies individuals to provide consultation services to help employers identify and correct workplace safety and health hazards. Exempts from civil penalties for two years (with a possible two-year renewal) employers who receive certificates of compliance from qualified consultants. Authorizes employers to establish alcohol and substance abuse testing programs in accordance with federal guidelines. Directs the Secretary to provide for: (1) employer cooperative agreements for comprehensive safety and health management systems; (2) an employer voluntary program, with increased small business participation, for excellence in technical and managerial protection of employees from occupational hazards; (3) state cooperative agreements for state consultation services for employers; and (4) a three-state pilot program for expedited consultation services for small businesses. Requires federal personnel responsible for enforcing OSHA to: (1) meet specified eligibility requirements; and (2) if they carry out inspections or investigations, receive professional education and training at least every five years. Authorizes the Secretary to develop and implement at least one training and educational exchange program with a specialty trade in the construction industry for specified activities relating to OSHA Rules.

Reservist Opportunities and Protection of Education Act - Amends the Higher Education Act of 1965 to require institutions of higher education, as a condition of their participation in the student aid program, to grant students who are called or ordered to active duty a military leave of absence while serving on active duty and for one year after conclusion of such service. Entitles students receiving such leave, upon release from active duty, to be restored to prior educational status attained without loss of academic credits earned, scholarships or grants awarded, or tuition or fees paid, unless those have been refunded. Requires institutions to give such students certain refunds of tuition or fees paid prior to active duty, or to credit such amounts to the next enrollment period after the student returns, at the student's option.

Sets forth requirements for these model material safety data sheets. Establishes a Global Harmonization Commission to: (1) consider the implementation of the United Nations Globally Harmonized System of Classification and Labeling of Chemicals to improve chemical hazard communication; and (2) make recommendations to Congress. Amends requirements for training and employee education under the Occupational Safety and Health Act of 1970 to direct the Secretary to award demonstration project grants to develop, implement, or evaluate strategies or programs to improve chemical hazard communication in the workplace through the use of technology.

Investing for Tomorrow's Schools Act of 2005 - Authorizes the Secretary of Education to enter into cooperative agreements with states to establish state and multistate infrastructure banks for education. Provides, under such agreements, that the Secretary will award grants to states for initial capital to make loans through such banks to local educational agencies and public libraries for construction, reconstruction, or renovation of public elementary or secondary schools and public library facilities. Grants congressional consent to states to enter into an interstate compact to establish a multistate infrastructure bank through such an agreement with the Secretary. Includes among infrastructure bank requirements that states contribute from nonfederal sources at least 25% of the amount of the federal grant. Lists types of projects eligible to be funded by such bank loans. Applies Davis-Bacon Act wage requirements with respect to individuals employed on such projects.

Forests for Future Generations Act - Directs the Secretary of Agriculture and the Secretary of the Interior to develop research protocols for collecting and analyzing scientific information about the effectiveness and ecological impacts of catastrophic event recovery projects and emergency stabilization treatments undertaken as part of a burned area emergency response to increase the long-term benefits of management activities and to decrease short-term impacts. Requires such Secretaries to enter into at least one cooperative agreement with one land-grant college or university in each Forest Service Region to form forest health partnerships to utilize the education, research, and outreach capacity of land-grant colleges and universities to address the recovery of forested land after a catastrophic event. Requires such Secretaries to conduct catastrophic event recovery evaluations of damaged federal lands. Directs such Secretaries to prepare a list of pre-approved management practices that may be immediately implemented as part of catastrophic event recovery projects or catastrophic event research projects. Requires determinations of whether or not to: (1) use any pre-approved management practices that can be immediately implemented; and (2) develop and carry out a recovery or research project or part of such a project using the alternative arrangements authorized by this Act. Directs such Secretaries to clarify agency-wide guidance regarding reforestation in response to catastrophic events. Provides for assistance to restore landscapes and communities affected by catastrophic events. Directs such Secretaries to establish a community protection and recovery fund for each recovery project. Provides for the availability and use of pre-approved management practices and alternative arrangements on National Forest experimental forests.

Ethiopia Consolidation Act of 2005 - Directs the President: (1) through the United States Agency for International Development (USAID), to revise the USAID country plan for Ethiopia to provide support for independent human rights monitoring and related training for government officials, and to provide support for training political parties on organization building, message development, and election monitoring; (2) through the International Criminal Investigative Training Assistance Program of the Department of Justice, to provide training for Ethiopian police, security, and prison personnel in maintaining international standards for arrest and interrogation; (3) through USAID, to support programs to increase the independence and competence of the Ethiopian judicial system, and to provide assistance for development of Ethiopia's Nile and Awash River resources, including assistance to help Ethiopia with technology for the construction of dams, irrigation systems, and hydroelectric power that might prevent future famine; (4) provide financing for U.S.-Ethiopian commercial ventures; and (5) suspend joint security activities until a certification is made that Ethiopia is observing international human rights standards and enforcing the principle of the rule of law. Declares that the current stalemate in the border dispute between Ethiopia and Eritrea has the potential to lead to conflict and must be addressed. Prohibits assistance to the governments of Ethiopia or Eritrea (with exceptions for assistance for democracy, peacekeeping, child survival and health, education, and agriculture) until the Secretary of State certifies that Ethiopia or Eritrea is taking steps to comply with the Algiers Agreements. Prohibits nonessential U.S. assistance to Ethiopia if the government of Ethiopia obstructs U.S. technical assistance to Ethiopian opposition parties.

Children's Hope Act of 2005 - Amends the Internal Revenue Code to allow a tax credit, up to $100 ($200 for joint returns), for charitable contributions to an education investment organization that disburses 90% of its contributions to provide grants to students for elementary and secondary education expenses, if at least 50% of such disbursements go to students who qualify for free or reduced-cost school lunches. Requires a taxpayer claiming such credit to first claim a state qualified scholarship tax credit, as defined by this Act, as a condition of eligibility for the federal tax credit.

Maritime Administration Enhancement Act of 2005

Maritime Administration Enhancement Act of 2005 - Amends the Maritime Education and Training Act to authorize the Secretary of Transportation to establish and maintain a voluntary organization for the training of U.S. citizens to perform functions to assist the U.S. merchant marine, as determined necessary by the Secretary. Amends the Merchant Marine Act, 1936 regarding: (1) investments as they relate to the war risk insurance fund; (2) satisfaction of certain requirements for admission to the U.S. merchant marine academy, including reserve training compliance and armed forces performance requirements for U.S. merchant marine academy graduates; (3) operation of the Global Maritime and Transportation School as a nonappropriated fund instrumentality under the Department of Transportation, Maritime Administration; (4) repeal of limitation on Secretary's authority to scrap obsolete National Defense Reserve Fleet vessels, including the transfer of such vessels to be disposed of as artificial reefs at no cost to the Government; (5) duty-free treatment for emergency war materials imported for use by the Maritime Administration, including the cost of repairs made in a foreign country to any National Defense Reserve Fleet vessel; and (6) availability of funds from deepwater port license fees and fees from administrative waivers of coastwise trade laws for eligible vessels for deposit into the Maritime Administration's operations and training account for administrative expenses and improvements to the programs' operations. Amends federal shipping law to revise the use of amounts contained in the Vessel Operations Revolving Fund. Credits certain amounts to the Fund. Authorizes appropriations for annual payments to regional maritime academies, including to state maritime academies for school ship fuel. Establishes a program to provide assistance to small shipyards for capital improvements and for maritime training programs in maritime communities. Grants the Administrator of the Maritime Administration authority to make certain non-fishing loan guarantee decisions (currently, made by the the Secretary of Transportation).

Domestic Violence Screening, Treatment, and Prevention Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services, acting through the Director of the Health Resources and Services Administration (HRSA), to award grants for the development of interdisciplinary training and education programs that provide health professions students with an understanding of, and clinical skills pertinent to, domestic violence, sexual assault, stalking, and dating violence. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to award grants to strengthen the response of state, tribal, territorial, or local health care systems to such violence. Amends title V (Maternal and Child Health Services) of the Social Security Act to give preference in awarding maternal and child health services grant funds to applicants that provide training for service providers in how to identify and treat the health effects of such violence. Requires states to set aside a reasonable portion of such funds to provide for such violence services. Directs the Secretary to allot additional funds to enable states to provide for identification and treatment of such violence. Allows the Secretary to awards grants to federally qualified health centers to improve the identification and treatment of such violence. Amends the Violence Against Women Act of 1994 to require the Secretary, acting through the Directors of CDC and the Agency for Healthcare Research and Quality (AHRQ), to fund research on effective interventions in the health care setting that: (1) prevent domestic violence, dating violence, and sexual assault across the lifespan; (2) prevent the health effects of such violence; and (3) improve the safety and health of individuals who are currently being victimized.

Tax Relief Act of 2005 - Amends the Internal Revenue Code to: (1) provide tax incentives in areas affected by Hurricanes Katrina, Rita, and Wilma; (2) extend various expiring tax provisions; (3) revise provisions relating to charitable contributions and charitable organizations; (4) restrict tax shelter activity and increase penalties for underpayment of tax; and (5) revise provisions relating to taxation of foreign income, tax reporting, and accounting methods. Establishes a Gulf Opportunity Zone to provide tax benefits for areas affected by Hurricane Katrina, including bonus depreciation and increased expensing for small business property, additional private activity bond authority, increased funding for low income housing, and a tax credit for the retention of employees in the Hurricane Katrina disaster area. Extends existing tax relief provisions to areas affected by Hurricanes Rita and Wilma, including expanded eligibility for mortgage loans, tax-free use of retirement funds for disaster relief purposes, increased tax deduction for corporate charitable contributions, and tax adjustments for low-income taxpayers. Extends various tax provisions, including: (1) increased expensing for depreciable business property; (2) the tax credit for retirement savings contributions; (3) the tax deduction for higher education expenses; (4) the election to deduct state and local sales taxes in lieu of income taxes; (5) increased exemption amounts for the alternative minimum tax; (6) the tax credit for increasing research activities; (7) the work opportunity and welfare-to-work tax credit; (8) tax deductions for school teacher expenses and for corporate donations of computer equipment for educational purposes; (9) expensing of environmental remediation costs; and (10) the Indian employment tax credit and accelerated depreciation for business property on Indian Reservations. Revises various provisions relating to charitable donations and charitable organizations, including: (1) allowing nonitemizing taxpayers a limited tax deduction for charitable contributions; (2) allowing tax-free distributions from retirement accounts for charitable purposes; (3) restricting participation of tax-exempt organizations in tax shelter activities; (4) modifying recordkeeping requirements for certain charitable organizations; and (5) setting standards for credit counseling organizations. Defines "economic substance" for purposes of evaluating tax shelter transactions. Imposes increased civil and criminal penalties for tax evasion. Revises tax rules for individuals who expatriate to avoid U.S. taxation.

Student Health Assessment Act of 2005 - Authorizes the Secretary of Education to provide grants to ten local educational agencies to develop and complete comprehensive health assessments for students. Requires the Secretary to take into consideration school size, socioeconomic status and ethnic composition of students, and location when awarding grants. Requires each grantee to: (1) notify parents of the availability and benefits of such assessments; (2) assist qualified parents to apply for the State Children's Health Insurance Program (SCHIP); (3) facilitate or provide such an assessment to each participating student; (4) make available the results of each assessment to the parents of participating children, upon request; and (5) consolidate statistical information, without including individually identifiable information, for the Secretary. Directs the Secretary to develop a checklist for physicians or health care workers authorized by the grantee to conduct such assessments. Requires each assessment to be performed by such an authorized physician or health care provider chosen by the student's parents and to include a physical evaluation and a psycho-social evaluation.

Magnuson-Stevens Fishery Conservation and Management Reauthorization Act of 2005 - Amends the Magnuson-Stevens Fishery Conservation and Management Act (the Act) to authorize appropriations for the national fishery management program through FY2012. Revises provisions under the Act with respect to: (1) regional fishery management councils; (2) fishery management plan requirements; and (3) environmental review of fishery management plans; and (4) collection and confidentiality of certain information submitted for development of fishery management plans. Establishes: (1) limited access privilege programs to harvest fish; (2) Western Pacific regional marine education and training programs; (3) a regional economic transition program for fishermen affected by a catastrophic fishery disaster; (4) a bycatch reduction engineering program to minimize bycatch mortality; (5) a regionally based registry program for recreational fishermen; (6) an information program generated by the Marine Recreational Fishery Statistics Survey; (7) a cooperative research and management program; and (8) a Fisheries Conservation and Management Fund. Amends the Northern Pacific Halibut Act of 1982 to increase the civil penalties for violations of the Convention between the United States of America and Canada for the Preservation of the Halibut Fishery of the Northern Pacific Ocean and Bearing Sea and such Act. Authorizes the Secretary of Commerce to deny, revoke or suspend a permit issued to a vessel owner under marine resource law for such violations. Reauthorizes certain fisheries Acts through FY2010. Requires the Secretary to identify a nation's vessels that have engaged in illegal, unreported, or unregulated fishing (including relevant international fishery management organizations that have failed to implement effective measures to end such activities), or that have engaged in fishing practices beyond the exclusive economic zone that result in bycatch of a protected living marine resource, and to encourage them to take appropriate corrective actions or to enter into bilateral treaties to end such offending activities. Reauthorizes the the Atlantic Tunas Convention Act of 1975 through FY2012. Western and Central Pacific Fisheries Convention Implementation Act - Directs the President to appoint U.S. Commissioners to the Commission for the Conservation and Management of Highly Migratory Fish Stocks in the Western and Central Pacific Ocean (WCPFC Convention). Directs the Secretary to promulgate regulations to carry out U.S. obligations under the WCPFC Convention with respect to the conservation and management of highly migratory fish stocks. Makes it unlawful for any person to violate such regulations. Authorizes appropriations. Pacific Whiting Act of 2005 - Directs the Secretary to appoint U.S. individuals to specified committees established by the Agreement between the Government of the United States and the Government of Canada on Pacific Hake/Whiting. Requires the Secretary to establish the U.S. catch level for Pacific whiting according to the standards of the Agreement. Authorizes appropriations.

National Flood Insurance Program Commitment to Policyholders and Reform Act of 2005 - Amends the Flood Disaster Protection Act of 1973 and the National Flood Insurance Act of 1968 to define an area having special flood hazards. Requires the Director of the Federal Emergency Management Agency (FEMA Director) to report annually to Congress on the extent to which updating and modernization of all floodplain areas and flood-risk zones have been completed. Amends the Flood Disaster Protection Act of 1973 to: (1) increase from $350 to $2,000 the civil monetary penalty for mortgage lender failures to require flood insurance; and (2) eliminate the $100,000 cap on the total amount of such penalties assessed against any single regulated lending institution or enterprise during any calendar year. Requires the FEMA Director to: (1) establish an appeals process through which holders of a flood insurance policy may appeal decisions on claims, proofs of loss, and loss estimates relating to such flood insurance policy; (2) enforce the minimum training and education requirements for all insurance agents who sell certain flood insurance policies; and (3) issue regulations to implement specified portions of the Bunning-Bereuter-Blumenauer Flood Insurance Reform Act of 2004. Amends the National Flood Insurance Act of 1968 to increase the maximum flood insurance coverage limits for residential property. Prescribes coverage of additional living expenses and business interruption. Increases the borrowing authority vested in the Director. Requires the Director to report semi-annually to Congress on the financial status of the national flood insurance program.

Defines "information technology education and training program expenses" to include: (1) course work; (2) certification testing; (3) apprenticeship programs registered by the Department of Labor; and (4) other expenses essential to assessing skill acquisition. Redefines "eligible educational institution" to include a commercial information and communications technology training provider. Establishes an Information Technology Training Certification Advisory Board to develop: (1) guidelines for computer science, information technology, and related college courses; and (2) a list of the information technology training and certifications that qualify for the tax credit established by this Act.

Directs the Secretary of the Interior to convey all preferential lease parcels not purchased by the leaseholder to the South Dakota Department of Game, Fish, and Parks, to be used for mitigating the wildlife habitat that was lost as a result of the development of the Pick-Sloan project. Directs the Secretary to convey to the Department the nonpreferential leased parcels and unleased parcels of the Blunt Reservoir and Pierre Canal, to be used for mitigating the wildlife habitat that was lost as a result of the development of the Pick-Sloan project. Requires the state of South Dakota to accept certain conditions of conveyance, including that it receives the land conveyed in "as is" condition. Authorizes the Commission, with the Department's concurrence, to allow a person to exchange other land in South Dakota for a nonpreferential lease parcel or unleased parcel at Blunt Reservoir or Pierre Canal.

Revises the work opportunity and welfare-to-work tax credits to: (1) consolidate such credits into a single tax credit and extend the consolidated tax credit through 2007; (2) repeal income eligibility requirements for ex-felons; and (3) increase the age limit for food stamp eligibility from 25 to 35. Extends through 2007 the expensing allowance for environmental remediation costs, including remediation of petroleum products. Extends through 2008 the exemption of active financial services income from Subpart F taxation. Extends through 2010 the: (1) tax credit for retirement savings contributions (saver's credit); (2) increased expensing allowances for depreciable business assets; and (3) reduced tax rates for capital gains and dividend income.

Personal Responsibility, Work, and Family Promotion Act of 2005 - Amends the Social Security Act (SSA) to: (1) require universal engagement and family self-sufficiency plans with respect to block grants to states for Temporary Assistance for Needy Families (TANF); and (2) revise work participation requirements and work-related performance improvement. Promotion and Support of Responsible Fatherhood and Healthy Marriage Act of 2005 - Amends the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 to establish a fatherhood program. Amends the SSA to provide state option to make TANF programs mandatory partners with one-stop employment training centers. Expresses the sense of Congress that a state welfare-to-work program should include a mentoring program. Places a prohibition on offshoring for states who receive block grants for TANF. Caring for Children Act of 2005 - Amends the Child Care and Development Block Grant Act of 1990 with respect to child care and a waiver of authority to expand the availability of services under such Act. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to develop a public education campaign about pandemic influenza and preparedness. Requires the United States Geological Survey to carry out an interagency effort to detect avian influenza in wild birds. Provides for the expansion and intensification of influenza research. Requires the Director of CDC to expand and intensify Global Disease Detection Initiative efforts. Requires the Secretary to submit to the Director of the World Health Organization (WHO) a proposal to study the feasibility of establishing a Pandemic Fund to support pandemic influenza control and relief activities. Requires such Secretaries to conduct catastrophic event recovery evaluations of damaged federal lands. Directs such Secretaries to prepare a list of pre-approved management practices that may be immediately implemented as part of catastrophic event recovery projects or catastrophic event research projects. Requires determinations of whether or not to: (1) use any pre-approved management practices that can be immediately implemented; and (2) develop and carry out a recovery or research project or part of such a project using the alternative arrangements authorized by this Act. Directs such Secretaries to clarify agency-wide guidance regarding reforestation in response to catastrophic events. Provides for assistance to restore landscapes and communities affected by catastrophic events. Provides for the availability and use of pre-approved management practices and alternative arrangements on National Forest experimental forests.

Requires the Secretary to award grants for individuals with FASD, including to: (1) establish programs of surveillance, prevention, and treatment for such individuals; (2) identify best practices for educating affected children, educating officials in the criminal justice system on coping with such individuals, and educating adoption or foster care agency officials about services for children with FASD; and (3) provide for transitional services for such individuals, for respite care for their caretakers, and for increased awareness and identification of FASD at community health centers. Requires: (1) the Secretary to provide for continuation of the Interagency Coordinating Committee on Fetal Alcohol Syndrome; and (2) the Comptroller General to evaluate and make recommendations regarding appropriate federal FASD activities. Requires the Secretary to issue public service announcements to raise awareness of the risks associated with alcohol consumption during pregnancy. Requires the National Task Force on Fetal Alcohol Spectrum Disorders to identify and describe the ten most important actions that must be taken to reduce prenatal alcohol exposure and all its adverse outcomes. Requires the Secretary of Education to direct the Office of Special Education and Rehabilitative Services to take certain actions with regard to individuals with FASD, including implementing screening procedures and introducing curricula on how to educate children with such disorders. Requires the Attorney General to direct the Office of Juvenile Justice and Delinquency Prevention to take certain actions with regard to individuals with FASD, including educating officials on how to treat such individuals, studying the inadequacies of the current system for dealing with such individuals, and developing transition programs for such individuals who are released from incarceration.

Directs the Administrator of the Environmental Protection Agency to develop a Comprehensive Environmental Sampling and Toxicity Assessment Plan. Provides for federal and state government to notify hurricane survivors of health risks they may face upon returning to their domiciles. Provides for the offer of alternative land and/or housing as compensation to residents whose homes or businesses have been destroyed or terminally compromised. Revises the TANF Emergency Response and Recovery Act of 2005 to provide for reimbursement of states for Temporary Assistance to Needy Families (TANF) benefits provided under part A of title IV of the Social Security Act to families from other states affected by Hurricane Katrina. Sets forth requirements relating to emergency extended unemployment compensation. Requires the Secretary of Health and Human Services to establish a program of emergency health coverage continuation relief. Sets forth housing and education requirements. Displaced Citizens Voter Protection Provisions of 2005 - Prescribes requirements for the protection of voting rights of Katrina evacuees. Prescribes requirements for: (1) regulatory relief for financial services; and (2) disaster loans and small business relief. Amends the Internal Revenue Code to provide for: (1) a tax credit for an eligible homebuyer who purchases a principal residence in the Hurricane Katrina disaster area; (2) an increase in the housing credit dollar amount; and (3) tax-exempt bonds for qualified Gulf Coast recovery projects. Hurricane Katrina Bankruptcy Relief and Community Protection Act of 2005 - Amends the federal bankruptcy code to exempt victims of natural disasters, including small businesses, from certain requirements for debtors seeking relief. Directs the Director of the Federal Emergency Management Agency (FEMA) to establish a temporary flood insurance buy-in program. Expresses the sense of Congress that the President should present, within six months, a plan to eradicate poverty in the United States by 2015.
