Pulmonary Hypertension Research Act of 2005

Pulmonary Hypertension Research Act of 2005 - Amends the Public Health Service Act to require the Director of the National Heart, Lung, and Blood Institute to expand, intensify, and coordinate the activities of the Institute with respect to research on pulmonary hypertension and to coordinate the Director's activities with related activities of other national research institutes and National Institutes of Health (NIH) agencies. Requires the Director to make grants to, or enter into contracts with, public or nonprofit private entities for the development and operation of centers to conduct research and programs on pulmonary hypertension, including: (1) basic and clinical research into the cause, diagnosis, early detection, prevention, control, and treatment of the disease; (2) training programs for scientists and health professionals; (3) programs to provide information and continuing education to health professionals; and (4) programs for the dissemination of information to the public. Requires the Director to establish: (1) a data system for the collection, storage, analysis, retrieval, and dissemination of data derived from patient populations with pulmonary hypertension; and (2) an information clearinghouse to facilitate and enhance knowledge and understanding of pulmonary hypertension by health professionals, patients, industry, and the public.

Shortens the period for certain advance notifications to Congress under the Departments of Labor, Health and Human Services, and Education, and Related Agencies Appropriations Act, 2005, in particular the Department of Education Appropriations Act, 2005.

Louisiana Katrina Reconstruction Act - Makes emergency supplemental appropriations for FY2005 related to Hurricane Katrina disaster relief. Makes appropriations for interoperable communications. Provides for reconstruction/repair of the New Orleans Regional VA Hospital. Directs the Secretary of the Navy to convey the Naval Support Activity to the City of New Orleans, Louisiana, or the Port of New Orleans, Louisiana, to facilitate their development and expansion. Amends the Robert T. Stafford Disaster Relief and Emergency Assistance Act with respect to hazard mitigation measures in a major disaster area. Directs the Secretary of Homeland Security, acting through the Director of the Federal Emergency Management Agency (FEMA), to reimburse all costs associated with the restoration of privately-owned utility infrastructure damaged or destroyed by Hurricane Katrina. Helping to House the Victims of Hurricane Katrina Act - Amends the United States Housing Act of 1937 with respect to Hurricane Katrina Emergency Assistance Vouchers. Prescribes requirements under the Home Program for families displaced as a result of Hurricane Katrina. Establishes in the Treasury the Home Business and Mortgage Protection Fund. Amends the TANF Emergency Response and Recovery Act of 2005 with respect to reimbursement of states for benefits under title IV (Temporary Assistance for Needy Families) (TANF) part A of the Social Security Act (SSA)) provided to assist families from other states affected by Hurricane Katrina. Requires a state to provide medical assistance under SSA title XIX (Medicaid) to Disaster Relief Medicaid (DRM)-eligible Katrina Survivors under a plan established during the DRM coverage period. Provides for 100% federal matching payments for medical assistance provided in direct impact parishes. Establishes in the Treasury the United States Disaster Relief Fund. Amends the Internal Revenue Code and the Workforce Investment Act of 1998 to make Katrina survivors eligible for: (1) a refundable income tax credit for 100% of health insurance costs; and (2) assistance with health insurance coverage under national emergency grants. Provides that an area in which the President has declared that a major disaster exists shall be designated as a health professional shortage area. Waives, during the disaster relief period, certain quality reporting requirements under SSA title XVIII (Medicare) for hospitals located in any parish affected by Hurricane Katrina. Amends the federal bankruptcy code with respect to debtors who are victims of a natural disaster. Amends SSA title IX (Employment Security) to authorize the Secretary of the Treasury to transfer from the federal unemployment account to a state's account in the Unemployment Trust Fund an amount appropriate to ensure that the state account is not insolvent. Amends the Small Business Investment Act of 1958 to authorize the Administrator of the Small Business Administration to guarantee the timely payment of any debenture issued to a qualified borrower for purposes of rebuilding or resuming operations in a damaged area. Amends the Small Business Act with respect to Supplemental Emergency Loans after Hurricane Katrina. Louisiana Hurricane Katrina Agriculture Disaster Relief Act of 2005 - Prescribes requirements for certain crop disaster assistance. Privately Owned Utility System Restoration Act of 2005 - Directs the President to compensate privately owned utilities in Louisiana for losses incurred as a result of Hurricane Katrina. Establishes a Protecting Essential Louisiana Infrastructure, Citizens, and Nature Commission (Pelican Commission). Directs the Secretary of Commerce to establish a program of grants for activities relating to transition, recovery, and relocation for federal and state agencies, businesses, institutions of higher education, and public-private partnerships in Louisiana that have been affected by Hurricane Katrina or a related condition. Amends the Communications Act of 1934 to provide for emergency grants for construction of public telecommunications facilities damaged or destroyed by Hurricane Katrina. Provides relief for the crawfish industry. Directs the Administrator of the National Oceanic and Atmospheric Administration (NOAA) to report on the impacts of Hurricane Katrina on fisheries in affected states. Establishes an entrepreneurship redevelopment program to be administered by the Economic Development Administration to rebuild and diversify New Orleans and the ten surrounding parishes. Requires the Louisiana Department of Transportation and Development to establish grant programs to: (1) construct, maintain, and repair evacuation and energy supply routes; (2) expand road and transit capacity in the community; (3) restore, protect, and improve the infrastructure of the Port of New Orleans and other affected ports. Authorizes appropriations to the Federal Aviation Administration for reimbursements to the Louis Armstrong New Orleans International Airport for anticipated revenue shortfalls. AmeriCorps Disaster Relief Corps Act of 2005 - Establishes an AmeriCorps Disaster Relief Corps to carry out projects in a major disaster or emergency area that provide food, clothing, shelter, and other humanitarian assistance for disaster victims. Domestic Offshore Energy Reinvestment Act of 2005 - Directs the Secretary of the Treasury to make payments to coastal states from certain offshore energy-related amounts for hurricane protection and protection of resources from natural disasters. Offshore Fairness Act of 2005 - Extends the seaward boundaries of Gulf of Mexico states from three geographical miles to three marine leagues if certain conditions are met. Louisiana Restoration Stamp Act of 2005 - Directs the Secretary of the Treasury to issue a Louisiana Restoration Stamp and establish the Louisiana Restoration Stamp Fund to hold sale proceeds for coastal and wetland restoration activities. Amends the Federal Water Pollution Control Act to authorize appropriations for the restoration of the Lake Pontchartrain basin. Amends the Internal Revenue Code to prescribe or revise emergency tax relief measures for residents of the Hurricane Katrina disaster area, including specified tax credits and deductions from gross income. Provides for suspension of air transportation excise taxes. Special Inspector General for Relief and Reconstruction Act of 2005 - Authorizes the Special Inspector General for Iraq Reconstruction to continue to serve as the Special Inspector General for Relief and Reconstruction in order to audit and investigate the use of funds made available for Hurricane Katrina recovery. Directs the Government Accountability Office (GAO) to track and report to Congress quarterly on spending of Hurricane Katrina emergency supplemental appropriations. Amends the federal criminal code to create a federal crime of interfering with federal disaster relief efforts. Shields volunteers from lawsuits arising out of their rendering of aid to victims of Hurricane Katrina.

Provides that the Secretary, for the period up to March 31, 2006, and so far as the Secretary considers appropriate: (1) may waive Head Start Act provisions limiting the federal share of funding; and (2) shall waive documentation requirements for HK- affected children who participate in Head Start and Early Head Start programs.

Natural Disaster Student Aid Fairness Act

Natural Disaster Student Aid Fairness Act - Authorizes, and in certain cases requires, the Secretary of Education to waive certain matching funds requirements and reallocation rules, and to extend the availability of certain funds, with respect to campus-based student assistance programs under the Higher Education Act of 1965, for institutions of higher education that: (1) are located in areas affected by a Gulf hurricane disaster caused by Hurricane Katrina or Hurricane Rita; or (2) have accepted for enrollment any students who were affected by such disaster. States that such students may be affected by reason of: (1) having been enrolled or accepted by an institution in the affected area; (2) being dependent on parents residing or employed in such an area; or (3) having suffered direct economic harm as a direct result of such disaster.

National Ocean Exploration Program Act - Directs the Secretary of Commerce to establish within the National Oceanic and Atmospheric Administration (NOAA) a coordinated national ocean exploration program that promotes collaboration with existing NOAA programs, including those authorized under this Act. Directs the NOAA Administrator to: (1) conduct interdisciplinary exploration voyages or other scientific activities to survey, inventory, observe, and assess little-known areas of the marine environment; (2) give priority to deep ocean regions, focusing on marine systems holding potential for important scientific discoveries; and (3) promote development of improved oceanographic research, communication, navigation, and data collection systems. Requires NOAA to convene an ocean exploration technology and infrastructure task force to develop and implement a strategy to: (1) facilitate the transfer of new exploration technology to the program; (2) improve the availability of communications infrastructure (including satellite) to the program; (3) develop a data management information processing system for information obtained under the program; and (4) conduct public education and outreach activities that improve the public understanding of ocean science, resources, and processes. Authorizes NOAA, the National Science Foundation, and other federal agencies to participate in interagency financing in carrying out program activities. NOAA Undersea Research Program Act of 2005 - Directs the Administrator of NOAA to establish and maintain an undersea research program conducted through a national headquarters, a network of regional undersea research centers, and a national technology institute.

Advancing FASD Research, Prevention, and Services Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services to establish a research agenda for the Fetal Alcohol Spectrum Disorders (FASD) and facilitate surveillance and prevention of such disorders. Requires the Secretary to award grants for individuals with FASD, including to: (1) establish programs of surveillance, prevention, and treatment for such individuals; (2) identify best practices for educating affected children, educating officials in the criminal justice system on coping with such individuals, and educating adoption or foster care agency officials about services for children with FASD; and (3) provide for transitional services for such individuals, for respite care for their caretakers, and for increased awareness and identification of FASD at health centers. Requires: (1) the Secretary to provide for continuation of the Interagency Coordinating Committee on Fetal Alcohol Syndrome; and (2) the Comptroller General to evaluate and make recommendations regarding appropriate federal FASD activities. Requires the Secretary to issue public service announcements to raise awareness of the risks associated with alcohol consumption during pregnancy. Requires the National Task Force on Fetal Alcohol Spectrum Disorders to identify and describe the ten most important actions that must be taken to reduce prenatal alcohol exposure and all its adverse outcomes. Requires the Secretary of Education to direct the Office of Special Education and Rehabilitative Services to take certain actions with regard to individuals with FASD, including implementing screening procedures and introducing curricula on how to educate children with such disorders. Requires the Attorney General to direct the Office of Juvenile Justice and Delinquency Prevention to take certain actions with regard to individuals with FASD, including educating officials on how to treat such individuals, studying the inadequacies of the current system for dealing with such individuals, and developing transition programs for such individuals who are released from incarceration.

Authorizes ED to: (1) make grants to LEAs for supplemental educational services or additional programs and activities for HK-displaced or -affected students; (2) make payments to LEAs in Louisiana, Mississippi, and Alabama to restart operations at schools in HK-disaster areas; and (3) delay applicability of ESEA teacher qualification requirements to Alabama, Louisiana, and Mississippi and their LEAs due to exceptional or uncontrollable circumstances. Allows any LEA to provide reciprocity for HK-displaced teachers and paraprofessionals. Directs ED to: (1) use the 2004-2005 child count for 2006-2007 funding under ESEA and the Individuals with Disabilities Education Act (IDEA) if the LEA serves a school in an HK-disaster area and has a net loss of students; (2) make payments to LEAs to improve instruction of HK-displaced students (if the LEA does not count such students for ESEA and IDEA funding); and (3) assist LEAs serving HK-displaced homeless children and youths. Provides for waiver authority by ED and suspends application of certain student aid requirements under the Higher Education Act of 1965, with respect to HK-affected students or educational institutions, including provisions for: grant assistance repayment, loan deferments, loan limits, work-study, grant uses, and distance education. Directs ED, with respect to HK-affected children with disabilities, to: (1) use 2004-2005 numbers for IDEA funding of sending states; and (2) provide funds to receiving LEAs to provide early intervention services. Directs ED, in reallocating funds under the Rehabilitation Act of 1973, to give preference to affected states that contain HK-disaster areas or that received a significant number of individuals from such areas. Allows affected states to apply for waivers of nonfederal share requirements and use reallocated funds for apprenticeship programs for individuals with disabilities to participate in reconstruction or other major disaster assistance activities in areas where they lived on August 22, 2005. Allows affected states to apply to use certain grant funds under the Assistive Technology Act of 1998 to enable HK-affected individuals with disabilities to replace damaged or lost assistive technology devices. Authorizes ED to make grants to enable affected states to carry out such replacement programs. Requires an audit of each ED program that includes HK-related response and recovery activities. Child Care Disaster Assistance Act of 2005 - Authorizes the Secretary of Health and Human Services (HHS) to: (1) waive, for HK-disaster areas, specified provisions of the Child Care and Development Block Grant Act of 1990 in order to provide child care services to orphaned children or displaced families; and (2) provide technical assistance and guidance to providers of child care services to such children and families. Directs HHS to: (1) waive income eligibility and documentation requirements for HK-affected children in programs under the Head Start Act; and (2) provide technical assistance, guidance, and resources for Head Start agencies serving such children.

Authorizes use of reading activities subgrants for individual or small-group instruction, as well as for class-wide instruction.

Amends SSA title XI part A (General Provisions) to require each state administering a program under SSA title IV part B or part E to establish a permanent, multidisciplinary, broad-based commission on state child welfare programs. Amends the Higher Education Act of 1965 to provide for loan forgiveness for: (1) family law, juvenile law, and domestic relations attorneys who work in the defense of low-income families, individuals, or children; and (2) child welfare workers. Amends the Victims of Child Abuse Act of 1990 to reauthorize at increased levels the Court Appointed Special Advocate Program, including such programs in rural and underserved urban areas. Expresses the sense of the Senate that the Chief Justice for each state and other state court leadership should take the lead in providing for the health, safety, and permanency of children before state abuse and neglect courts.

Deems volunteer health professionals providing a qualifying health service related to a declared major disaster to be employees of the Public Health Service for purposes of liability protection. Authorizes the Secretary to suspend state health professional licensing and certification requirements for health professionals that are operating in such state during a declared major disaster. Authorizes the Secretary and the Secretary of Homeland Security to waive any federal requirements applicable to health professions that would limit the ability of health professionals to provide volunteer medical services related to a declared major disaster.

Hurricane Emergency Limitation on Payments (HELP) Act of 2005 - Prohibits certain penalties against a person affected by Hurricane Katrina for failing to make timely payments on a federal financial obligation. Allows the President to provide mortgage or rental payments to people affected by Hurricane Katrina. Amends the Robert T. Stafford Disaster Relief and Emergency Assistance Act to require the President to provide appropriate benefit assistance to any individual unemployed as a result of a major disaster. Provides tax relief to taxpayers affected by Hurricane Katrina, including disregarding a specified period in determining the tax liability of such taxpayers and excluding certain withdrawals from retirement plans from gross income. Hurricane Katrina Food Assistance Relief Act of 2005 - Amends the Food Stamp Act of 1977 to provide expedited and increased food stamp benefits for households in areas affected by Hurricane Katrina. Delays the changes to bankruptcy law for residents of a declared major disaster area in connection with Hurricane Katrina.

Requires each local educational agency or school to provide notice of the integrated pest management system of the school district at the beginning of each school year and to give prior notice of any use of a pesticide (other than a least toxic pesticide) to parents, guardians, and school staff members. Prescribes procedures to be followed if a pest cannot be controlled after having used an integrated pest management system and least toxic pesticides. Prescribes civil penalties for violations of this Act. Establishes the Integrated Pest Management Trust Fund to carry out education, training, propagation, and development activities under school integrated pest management systems. Prohibits, no later than six years after this Act's enactment, the use of any pesticide other than a least toxic pesticide in schools unless the Administrator has met the requirements of this Act.

Requires the Administrator of NOAA to: (1) undertake marine debris mapping, impact assessment, prevention, and removal efforts, with a focus on marine debris posing a threat to living marine resources (particularly endangered or protected species) and navigation safety; (2) improve efforts and actively seek to prevent and reduce fishing gear losses, as well as their adverse impacts on living marine resources and navigation safety; and (3) undertake outreach and education of the public and other stakeholders in the fishing, fishing gear manufacturers, and other marine-dependent industries on sources of and threats associated with marine debris and approaches to identify, determine sources of, reduce, and prevent such debris and its adverse impacts on the marine environment and navigational safety. Directs the Commandant of the Coast Guard to undertake measures to reduce violations of MARPOL Annex V (Annex V of the International Convention for the Prevention of Pollution from Ships, 1973) and the Act to Prevent Pollution from Ships with respect to the discard of plastics and other garbage from vessels. Establishes an Interagency Committee on Marine Debris to: (1) coordinate a comprehensive program of marine debris research and activities among federal agencies, in cooperation with nongovernmental organizations, industry, universities, state governments, Indian tribes, and other nations; and (2) foster cost-effective mechanisms to identify, determine sources of, reduce, and prevent marine debris and its adverse impact on the marine environment and navigational safety, including the joint funding of research and mitigation and prevention strategies.

Increases Pell grant maximums, allows year-round grants, and eliminates tuition-sensitivity. Eliminates programs of 21st Century Scholar Certificates, Academic Achievement Incentive Scholarships, and Learning Anytime Anywhere Partnerships. Revises HEA title IV need analysis and general provisions for student assistance, including forms. Requires an early financial aid information system and a college access initiative. Raises certain student loan limits. Revises parent loan interest rates. Provides for recapture of excess interest with respect to special allowance payments to lenders. Reduces lender insurance reimbursement rates. Requires guaranty agencies to deposit loan origination fees in a federal fund. Provides for student loan repayment deferment for military service in a combat zone. Prohibits guaranty agencies from: (1) having consolidation lending as an excessive proportion of their recoveries on defaulted loans; and (2) charging excessive collection costs on such consolidation loans. Repeals a single holder rule for consolidation loans. Provides for: (1) a school as lender moratorium; (2) income contingent repayment for public sector employees; (3) an increased income protection allowance for dependent students; (4) a simplified need test; and (5) an increased ceiling for automatic-zero eligibility. Reauthorizes appropriations for: (1) teacher quality enhancement grants for states and partnerships, grants for preparing teachers to use technology, and new centers of excellence for recruiting and preparing teachers; (2) grants for American Indian tribally controlled colleges and universities, Alaska Native and Native Hawaiian-serving institutions, and historically Black colleges and universities; (3) student assistance; (4) developing institutions grants for Hispanic-serving institutions, and new grants for graduate programs at such institutions; (5) international education programs; and (6) graduate and postsecondary improvement programs. Establishes programs relating to: (1) mathematics and science scholars; (2) postsecondary education assessment; (3) job skill training in high-growth occupations or industries; (4) student retention and articulation agreements; (5) knowledge of American history, free institutions, and Western civilization; (6) Teach for America, the national teacher corps; (7) Patsy T. Mink graduate fellowships; and (8) college enrollment rates of secondary schools. Amends the Taxpayer-Teacher Protection Act of 2004 to make permanent: (1) a reduction of special allowance payments for loans from the proceeds of tax exempt issues; and (2) expanded student loan forgiveness for special education teachers in elementary and secondary schools and mathematics and science teachers in secondary schools. Reauthorizes appropriations for various programs under the Education of the Deaf Act of 1986 and the Tribally Controlled College or University Assistance Act of 1978. Repeals certain programs under the Higher Education Amendments of 1998. Navajo Nation Higher Education Act of 2005 - Reauthorizes appropriations for the Navajo Community College Act.

Nurse Faculty Education Act of 2005 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services, acting through the Health Resources and Services Administration, to establish a Nurse Faculty Education Program to ensure an adequate supply of nurse faculty through the awarding of grants to eligible entities to: (1) provide support for hiring new faculty, retaining existing faculty, and purchasing educational resources; (2) provide for increasing enrollment and graduation rates for students from doctoral programs; and (3) assist graduates in serving as nurse faculty in nursing schools. Sets forth provisions regarding eligibility requirements and permissible uses of grant funds. Directs the Secretary to give priority to entities from states and territories that have a lower number of employed nurses per 100,000 population. Directs the Secretary to award specified numbers and amounts of grants for FY2006-FY2010, subject to specified limitations. Directs: (1) the Secretary to evaluate and report to Congress on the results of activities carried out under such grants; and (2) the Comptroller General to study and report to Congress concerning activities to increase participation in the nurse educator program.

Specialty Crop and Value-Added Agriculture Promotion Act - Amends the Specialty Crops Competitiveness Act of 2004 to include within the definition of specialty crop: (1) farm-raised or wild-harvested fish and shellfish; and (2) organically produced specialty crops. Makes the authorization of appropriations for state specialty crop block grants permanent. Amends the Agricultural Risk Protection Act of 2000 to replace the agricultural marketing resource center pilot project with a state block grant program for value-added agricultural product market development. Directs the Secretary of Agriculture to establish an incentive program for third-party certification of agricultural producers and processors for quality and production practices that increase agricultural commodity marketability or value. Provides for up 50% reimbursement of participant certification costs. Amends the Federal Crop Insurance Act to direct the Commodity Credit Corporation to carry out the adjusted gross revenue insurance pilot program as a permanent program. Authorizes the Corporation to: (1) expand the program to cover any county in which crops are produced; and (2) grant temporary policy subsidies for producers located in a county that has a high level of specialty crop production and has not had a high level of crop insurance coverage coverage. Amends the Richard B. Russell National School Lunch Act to direct the Secretary to: (1) make available to students in not more than 100 schools in each state, and in elementary and secondary schools on one Indian reservation, free fresh and dried fruits and vegetables throughout the school day in one or more school-designated areas; and (2) give priority to states that produce large quantities of specialty crops. Amends the Consolidated Farm and Rural Development Act to increase operating loan limits for loans guaranteed other than by the Secretary. Revises the related inflation percentage determination. Amends the Trade Act of 1974 to establish the position of Assistant United States Trade Representative for Specialty Crops. Amends the Farm Security and Rural Investment Act of 2002 to increase the authorization of appropriations for specialty crop technical assistance.

Directs the Secretary of Veterans Affairs to provide a percentage annual increase in the rates of such educational assistance based on the average monthly costs of higher education. Authorizes reimbursement of reductions in basic pay for educational assistance coverage in the case of extended active-duty service. Provides similar eligibility for the transfer of educational assistance for members of the Selected Reserve who have completed at least six years of service and enter into an agreement to remain a member of such Reserve for at least four more years. Provides educational assistance eligibility credit for cumulative active-duty service in the Selected Reserve. Increases the rates of educational assistance under the Reserve Montgomery GI Bill. Applies an annual adjustment to the rates of survivors' and dependents' educational assistance.
