Energy Innovation and Carbon Dividend Act of 2023

Energy Innovation and Carbon Dividend Act of 2023 This bill imposes a fee on the carbon content of fuels, including crude oil, natural gas, coal, or any other product derived from those fuels that will be used so as to emit greenhouse gases into the atmosphere. The fee is imposed on the producers or importers of the fuels and is equal to the greenhouse gas content of the fuel multiplied by the carbon fee rate. The rate begins at $15 per metric ton of CO2-e (i.e., carbon dioxide equivalent) in 2023, increases by $10 each year, and is subject to further adjustments based on the progress in meeting specified emissions reduction targets. The bill also includes exemptions for fuels used for agricultural or nonemitting purposes, exemptions for fuels used by the Armed Forces, rebates for facilities that capture and sequester carbon dioxide, and border adjustment provisions that require certain fees or refunds for carbon-intensive products that are exported or imported. The fees must be deposited into a Carbon Dividend Trust Fund and used for administrative expenses and dividend payments to U.S. citizens or lawful residents. The fees must be decommissioned when emissions levels and monthly dividend payments fall below specified levels. The bill also requires the Department of Energy to enter into agreements with the National Academy of Sciences to study and report on various impacts related to the carbon fee and emissions reduction schedule established by the bill.

Responsible Legislating Act This bill establishes or modifies various federal programs, including programs to increase participation in tax-exempt retirement plans, assist members of the Armed Forces, and increase penalties for human trafficking. Among other provisions, the bill extends through FY2024 livestock mandatory reporting requirements under the Livestock Mandatory Reporting Act of 1999; provides for apprenticeship training for members of the Armed Forces; makes various changes to tax-exempt pension plan provisions, including expanding automatic enrollment, increasing the tax credit for retirement savings contributions, and increasing the age for mandatory minimum distributions; establishes a Boots to Business Program to assist current and former members of the Armed Forces, including members of the National Guard and Reserves, interested in business ownership; increases criminal penalties for human trafficking and coercion and enticement in school zones; establishes the Commission to Study the Potential Creation of a National Museum of Asian Pacific American History and Culture; requires a report on increasing foreign direct investment in semiconductor-related manufacturing and production; and directs the Federal Maritime Commission, through a federally-funded research and development center, to evaluate the effect of foreign ownership of marine terminals at the 15 largest U.S. container ports on U.S. economic security. The bill appropriates funds in FY2024 for programs or divisions of the Departments of Health and Human Services, Agriculture, State, Defense, Homeland Security, and Energy.

Supporting Armenians Against Azerbaijani Aggression Act of 2023 This bill directs and authorizes certain actions aimed at supporting Armenia in its conflict with Azerbaijan. For example, the bill repeals presidential waiver authority that allows for certain foreign assistance to Azerbaijan; authorizes foreign military financing grants to Armenia for FY2024; requires the Department of State to submit a detailed strategy to Congress to ensure the durable security for the people of Nagorno-Karabakh and a detailed report on alleged Azerbaijani atrocities in its attacks on Armenia and Nagorno-Karabakh in 2022 and 2023; authorizes the State Department and USAID to implement activities related to development of Armenia's energy sector; requires the State Department to seek opportunities for partnership between U.S. and Armenian entities on science and technology; and requires the President to impose sanctions on certain Azerbaijani officials determined to have directed (1) operations instigating the 2020 Nagorno-Karabakh war, (2) attacks on Armenia in September 2022, (3) the blockade of the Lachin corridor beginning in December 2022, or (4) attacks on Nagorno-Karabakh in September 2023.

Michael F. Donoughe Tax Credit for Off Road Electric Vehicles Act This bill expands the clean vehicle tax credit to include new qualified off-road plug-in electric vehicles. The amount of the tax credit allowed for a new qualified off-road plug-in electric vehicle is 10% of the cost of the vehicle or $2,500, whichever is lower. The bill defines a new qualified off-road plug-in electric vehicle as any vehicle that is acquired new and for use by the taxpayer; is made by a qualified manufacturer; is powered by an electric motor that draws electricity from a battery with a capacity of at least six  kilowatt hours; has final assembly occurring in North America; has a dry weight of less than 3,500 pounds; has three or more wheels; has one or more seats; is manufactured primarily for off-road use; is designed for use on rough terrain and, except in the case of a vehicle designed to operate on land and water, is not designed to operate on rails, in the air, or in or on the water; and is capable of reaching a speed of 40 miles per hour. Under current law, a qualified manufacturer is any manufacturer that has a written agreement with the Internal Revenue Service and submits reports containing information about each eligible clean vehicle. Finally, the bill allows the tax credit for a new qualified off-road plug-in electric vehicle to be transferred from the taxpayer to an eligible entity (e.g., vehicle dealer) in exchange for a financial benefit (e.g., rebate).

Community Assistance for Recovery and Empowerment Act or the CARE Act This bill allows inpatient psychiatric treatment facilities and chemical dependence treatment facilities to qualify for Federal Housing Authority mortgage insurance. The bill establishes the Office of Psychiatric and Addition Treatment Facilities to oversee mortgage insurance provided to these facilities. The bill also specifies that a federally insured loan for improvements to a multifamily housing project or health facility may be used to protect against floods, hurricanes, earthquakes, and other natural disasters. The bill also expands loan insurance for certain energy conservation improvements to include health facility projects.

Stop EV Freeloading Act This bill imposes a new excise tax in the amount of $1,000 on the sale of an electric vehicle and a new excise tax in the amount of $550 on the sale of a battery module weighing over 1,000 pounds for use in an electric vehicle. The bill also requires the Department of the Treasury to transfer amounts collected from the new excise taxes to the Highway Trust Fund. The bill defines electric vehicle as a light-duty vehicle (a motor vehicle weighing less than 8,500 pounds that is manufactured for use on public roads) that is powered by a battery with a capacity of at least seven kilowatt hours and is recharged through an external source of electricity. The bill specifies that the term does not apply to hybrid vehicles, which are powered by a combination of fuel and a rechargeable energy storage system. The bill defines battery module as two or more battery cells configured to create voltage or current (or no battery cells) and with an aggregate capacity of at least seven kilowatt hours (or one kilowatt hour for a hydrogen fuel cell vehicle).

Children's Savings Accounts Offer Parents Plenty Of Reasons To Understand and Invest in Tuition Yearly Act or the CSA OPPORTUNITY Act This bill excludes the value of certain children's savings accounts, provided they meet specified requirements, when determining eligibility for particular means-tested federal programs. To be excluded, the savings account must be created as part of a program organized by a government, nonprofit, school district, or college or university and meet other administrative criteria. Furthermore, proceeds of the account may only be used for postsecondary educational expenses, the purchase of a first home, or costs associated with starting a business once the individual receives a secondary school diploma or equivalent. Programs subject to this bill are the Supplemental Nutrition Assistance Program (SNAP), Temporary Assistance for Needy Families (TANF), Supplemental Security Income for the Aged, Blind, and Disabled (SSI), and the Low-Income Home Energy Assistance Program (LIHEAP). If a state considers the value of children’s savings accounts in determining TANF eligibility in violation of this bill, the Department of Health and Human services is directed to reduce the state’s TANF grant for the next fiscal year.

Climate Solutions Act of 2023 This bill establishes renewable energy standards, energy saving targets, and greenhouse gas emission reduction targets. Specifically, the Department of Energy (DOE) must promulgate regulations to increase the percentage of electricity sold in the United States that is generated from renewable sources. By 2035, 100% of electricity must be generated from renewable sources. DOE must also promulgate regulations that set end-user electricity savings targets for retail electric energy suppliers and natural gas saving targets for retail natural gas suppliers through 2030 as specified by the bill. Each year's savings must be in addition to the previous years' savings. DOE must allow suppliers to achieve the targets through a market-based trading system. The Environmental Protection Agency (EPA) must promulgate annual net emission reduction targets for 2030 through 2050 to ensure that U.S. greenhouse gas emissions (1) in 2035 are at least 52% below those in 2005, and (2) in 2050 are zero. The EPA must promulgate final regulations to implement those targets within seven years and review them at least every five years thereafter.

Stopping Genetic Monitoring by China Act

Stopping Genetic Monitoring by China Act This bill imposes export controls on genetic testing and sequencing technologies and bars exports of such technologies to specific countries. The bill also imposes sanctions on foreign persons (individuals and entities) involved with certain activities, including human rights violations. Specifically, the End-User Review Committee must place on the Commerce Control List (CCL) technologies identified as genetic instruments by the Department of Defense, the Department of State, or the Department of Energy. The committee must also deny licenses required to export or transfer such technology to countries specified in this bill (e.g, Iran, North Korea, China, or Russia) unless the license applicant demonstrates that the technology will not be used for human rights abuses or by an entity engaged in human rights abuses. (Items covered by the CCL are subject to export controls and typically may not be exported without a license.) The bill also requires the President to impose property- and visa-blocking sanctions on certain foreign persons, including (1) persons that are responsible for or complicit in gross violations of internationally recognized human rights, (2) persons that conduct genetic testing and analysis and are located in a country targeted by the export controls in this bill, (3) any university in China involved in genetic monitoring and human rights abuses, (4) any private company in China with an owner or senior management official who is a delegate to the National People's Conference, and (5) corporate officers of entities sanctioned under this bill.

Congressional Trade Authority Act of 2023 This bill requires congressional approval for a presidential import adjustment due to a national security threat from an import related to military equipment, energy resources, or critical infrastructure essential to national security. Specifically, the bill requires the President to submit a proposal to Congress, which Congress may approve by a joint resolution. Under current law, the President determines whether any adjustment of an import is necessary and must submit to Congress the reasons for any action taken or not taken. The Department of Defense (currently, the Department of Commerce) must investigate the effect of these imports on national security. The bill retroactively applies to any proposed action made six years before enactment of this bill.

Renewable Energy for U.S. Territories Act This bill directs the Department of Agriculture (USDA) to establish a grant program under which USDA may award grants to eligible nonprofit organizations for renewable energy systems, energy efficiency activities, energy storage, smart grids, or microgrids in U.S. territories. In addition, USDA may award grants to train residents of U.S. territories to develop, construct, maintain, or operate renewable energy systems. The Department of Energy must ensure that its national laboratories offer to provide technical assistance to grant recipients. The Government Accountability Office must study and report on renewable energy and energy efficiency in U.S. territories.

Foreign Agricultural Restrictions to Maintain Local Agriculture and National Defense Act of 2023 or the FARMLAND Act of 2023 This bill expands federal authority and oversight over foreign investments in the U.S. agricultural industry. The bill expands the authority of the Committee on Foreign Investment in the United States (CFIUS) to include the review of land transactions (involving foreign entities) that exceed $5 million or 320 acres of land over the preceding three years. This applies to land that is primarily used for agriculture, the extraction of energy sources, or the extraction of critical precursor materials for biological technology industries, information technology components, or national defense technologies. Further, the bill adds the Secretary of Agriculture and the Commissioner of Food and Drugs to CFIUS membership. (CFIUS is an interagency committee that oversees the national security risks of certain foreign direct investment in the U.S. economy, including by reviewing certain real estate transactions.) Further, the bill expands enforcement of the Agricultural Foreign Investment Disclosure Act (AFIDA). The Department of Agriculture (USDA) must appoint a Chief of Operations of Investigative Actions to (1) monitor AFIDA compliance, and (2) conduct investigations on efforts to steal agricultural knowledge and technology and to disrupt the U.S. agricultural base. The bill prohibits foreign persons who own or operate land from participating in Farm Service Agency programs and establishes penalties for violators. The bill also requires USDA and the Department of Homeland Security to jointly develop a database of agricultural land owned by foreign persons.
