Strengthening Manufactured Appliance Requirements towards Thoughtful Energy Efficiency Standards Act or the SMART Energy Efficiency Standards Act This bill modifies the date that regional energy efficiency standards established under the Energy Policy and Conservation Act (EPCA) apply to furnaces, central air conditioners, and heat pumps. EPCA applies the standard on the date such products are installed. The bill applies the standard on the date such products are manufactured or imported.

Northeast Fisheries Heritage Protection Act

Northeast Fisheries Heritage Protection Act This bill bans the development of commercial offshore wind energy in Lobster Management Area One in the Gulf of Maine. The bill also directs the Government Accountability Office to assess the sufficiency of the environmental review processes of the National Marine Fisheries Service, the Bureau of Ocean Energy Management, and other relevant federal agencies for existing offshore wind projects in the Gulf of Maine.

Transparency in Energy Production Act of 2023

Transparency in Energy Production Act of 2023 This bill requires certain disclosures by entities seeking a lease or holding a lease to develop renewable energy operations or fossil fuel operations on public lands or Indian lands or any operation using any right-of-way or special use permit that would cross public lands, Indian lands, or national forests that would facilitate fossil fuel development. The disclosures are those described in the Sustainability Accounting Standard for the Renewable Resources and Alternative Energy Sector or the Extractives and Mineral Processing Sector. Every two years, the Department of the Interior and the Department of Agriculture must report to Congress on such operations, including greenhouse gas emissions, air quality, water management, biodiversity impacts, production, and the number of sites. For renewable energy operations on public lands or Indian lands, the report must include greenhouse gas emissions that would result from the production of the same amount of energy using fossil fuels.

Clean Cooking Support Act This bill requires actions to increase the number of clean cookstoves and fuels for household, institutional, or commercial use throughout the world. The Department of State and the U.S. Agency for International Development (USAID) shall jointly establish the Clean Cooking Interagency Working Group to assist with overseeing the planning, management, and coordination of initiatives to increase the number of clean cookstoves and fuels worldwide. The State Department, USAID, the Department of Energy, the National Institutes of Health, the Centers for Disease Control and Prevention, and the Environmental Protection Agency shall work with the Clean Cooking Alliance to carry out clean cooking activities that relate to the missions of such departments or agencies.

Public School Green Rooftop Program This bill allows state energy conservation plans established under the Energy Policy and Conservation Act to include programs that award grants for green roofs on public elementary school and secondary school buildings. Under the bill, a green roof is a layer of vegetation planted over a waterproofing system or waterproof management practice that is installed on top of a flat or slightly-sloped roof that may support plant growth.

Among other priorities, the resolution commits to updating the poverty measure; raising the minimum wage; expanding unemployment insurance; ensuring that all workers receive paid family and medical leave; implementing a federal jobs guarantee; guaranteeing safe and quality housing, a right to water, high-quality public education, and quality health care for all; enacting relief from household and personal debt that cannot be paid; ensuring that state, local, and tribal governments are adequately funded; expanding and protecting the right to vote; eliminating persistent racial inequities; protecting the constitutional rights of assembly and free speech; enacting comprehensive and just immigration reform; ensuring all the rights of Native and Indigenous peoples and tribal nations; transforming the economy into a green renewable energy economy; demilitarizing U.S. foreign policy, borders, and policing; enacting fair taxes on corporations and the wealthy; using deficit spending to meet pressing needs; and encouraging states and cities to enact policies that follow the direction provided by this resolution.

FARMLAND Act of 2023

Foreign Agricultural Restrictions to Maintain Local Agriculture and National Defense Act of 2023 or the FARMLAND Act of 2023 This bill expands federal authority and oversight over foreign investments in the U.S. agricultural industry. The bill expands the authority of the Committee on Foreign Investment in the United States (CFIUS) to include the review of land transactions (involving foreign entities) that exceed $5 million or 320 acres of land over the preceding three years. This applies to land that is primarily used for agriculture, the extraction of energy sources, or the extraction of critical precursor materials for biological technology industries, information technology components, or national defense technologies. Further, the bill adds the Secretary of Agriculture and the Commissioner of Food and Drugs to CFIUS membership. (CFIUS is an interagency committee that oversees the national security risks of certain foreign direct investment in the U.S. economy, including by reviewing certain real estate transactions.) Further, the bill expands enforcement of the Agricultural Foreign Investment Disclosure Act (AFIDA). The Department of Agriculture (USDA) must appoint a Chief of Operations of Investigative Actions to (1) monitor AFIDA compliance, and (2) conduct investigations on efforts to steal agricultural knowledge and technology and to disrupt the U.S. agricultural base. The bill prohibits foreign persons who own or operate land from participating in Farm Service Agency programs and establishes penalties for violators. The bill also requires USDA and the Department of Homeland Security to jointly develop a database of agricultural land owned by foreign persons.

To amend the Internal Revenue Code of 1986 to require certain contract terms in contracts relating to wind turbines on land not owned by the taxpayer as a requirement in order to claim the credit relating to electricity produced from certain renewable resources.

However, the Federal Energy Regulatory Commission may not grant expedited approval for applications to export natural gas to any nation that is (1) subject to sanctions or trade restrictions imposed by the United States, or (2) designated by an act of Congress as excluded from such expedited approval for reasons of national security.

Future of Aviation Act

Future of Aviation Act This bill expands the Airport Improvement Program (AIP) to include grant coverage for current and future electric power requirements of public-use airports. Specifically, this bill directs the Federal Aviation Administration (FAA) to establish a program and provide airport sponsors grants to conduct airport development to increase energy efficiency or meet future electrical power demands. The bill also expands two definitions under the AIP to specify that (1) airport development includes an on-airport project to meet current and future electrical power demand, and (2) airport planning includes assessing current and future electrical power demand. The FAA may also establish an AIP pilot program to provide funding for electric aircraft infrastructure. Up to 10 public-use airports may be eligible for grants to carry out (1) the acquisition, operation, and installation of equipment to support electric aircraft operations; and (2) the construction or modification of infrastructure for power delivery or services for electric aircraft.

For example, the FAA and DOE must establish positions and goals for the use of hydrogen to increase aviation decarbonization; study (through grants, contracts, or interagency agreements) how the use of hydrogen would contribute to aviation decarbonization and air and noise pollution; study ways of accelerating the introduction of hydrogen-powered aircraft; and establish an advisory committee composed of representatives of the National Aeronautics and Space Administration, the aerospace industry, aviation suppliers, hydrogen producers, airlines, airport sponsors, fixed base operators, and other stakeholders to advise the Department of Transportation, the FAA, and DOE on related activities. The FAA must also exercise leadership in the creation of federal regulations, standards, and guidance relating to the safe and efficient use of hydrogen to increase aviation decarbonization and reduce air and noise pollution.

Build It in America Act

Build It in America Act This bill provides for tax incentives to encourage investment in the United States. The bill permits the expensing of research and experimental expenditures (including software development costs) through 2025. It extends (1) the allowance for depreciation, amortization, or depletion in determining the limitation on business interest; and (2) the 100% bonus depreciation allowance. The bill terminates the hazardous substance Superfund financing rate. It allows a taxpayer election to disregard specified regulations when determining if any tax is an income, war profits, or excess profits tax. The bill imposes a 60% excise tax on buyers of U.S. farmland by citizens of a country of concern (e.g., a state supporter of terrorism) or by a private business entity that is 10% or more owned by a citizen or business entity domiciled in a country of concern. The bill repeals the clean electricity production tax credit, the clean electricity investment tax credit, the tax credit for previously owned clean vehicles, and the tax credit for qualified commercial clean vehicles. It modifies provisions of the clean vehicle tax credit, including those relating to the base amount and battery capacity.

In addition, the Center of Excellence for Alternative Jet Fuels and Environment (ASCENT) must conduct research on hydrogen to increase aviation decarbonization. Such research must be in addition to any other research authorized to be carried out by the center, including other hydrogen-related research. (ASCENT is a cooperative aviation research organization co-led by Washington State University and the Massachusetts Institute of Technology, in collaboration with the FAA, the National Aeronautics and Space Administration [NASA], the Department of Defense, the Environmental Protection Agency, and Transport Canada.)

Neighborhood Homes Investment Act

Neighborhood Homes Investment Act This bill allows a business-related tax credit for certain development costs for the acquisition, rehabilitation, or remediation of qualified real property (i.e., real property affixed on a permanent foundation and comprised of four or fewer residential units, a condominium unit, or a house or apartment owned by a cooperative housing corporation). The bill also provides for the exclusion from gross income, for income tax purposes, of the value of any subsidy provided to a taxpayer by any state energy office for purposes of improvements made to a qualified residence.

International Maritime Pollution Accountability Act of 2023

International Maritime Pollution Accountability Act of 2023 This bill establishes requirements and incentives to reduce greenhouse gas emissions from the marine shipping industry. Specifically, the Environmental Protection Agency (EPA) must assess fees on certain cargo vessels for emissions of carbon dioxide, nitrogen oxides, sulfur dioxide, and fine particulate matter from fuel consumed during voyages. The fees apply to certain large vessels that are off-loading cargo or freight at U.S. ports. However, the fees do not apply to (1) certain vessels already regulated under the Clean Air Act; or (2) vessels transporting military cargo, food aid, or supplies for disaster or emergency relief. The amount of the fee must be based on the amount of fuel consumed and the quantity of emissions. The EPA must also assess alternative fees on certain cargo vessels that off-load cargo or freight at foreign ports if the cargo or freight is ultimately intended to be transported to the United States. The Coast Guard and U.S. Customs and Border Protection must penalize vessels that do not pay fees by deadlines. The bill also creates incentives related to decreasing greenhouse gas emission from vessels, port equipment, maritime technologies, and harbor crafts. A portion of the revenue generated from the fees must be provided to the EPA, the Maritime Administration, and the Department of Energy to carry out new programs that award such incentives. A portion of such revenue must also be used for certain existing programs related to clean ports, port infrastructure, ocean and coastal security, and marine debris.

PROVE IT Act of 2024

Providing Reliable, Objective, Verifiable Emissions Intensity and Transparency Act of 2023 or the PROVE IT Act of 2023 This bill directs the Department of Energy (DOE) to conduct and report on the results of a study regarding the greenhouse gas emissions intensity of certain products produced in the United States compared to the greenhouse gas emissions intensity of products produced in certain other countries. In addition, DOE must establish a public online database that contains such comparisons and product emissions intensity data. 

To amend the Energy Act of 2020 to include copper as a critical mineral, and for other purposes.

The U.S. Agency for International Development shall report to Congress on the feasibility and advisability of expanding development projects to include multilateral cooperation among the United States, Israel, and regional Arab partners.

Save Our Gas Stoves Act

Save Our Gas Stoves Act This bill places limits on energy conservation standards for kitchen ranges or ovens under the Energy Policy and Conservation Act. The Department of the Energy (DOE) may not prescribe or amend energy conservation standards for kitchen ranges or ovens if they would result in the unavailability of a product on account of the type of fuel the range or oven uses. In addition, DOE may not finalize, implement, or enforce the proposed rule titled Energy Conservation Program: Energy Conservation Standards for Consumer Conventional Cooking Products issued on February 1, 2023, or any substantially similar rule. The proposed rule prescribes energy conservation standards for consumer conventional cooking products, including electric cooking tops, gas cooking tops, electric ovens, and gas ovens. 

A resolution commending the Tennessee Valley Authority on the 90th anniversary of the signing of the Tennessee Valley Authority Act of 1933.

This resolution commends the Tennessee Valley Authority (TVA), a federally owned electric utility corporation, on the 90th anniversary of the signing of the Tennessee Valley Authority Act of 1933. It also honors the accomplishments of the TVA in improving navigation, controlling floods, promoting environmental stewardship, and providing electricity. Further, it recognizes the TVA, its employees, and its retirees for their service in the areas of energy, the environment, and economic development in Alabama, Georgia, Tennessee, Mississippi, Kentucky, North Carolina, and Virginia.

Sustainable Agriculture Research Act This bill revises the goals of the Agriculture Advanced Research and Development Authority (AGARDA). Specifically, the bill expands the goals to require AGARDA to enhance the role of sustainable agriculture in innovative voluntary resilience solutions in the United States through the development of agricultural technologies that may address the impact of extreme weather on crop production; the effects of drought and the potential of building water holding capacity in soils on croplands and rangelands; the expansion of the potential for long-term carbon storage through sustainable agriculture; increased economic and practical feasibility for renewable and sustainable energy on farms and in the agriculture industry; increased voluntary adoption of conservation practices that sequester carbon and build on-farm climate resilience; and increased economic and practical feasibility for, and voluntary adoption of, precision agriculture technology. The bill defines precision agriculture as managing, tracking, or reducing crop or livestock production inputs (including seed, feed, fertilizer, chemicals, water, and time) at a heightened level of spatial and temporal granularity to improve efficiencies, reduce waste, and maintain environmental quality.

This bill requires the Department of Energy to report to Congress on Puerto Rico's progress toward rebuilding the electric grid and on the federal government's efforts to expedite such rebuilding. Such report must contain an analysis of the state of Puerto Rico's electric grid; information on accountability measures the federal government is implementing or planning to implement to oversee the work that the government of Puerto Rico, the Puerto Rico Electric Power Authority, and private sector entities are carrying out in the rebuilding of the grid; an analysis of the role of the Financial Oversight and Management Board for Puerto Rico in the rebuilding of the grid; recommendations for private sector entities and governments to reduce the number of outages and blackouts; proposals for legislative actions and funding needed to improve the process of fund disbursement for critical projects related to electric grids; and a plan for expediting such rebuilding by not later than three months after the report is submitted.

Spent Fuel Prioritization Act of 2023 This bill requires the Department of Energy (DOE), in determining the order for accepting high-level radioactive waste or spent nuclear fuel for disposal or storage under the Nuclear Waste Policy Act of 1982, to prioritize the acceptance of waste or fuel from certain civilian nuclear power reactors. DOE must give the highest priority to decommissioned or decommissioning reactors located in areas (1) with large populations, (2) with high earthquake hazards, and (3) where the continued storage of high-level radioactive waste or spent nuclear fuel poses a significant national security concern.

Future of Agricultural Resiliency And Modernization Act This bill directs the Department of Agriculture (USDA) to award grants to certain entities, including states, local governments, and nonprofit organizations, to carry out projects that further agricultural resiliency and modernization, such as projects that reduce greenhouse gas emissions; improve air, water, and soil health; and increase carbon sequestration. Additionally, USDA must establish a program to award grants to governmental organizations and private entities in the agricultural sector to carry out at least 10 pilot projects; these projects must have the potential to reduce or sequester greenhouse emissions that convert and valorize tree nut harvest by-products and waste into multiple higher value biocarbon products, including sustainable industrial applications, agrochemicals, repurposing process heat, energy, and construction materials.

Providing for consideration of the bill (H.R. 277) to amend chapter 8 of title 5, United States Code, to provide that major rules of the executive branch shall have no force or effect unless a joint resolution of approval is enacted into law; providing for consideration of the bill (H.R. 288) to amend title 5, United States Code, to clarify the nature of judicial review of agency interpretations of statutory and regulatory provisions; providing for consideration of the bill (H.R. 1615) to prohibit the use of Federal funds to ban gas stoves; and providing for consideration of the bill (H.R. 1640) to prohibit the Secretary of Energy from finalizing, implementing, or enforcing the proposed rule titled "Energy Conservation Program: Energy Conservation Standards for Consumer Conventional Cooking Products", and for other purposes.

U.S.-Israel Partnership and Abraham Accords Enhancement Act of 2023 This bill modifies and extends certain authorities related to Israel. For example, the bill  extends the authorization for the Department of Defense (DOD) to transfer certain defense items to Israel;  extends the authorization to finance cooperative projects among the United States, Israel, and developing countries related to water resources, agriculture, and energy storage;  extends energy cooperation and authorizes the Department of Energy to make grants to Israel to support advanced nuclear technologies, as well as for carbon capture, utilization, and storage;  requires the U.S. Agency for International Development to ensure that applicants from Abraham Accord countries are eligible for Middle East Regional Cooperation grants; and  requires the Department of State to report to Congress on U.S. diplomatic efforts to oppose politically motivated investigations against the United States and Israel at the International Criminal Court.
