Earth Act of 2022

Earth Act of 2022 This bill addresses climate change by establishing requirements concerning renewable energy, zero emission vehicles, regenerative agriculture, and tax incentives related to climate transition costs. Specifically, the bill requires that by 2030, 100% of electricity sold by certain retail electric suppliers must be from renewable energy resources (e.g., wind energy); new motor vehicles (e.g., certain cars and trucks) sold by manufacturers must be zero emission vehicles; land and livestock managed by certain publicly-traded corporations must be managed with regenerative agricultural practices. The Department of Energy (DOE), the Department of Transportation, and the Department of Agriculture (USDA) must create grants to pay up to 50% of the costs of meeting those requirements. DOE must also issue regulations regarding the sourcing, recycling, and disposal of materials used to manufacture renewable energy sources (e.g., equipment that stores renewable energy). The goals of the regulations must be to (1) eliminate the use of rare earth metals in the manufacture of those sources, and (2) ensure the recycling of all such materials. USDA must issue regulations that (1) require the reduction of greenhouse gas emissions resulting from certain land or livestock corporations, and (2) ensure the well-being of animals raised for human consumption or the production of dairy products. The bill also provides tax incentives for electric suppliers, vehicle manufacturers, and such corporations to meet the requirements established by this bill by allowing them to double certain tax deductions for qualified capital climate transitions costs.

Healthy Climate and Family Security Act of 2022

Stop Arctic Ocean Drilling Act of 2022 This bill limits oil and gas leasing in Arctic areas of the Outer Continental Shelf (OCS). Specifically, the bill prohibits the Department of the Interior from issuing or extending a lease or any other authorization for the exploration, development, or production of oil, natural gas, or any other mineral in Arctic areas of the OCS. In addition, the bill declares that it is the policy of the United States that the Arctic Ocean should be managed for the best interests of the people of the United States, including by keeping fossil fuels in the ground to avoid the dangerous impacts of climate change.

To prohibit States, local governments, or State regulatory authorities from prohibiting a natural gas consumer from connecting or reconnecting to a gas utility for natural gas service, and for other purposes.

Not later than 2 years after the enactment of this bill, the EPA must develop national model building performance standards.

The Range of Light National Monument Act

The Range of Light National Monument Act This bill establishes the Range of Light National Monument as a unit of the National Park System in California, between Yosemite National Park and Kings Canyon National Park. The monument consists of approximately 1,427,750 acres of federal land and includes the entirety of Sierra National Forest. The Department of the Interior shall manage the public lands included in the monument area in a manner that protects and enhances the natural resources and values of the lands; and prohibit the cutting, sale, harvest, or removal of timber and other vegetative material within the monument for commercial purposes or for biomass energy production. Interior shall develop and apply an integrated visitor services plan for the monument.

LOWER Energy Bills Act of 2022

Leveraging Our Water and Energy data to Reduce Energy Bills Act of 2022 or the LOWER Energy Bills Act of 2022 This bill requires the Environmental Protection Agency to develop and implement a benchmarking and transparency initiative for certain types of properties (such as commercial or multifamily properties) to (1) advance the knowledge of owners and occupants regarding building energy and water use and greenhouse gas emissions, and (2) inform efforts to reduce energy and water use and greenhouse gas emissions nationwide.

To direct the Administrator of the Western Area Power Administration to provide its firm electric service customers with credits from shortfalls in generation from certain Bureau of Reclamation hydroelectric facilities, and for other purposes.

Federal Land Freedom Act

Federal Land Freedom Act This bill sets forth a process that allows a state (including the District of Columbia) to seek to transfer the responsibility of energy development on federal land within its boundaries from the federal government to the state. Federal land does not include land that, as of May 31, 2013, is (1) held for the benefit of an Indian tribe, (2) in the National Park System, (3) in the National Wildlife Refuge System, or (4) in a congressionally designated wilderness area. To qualify for such a transfer of responsibility, a state must have a program that regulates the exploration and development of oil, natural gas, and other forms of energy on its land. The federal responsibility transfers to the state once the state submits to the Department of the Interior, the U.S. Department of Agriculture, and the Department of Energy a declaration that it has such a program and that it seeks to transfer the responsibility. Any action taken by a state to lease, permit, or regulate the exploration and development of energy on federal land in lieu of the federal government is not subject to the Administrative Procedure Act, the National Historic Preservation Act, the Endangered Species Act of 1973, or the National Environmental Policy Act of 1969.

Petroleum Price Reduction Act

A bill to amend the Energy Policy Conservation Act to provide that consumer room air cleaners are covered products to which certain energy conservation standards apply, and for other purposes.

This bill establishes energy efficiency standards for consumer room air cleaners under the Energy Policy and Conservation Act (EPCA). The bill defines consumer room air cleaners as cleaners that (1) are portable or wall-mounted (fixed) units; (2) plug into an electrical outlet; (3) operate with a fan for air circulation; and (4) contain a means to remove, destroy, or deactivate particulates. The bill enumerates energy efficiency standards for air cleaners manufactured on December 31, 2023–December 30, 2025, as well as air cleaners manufactured on or after December 31, 2025. It also prescribes procedures to test the energy efficiency of air cleaners. Energy efficiency labeling requirements apply to air cleaners beginning on December 31, 2023.

National Laboratory Biotechnology Research Act of 2022

National Laboratory Biotechnology Research Act of 2022 This bill directs the Department of Energy (DOE) to establish a National Laboratory Biotechnology Program to integrate the resources of DOE, including the Office of Science, the Office of Intelligence and Counterintelligence, and the National Nuclear Security Administration, to provide research and development and response capabilities to respond to long-term biotechnology threats facing the United States, and any remaining threats posed by COVID-19. The Office of Science shall support research that harnesses the capabilities of the national laboratories to address advanced biological threats of national security significance. The Office of Science shall promote cooperative research and development activities under the program, including collaboration between appropriate industry and academic institutions to promote innovation and the creation of knowledge. No less frequently than biennially, DOE shall develop a strategic research plan under the program.

The bill defines such property as property that, amount other things (1) adds or improves fish passage at a qualified dam (i.e., a hydroelectric dam licensed by the Federal Energy Regulatory Commission or legally operating without such a license before the enactment of this bill); (2) maintains or improves the quality of the water retained or released by such a dam; (3) promotes downstream sediment transport processes and habitat maintenance for such a dam; (4) removes an obsolete river obstruction; or (5) places into service an approved remote dam (i.e., a hydroelectric dam that services certain communities and does not contribute to atmosphere pollution).

In demand response programs, end-use electricity customers are typically remunerated for voluntarily decreasing their short-term electrical consumption generally in response to compromised grid reliability or high wholesale electricity prices.
