Preservation of Antibiotics for Human Treatment Act of 2002 - Amends the Federal Food, Drug, and Cosmetic Act to require the Secretary of Health and Human Services to refuse to approve an application for an antimicrobial new animal drug when the applicant fails to demonstrate to a reasonable certainty that human health will not be harmed because of the development of antimicrobial resistance attributable to the nontherapeutic use of such drug. Rescinds within a specified period existing approvals and exemptions concerning the nontherapeutic use of certain antimicrobial drugs until the applicant meets the same standard of lack of harm to human health as required for new animal drugs, including the use of penicillins, tetracyclines, macrolides, lincomycin, bacitracin, virginiamycin, aminoglycosides, and sulfonamides in an animal and fluroroquinolones in poultry.

Mental Health Juvenile Justice Act - Amends the Juvenile Justice and Delinquency Prevention Act of 1974 to direct the Administrator of the Office of Juvenile Justice and Delinquency Prevention to make grants to train State juvenile justice system officers and employees regarding appropriate access to mental health and substance abuse treatment services for juveniles. Directs: (1) the Attorney General and the Secretary of Health and Human Services to make grants to partnerships between State and local or county juvenile justice agencies and State and local mental health authorities for programs that provide for appropriate diversion of juveniles from incarceration and for mental health screening and treatment; and (2) the Secretary to make grants to monitor mental health and special education services to, and to advocate on behalf of, juveniles. Amends the Public Health Service Act to direct the Attorney General and the Secretary to award competitive grants to eligible entities for programs that address the service needs of juveniles and of juveniles with serious mental illnesses through diversion and treatment services including for juveniles on probation, on parole, or discharged. Establishes a Federal Coordinating Council on Criminalization of Juveniles With Mental Disorders. Requires a State, to be eligible for funds under the violent offender incarceration and truth-in-sentencing grants program, to have (by January 1, 2003) a program of mental health screening and treatment for appropriate categories of offenders during periods of incarceration and supervision that is consistent with guidelines issued by the Attorney General. Makes Federal criminal code provisions regarding appropriate remedies with respect to prison conditions applicable to a civil action that seeks to remedy conditions which pose a threat to the health of individuals who are under age 16 or mentally ill.

Amends title XIX (Medicaid) of the Social Security Act (SSA) with respect to the determination of the amount to be paid to a State, in particular the reduction of the total medical assistance the State expended during a fiscal year by any revenues the State or local government receives from a broad-based health care related tax (such as a provider assessment program, or tax on hospitals) if a hold harmless provision is in effect with respect to the tax. (Current law declares that such a hold harmless provision is in effect if the Secretary of Health and Human Services determines that the State or local government imposing the tax provides even indirectly for any payment, offset, or waiver that guarantees to hold taxpayers harmless for any portion of the costs of the tax; in effect, a guarantee that a taxpaying hospital will receive back from Medicaid the amount of funds the hospital paid to the State in provider taxes.) Declares that the State shall not be considered to have provided an indirect guarantee to hold taxpayers harmless (and so the Federal Medicaid payment to the State shall not be determined upon a total State Medicaid expenditure that is reduced by the amount of provider taxes) if the tax is applied at a rate that produces revenues that do not exceed six percent of the revenues received by the taxpayers (hospitals) for the fiscal year involved.

Organ Donation and Recovery Improvement Act - Amends the Public Health Service Act to direct the Secretary of Health and Human Services to: (1) establish an interagency task force on organ donation and research; (2) award grants to carry out studies and demonstration projects to increase organ donation and recovery rates; (3) establish a public education program; and (4) support model curricula to train health care and other professionals in issues surrounding organ donation. Requires the President's Council on Bioethics to evaluate and report to the Secretary on the ethical implications of reducing economic barriers to organ donation. Authorizes the Secretary to award grants: (1) to qualified organ procurement organizations to establish programs to coordinate their efforts with hospitals; and (2) for reimbursement of travel and subsistence expenses incurred by individuals toward making living organ donations. Directs the Secretary, acting through the Administrator of the Health Resources and Services Administration and the Director of the Agency for Healthcare Research and Quality, to: (1) develop scientific evidence supporting increased donation and improved recovery, preservation, and transportation of donated organs and tissues; and (2) support efforts to develop a uniform clinical vocabulary and technology and to enhance the skills of the organ procurement workforce. Directs the Secretary to contract with the Institute of Medicine to evaluate: (1) existing organ donation practices; and (2) living donation practices and procedures. Requires the Secretary to establish: (1) an advisory committee to study and report to Congress on existing organ donor registries; and (2) and maintain a registry of living organ donors.

Directs: (1) the Secretary of Transportation and the Administrator of the Environmental Protection Agency (EPA) to designate as hazardous certain byproducts of the methamphetamine production process and expand penalties against laboratory operators; (2) the Administrator of the Drug Enforcement Administration to list byproducts likely to cause long-term environmental harm; (3) the Secretary of Labor, acting through the Occupational Safety and Health Administration, to provide grants to local law enforcement for specified training and equipment acquisition; (4) the EPA Administrator to study the impact of methamphetamine laboratory operation on the environment; and (5) the Secretary of Health and Human Services to study contamination issues. Amends: (1) the Elementary and Secondary Education Act of 1965 to authorize grants for educational programs; (2) the Public Health Service Act to authorize grants to provide treatment; (3) the Omnibus Crime Control and Safe Streets Act of 1968 to include among permissible grant projects under the "cops on the beat" program hiring personnel and purchasing equipment; and (4) the Controlled Substances Act to set penalties for promoting an entertainment event where the promoter knows that a controlled substance will be used or distributed in violation of specified law. Urges the President to seek commitments from the Canadian Government regarding the availability of pseudoephedrine.

Medical Excellence Demonstration Program Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act to direct the Secretary of Health and Human Services to establish a demonstration program under which the Secretary conducts population-based demonstration projects to test the use of providing incentives to comprehensive centers for medical excellence that: (1) eliminate underuse of effective care by beneficiaries; (2) ensure the safety of care provided to such individuals; (3) reduce scientific uncertainty in the delivery of care through outcomes measurement and research; (4) encourage shared decision-making for specific treatments and the management of chronic disease and end-of-life care; (5) encourage resource allocation decisions based on efficient practice benchmarks; (6) promote the conservative delivery of care when more intensive care is wasteful if not harmful; and (7) reward such centers for improving the quality of care and achieving efficient allocation of resources. Directs the Secretary to establish: (1) a Medicare claims-based information system that links individual sites and providers benchmarks for evaluating health care quality and efficiency; and (2) within the Department of Health and Human Services a National Steering Committee for Comprehensive Centers for Medical Excellence Demonstration Projects to recommend the design of such demonstration program and to provide a forum for coordination of Federal support for it.

Global Coordination of HIV/AIDS Response Act or Global CARE Act - Establishes an interagency working group to coordinate Federal programs related to the prevention, treatment, and monitoring of HIV/AIDS in foreign countries and to conduct global HIV/AIDS activities. Establishes the International HIV/AIDS Prevention and Capacity Development Initiative to prevent the spread of HIV/AIDS and opportunistic infections through specified measures. Establishes the International AIDS Care and Treatment Access Initiative. Authorizes appropriations to the following Federal agencies for such purposes: (1) the Centers for Disease Control and Prevention; (2) the Health Resources and Services Administration; (3) the National Institutes of Health; (4) the Agency for Healthcare Research and Quality; (5) the Food and Drug Administration; (6) the United States Agency for International Development; and (7) the Departments of Defense, Agriculture, Labor, and Commerce, including the Global Health Fund. States that the United States should make contributions to such Fund consistent with the general principles outlined in the Global AIDS and Tuberculosis Relief Act of 2000. Authorizes the Secretary of Health and Human Services to establish a (HIV/AIDS) Global Physician Corps using international assignment of physicians to provide care, train host country physicians, and establish or adapt clinical protocols for prevention and treatment. Amends the Foreign Assistance Act of 1961 to authorizes funds for injection safety. AIDS Orphans Relief Act of 2002 - Amends the Foreign Assistance Act of 1961 to provide assistance to communities affected by AIDS, including microcredit programs. Requires the Director of the Centers for Disease Control and Prevention to create a pilot program concerning the use of antiretroviral drugs in resource-poor settings.

Provides for SCHIP and Medicaid coordination with SSA title V (Maternal and Child Health Services). Increases the SCHIP income eligibility level with respect to a low-income child. Amends: (1) SSA title XIX to provide for an enhanced Federal Medicaid medical assistance percentage for increased expenditures for medical assistance for children; (2) SSA title XXI to increase SCHIP appropriations; and (3) SSA titles XIX and XXI to permit a State to elect to provide Medicaid and SCHIP coverage of children age 20 or 21.

Requires the Secretary of Health and Human Services to: (1) conduct and support research concerning high-risk elders, risk and protective factors, fall reduction strategies, fall prevention interventions, diagnosis and treatment of victims, barriers to adopting proven interventions, and the effectiveness of community programs in preventing assisted living and nursing home falls; and (2) award grants to enable organizations to provide professional education for physicians and health professionals in elder fall prevention. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention, to : (1) oversee and support demonstration and research projects to be carried out by the Council to assess the utility of targeted fall risk screening and referral programs and to include programs targeting newly-discharged fall victims at high risk for second falls and private-public partnerships involving home design and remodeling; and (2) provide grants to design and implement fall prevention programs in residential and institutional settings, including a multi-State demonstration project. Directs the Secretary to review the effects of falls on the costs of the Medicare and Medicaid Programs and the potential for reducing costs by expanding covered services, including a review of reimbursement policies.

Health Care Assistance for America's Unemployed Workers Act of 2002 - Sets forth health insurance coverage options for recently unemployed individuals and their families. Requires establishment of a temporary program under which 75 percent of the premium for COBRA continuation coverage for Medicaid be provided for an individual who: (1) at any time during the period that begins on January 1, 2001, and ends on December 31, 2002, is separated from employment or was covered under the health insurance of an individual killed as a result of terrorist-related activity during that same period; and (2) is eligible for, and has elected coverage under, COBRA continuation coverage. (COBRA refers to title X of the Consolidated Omnibus Budget Reconciliation Act of 1985, and concerns employee group health plan coverage under specified provisions of the Public Health Service Act, the Internal Revenue Code, and the Employee Retirement Income Security Act of 1974.) Permits a State to elect to provide temporary Medicaid coverage (under title XIX of the Social Security Act) for individuals who: (1) are separated from employment at any time during the period that from January 1, 2001, through December 31, 2002; (2) are not eligible for COBRA continuation coverage; (3) are uninsured; and (4) do not have assets, resources, and earned or unearned income that exceed limitations set by the State. Permits a State to pay the entire COBRA premium for individuals whose family income does not exceed 200 percent of the poverty line and who are receiving COBRA premium assistance under this Act. Terminates all assistance after March 31, 2003.

Elder Fall Prevention Act of 2002

Elder Fall Prevention Act of 2002 - Directs the Administration on Aging within the Department of Health and Human Services to: (1) oversee and support a three-year national education campaign by the National Safety Council focusing on ways to reduce the risk of elder falls and prevent repeat falls; and (2) provide grants for State coalitions for local education campaigns addressing reduction and prevention of elder falls. Requires the Secretary of Health and Human Services to: (1) conduct and support research concerning high-risk elders, risk and protective factors, fall reduction strategies, fall prevention interventions, diagnosis and treatment of victims, barriers to adopting proven interventions, and the effectiveness of community programs in preventing assisted living and nursing home falls; and (2) award grants to enable organizations to provide professional education for physicians and health professionals in elder fall prevention. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention, to : (1) oversee and support demonstration and research projects to be carried out by the Council to assess the utility of targeted fall risk screening and referral programs and to include programs targeting newly-discharged fall victims at high risk for second falls and private-public partnerships involving home design and remodeling; and (2) provide grants to design and implement fall prevention programs in residential and institutional settings, including a multi-State demonstration project. Directs the Secretary to review the effects of falls on the costs of the Medicare and Medicaid Programs and the potential for reducing costs by expanding covered services, including a review of reimbursement policies.

Immediate Helping Hand Prescription Drug Assistance Act of 2002 - Amends the Social Security Act (SSA) to establish an outpatient prescription drug assistance entitlement program for low-income Medicare (SSA title XVIII ) beneficiaries under a new title XXII (Outpatient Prescription Drug Assistance Program). Allows States, in lieu of using the funding provided under this new title, to provide assistance to such beneficiaries through a State plan under SSA title XIX (Medicaid) or through Medicare part C (Medicare+Choice). Amends SSA title XIX to provide for expanded coverage of low-income Medicare beneficiaries under Medicaid. Amends SSA title XVIII to provide for: (1) coverage of low-income Medicare beneficiaries in Medicare+Choice; and (2) low-income Medicare beneficiaries to elect to suspend Medicare supplemental (Medigap) insurance.

Improved Maternal and Children's Health Coverage Act of 2002 - Amends title XXI (State Children's Health Insurance) (SCHIP) of the Social Security Act (SSA) to require a State child health plan, among other things, to provide for: (1) development and use of a uniform, simplified application form for establishing SCHIP- and Medicaid-eligibility under SSA title XIX (Medicaid); (2) an enrollment process coordinated with that under Medicaid so that a family need only interact with a single agency to determine whether a child is SCHIP- or Medicaid-eligible; (3) acceptance and timely response to inquiries received through the national toll-free system established by this Act; (4) methods to ensure that children within a family eligible for SCHIP assistance are allowed to be seen by the same pediatric provider or group of pediatric providers in a manner that permits coordinated receipt of care by children in the same family to the extent a State child health plan provides coverage other than through providing benefits under the State's Medicaid plan; and (5) responsibility of the State and its contractors for assuring compliance with limitations on cost-sharing. Amends SSA titles XIX and XXI to provide for automatic reassessment of eligibility for Medicaid and SCHIP benefits for children losing Medicaid or SCHIP eligibility. Amends SSA title XXI to provide for optional coverage of low-income, uninsured pregnant women under a State child health plan. Amends SSA title XIX to grant States the option of: (1) using enhanced Federal medical assistance percentage for coverage of additional pregnant women under Medicaid; and (2) covering qualified alien children under Medicaid and SCHIP programs. Amends SSA titles XIX and XXI to provide for program coordination with the Maternal and Child Health program under SSA title V.

Veterans Health-Care Items Procurement Reform and Improvement Act of 2002 - Requires any procurement of a health-care item by any element of the Department of Veterans Affairs to be made through the use of a Federal Supply Schedule contract or national contract that meets specified requirements, including the presence of pre-award and post-award audit clauses and a price reduction clause. Allows, in limited circumstances including the presence of a medical emergency at a Department medical center, the use of a contract other than the above contracts, as long as it meets such requirements. Requires, in the case of an emergency Department procurement of a health-care item, that the quantity procured not exceed that reasonably necessary to meet the emergency at the medical center concerned. Directs the Secretary of Veterans Affairs to establish annual goals for Department medical centers for the purchase of health-care items using the above contracts.

Job Creation and Economic Security Act of 2002 - Amends the Internal Revenue Code to: (1) provide for a supplemental rebate; and (2) accelerate the 25 percent individual income tax rate. Provides for a special depreciation allowance for certain property acquired after September 10, 2001, and before September 11, 2004. Temporary Extended Unemployment Compensation Act of 2002 - Provides a program of temporary extended unemployment compensation. Establishes a displaced worker health insurance credit. Amends the Workforce Investment Act of 1998, with respect to national emergency grants, to authorize grants for employment and training assistance and temporary health care coverage assistance to workers affected by major economic dislocations. Establishes a small ethanol producer credit by allowing a tax-exempt farmers' cooperative to allocate such a credit to its patrons on the basis of the quantity or value of business done with or for them for the taxable year. Declares that cooperative marketing includes the value-added processing of the products of cooperative members and other producers through animals by: (1) feeding such products to cattle, hogs, fish, chickens, or other animals; and then (2) selling the animals (or animal products) which were fed such feed products. Authorizes a U.S. district court to issue a declaratory judgment relating to the initial or continuing qualification of a farmers' cooperative as tax-exempt.

Children's Dental Health Improvement Act of 2002- Amends title V (Maternal and Child Health Services) of the Social Security Act (SSA) to direct the Secretary of Health and Human Services to make grants to States to improve dental services to children enrolled in a State plan under title XIX (Medicaid) or title XXI (State Children's Health Insurance Program) (SCHIP). Amends the Public Health Service Act to establish a grant program for eligible entities and individuals (including Indian tribes) to expand the availability of primary dental care services where necessary. Offers retention bonuses for eligible dental officers of the Indian Health Service. Revises the process for designating dental health professional shortage areas. Directs the Secretary to establish: (1) demonstration projects to increase access to dental services for children in underserved areas; (2) an oral health initiative to reduce disparities in oral health, targeting low-income children and including community water fluoridation and dental sealants; and (3) a Chief Dental Officer for the Medicaid and State children's health insurance programs. Requires the Director of the Centers for Disease Control and Prevention to annually collect data on the dental, craniofacial, and oral health of residents of at least one State and one Indian tribe from each region. Requires the Secretary to identify populations at high risk for early childhood caries and provide for the development of prevention programs. Revises the eligibility requirements for the school-based dental sealant program to include Indian tribes.

Requires such an enrollee to be entitled to hospital insurance benefits under Medicare part A (Hospital Insurance) and enrolled in Medicare part B (Supplementary Medical Insurance). Establishes within the Supplementary Medical Insurance Trust Fund the Prescription Drug Benefit Insurance Account for the payment of benefits under the program. Makes program enrollees responsible for a $250 annual deductible and a co-payment for services for which payment may be made under the program. Establishes a Medicare Prescription Drug Benefit Advisory Commission. Directs the Secretary of Health and Human Services, with the Commission's advice, to: (1) determine and promulgate a coinsurance amount that qualified beneficiaries pay with benefits covered under this program for the next calendar year; and (2) determine and promulgate a monthly premium.
