Maternal Health Pandemic Response Act This bill addresses data collection, public education, workplace safety, and other matters related to maternal health during public health emergencies. Specifically, the bill supports (1) various programs and initiatives carried out by the Centers for Disease Control and Prevention (CDC) to collect data about maternal health, including racial, ethnic, and other demographic data; and (2) research activities of the National Institute of Child Health and Human Development. Additionally, the CDC and the Centers for Medicare & Medicaid Services must make publicly available and periodically update pregnancy and postpartum data that is collected through federal surveillance systems during public health emergencies. The data must be disaggregated by factors such as race, ethnicity, insurance status, and location. Further, the CDC must carry out a program to educate pregnant individuals, their employers, and their health care providers about maternal and infant health risks during public health emergencies. The bill also requires the Department of Health and Human Services to convene a task force to develop recommendations on the provision of maternity care during public health emergencies with a particular focus on communities of color and rural populations.

Protecting Moms and Babies Against Climate Change Act This bill establishes requirements and grants that address risks associated with climate change, particularly for vulnerable individuals (i.e., members of racial and ethnic minority groups, pregnant or postpartum individuals, and children younger than age three). Specifically, the Department of Health and Human Services (HHS) must establish a program to award grants to partnerships of community-based organizations and other entities to identify and address climate-change-related risks to these individuals at a county level. HHS must also establish a program to award grants to health professional schools for developing—and integrating into their curriculums—education and training on identifying risks associated with climate change for vulnerable individuals. In addition, the National Institutes of Health (NIH) must establish the Consortium on Birth and Climate Change Research. The consortium must coordinate research on such risks conducted and supported by various NIH institutes and offices. The Centers for Disease Control and Prevention must also develop a strategy to designate areas that have a high risk of adverse maternal and infant health outcomes among vulnerable individuals due to risks associated with climate change.

Unfunded Mandates Accountability and Transparency Act This bill revises rulemaking requirements with respect to unfunded mandates. Specifically, the bill requires federal agencies to prepare and publish in the Federal Register an initial and final regulatory impact analysis prior to promulgating any proposed or final major rule. The analysis must include regulatory alternatives to the rule. Major rule means a rule that the Office of Information and Regulatory Affairs determines is likely to cause an annual effect on the economy of $100 million or more; a major increase in costs or prices for consumers, individual industries, federal, state, local, or tribal government agencies, or geographic regions; or significant adverse effects on competition, employment, investment, productivity, innovation, public health and safety, or the ability of U.S.-based enterprises to compete with foreign-based enterprises in domestic and export markets. Before promulgating any proposed or final major rule, an agency shall select the regulatory alternative that maximizes net benefits, taking into consideration only the costs and benefits that arise within the scope of the statutory provision that authorizes the rulemaking, with exceptions. The bill prohibits Congress from considering a bill that increases private sector costs more than a certain amount unless certain conditions are met.

Ensuring Seniors' Access to Quality Care Act This bill repeals certain restrictions under Medicare and Medicaid that prohibit the approval of nurse-aide training and competency evaluation programs in skilled nursing facilities that have been subject to specified regulatory actions (e.g., civil penalties) for substandard quality of care. The Centers for Medicare & Medicaid Services (CMS) must still disapprove such programs for up to two years; however, the CMS must rescind the disapproval upon completion of corrective action and may require additional oversight of the program for purposes of rescission. The bill also allows Medicaid and Medicare providers (e.g., skilled nursing facilities) to access, through the National Practitioner Data Bank, disciplinary information for affiliated physicians and other health care practitioners, as reported by state licensing authorities.

Specifically, the bill requires entities, subject to civil penalties, to annually report to the Department of Health and Human Services (HHS) information relating to mergers, acquisitions, and changes in ownership over the previous year, as well as information on the entity's parent company, if applicable. The requirements apply to hospitals, certain ambulatory surgical centers, independent freestanding emergency departments, physician-owned practices that have more than 25 physicians, and physician practices that are owned by a hospital, health plan, private equity company, or venture capital firm. Hospitals must also report information about their business structure, debts, real estate transactions, and certain investments. HHS must post a summary of the reported information on its website, including trends in consolidation.

Specifically, the CMS must annually report (for as long as funds are available) on the amounts expended, the use of funds, and the projected and actual unused funds from amounts appropriated to implement the program. The CMS must also report on relevant contracts, efforts to prevent fraud, waste, and abuse, and other implementation activities and associated expenditures. The bill also explicitly restricts the CMS from using program funds for other programs or purposes.

Rural Hospital Closure Relief Act of 2023 This bill allows additional hospitals to qualify as critical access hospitals (CAHs) that receive special payment under Medicare. Currently, in order to qualify as a CAH under Medicare, a hospital must either (1) be located more than 35 miles (or 15 miles in mountainous regions or areas with only secondary roads) from another hospital, or (2) have been certified prior to January 1, 2006, by the state as a necessary provider of services in the area. The bill allows a hospital to also qualify if the hospital is a small, rural hospital that (1) serves a health professional shortage area, or a high number of low-income individuals or Medicare or Medicaid beneficiaries; (2) has experienced financial losses for two consecutive years; and (3) attests to having a strategic plan to address financial solvency. The Government Accountability Office must study the effects of the bill's implementation. The Centers for Medicare & Medicaid Services must subsequently establish a mechanism and issue guidance on how newly designated CAHs may transition to different payment models under Medicare.

Educating Future Nurses Act This bill establishes a permanent National Graduate Nurse Education Program to provide clinical training to advanced practice registered nurses (APRNs), particularly with respect to services for Medicare beneficiaries. (The Centers for Medicare & Medicaid Services conducted a similar demonstration program from 2012-2016.) Under the program, hospitals may receive payments for the costs associated with providing clinical education to APRNs. Hospitals must partner with nursing schools, regional hospitals or health systems, or non-hospital community providers (e.g., nursing homes) to provide qualifying clinical education. Such education must consist of clinical experience in primary, preventive, transitional, acute, and chronic care, as well as other services that are appropriate for Medicare beneficiaries; at least half of this education must be provided in non-hospital, community-based settings. Participating hospitals must report annually on their programs, subject to payment reductions.

Under the bill, the covered care system includes VA medical facilities, health care providers participating in the Veterans Community Care Program (VCCP), and eligible entities or providers that have entered into a Veterans Care Agreement. A veteran participating in the program may elect to receive care at any provider in the covered care system. The pilot program removes certain requirements (e.g., location of the veteran) to access care at VA and non-VA facilities. After four years, the bill permanently phases out the requirements for accessing care under the VCCP and Veterans Care Agreements and requires the VA to provide such care under the same conditions of the pilot program. Additionally, after four years, veterans may receive care at a VA medical facility regardless of whether the facility is in the same Veterans Integrated Service Network as the veteran.

Enhance Access To SNAP Act of 2023 or the EATS Act of 2023 This bill expands eligibility for the Supplemental Nutrition Assistance Program (SNAP) for certain students. Specifically, the bill removes the restriction on SNAP eligibility for students to allow otherwise eligible students who are attending institutions of higher education (IHEs) at least half time to participate in SNAP. Under current law, students 18-49 years old are restricted, with exceptions, from participating in SNAP. The Consolidated Appropriations Act, 2021 temporarily exempted some students from certain SNAP eligibility requirements; these temporary student exemptions are currently scheduled to expire after the end of the COVID-19 public health emergency on May 11, 2023. Further, the bill provides that students enrolled at least half time in a recognized school, training program, or IHE constitute individual households (not residents of institutions ) and may be eligible for SNAP benefits. (Participation in SNAP is limited to households.)

Emergency Access to Insulin Act of 2023 This bill reduces the marketing exclusivity period for biological drug products from 12 to 7 years and establishes policies and programs designed to increase access to prescription insulin. Specifically, the bill requires the Department of Health and Human Services (HHS) to award grants to states to create insulin card programs, which provide uninsured or underinsured individuals with insulin at no cost for specified time periods. Payments for insulin prescriptions made through the program must count toward an underinsured individual’s health plan deductible or other out-of-pocket expenses required under the plan. Further, HHS must collect annual fees from insulin manufacturers, based on each manufacturer’s market share, equal to the total estimated expenditures under the insulin grants program. Subject to certain exceptions, the bill also establishes an excise tax on insulin manufacturers when the price of an insulin product spikes. The tax amount is a specified percentage of the revenue a manufacturer received as a result of the price spike. The tax amount increases in tiers based on the percentage of the price spike for that product.

Supporting all Healthy Options when Purchasing Produce Act or the SHOPP Act This bill modifies the Gus Schumacher Nutrition Incentive Program (GusNIP), which provides grants for projects that provide incentives for Supplemental Nutrition Assistance Program (SNAP) participants to purchase fruits and vegetables.  Specifically, the bill amends GusNIP to require the Department of Agriculture to give priority to projects that increase year-round availability of nutrition incentives by offering fresh frozen fruits or vegetables in the program. The bill also amends the GusNIP Produce Prescription Program to include fresh frozen fruits and vegetables, as well as fresh and fresh frozen legumes. Currently, only fresh fruits and vegetables are covered under the program. (This program supports projects that demonstrate and evaluate the impact of fruit and vegetable prescriptions on increasing procurement and consumption of fruits and vegetables, reducing individual and household food insecurity, and reducing healthcare usage and associated costs.)

Grandfamily Housing Act of 2023 This bill establishes grants through the Department of Housing and Urban Development for owners of intergenerational dwellings. Grants must be used to (1) provide services such as tutoring, health care services, and after-school care; (2) perform outreach to intergenerational families in the surrounding community; and (3) maintain spaces within the property to be used for programs and services for intergenerational families.
