HHS must prioritize awarding grants to states that, among other things, require mandatory reporting of claims data. Further, the bill permits states to require self-insured employer plans to submit claims data to the state's all-payer claims database.

The BJA must ensure that at least one police department designated as a Law Enforcement Mental Health Learning Site utilizes the tools and that such tools are part of the Police-Mental Health Collaboration Toolkit. Additionally, the bill requires the Centers for Disease Control and Prevention to study and report about the prevalence and incidence of concussions among first responders.

Supporting Athletes, Families and Educators to Protect the Lives of Athletic Youth Act of 2020 or the SAFE PLAY Act of 2020 This bill directs several agencies to undertake specified activities and expand surveillance related to cardiac conditions, concussions, and heat-related illnesses among young athletes. The bill also establishes requirements for schools with respect to concussions and excessive heat. Specifically, the Centers for Disease Control and Prevention (CDC) must (1) develop information for schools, childcare centers, and others on high-risk cardiac conditions in children, adolescents, and young adults; and (2) incorporate questions about cardiac conditions in an existing school-based health survey. In addition, the CDC must develop guidelines for emergency action plans for youth athletics programs, and the Food and Drug Administration may issue guidelines related to youth consumption of energy drinks. The Department of Health and Human Services (HHS) must award matching grants to local educational agencies for automated external defibrillator and cardiopulmonary resuscitation trainings. The Department of Education, in consultation with HHS and the National Oceanic and Atmospheric Administration, must develop public education materials focused on the health risks of exposure to extreme heat and humidity, and public schools must develop action plans for athletic activities during periods of excessive heat or humidity. The bill establishes minimum requirements for elementary and secondary schools related to concussions, including but not limited to (1) implementing a standard plan for concussion safety and management, and (2) ensuring students returning to academics after a concussion receive certain services and supports.

K2 Veterans Toxic Exposure Accountability Act of 2020 This bill addresses toxic exposure of members of the Armed Forces deployed to Karshi-Khanabad (K-2) Air Base in Uzbekistan between October 1, 2001, and December 31, 2005. Specifically, the bill requires the Department of Defense (DOD) to conduct a study and report on such exposure. Based on the results of the study, the Department of Veterans Affairs (VA) must determine (1) whether a positive association exists between such exposure and the occurrence of a diagnosed illness in humans, and (2) whether a presumption of service-connection is warranted. Under a presumption of service-connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded. If the VA determines a presumption of service-connection is not warranted, notice must be published and include an explanation of the basis for the determination. The bill also requires the VA to remove previous presumptions if evidence indicates such presumption is not warranted. The bill requires the VA to establish and maintain a registry for individuals who were deployed to K-2 during the specified time frame. Finally, DOD must provide access to information upon request by the National Academies of Sciences, Engineering, and Medicine for purposes of a study regarding the effects of exposure to toxic substances at K-2.

Transparency in Prescription Drug Advertising Act This bill requires that the list prices of drugs be included, as appropriate, in advertising for such drugs and directs the Department of Health and Human Services to issue department-wide guidance to that effect that is consistent with regulations issued by the Centers for Medicare & Medicaid Services (CMS) regarding drug price transparency. On May 10, 2019, the CMS issued a final rule titled Medicare and Medicaid Programs; Regulation to Require Drug Pricing Transparency . The rule requires direct-to-consumer television advertisements for drugs and biologics covered under Medicare and Medicaid to include the list price of a 30-day supply or for a typical course of treatment, if the list price is at least $35 per month. The rule was scheduled to take effect on July 9, 2019; however, a federal court blocked the rule's implementation, citing a lack of statutory authority.

Congressional Oversight of Sanctions Act This bill limits the duration of a declaration of national emergency by the President, directs the President to allow certain exports to a country under sanctions, and requires the President to provide specified information when exercising emergency economic powers. Specifically, the bill provides that any national emergency declared by the President shall terminate 60 days after the first day on which either house of Congress is in session following the declaration, unless Congress enacts a joint resolution to extend the emergency. If Congress does not enact a joint resolution to extend the emergency, the President may not declare a new national emergency based on substantially similar facts during the 1-year period following such 60-day period. The President must allow the export of certain equipment and material to a territory that is controlled by a person that is otherwise subject to sanctions if the material is intended for (1) civilian health care facilities, (2) water infrastructure, (3) civilian energy infrastructure, or (4) primary or secondary educational facilities. When exercising any international emergency economic powers, the President must issue a report that includes (1) the goals and outcomes expected to be achieved through such actions; (2) other tools considered to address the emergency and the reason for the chosen response; (3) a list of countries imposing similar sanctions; and (4) the strategy to provide compliance guidance to entities in the private sector, humanitarian organizations, and peace-building organizations.

Fairness in Orphan Drug Exclusivity Act This bill limits which orphan drugs may be granted a market exclusivity period by the Food and Drug Administration (FDA). (Generally, an orphan drug is one that is not economically viable because of the rarity of the disease that it treats; the sponsor of an FDA-designated orphan drug may be granted various incentives, such as a seven-year period in which the FDA may not grant market approval to a different sponsor for the same drug to treat the same disease.) Specifically, when determining whether to grant an exclusivity period to a drug that has orphan status due to low expected sales, the FDA must consider the sales of all drugs from the sponsor that are covered by the same orphan drug designation.

Helping Our Senior Population in Comfort Environments Act or the HOSPICE Act This bill establishes survey requirements for, and enforcement mechanisms against, certified hospice programs under Medicare. Specifically, certified programs must undergo periodic surveys by a state, local, or approved accreditation agency, as specified; the Centers for Medicare & Medicaid Services (CMS) must provide appropriate training for surveyors and publish information relating to survey results on its website. The CMS must also (1) conduct more frequent surveys of programs that are found to be noncompliant with applicable standards; and (2) take specified enforcement actions against such programs, based on the severity of the deficiencies. Enforcement actions include civil penalties, suspended Medicare payments, and termination of program certification.

Consumer Protections Against Surprise Medical Bills Act of 2020 This bill makes a series of changes related to health care costs and billing practices. Among other things, the bill applies the in-network cost-sharing amount to certain emergency and related nonemergency services that are provided out-of-network, applies the in-network cost-sharing amount to nonemergency services that are provided out-of-network at an in-network facility unless specified written notice requirements are met, establishes procedures for health insurance plans to negotiate reimbursement amounts paid to out-of-network providers in states without such a process, requires insurance plans to establish publicly available databases that list the contact information for in-network providers and facilities, requires health care providers and insurance plans to provide certain cost estimates for services scheduled at least three days in advance, requires plans to continue benefits for specified long-term care when an insurance plan's contractual relationship with a provider or facility changes or terminates, requires insurance plans to include specified consumer assistance and benefits information on a plan holder's membership card and maintain certain price comparison tools for in-network services, establishes reporting requirements related to air ambulance services, establishes a temporary income tax deduction for specified expenses resulting from out-of-network and emergency services.
