Bioterrorism Protection Act (BioPAct) of 2001 - Amends the Public Health Service Act to provide for grants, scholarships, and loans in order to strengthen the nursing profession. Establishes the National Nursing Service Corps Scholarship Program. Authorizes appropriations to: (1) increase hospital and provider capacity, training, and resources for treating bioterrorism victims; (2) increase and improve vaccine and antibiotic supplies for attack victims; and (3) provide for the coordination, training, and equipping of bioterrorism emergency responders. Authorizes appropriations for Department of Agriculture activities to: (1) reduce agricultural pathogen and insect pest threats; and (2) increase Department information systems security. Directs the Secretary of Health and Human Services to expand the Food and Drug Administration's capacity to ensure the safety of the food supply system, including imported food, and protect against the threat of bioterrorism. Amends the Federal Food, Drug, and Cosmetic Act to: (1) permit debarment for repeated or serious food import violations; (2) deem as misbranded imported food without country-of-origin labeling; (3) deem as adulterated a food item imported by a debarred person; and (4) require registration of food manufacturing, processing, and handling facilities. Directs the Administrator of the Environmental Protection Agency to: (1) undertake public water systems vulnerability assessments and review related emergency response plans; and (2) provide such systems with assistance for basic security enhancements and information systems protection. Amends the Federal criminal code to set penalties for possessing a select agent known to be a biological agent, with reckless disregard for the public health and safety. Authorizes appropriations for neutron scanner technology and technology to detect biological or chemical agents and for increased numbers of border patrol and immigration officers. Directs the Attorney General to develop or carry out various programs, including programs to improve identification of those appearing on law enforcement "watch lists" and to mandate better tracking of visas. Requires the Assistant to the President for Homeland Security to: (1) assess terrorist threats within the United States and its territories and possible responses to such threats; (2) implement a public education campaign concerning appropriate response to a terrorist attack; and (3) coordinate the deployment of chemical and biological detection capabilities. Requires the President to: (1) establish a database of information concerning terrorist activity; and (2) reduce barriers to the sharing of such information among Federal law enforcement agencies and the intelligence community. Requires the Secretary of Defense to: (1) increase military capability to respond to domestic crises involving chemical or biological weapons; (2) implement interagency crisis response and consequence management; and (3) accelerate response research and development. Requires the Secretary of Energy to increase efforts relating to nonproliferation verification of chemical and biological materials in countries other than the United States. Urges the President to seek to establish a United States-Russian Federation Biological-Chemical Working Group.

Requires the Secretary to establish criteria that provide recommendations to the States for response plans which include provisions for: (1) a comprehensive assessment of State and local government response capabilities; (2) storage and distribution of pharmaceuticals in coordination with the Office of Emergency Preparedness and the CDCP designed to provide supplies for every victim within 24 hours of diagnosis; (3) training medical personnel; and (4) hospitals and medical personnel to conduct emergency drills. Directs the Secretary to request that the States submit proposed response plans to the Assistant to the President for Homeland Security, who shall coordinate the evaluation of such plans and the provision to the States of recommendations regarding plan modifications.

Biological and Chemical Weapons Preparedness Act of 2001 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services to develop a coordinated plan to achieve the following biological or chemical preparedness goals by 2010: (1) first responders (law enforcement, fire, and medical services) will have adequate response capacity, training, and technology; (2) sophisticated electronic disease surveillance and information exchange; and (3) development of the health care and public health workforce in key biopreparedness priority areas. Requires such plan to include specific benchmarks and outcome measures. Funds activities through block grants to States. Includes Indian tribes in this program at their request. Requires each participating States' public health agency to develop (with the recommendations of a State Bioterrorism Preparedness Advisory Committee) a certifiable plan. Sets forth uniform data collection and reporting requirements. Requires fiscal controls on the use of such funds, including audits, repayments, and withholding (after investigation). Requires compliance with specified nondiscrimination acts. Establishes criminal penalties for fraudulently collecting payments. Directs the Secretary to award competitive grants with an emphasis on building emergency surge capacity, biocontainment, and decontamination capabilities. Authorizes additional appropriations for programs concerning; (1) vaccine, antibiotic, and therapeutic research and development; (2) protecting the food supply (including interdiction); and (3) research by specified federal agencies and departments. Requires the Secretary to review Federal counterterrorism efforts in light of unique rural community requirements.

Late Term Abortion Ban Act of 2001 - Prohibits intentionally and knowingly performing an abortion of a viable unborn child during the third trimester of pregnancy, except where the person performing the abortion is a physician who concludes in good faith that the abortion is necessary to prevent the death or a substantial risk of serious impairment to the physical or mental health of the woman. Requires a physician who performs such an abortion to certify to the designated State agency the medical indications supporting the physician's judgement. Requires each State to enact legislation to assure that its licensing body may take appropriate disciplinary action against a physician who violates this Act, including authority to refuse to admit to examination or to issue a license or license renewal to a violator of this Act.

Pathogen Research, Emergency Preparedness and Response Efforts Act of 2001 (PREPARE Act) - Amends the Public Health Service Act to direct the Secretary of Health and Human Services to encourage the development and manufacture of new products or new uses for products which can identify, prevent, or treat chemical or biological agents. Permits a limited antitrust exemption for the cooperative efforts of the pharmaceutical, biotechnical, medical device, and research industries when working to develop and bring such countermeasure products to market. Authorizes the Secretary to enter into contracts and provide assistance for product development, including good manufacturing practices and facility security. Requires the Secretary to ensure that medical supplies from the National Pharmaceutical Stockpile are located in appropriate proximity to the site of special events. Amends the Federal Food, Drug, and Cosmetic Act to permit: (1) fast-track designation and priority review for unapproved countermeasure products; and (2) the use of animal trials for drugs useful against lethal or disabling agents. Requires the Secretary to: (1) prohibit the unauthorized transportation of chemical or biological agents; (2) establish and maintain a list of each biological agent and toxin potentially threatening to public health and another list of those agents and toxins potentially threatening to national security; and (3) establish safety procedures for the transfer of such agents and toxins. Requires the Secretaries of Health and Human Services and Defense to coordinate the creation of a government-owned, contractor-operated vaccine production facility on a military installation.

Sets forth requirements for processing such products, including examination, holding, destruction, and subsequent labeling as refused entry. Prohibits: (1) port shopping when a product has been refused admission; and (2) imports of perishable products by debarred persons. Provides for the promulgation and enforcement of regulations governing, and the imposition of penalties against, the importing of contaminated perishable products. Authorizes the debarment of repeat offenders. Amends the Public Health Service Act to authorize the Secretary to (1) make grants or agreements with, and provide technical assistance to, eligible agencies to enhance their capacity to carry out activities relating to surveillance and prevention of pathogen-related disease borne in a perishable product; and (2) conduct related training, education, and public awareness activities. Requires the Secretary to award grants to universities, nonprofits, and industrial partners to develop improved methods of pathogen detection and food safety monitoring sensors.

Amends the Public Health Service Act to establish a grant program for eligible entities and individuals (including Indian tribes) to expand the availability of primary dental care services where necessary. Offers retention bonuses for eligible dental officers of the Indian Health Service. Revises the process for designating dental health professional shortage areas. Directs the Secretary to establish: (1) demonstration projects to increase access to dental services for children in underserved areas; (2) an oral health initiative to reduce disparities in oral health, targeting low-income children and including community water fluoridation and dental sealants; and (3) a Chief Dental Officer for the Medicaid and State children's health insurance programs. Requires the Director of the Centers for Disease Control and Prevention to annually collect data on the dental, craniofacial, and oral health of residents of at least one State and one Indian tribe from each region. Requires the Secretary to identify populations at high risk for early childhood caries and provide for the development of prevention programs. Revises the eligibility requirements for the school-based dental sealant program to include Indian tribes.

Declares that each such owner and operator has a general duty to: (1) identify hazards that may result from an accidental or criminal release; (2) ensure safer design and maintenance of that source; and (3) minimize the consequences of any such release. Grants authority to the Administrator or the Attorney General to: (1) secure necessary relief to abate imminent and substantial endangerments to the public health or welfare or the environment because of a potential release or to issue orders necessary to protect the public; (2) require persons believed to have information relating to a potential release, or persons subject to any Act requirement, to establish and maintain records, make reports, and provide information; and (3) enter the premises and have access to records and required information of such an owner or operator. Provides for: (1) public availability of records and information obtained, with exceptions for national security and trade secrets; and (2) civil and criminal penalties.

Provides for coverage of care coordination and assessment services furnished by a care coordinator as a Medicare part B medical service. Directs the Secretary to provide for appropriate adjustments to specified payment systems to take into account the additional costs incurred in providing items and services under the Medicare program to Medicare beneficiaries who suffer from serious and disabling chronic conditions. Requires the Secretary to: (1) revise the risk adjustment methodology under SSA title XVIII part C (Medicare+Choice) applicable to payments to Medicare+Choice organizations offering specialized programs for frail elderly and at-risk beneficiaries to take into account variations in costs incurred by such organizations; and (2) establish a demonstration program under which additional payments may be made to such an organization, if certain requirements are met. Directs the Secretary to: (1) study and report to Congress on chronic condition trends of Medicare beneficiaries and associated service utilization, quality indicators, and cumulative costs; and (2) contract with the Institute of Medicine of the National Academy of Sciences to make a Medicare chronic condition care improvement study and report.

Protecting the Food Supply from Bioterrorism Act - Requires any facility engaged in processing or handling food products for consumption in the United States, including any facility of an importer, to be registered with the Secretary of Health and Human Services. Directs the Secretary to compile and maintain an up-to-date list of registered facilities. Suspends, immediately, the registration of any facility or importer's facility for: (1) failure to permit access to the facility for inspection: (2) violation of a food safety law, including a regulation issued under a food safety law, concerning the facility, in a case in which the Secretary determines that such suspension is likely to prevent a significant risk of adverse health consequences; or (3) conviction of the registrant in any Federal or State court of either any felony relating to food or more than one violation of any law relating to food, whether or not the violation involves any fraud in connection with transactions in food. Amends the Federal Food, Drug, and Cosmetic Act to provide for enforcement, including: (1) penalties; (2) notification and recall of unsafe food; and (3) import restrictions. Amends the Public Health Service Act to provide for: (1) food security research; (2) food safety grants; (3) the surveillance of animal and human health; and (4) information resources for health professionals concerning the diagnosis and detection of illnesses caused by bioterrorism.

Authorizes the Secretary to award grants to applicant Medicare hospitals to: (1) adopt such educational materials for local use and to assist hospitals in applying such information on community and media relations and in developing ties with the local and regional media; (2) assist such hospitals in meeting epidemic training, recognition, and response standards identified by the Secretary as designed to educate Medicare hospital staff regarding epidemics resulting from natural causes or bioterrorism, and to enable such staff to effectively recognize and respond to such epidemics; and (3) reimburse such hospitals that serve an area that the President has determined warrants assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance Act due to the direct effects of an epidemic to reimburse for specified post-disaster costs.

Establishes penalties for intentionally accessing a protected computer without authorization, or exceeding authorized access, thereby causing: (1) loss to one or more persons during any one-year period aggregating at least $5,000 in value; (2) the modification or impairment of the medical examination, diagnosis, treatment, or care of one or more individuals; (3) physical injury to any person; (4) a threat to public health or safety; or (5) damage affecting a computer system used by or for a government entity in furtherance of the administration of justice, national defense, or national security. Increases penalties and broadens the scope of provisions regarding computer-related fraud. Includes within the definition of "protected computer" a computer located outside the United States that is used in a manner that affects interstate or foreign commerce or communication of the United States. Includes good faith reliance on a request of a governmental entity to preserve evidence among defenses to civil actions relating to a violation of provisions governing access to stored wire or electronic communications. Requires the Director of the Federal Bureau of Investigation to take appropriate actions to develop at least ten regional computer forensic laboratories and to provide support, education, and assistance for existing laboratories so that such laboratories have the capability to provide forensic examinations regarding seized or intercepted computer evidence relating to criminal activity, to provide training and education regarding computer-related crime for and to assist law enforcement personnel, and to promote sharing of Federal law enforcement computer crime expertise with State and local authorities.
