Access to Birth Control Act This bill requires pharmacies to comply with certain rules related to ensuring access to contraceptives. Specifically, pharmacies must provide without delay a customer with any contraceptive or related medication that is in stock. If the contraceptive is not in stock, the pharmacy must immediately inform the customer and either order the contraceptive or refer the customer to a pharmacy that has it in stock. Laws in some states provide pharmacists with the right to refuse to dispense contraceptive-related drugs on religious or conscience grounds. Pharmacies may refuse to provide a contraceptive to a customer (1) if the customer lacks a valid prescription for a prescription contraceptive or is unable to pay for the contraceptive, or (2) based on a pharmacy employee's professional clinical judgment. The bill also establishes a private cause of action and civil monetary penalties for violations of the bill.

Precision Medicine Answers for Kids Today Act This bill establishes programs and requires reporting relating to Medicaid coverage of genetic and genomic testing, particularly for children. Specifically, the bill establishes a demonstration program for up to 15 state Medicaid programs to cover genetic and genomic testing for certain individuals under the age of 21 (or a lower age, if the state chooses) and for former foster youth under the age of 26. Additionally, the Centers for Medicare & Medicaid Services must report on overall Medicaid coverage of such services and issue guidance for states on ways to increase coverage for children; the National Academy of Medicine must study the impact of this guidance as well as the general utility of genetic and genomic testing.

Men's Health Awareness and Improvement Act This bill establishes the Office of Men's Health within the Department of Health and Human Services (HHS) and requires other activities to improve men's health in the United States. The office must support and promote men's health programs and initiatives, including by working with relevant federal agencies (e.g., the Department of Defense and the Department of Veterans Affairs) and consulting with other HHS offices and agencies on activities related to men's health. HHS must issue associated guidance and recommendations on improving men's health outcomes that include short-term and long-term objectives for disease prevention, health promotion, and other areas of concern. The bill also requires studies and reports on men's health topics. The Office of the Assistant Secretary for Health must study men's use of health screenings and services, and the Government Accountability Office must report on the effectiveness of federal outreach related to men's health initiatives.

Provider Relief Fund Improvement Act This bill extends deadlines, expands the uses of, and makes other changes pertaining to the Provider Relief Fund. The fund reimburses health care providers for increased expenses or lost revenue attributable to COVID-19. Specifically, the bill extends the deadline by which providers must use any reimbursements they received in 2020 from the fund to the end of the COVID-19 emergency. Providers must use reimbursements received in the first half of 2021 by the end of the emergency or June 30, 2022, whichever is later. Additionally, the Department of Health and Human Services must distribute the remaining provider relief funds by March 31, 2022. Providers must use these funds by June 30, 2023. The bill also allows the use of the funds for workplace safety activities, such as hiring additional security personnel.

Inpatient Opioid Safety Act of 2021 This bill requires hospitals, as a condition of Medicare and Medicaid participation, to use specified technology to monitor patients for opioid-induced respiratory depression for 12 hours after the administration of an opioid or until the patient is discharged, whichever is earlier, unless a health care practitioner determines before administering an opioid that such monitoring should not be used and records this determination in the patient's record.

Mental Health Workforce and Language Access Act of 2021 This bill establishes within the Department of Health and Human Services (HHS) two demonstration programs to increase access to mental health services provided in languages other than English at federally qualified health centers (FQHCs). In carrying out the programs, HHS must give preference to FQHCs at which at least 20% of the patients are best served in a language other than English. First, HHS must provide National Health Service Corps (NHSC) loan repayments to mental health care providers who agree to serve their period of obligated service in an FQHC. HHS may provide enhanced payments to those who serve in an FQHC with non-English language needs. (The NHSC is a scholarship and student loan repayment program for eligible health care providers who agree to work in areas with a shortage of primary care, dental care, and mental health care providers.) Second, HHS must award grants to FQHCs for recruiting and retaining mental health care providers who are fluent in a language other than English.

Let Our Cities And Local businesses Help Employees Achieve Long-Term Health Act or the LOCAL HEALTH Act This bill authorizes private businesses and local governments and agencies to require the use of face masks and take other measures aligned with Centers for Disease Control and Prevention guidelines to prevent the spread of COVID-19, provided that the required measures accommodate individuals with disabilities and include exemptions for sincerely held religious beliefs. The bill also (1) prohibits a state from establishing or enforcing a law that restricts an authorized measure, and (2) provides immunity to private businesses and local government entities from federal or state claims arising from an authorized measure unless the claim involves negligent behavior or willful misconduct.

United States-Taiwan Public Health Protection Act This bill requires the Department of State to establish an Infectious Disease Monitoring Center within the American Institute in Taipei, Taiwan. (The U.S.-Taiwan relationship is unofficial, and the American Institute in Taiwan office in Taipei performs many of the same functions as an embassy.) The center must seek to partner with the Taiwan Centers for Disease Control to monitor infectious diseases in the region, including by regularly monitoring, analyzing, and disseminating open-source material, such as viral strains and other pathogens, from countries in the region.

Rural Health Training Act of 2021 This bill requires the Health Resources and Services Administration to establish a grant program for rural hospitals, health clinics, and community health centers to provide training to employees who are nonphysician clinicians or health care support staff. As a condition of receiving grant-funded training, a trainee must continue working for the grantee for at least five years. The bill also expands the allowable uses of funding to include a trainee's childcare or transportation expenses. The Government Accountability Office must report on the impact of the grants on health care workforce retention at rural health care facilities.

Keeping Our COVID-19 Heroes Employed Act This bill exempts essential workers from COVID-19 vaccination requirements imposed by the federal government and contractors, public entities that received federal COVID-19 relief funds, and private entities that received any federal funds. An essential worker is an individual who was deemed to be essential or exempted from response measures during the COVID-19 pandemic by a state, tribe, or territory.

Rural Health Fairness in Competition Act This bill requires the Centers for Medicare & Medicaid Services (CMS) to establish a Medicare Rural Health Clinic Value-Based Care Program that exempts certain rural health clinics (e.g., those participating in Medicare quality programs) from payment limitations if they meet reporting requirements relating to quality measures and performance standards, as set by the CMS.

Comprehensive TB Elimination Act of 2021 This bill reauthorizes for FY2022-FY2027 and revises the tuberculosis (TB) prevention and treatment grant program administered by the Centers for Disease Control and Prevention. The Health Resources and Services Administration may also award grants to state, tribal, territorial, and local governments and specified health care providers (e.g., Native Hawaiian health organizations and federally qualified health centers) for TB prevention and treatment efforts. Additionally, the Government Accountability Office must report on (1) national TB prevention and treatment efforts, and (2) matters concerning TB drug shortages and costs.

Natural Cosmetics Act This bill requires the Food and Drug Administration (FDA) to issue a final rule defining the terms natural and naturally derived ingredient with respect to cosmetics (including personal care products). It also prohibits the sale of a cosmetic that includes these terms on its packaging or labeling unless the cosmetic meets the definitions established under this bill. The FDA must issue the final rule within two years of this bill's enactment. When developing the definitions, the FDA must (1) consider how each ingredient in a cosmetic is processed; (2) consider any impurities that would adversely impact human health; and (3) base the definitions on relevant scientific data, including data on consumers' understanding of such terms when applied to cosmetics.

Mary Jo Lawyer Spano Mesothelioma Patient Registry Act of 2021 This bill requires the Agency for Toxic Substances and Disease Registry, which is part of the Department of Health and Human Services, to establish a mesothelioma patient registry. (Mesothelioma is a cancer of the tissue lining the lung, chest, and abdomen areas and is generally associated with asbestos exposure.) The registry must include information relating to the incidence and prevalence of mesothelioma in the United States, including treatment outcomes and demographics.

Parental Rights Protection Act This bill restricts government entities from requiring that individuals age 18 or younger receive certain COVID-19 vaccines that were authorized through emergency use and related procedures. Specifically, a federal, state, tribal, territorial, or local government entity (including a local educational agency) that receives funding from either the Department of Education or the Department of Health and Human Services may not require such COVID-19 vaccinations for individuals age 18 or younger. In particular, a local educational agency that mandates COVID-19 vaccinations for students loses its eligibility for federal education funding. The bill also requires the prior, informed, written consent of a parent or guardian before administration of such COVID-19 vaccines to an individual age 18 or younger.

Expanded Telehealth Access Act This bill permanently allows audiologists, physical therapists, occupational therapists, speech-language pathologists, and other providers designated by the Centers for Medicare & Medicaid Services (CMS) to provide telehealth services under Medicare. Currently, the CMS is authorized to waive requirements for Medicare telehealth services during the public health emergency relating to COVID-19, and it has done so to allow all providers that are otherwise eligible to furnish in-person services under Medicare to also furnish telehealth services.

Vet Center Support Act This bill requires the Department of Veterans Affairs (VA) to report on its provision of mental health care to veterans in covered states. A covered state is each state (including Puerto Rico, the District of Columbia, and any territory or possession of the United States) that has a ratio of one or fewer Vet Centers per 100,000 or more veterans residing in the state or territory. Vet Centers are community-based counseling centers that provide social and psychological services to eligible veterans, active duty service members, and their families. The VA must also report on the marketing and outreach funding of Vet Centers in covered states.

Medicaid Dental Benefit Act of 2021 This bill requires state Medicaid programs to cover dental and oral health services for adults. It also increases the Federal Medical Assistance Percentage (i.e., federal matching rate) for such services. This bill modifies requirements relating to coverage of certain telehealth services under Medicare. Specifically, the bill permanently allows telehealth services for substance-use disorders and mental health disorders to be provided via audio-only technology and without an initial in-person evaluation. Schedule III or IV controlled substances may also be prescribed online if a practitioner has conducted a telehealth evaluation with video; certain opioid agonists may be prescribed via audio-only technology if the beneficiary initially lacks access to video technology but receives a follow-up evaluation via video within 10 days. The Department of Health and Human Services must establish an interagency task force to study the utilization and effect of opioid agonist prescriptions that are issued via telehealth.

COVID-19 Individual Liberty Act of 2021 This bill nullifies executive orders and otherwise limits the authority of the federal government and federally funded entities to mandate COVID-19 vaccines and other prevention measures. Specifically, the bill nullifies two executive orders issued on September 9, 2021, which (1) mandate COVID-19 vaccines for federal employees, and (2) require federal contractors to comply with workplace safety guidance for preventing COVID-19. In addition, the bill bars the use of federal funds for implementing or enforcing a COVID-19 vaccine mandate, including employer-based mandates. The bill also prohibits requiring, as a condition of participation in Medicare or Medicaid, that health care providers mandate COVID-19 vaccinations for their employees. Furthermore, the federal government may not (1) issue any standardized documentation that certifies an individual's COVID-19 vaccination status to a third party, or (2) condition the provision of any service or benefit on the receipt of documentation certifying an individual's COVID-19 vaccination status or post-transmission recovery. These prohibitions apply to state, tribal, and local governments (excluding schools and institutions of higher education) as a condition of receiving federal COVID-19 relief funds. The bill also requires the Department of Health and Human Services to publish guidelines on the extent to which natural immunity to COVID-19 prevents contracting or spreading the disease.

Outpatient Surgery Quality and Access Act of 2021 This bill establishes and modifies certain requirements relating to Medicare payments for ambulatory surgical center (ASC) services. Specifically, the bill (1) requires the payment system for ASC services to feature certain positive annual adjustments equivalent to those made with respect to hospital outpatient department (OPD) services; (2) revises quality reporting requirements to permit publicly available, side-by-side comparisons of quality measures for ASCs and OPDs in the same geographic area; and (3) requires the Centers for Medicare & Medicaid Services (CMS), when excluding requested procedures from the list of those approved to be performed in ASCs, to cite specified reasons for doing so. With respect to excluding procedures from the approved list for ASCs, the CMS may not cite as a basis for exclusion that a procedure can only be reported using an unlisted surgical procedure code. (Physicians sometimes use unlisted codes when performing new procedures or services if no existing code is adequately descriptive.) The bill also limits the copayment amount for ASC services under Medicare to that of the inpatient hospital deductible.

National Patient ID Repeal Act This bill repeals the requirement that the Department of Health and Human Services adopt a standard unique health identifier for each individual, employer, health plan, and health care provider. The provision has not been implemented to date because language included in annual appropriations acts has prohibited the use of federal funds for developing a unique identifier. However, some appropriations bills introduced in recent years have not included this funding restriction.

National Informed Consent Exemption (NICE) Act This bill restricts the federal government and federally funded entities from mandating that U.S. citizens receive a vaccination or a test for an infectious disease in order to participate in federal programs or activities such as travel. It also specifies that laws, regulations, or policies that discriminate on the basis of a citizen's vaccination status are unenforceable, subject to limited exceptions. The bill establishes a national vaccination exemption that may be exercised by any individual, including on behalf of the individual's children or dependents. Further, the bill prohibits vaccinating a child without the consent of each parent or guardian. One parent or guardian may consent if the other parent or guardian received, at least three days prior, written notice of the child's vaccination appointment. The bill's provisions do not apply (1) to lawfully incarcerated or institutionalized individuals, (2) to a specific individual subject to an individualized court order that meets due process protections, or (3) during declared emergencies if the jurisdiction's governing authority formally applies to the President for an exception to the national vaccination exemption that meets specified standards. An aggrieved individual may enforce the bill through a private right of action. Additionally, an entity that provides false information to influence an individual's decision about receiving a vaccine shall be liable for damages resulting from the vaccination. The Surgeon General must establish an independent commission to evaluate the safety of COVID-19 vaccines and other vaccines recommended by the Centers for Disease Control and Prevention.

Pandemic Risk Insurance Act of 2021 This bill establishes the Pandemic Risk Reinsurance Program within the Department of the Treasury. The program generally provides compensation to property and casualty insurers if they incur losses as a result of coverage related to pandemics and outbreaks of disease. All insurers as specified in the bill must participate in the program. These insurers must offer, in all property and casualty insurance policies, coverage of losses related to an outbreak of infectious disease or a pandemic for which a covered public health emergency is certified by the Department of Health and Human Services. Additionally, these insurers must offer, in all its commercial property insurance policies, coverage to compensate the insured for a portion of 180 days' fixed costs and payroll triggered upon the certification of a public health emergency and state or local government closure orders without requiring specific proof of losses. The bill establishes the share of insured losses covered by the program and conditions for payment to insurers. The bill also provides for the treatment of reinsurance, captive insurers, other self-insurance arrangements, and state residual market insurance entities. The Government Accountability Office must report on the availability and affordability of property and casualty insurance.

Help Ensure Lower Patient Copays Act or the HELP Copays Act This bill requires health insurance plans to apply certain payments made by, or on behalf of, a plan enrollee toward a plan's cost-sharing requirements. Specifically, plans must apply third-party payments, financial assistance, discounts, product vouchers, and other reductions in out-of-pocket expenses toward the requirements.

Expanding Access to Diabetes Self-Management Training Act of 2021 This bill expands Medicare coverage of diabetes outpatient self-management training. It also requires the Center for Medicare and Medicaid Innovation to test a model in which such training is provided virtually.

National Patient ID Repeal Act This bill repeals the requirement that the Department of Health and Human Services adopt a standard unique health identifier for each individual, employer, health plan, and health care provider. The provision has not been implemented to date because language included in annual appropriations acts has prohibited the use of federal funds for developing a unique identifier. However, some appropriations bills introduced in recent years have not included this funding restriction.

No Veteran Falls Through the Cracks Act This bill requires the Department of Veterans Affairs to attempt to reschedule a veteran's mental health care appointment if the veteran has canceled such an appointment.

Brycen Gray and Ben Price COVID-19 Neurological Impact Act This bill authorizes grants and requires other activities to address neurological and psychiatric illnesses associated with COVID-19 infection. Specifically, the National Science Foundation may award competitive grants for multidisciplinary research on such illnesses. In addition, the White House Office of Science and Technology Policy must establish a temporary interagency working group to coordinate relevant federal programs, data collection, and other activities focused on neurological and psychiatric illnesses associated with COVID-19 infection. The working group must also engage with researchers and nonfederal stakeholders to ensure the sharing and dissemination of relevant research, information, and best practices pertaining to those illnesses. The working group terminates after five years.
