Biosimilar Red Tape Elimination Act This bill removes and otherwise modifies certain requirements related to the approval of biosimilars, such as prohibiting the Food and Drug Administration from requiring studies that assess the risks of switching between the biosimilar and the reference biologic.

Medicare & You Handbook Improvement Act of 2022 This bill specifically requires the Centers for Medicare & Medicaid Services to describe the types of prior authorization requirements and other utilization management requirements that may apply under Medicare in the Medicare & You handbook, including how to inquire about requirements under Medicare Advantage (MA) or prescription drug plans. It also requires the handbook to include a description of the network sizes of MA plans and an illustrative example showing the impact of switching from an MA plan to Medicare on the ability to purchase Medigap supplemental policies.

Preventive Services Early Action Act This bill requires the U.S. Preventive Services Task Force to review scientific evidence concerning clinical preventive service recommendations and update those recommendations if supported by those reviews on a more frequent basis. The task force is an independent panel of national experts in disease prevention and evidence-based medicine that makes recommendations (subject to public comment) about clinical preventive services. Currently, the task force must review relevant evidence about its recommendations, and update them if necessary, at least once during every five-year period. Under this bill, the task force must implement a process for carrying out ongoing reviews of scientific evidence related to its existing recommendations and new topics and report findings and other information about those reviews on a quarterly basis. The bill also requires the task force to determine whether to initiate the process for updating or modifying a recommendation before the close of the five-year period if (1) the scientific review supports such early action, or (2) the Food and Drug Administration approves or clears a new screening test or medication that could serve as a preventive strategy or modality related to a recommendation.

Independent Drug Value Assessment Act This bill requires the Office of the Assistant Secretary for Planning and Evaluation to contract with outside entities to conduct independent value assessments of approved drugs (i.e., economic analysis of the benefits to patients and the health care system).

PACE Part D Choice Act of 2022 This bill allows Medicare-only beneficiaries who are enrolled in Programs of All-Inclusive Care for the Elderly (PACE) to choose prescription drug plans that are not operated by PACE. (PACE is a program under Medicare and Medicaid that provides in-home and community services for certain individuals as an alternative to nursing home care.) Specifically, the bill allows PACE enrollees who are Medicare (but not Medicaid) beneficiaries to choose a prescription drug plan that is not a Medicare Advantage plan or operated by PACE and for which annual out-of-pocket costs and federal subsidies are equal to or less than that under the applicable PACE prescription drug plan. The bill also allows for disenrollment from a chosen plan upon a change in medication or demonstration of an unexpected increase in out-of-pocket costs. PACE programs must conduct outreach, monitor data, and coordinate benefits with respect to such options.

Data on Interactions and Accountability for Law Enforcement with Individuals with Disabilities Act This bill expands activities to collect data about interactions between law enforcement officers and individuals with disabilities. In particular, the bill establishes a temporary advisory council within the Department of Health and Human Services (HHS) to develop a methodology for collecting and reporting data on interactions between law enforcement officers and individuals with disabilities. HHS must award a grant to an independent research organization or institution of higher education to test the validity and reliability of the council's methodology. The council must also provide the Department of Justice with best practices to collect disability status in cases where a death or injury occurred because of an interaction with law enforcement. The bill also requires certain federal initiatives that collect information about interactions with law enforcement (e.g., the National Use-of-Force Data Collection) to include disability status. Further, the Bureau of Justice must award a grant to an independent third-party organization (e.g., an institution of higher education) for identifying trends using certain survey data in violence committed by law enforcement officers against individuals with disabilities.

Pre-Approval Information Exchange Act of 2022 This bill specifies that product information that is exchanged between drug manufacturers and certain health care entities (e.g., formulary committees) about drug products before regulatory approval is not considered to be misbranding if it relates to the product's investigational use and meets other specified criteria. The Government Accountability Office must study the use and effects of such information.

Dr. Joanne Smith Memorial Rehabilitation Innovation Centers Act of 2022 This bill directs the Centers for Medicare & Medicaid Services (CMS) to publish and biennially update a list of all rehabilitation innovation centers. The bill defines rehabilitation innovation centers as rehabilitation facilities that (1) hold specified federal research and training designations for traumatic brain injury or spinal cord injury research, and (2) serve at least a certain number of Medicare patients. The CMS may waive such criteria as it deems appropriate.

Rural ER Access Act This bill requires the Centers for Medicare & Medicaid Services to repeal regulations that require off-campus facilities to be located within 35 miles of the main hospital or critical access hospital in order to receive provider-based status under Medicare (i.e., to be considered as hospital outpatient departments for purposes of Medicare payment).

Rural Health Care Access Act of 2022 This bill eliminates certain criteria that hospitals must meet in order to qualify as critical access hospitals that receive special payment under Medicare. Specifically, the bill eliminates the requirement that a hospital must either (1) be located more than 35 miles (15 miles in mountainous regions or areas with only secondary roads) from another hospital, or (2) have been certified prior to January 1, 2006, by the state as a necessary provider of services in the area.

Abortion Care Awareness Act of 2022 This bill requires the Department of Health and Human Services to carry out a campaign to educate the public about how to access abortion and related health services. The campaign must address, among other matters, the legality of interstate travel to obtain abortions and related services and accurate information about medication abortions.

Caring for Mothers Act of 2022 This bill permits an individual enrolled in a group or individual health insurance plan and who intends to adopt a child to enroll the pregnant mother of the child in the adoptive individual's coverage for the purpose of providing (1) pregnancy-related and postpartum care, and (2) mental health and substance use disorder services.

Program of All-Inclusive Care for the Elderly Expanded Act or the PACE Expanded Act This bill modifies requirements regarding Programs of All-Inclusive Care for the Elderly (PACE). PACE is a program under Medicare and Medicaid that provides in-home and community services for certain individuals as an alternative to nursing home care. The bill allows Medicare beneficiaries to enroll in a PACE program at any time and provides states with the option to allow Medicaid beneficiaries to do the same. Entities may also apply to become PACE providers at any time, upon specified assurances relating to staffing and other requirements. The bill also (1) allows the Center for Medicare and Medicaid Innovation to test a model for expanded PACE eligibility that targets high-need and high-cost populations, and (2) requires an evaluation of the effectiveness of PACE in rural and underserved areas.

Bruce's Law This bill reauthorizes certain grants through FY2027 and sets out other activities to address drug overdoses, with a particular focus on contamination with fentanyl or other synthetic opioids. Specifically, the bill (1) reauthorizes grants that are available through the White House Office of National Drug Control Policy (ONDCP) for community-based coalitions to address local drug crises, and (2) authorizes new grants for coalitions to implement education and prevention strategies in communities that face significant levels of drug overdoses related to fentanyl and other synthetic opioids. The ONDCP may delegate authority to execute the new grants to the Centers for Disease Control and Prevention. Additionally, the Department of Health and Human Services (HHS) must carry out a campaign to increase public awareness of the dangers of fentanyl and other synthetic opioids, including the risks of such substances contaminating counterfeit drugs. The bill also establishes an interagency work group to coordinate and improve federal efforts to reduce and prevent overdoses caused by illegal drugs contaminated with fentanyl or other synthetic opioids. Work group members include the ONDCP, HHS, the Department of Justice, and the Department of State.

Access to Donor Milk Act of 2022 This bill establishes programs and requirements to support the provision of donor milk for infants by nonprofit milk banks, including by (1) allowing Special Supplemental Nutrition Program for Women, Infants, and Children (WIC) funding to be used towards nonprofit milk banks, (2) establishing grants to expand the emergency capacity of nonprofit milk banks, and (3) establishing a donor milk awareness program.

Stop Nurse Shortages Act This bill includes the development of accelerated nursing programs to increase the number of graduating nurses (including graduates who are from disadvantaged backgrounds) as a priority area for certain grants made to institutions of higher education or other eligible entities for nurse education, practice, quality, and retention.

This resolution affirms that there is well-established authority for the Food and Drug Administration to approve, license, and otherwise regulate reproductive health products under the Federal Food, Drug, and Cosmetic Act and the Public Health Service Act. The resolution also affirms that (1) such federal laws preempt (i.e., supersede conflicting state or local laws) any state or local laws that prohibit or limit access to or use of any reproductive health product, and (2) the Department of Justice has authority to enforce the preemptive effect of such federal laws by suing any state or political subdivision of a state that prohibits or limits access to or use of any reproductive health product.

Nursing Home Pandemic Protection Act This bill establishes several requirements for skilled nursing facilities, nursing facilities, and assisted living facilities to address the outbreak of COVID-19. Specifically, the bill requires these facilities to establish crisis plans and to maintain at least a 30-day supply of personal protective equipment to respond to the outbreak.

Speak Up to Protect Every Abused Kid Act This bill establishes and modifies certain requirements related to mandatory reporting of suspected and known incidents of child abuse. Specifically, the bill requires the Department of Health and Human Services to provide grants for campaigns to educate the public and for training about (1) state child abuse or neglect laws, and (2) the responsibility to report suspected incidents of such abuse or neglect. Further, for a state to be eligible for various grants supporting child abuse or neglect treatment and prevention programs, the state must provide assurances that it has mandatory reporting requirements in place for specified individuals who provide services involving children (e.g., health care providers, school personnel, child care employees, and volunteers). States must (1) provide training to these individuals about reporting abuse, and (2) evaluate the effectiveness of the state's reporting requirements. The bill also revises reporting requirements for child abuse or neglect treatment and prevention grants to include data about changes in the rates of child abuse reporting and child abuse fatalities.

Oral Health Literacy and Awareness Act of 2022 This bill requires the Health Resources and Services Administration (HRSA) to conduct a public education campaign to increase oral health literacy and awareness. HRSA must design the campaign to focus on children, pregnant women, parents, older adults, people with disabilities, and racial and ethnic minorities.

Train More Doctors Act of 2022 This bill extends the resident cap building period for purposes of Medicare graduate medical education payments for hospitals that began training residents in a new program between July 1, 2018, and July 1, 2021, to take into account the impact of the COVID-19 public health emergency on these hospitals.

Healthcare Freedom Act of 2022 This bill expands the availability of health savings accounts. It renames such accounts as health freedom accounts and allows all individuals to receive increased tax deductions for contributions to such accounts. The term qualified medical expenses is expanded to include costs associated with direct primary care, health care sharing ministries, and medical cost sharing organizations. The bill also excludes employer contributions to health freedom accounts from employee gross income for income tax purposes.

Grief Resilience Investment and Education Fund Act or the GRIEF Act This bill requires the Department of Health and Human Services to support activities to address grief and loss, with a particular focus on grief and loss related to the COVID-19 pandemic. Specific activities required include (1) a public education campaign on understanding grief and loss; (2) grants for training providers on bereavement care and providing such care to individuals affected by COVID-19 and related deaths; and (3) research on complicated and prolonged grief, including interventions for its prevention and treatment.

Strategies To Address Antimicrobial Resistance Act or the STAAR Act This bill expands various initiatives to address antimicrobial resistance. The bill reestablishes the interagency Antimicrobial Resistance Task Force to coordinate and develop efforts addressing antimicrobial resistance. The Department of Health and Human Services must encourage health care facilities to implement antimicrobial stewardship programs to evaluate and improve the use of antimicrobial drugs. The bill also requires the use of the National Healthcare Safety Network and similar surveillance systems to collect and report data about the usage of antimicrobial drugs, changes in resistance to such drugs, and other trends impacting patient outcomes. Additionally, the bill increases nationwide efforts to monitor, research, and prevent the spread of infection from resistant organisms by establishing the Antimicrobial Resistance Surveillance and Laboratory Network in at least seven geographic regions, maintaining the Clinical Trials Network on Antimicrobial Resistance to conduct clinical research, and requiring collaboration with state and local agencies that support health care facilities that focus on preventing the spread of antibiotic-resistant bacteria.

Expanding Representation at HHS Act of 2022 This bill requires certain agencies and offices within the Department of Health and Human Services to address diversity in their procurement activities and workforce. The bill specifically covers offices and agencies that are authorized to award grants or other financial assistance, such as the Centers for Medicare & Medicaid Services and the Centers for Disease Control and Prevention. Each covered entity must establish an Office of Minority and Women Inclusion that is responsible for managing diversity within the entity and with respect to the entity's activities. This new office is not, however, responsible for enforcing civil rights statutes, regulations, or executive orders. In addition, an entity subject to the bill's requirements must modify its evaluation, award, and termination of grants and contracts to ensure, to the maximum extent feasible, the inclusion of minorities; women; and minority-led and women-led grantees, contractors, subgrantees, and subcontractors. Each entity must also undertake actions to increase diversity in its workforce, including by recruiting at institutions of higher education where the majority of the students are members of minority populations.
