Infrastructure Modernization Project Related to the OVerall Enhancement of Nursing Homes Act or the IMPROVE Nursing Homes Act This bill requires the Centers for Medicare & Medicaid Services to establish a grant program to support the conversion of traditional nursing facilities to small-house nursing facilities (i.e., facilities that offer private rooms for up to 12 residents in separate buildings or areas). Grant funds may be used to convert facilities but not for facility operation; grant recipients must agree to provide person-centered care that supports certain resident flexibilities and to operate such facilities for at least 20 years.

Salton Sea Public Health and Environmental Protection Act of 2022 This bill provides support for restoring the Salton Sea in California. Specifically, the Bureau of Reclamation must establish a program to provide for water quality improvements, dust mitigation, and environmental restoration at the Salton Sea. The Department of the Interior must, in coordination with efforts by California, engage in activities to improve dust control and habitat conservation. Interior must also establish a Salton Sea Council to coordinate and expedite various Salton Sea projects.

Achieving Thorough Transparency and Accessibility for Information Navigation on Mental Health Act of 2022 or the ATTAIN Mental Health Act This bill requires the Department of Health and Human Services (HHS) to establish a public-facing, online dashboard to publicize federally funded mental health grants. The dashboard must contain, for example, program names and opening and closing dates for applications. In addition, HHS must establish a process to include information voluntarily provided by states about their federally supported mental health grants on the dashboard. In developing the dashboard, HHS must consult with appropriate federal departments and agencies and other stakeholders.

Greater Mental Health Access Act This bill establishes a special enrollment period for family members of individuals who died by suicide to enroll in, or change enrollment under, a health insurance plan. The bill also requires the Substance Abuse and Mental Health Services Administration to use funds from the Prevention and Public Health Fund to award grants to medical providers and others to provide outpatient mental health services for individuals impacted by the attempted or completed suicide of a friend or family member.

Streamlining Text for Official Policy by Formulating Effective Needed Tools to Address Narcotics, Yearly Loss of life and Protect Americans from Chemical Killers and Against Gangs Effectively Act or the STOP FENTANYL PACKAGE This bill temporarily expands access to drugs that reverse opioid overdoses and makes other changes to drug control activities. The bill expands the authority of health care providers to distribute, and the authority of first responders and lay administrators to administer, opioid overdose reversal drugs. Health care providers may distribute the drugs to those at risk of an overdose or others in the community able to assist an individual at such risk. Additionally, the bill provides immunity from civil and criminal liability and other adverse actions for injuries that arise from distributing or administering those drugs unless the injury was caused by gross negligence or willful or wanton misconduct. The authority and liability protections terminate 90 days after the Department of Health and Human Services (HHS) terminates the on-going opioid public health emergency first declared on October 26, 2017, and the bill preempts state laws that provide lesser protections. Further, the Department of Justice (DOJ) must support training for law enforcement on drug-related matters and upgrading laboratories; HHS and DOJ may award grants for improving data collection and surveillance concerning overdoses. The bill also expands existing drug control activities. For example, recipients may use their community policing grants to procure equipment that protects first responders from secondary fentanyl exposure. Other matters addressed in the bill include interagency coordination of drug control activities; uniform reporting standards for information concerning drug control activities; budgeting for a program that analyzes fentanyl samples; and challenges with implementing State Opioid Response grants.

Reproductive Health Care Accessibility Act This bill establishes various grants and related programs that address sexual and reproductive health care for individuals with disabilities. Specifically, the Health Resources and Services Administration must support training for health care providers who offer sexual and reproductive health care to individuals with disabilities, and educating individuals with disabilities about sexual and reproductive health care. The Administration for Community Living must establish a national center to provide recommendations, technical assistance, and other resources related to the provision of sexual and reproductive health care for individuals with disabilities. The bill also authorizes support for medical schools, nursing schools, and other educational institutions that offer obstetrics and gynecology training programs to expand the number of individuals with disabilities entering the reproductive health care workforce. Additionally, the Department of Health and Human Services must study the effectiveness and other aspects of reproductive health care services and programs for individuals with disabilities.

Furthermore, states may not use federal funds to pursue legal cases or similar proceedings (e.g., adverse licensing proceedings) against health care providers, individuals, or entities that offer or assist with lawful reproductive health care services. Additionally, medical malpractice insurers may not deny coverage to or sue a health care provider because the provider offers or assists with lawful reproductive health care services. The bill also funds grants to assist health care providers who offer or refer for abortion services and face legal issues relating to their provision of reproductive health care services with legal matters and improving security.

The bill allows the Department of Justice to bring a civil action and establishes a private right of action for violations.

Health Security and Countering Weapons of Mass Destruction Act This bill makes changes to the Countering Weapons of Mass Destruction (CWMD) office of the Department of Homeland Security (DHS) and provides statutory authority for and expands DHS's Office of Health Security (OHS). Specifically, the bill establishes the new OHS to advise DHS on medical, public health, and workforce safety matters; sets forth the responsibilities of the Chief Medical Officer and a Privacy Officer in OHS; repeals the terminating date for the CWMD office and sets forth the responsibilities of that office, including efforts to counter chemical, biological, radiological, and nuclear (CBRN) threats, as well as other emerging terrorism threats; establishes a CWMD Advisory Council; and requires a biodefense review and issuance of a DHS biodefense strategy. The Government Accountability Office must report to Congress on efforts of the CWMD office to prioritize its programs and activities to safeguard against CBRN threats and on other activities of that office.

Funding Affordable Internet with Reliable Contributions Act or the FAIR Contributions Act This bill requires the Federal Communications Commission (FCC) to study and report on the feasibility of funding the Universal Service Fund through contributions from edge providers (i.e., providers of online content or services, such as search engines). The fund provides support to high-cost areas, schools and libraries, rural health care facilities, and the Lifeline program (an FCC program that provides a discount on phone service for low-income consumers). The report must consider (1) the type and size of firms and services on which contributions could be assessed, (2) equity issues related to current versus alternative systems for contributing to the fund, (3) the effect of any change to the contribution system on the telecommunications bills of consumers, and (4) the sustainability of the fund and how to ensure that fund disbursements are consistent and predictable over time.

Preserving Access to Home Health Act of 2022 This bill restricts the Centers for Medicare & Medicaid Services (CMS) from decreasing payments for Medicare home health services based on certain adjustments until 2026. Current law requires the CMS to make certain permanent and temporary payment adjustments under the Medicare prospective payment system for home health services based on behavioral assumptions for 2020 through 2026. The bill restricts the CMS from making adjustments that decrease payments until 2026; the CMS must also ensure that any such necessary decreases are made before 2032.

National Plan to End Parkinson's Act This bill requires the Department of Health and Human Services (HHS) to carry out a project to prevent and cure Parkinson's disease (a progressive brain disorder that causes unintended or uncontrollable movements) and related conditions. Among other components of the project, HHS must (1) implement and periodically update a national plan to coordinate and guide efforts to prevent and cure the disease; (2) improve diagnosis, treatment, and care of those with the disease; and (3) address health and other disparities related to the disease. HHS must also conduct annual assessments on the preparation for and response to the increased burden of Parkinson's disease. In addition, the bill establishes a council, comprised of federal and nonfederal stakeholders, to advise HHS on and make recommendations concerning the prevention and cure of Parkinson's disease. The bill's provisions terminate at the end of calendar year 2035.

Mental Health Workforce and Language Access Act of 2022 This bill establishes within the Department of Health and Human Services (HHS) two demonstration programs to increase access to mental health services provided in languages other than English at federally qualified health centers (FQHCs). In carrying out the programs, HHS must give preference to FQHCs at which at least 20% of the patients are best served in a language other than English. First, HHS must provide National Health Service Corps (NHSC) loan repayments to mental health care providers who agree to serve their period of obligated service in an FQHC. Additionally, HHS must provide enhanced payments to those who serve in an FQHC with non-English language needs. (The NHSC is a scholarship and student loan repayment program for eligible health care providers who agree to work in areas with a shortage of primary care, dental care, and mental health care providers.) Second, HHS must award grants to FQHCs for recruiting and retaining mental health care providers who are fluent in a language other than English.

Developing and Nationalizing Key Cannabis Research Act of 2022 This bill directs the National Institutes of Health (NIH) and the Centers for Disease Control and Prevention (CDC) to expand activities concerning cannabis research. The NIH must collaborate with specified agencies to develop a national cannabis research agenda. Among other topics, the agenda must address (1) the therapeutic benefits of cannabis, (2) how cannabis effects specified populations, and (3) other public safety considerations. Additionally, the NIH must designate centers of excellence in cannabis research at institutions of higher education to conduct interdisciplinary research about biomedical, behavioral, and social issues related to cannabis. The CDC must work with other agencies to collect population-wide data about cannabis use, including (1) demographic factors, (2) health outcomes, (3) product variety, and (4) other relevant health information.

Mental Health Justice Act of 2022 This bill creates a grant program for states, tribal entities, and local governments to train and dispatch mental health professionals to respond, instead of law enforcement officers, to emergencies that involve people with behavioral health needs. The Substance Abuse and Mental Health Services Administration (SAMHSA) must manage the program in consultation with the Department of Justice (DOJ). SAMHSA may cancel grants that increase incarceration or institutionalization. The Department of Health and Human Services and DOJ must evaluate this program.

Property Tax Reduction Act of 2022 This bill reduces federal Medicaid funding beginning in FY2025 for certain states that require political subdivisions to contribute funds towards medical assistance. Specifically, the bill applies to states that received, for FY2022, disproportionate share hospital (DSH) allotments greater than six times the national average. (DSHs are hospitals that receive additional payment under Medicaid for treating a large share of low-income patients.) Excepted from the bill are contributions that: (1) are required from a political subdivision that has a population greater than 5 million and imposes a local income tax upon its residents, or (2) were required for administrative expenses as of January 1, 2022.

Protect Sexual and Reproductive Health Act of 2022 This bill requires the Department of Health and Human Services (HHS) to undertake activities to promote access to sexual and reproductive health and well-being. The bill renames HHS's Office of Population Affairs as the Office of Sexual and Reproductive Health and modifies its responsibilities. Among other activities, the office must develop and implement a strategy to promote sexual and reproductive health and well-being. This strategy must include recommendations to integrate sexual and reproductive health equity and reproductive justice into federal programs. HHS must also award grants for improving access to sexual and reproductive health care to nonprofit or community-based organizations that assist individuals seeking abortion services through programs that are unbiased and medically and factually accurate. Grant funds may not be used to pay for abortion services. Additionally, HHS and the Director of the White House Gender Policy Council must jointly establish an interagency task force to coordinate and promote federal programs and activities related to sexual and reproductive health and well-being.

Specifically, MA plans must (1) establish an electronic prior authorization program that meets specified standards, including the ability to provide real-time decisions in response to requests for items and services that are routinely approved; (2) annually publish specified prior authorization information, including the percentage of requests approved and the average response time; and (3) meet other standards, as set by the Centers for Medicare & Medicaid Services, relating to the quality and timeliness of prior authorization determinations.
