Medicare Wellness Act of 2001

Medicare Wellness Act of 2001 - Establishes within the Department of Health and Human Services a Working Group on Disease Self-Management and Health Promotion (Working Group) to establish policies and criteria for the Secretary of Health and Human Services to make grants to approved applicants to study specified approaches to further health promotion and disease prevention among Medicare beneficiaries under title XVIII of the Social Security Act (SSA). Directs the Secretary to conduct demonstration projects to promote disease self-management for conditions identified by the Working Group for target individuals. Amends SSA title XVIII to outline Medicare coverage of various specified preventive services, including: (1) therapy and counseling for cessation of tobacco use, and counseling for post-menopausal women; (2) screening for diminished visual acuity, and screening for hypertension; and (3) medical nutrition therapy services for Medicare beneficiaries with cardiovascular diseases, diabetes, or a renal disease. Permits waiver of coinsurance and deductibles for certain preventive services, such as: (1) diabetes outpatient self-management training services; (2) colorectal and prostate cancer screening tests; and (3) bone mass measurement. Directs the Secretary to: (1) integrate supplemental preventive health services with existing program integrity measures; and (2) conduct specified activities, including annual notices to Medicare beneficiaries, to promote use of preventive health benefits, items, and services. Directs the Director of the Centers for Disease Control and Prevention to conduct a national falls prevention and awareness campaign among Medicare beneficiaries. Prescribes requirements for clinical depression screening demonstration projects. Amends SSA title XVIII to direct the Secretary to establish a health education and risk appraisal program. Provides for fast-track consideration of prevention benefit legislation in Congress.

Makes it unlawful for any person receiving Federal funds to knowingly acquire, receive, or otherwise transfer any human embryos for valuable consideration if such action affects interstate commerce. Directs the Secretary, in conjunction with the Director of the National Institutes of Health (NIH), to issue guidelines expanding on the rules governing human embryonic stem cell research to include rules that govern the derivation of stem cells from donated embryos under this Act.

Government Neutrality in Contracting Act

Government Neutrality in Contracting Act - Directs the head of any Federal agency that awards or obligates funds for any construction contract, or that awards grants, provides financial assistance, or enters into cooperative agreements for construction projects, to ensure that bid specifications, project agreements, or other controlling documents do not: (1) require or prohibit a bidder, offeror, contractor, or subcontractor from entering into, or adhering to, agreements with labor organization, with respect to that construction project or another related construction project; or (2) otherwise discriminate against such a party because it did or did not become a signatory or otherwise adhere to such an agreement. Allows exemptions to avert an imminent threat to public health or safety or to serve national security. Allows additional exemptions for certain projects. Directs the Federal Acquisition Regulatory Council to amend the Federal Acquisition Regulation to implement this Act with respect to the applicable Federal contracts.

Amends SSA title XVIII to establish a health education and risk appraisal program that identifies target individuals with specified behavioral risk factors through self-assessment.

Lyme and Infectious Disease Information and Fairness in Treatment (LIFT) Act - Establishes the Tick-Borne Disorders Advisory Committee in the Office of the Secretary of Health and Human Services (HHS). Directs the Committee to advise the Secretary and the Assistant Secretary of HHS and the Social Security Administration (SSA) Commissioner regarding how to: (1) provide public input on the public's needs regarding tick-borne disorders (lyme and other infectious diseases) so that government agencies can coordinate and more effectively plan and execute their activities; and (2) develop informed responses to constituency groups regarding the efforts and progress of the HHS and SAA. Authorizes appropriations to: (1) the Centers for Disease Control and Prevention to focus on developing better diagnostic tools and tests, expanding educational efforts, and re-educating clinicians, medical license boards, and health care insurers about the inappropriate uses of the Lyme disease case surveillance definition in patient diagnosis and treatment; and (2) the U.S. Army Center for Health Promotion and Preventive Medicine to increase risk assessment evaluations of U.S. military bases in the United States for all tick-borne disorders, and continue to study preventive methods to decrease troop exposure to tick-borne disorders. Requires the Director of the National Institutes of Health to coordinate activities and research regarding tick-borne diseases across Institutes to encourage collaborative research.

Dental Health Improvement Act - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services (HHS) to award grants to States to help them develop innovative programs to address the dental workforce needs of designated dental health professional shortage areas in a manner appropriate to the State's individual needs. Defines "designated dental health professional shortage area" to mean an area, population group, or facility designated by the Secretary as a dental health professional shortage area or by a State as having a dental health manpower shortage. Directs the Secretary to develop a plan for increasing participation of dentists and dental hygienists in the National Health Service Corps' scholarship and loan repayment programs. Revises scholarship and loan repayment program requirements to allow periods of obligated service (period of time that a recipient must serve in a health professional shortage area in order to receive a scholarship or loan) to be served and fulfilled on a part time basis if certain conditions are met. Sets forth requirements with respect to the dental health professional shortage area designation process. Amends the Internal Revenue Code to exclude from the gross income of an individual certain amounts received under the National Health Service Corps Scholarship program, the National Health Service Corps Loan Repayment program, or any similar State program.

Steel Revitalization Act of 2001

Steel Revitalization Act of 2001 - Directs the President to impose quotas, tariff surcharges, or other measures on, and to negotiate enforceable voluntary export restraint agreements with respect to, imports of steel products in order to ensure that: (1) the tonnage of iron ore, coke and coke products, semifinished steel, and pig iron imported into the United States during any month does not exceed the average tonnage of each product imported monthly into the United States during the 36-month period preceding July 1997; and (2) the share of domestic consumption of any other applicable steel product in the United States derived from imports during any month does not exceed the average monthly share of domestic U.S. consumption of that steel product during any month in the 36-month period preceding July 1997. Establishes: (1) the Steel Retiree Health Care Board in the Department of Labor; (2) the Steelworker Retiree Health Care Trust Fund; and (3) the Health Care Benefit Costs Assistance Program. Amends the Internal Revenue Code to impose an excise tax on steel sold by the manufacturer, producer, or importer (with proceeds to be deposited into the Steelworker Retiree Health Care Trust Fund). Amends the Emergency Steel Loan Guarantee Act of 1999 to increase the aggregate amount of loans guaranteed and outstanding at any one time under Emergency Steel Guarantee Loan Program or with respect to a single qualified steel company. Directs the Secretary to make a grant to help a merged steel product company comply with environmental requirements if such merger will promote the retention of at least 80 percent of the jobs of the steel workers and of the steel- producing facilities of the merging companies.

Amends the Public Health Service Act to require the NIH Director to: (1) appoint an official of the Department of Health and Human Services to serve as the NIH coordinator regarding breast implant research; (2) establish either a study section or special emphasis panel for NIH to review extramural breast implant research grant applications to ensure research design and quality, as well as quality intramural research; and (3) conduct or support research to expand the understanding of the health implications of both saline and silicone breast implants. Requires a report from the Commissioner of Food and Drugs concerning postmarket evaluations of saline implant manufacturers' data. Directs the Commissioner to take specified steps to assist women in receiving accurate and complete information about the risks of silicone breast implants.

Kids Deserve Freedom from Tobacco Act of 2001 or the KIDS Act - Amends the Federal Food, Drug, and Cosmetic Act to provide for additional restrictions on the marketing, advertising, and access to tobacco products. Comprehensive Insurance Coverage of Childhood Immunization Act of 2001 - Amends ERISA, PHSA, and the Internal Revenue Code (IRC) to outline standards relating to coverage of childhood immunization. Children's Environmental Protection Act - Amends the Toxic Substances Control Act to provide for environmental protection for children and other vulnerable subpopulations. School Environment Protection Act - Amends the Federal Insecticide, Fungicide, and Rodenticide Act to provide for integrated pest management systems for public schools. Directs the Secretary of Health and Human Services (HHS Secretary) to make grants to eligible States to support parenting support and education programs. Family and Medical Leave Fairness Act of 2001 - Amends the Family and Medical Leave Act of 1993 to extend its coverage to private employers with 25 or more (currently, 50 or more) employees. Family Income to Respond to Significant Transitions Insurance Act - Directs the Secretary of Labor to make grants to pay for the Federal share of projects to provide wage replacement for eligible individuals responding to family caregiving needs, including those resulting from the birth or adoption of a child. Children's Environmental Protection and Right to Know Act - Amends: (1) the Emergency Planning and Community Right-To-Know Act of 1986 with respect to reporting toxic chemicals; and (2) the Federal Hazardous Substances Act to require publication of a list of substances or mixtures determined toxic to children. Amends SSA title IV part D (Child Support and Establishment of Paternity) to provide block grants to States for media campaigns promoting responsible fatherhood. Focus On Committed and Underpaid Staff for Children's Sake Act or the FOCUS Act - Establishes the Child Care Provider Development and Retention Grant Program and the Child Care Provider Scholarship Program. Federal Employees Child Care Act - Provides for child care centers in Federal facilities as well as for child care services for Federal employees. Early Learning Linkages Act of 2001 - Repeals the Early Learning Opportunities Act to replace it with a program of grants by the HHS Secretary to State and Local Councils to provide funds to early childhood learning providers to: (1) increase the number of full-day full-year Head Start programs, and the number of children served by Early Head Start and State prekindergarten education programs; and (2) develop linkages among such programs within a community and between them and health care services for young children in ways that facilitate greater access to such programs. Child Care Facilities Financing Act - Authorizes the Secretary to award grants for the Federal share of the cost of the acquisition, construction, or improvement of child care facilities or equipment. Book Stamp Act - Directs the Secretary to make grants to State agencies to promote child literacy and improve children's access to books at home and in early learning and other child care programs. America's Better Classroom Act of 2001 - Amends the IRC to establish an income tax credit for qualified public school modernization, school construction, and zone academy bonds. Child Opportunity Zone Family Center Act of 2001 - Amends the Elementary and Secondary Education Act of 1965 to authorize the Secretary of Education to award grants to partnerships for child opportunity zone family centers. Tax Relief for Working Families Act of 2001 - Amends the IRC to increase the earned income tax credit for married couples and for two or more qualifying children. Extends the dependent care tax credit to respite care services. Establishes the Gateways Grant Program to improve the administration of State and county low-income families with children programs. Child Support Distribution Act of 2001 - Amends SSA title IV parts A (Temporary Assistance for Needy Families) (TANF) and B (Child Support and Establishment of Paternity) to provide for increased child support payments to families and enforcement of child support obligations. Child Support Assurance Act of 2001 - Directs the HHS Secretary to make grants to States for child support assurance demonstration projects. Fair Minimum Wage Act of 2001 - Amends the Fair Labor Standards Act of 1938 to provide for a graduated increase in the minimum wage (and apply it to the Commonwealth of the Northern Mariana Islands). Federal Living Wage Responsibility Act - Specifies minimum hourly wages and other employment terms for employees under Federal contracts. Amends the Richard B. Russell National School Lunch Act concerning the child and adult care food program, and the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 concerning the food stamp program. Directs the Secretary of Housing and Urban Development (HUD) to establish a rental assistance voucher program. Establishes the Voucher Success Fund and the National Affordable Housing Trust Fund. Amends SSA title IV part B (Child and Family Services) for expansion of the promoting safe and stable families program. Social Services Block Grant Restoration Act of 2001 - Amends SSA title IV part A (TANF) and SSA title XX (Block Grants to States for Social Services) to provide for restoration of funds for the social services block grant. Child Protection/Alcohol and Drug Partnership Act of 2001 - Amends SSA title IV part B to provide for child protection and alcohol and drug partnerships for children. Amends SSA title IV part E to provide for a permanency grants program. Amends the Family Violence Prevention and Services Act to direct the HHS Secretary to award grants for programs to encourage domestic violence models using multisystem partnerships to address the needs of children exposed to domestic violence. Directs the Secretary to make grants to States to address the mental health and developmental needs of young children. Revises the 21st Century Community Learning Centers Act. Younger Americans Act - Establishes a national youth policy, an Office of National Youth Policy in the Executive Office of the President, and a Council on National Youth Policy. Establishes grants for State and community programs to encourage and assist State agencies, community boards, and area agencies on youth to assure that all youth have access to the full array of core resources. Mental Health Juvenile Justice Act - Amends the Juvenile Justice and Delinquency Prevention Act of 1974 (JJDPA) to establish grants for a State and local juvenile justice agency training program regarding access to mental health and substance abuse treatment for juveniles in contact with the State juvenile justice system. Establishes a Federal Coordinating Council on Criminalization of Juveniles With Mental Disorders. Juvenile Justice and Accountability Act - Amends the JJDPA to establish grants to States for juvenile accountability block grants. Amends the Federal criminal code to: (1) provide for the regulation of firearms transfers at gun shows; and (2) require child handgun safety locks on firearms. Amends the Consumer Product Safety Act to require child handgun safety locks. Prohibits weapons transfers to juveniles and imports of large capacity ammunition feeding devices. Amends the Violent Crime Control and Law Enforcement Act of 1994 to establish grants for: (1) State and local domestic violence offender recordkeeping improvements; (2) State and local gun prosecutors; and (3) local and antigun violence media campaigns. Provides for regulation of Internet firearms transfers. Prohibits multiple handgun sales or purchases. Directs the HHS Secretary to establish the Advisory Committee on Private Sector Support for Children and Families.

Small Business and Financial Institutions Tax Relief Act of 2001- Amends the Internal Revenue Code to include individual retirement accounts (IRAs) as eligible S corporation shareholders. Exempts from prohibited transaction rules any sale of stock in an IRA pursuant to a small business corporation's election to be an S corporation. Excludes from the definition of passive income for purposes of S status termination any interest income earned by or dividends on assets required to be held by a bank, a bank holding company, or a qualified subchapter S subsidiary bank. Increases to 150 the maximum number of shareholders a small business organization may have to be eligible to elect S corporation treatment. States that stock held by a bank director as required by banking regulations (director qualifying stock) shall not be considered a disqualifying second class of S corporation stock. Directs the Secretary of the Treasury to modify a certain regulation to permit an S corporation bank to treat certain bad debt deductions as built-in losses during the entire period during which the bank recognized built-in gains from changing its accounting method for recognizing bad debts from the reserve method to the charge-off method. Includes all banks within the three-year deduction preference rule. Repeals the requirement that partnership rules apply to S corporations (and two-percent shareholders in such corporations) for fringe benefit purposes. Applies current special corporation rules for health insurance costs of self-employed individuals to two-percent shareholders in S corporations, except that a two-percent shareholder's wages shall be treated as self-employed earned income. (Thus provides that non-health care related fringe benefits such as group-term life insurance will be excludible from such wages, and not taxed.) Makes family limited partnerships eligible to be S corporation shareholders. Permits the issuance of qualified preferred stock, which shall not be treated as second class stock. Makes any distribution (not in payment in exchange for stock) made by an S corporation with respect to qualified preferred stock includible as ordinary income of the holder and deductible to the corporation as an expense. Reduces to 90 percent the percentage of shares held by shareholders necessary for consent to election by a small business organization to be an S corporation. Revises exceptions to the criteria for the treatment of certain wholly owned subchapter S subsidiaries with reference to required information returns.

Allows a patient to receive, and the practitioner to provide or administer, any unapproved drug or medical device the patient or their legal representative desires, provided certain conditions are met. Sets forth circumstances under which a health care practitioner may recommend, provide, or administer an unapproved drug or medical device. Requires a practitioner who discovers that an unapproved drug or medical device creates a danger to a patient immediately to cease use and recommendation of such drug or device and provide specified information to its manufacturer and the Director of the Centers for Disease Control and Prevention. Requires the manufacturer that receives such information to: (1) immediately cease sale and distribution of the drug or device; and (2) comply with specified notification and reporting requirements. Sets forth certain investigative and reporting duties that the Director, the Secretary of Health and Human Services, and a practitioner must perform with respect to the dangerousness or effectiveness of unapproved drugs or medical devices. Sets forth a penalty for violations of this Act.

Requires the recipient of a patent to make a reasonable pricing agreement with the Secretary (or the Secretary to waive such an agreement in the public interest) if any Federal agency or any non-profit entity: (1) undertakes federally funded health care research and development; and (2) is to convey or provide a patent or other exclusive right to use such research and development for a drug or other health care technology.

Requires that training emphasis be given to medical laboratory personnel in medical laboratory disciplines with respect to which there are needs for increased numbers of personnel.

Requires the Secretary to determine whether or not such mergers will promote the retention of at least 80 percent of the jobs of the steel workers and production capacity for such steel products. Sets forth penalties for failure to achieve such retention levels.

Outlines requirements for the offering of NICE program coverage, which include prohibiting pre-existing condition exclusions. Establishes in the Treasury the NICE Trust Fund, consisting in part of amounts from the on-budget surplus, to be available only for expenditures to carry out the NICE program. Amends the Omnibus Budget Reconciliation Act of 1990 to include with Medicare supplemental policy (Medigap) comparison information for Medigap policies, information on the NICE program for purposes of State grant application plans for State-wide health insurance, counseling, and assistance grants.

Amends the Employee Retirement Income Security Act of 1974, the Public Health Service Act, and the Internal Revenue Code to, among other things: (1) provide for review and appeal of health plan decisions; (2) provide penalties and court remedies for health plans failing to provide benefits; (3) provide limitations on certain class action litigation; (4) provide for limitation on preemption of State law respecting health insurance issuers; and (5) provide for patient protection standards. Establishes in the Department of Health and Human Services a Patient's Protection Board.

Amends the Public Health Service Act, the Employee Retirement Income Security Act of 1974, and the Internal Revenue Code to set forth requirements for group health plans to provide coverage of immunosuppressive drugs.

Bipartisan Patient Protection Act - Amends the Public Health Service Act, the Employee Retirement Income Security Act of 1974, and the Internal Revenue Code with respect to health care coverage. Requires group health plans, and health insurance issuers providing health insurance coverage, to conduct utilization review activities in connection with the provision of benefits under such plans or coverage only in accordance with an approved utilization review program. Requires health plans and insurers to offer consumers: (1) more care options; and (2) greater access to patient information. Restricts interference by health plans and insurers with the doctor-patient relationship. Prohibits health plans and insurers from discriminating against a licensed health care professional with respect to participation or indemnification. Requires health plans and insurers to comply with patient protection requirements of this Act. States that nothing in this Act shall be construed to alter or amend the social Security Act. Amends the Consolidated Omnibus Reconciliation Act of 1985 to extend authority for customs user fees through September 30, 2011. Requires that any payment under part B (Supplementary Medical Insurance) of title XVIII (Medicare) of the Social Security Act that would otherwise be disbursed on September 30, 2002, by a carrier with a contract to a provider of services for which payment may be made under part B shall be made on October 1, 2002.
