This concurrent resolution establishes the congressional budget for the federal government for FY2022, sets forth budgetary levels for FY2023-FY2031, and provides reconciliation instructions for legislation that increases the deficit. The resolution recommends levels and amounts for FY2022-FY2031 for federal revenues, new budget authority, budget outlays, deficits, public debt, debt held by the public, and the major functional categories of spending. It also recommends levels and amounts for Social Security and Postal Service discretionary administrative expenses for the purpose of budget enforcement in the Senate. The resolution includes reconciliation instructions that direct (1) several House and Senate committees to report legislation that will increase the deficit over FY2022-FY2031 by no more than an amount specified for each committee, and (2) the Senate Finance Committee and the House Ways and Means Committee to report legislation that will reduce the deficit by at least $1 billion over FY2022-FY2031. (Under current law, reconciliation bills are considered by Congress using expedited legislative procedures that prevent a filibuster and restrict amendments in the Senate.) In addition, the resolution establishes reserve funds that allow certain adjustments to committee allocations and other budgetary levels to accommodate reconciliation legislation, tax legislation that does not raise taxes on people making less than $400,000, and legislation that would not increase the deficit over specified time periods. The resolution also sets forth budget enforcement procedures that address issues such as emergency legislation, advance appropriations, infrastructure legislation, adjustments to budget allocations, and cost estimates for child care or prekindergarten legislation.

Semipostal Stamp Clarification Act of 2021 This bill removes the authority of the U.S. Postal Service (USPS) to issue semipostal stamps (stamps sold at a premium to raise funds for causes of national public interest) except as provided by an act of Congress. (Currently, the USPS issues semipostals using its own discretion to determine the causes it considers to be in the national public interest.) The bill also makes entities (currently, only agencies) eligible to receive amounts that become available from the sale of semipostals. Congress must determine the appropriate agencies or entities that receive such amounts. The USPS must issue regulations addressing how administrative costs incurred relating to semipostals shall be computed, recovered, and kept to a minimum.

Specifically, DOD must develop the plan by consulting with state and local election officials. Further, the plan must include (1) methods to ensure that voters have the opportunity to verify that their ballots are received and tabulated, (2) methods to generate a verifiable and auditable vote trail, and (3) an assessment of whether commercially available technologies may be used to carry out the plan. DOD must implement the plan for a trial group of voters in participating states for the 2024 federal elections. The plan must be implemented for all voters in participating states for the 2026 federal elections and subsequent years.

Vote Outcome Transparency in Elections Act or the VOTE Act This bill establishes certain requirements for counting ballots in federal elections. Specifically, the bill requires the appropriate state or local election official, within one hour after the closure of a polling place on election day, to submit a report to the chief state election official. The report must document (1) the total number of voted ballots in the possession of the state or local official, and (2) the total number of voted ballots that have been tabulated for the election. Within one hour after the closure of polling places on election day, the chief state election official must (1) submit a final report to the chief executive of the state, and (2) make the final report publicly available on a government website. The bill also requires each state and local jurisdiction to ensure that voted ballots delivered by postal mail are postmarked, signed, or otherwise indicated as delivered by the U.S. Postal Service.

Postal Service Electric Fleet Authorization Act of 2021 This bill establishes requirements for U.S. Postal Service (USPS) acquisition of vehicles and the infrastructure required to operate a fleet of electric vehicles. The bill's provisions only apply if specified funding is appropriated. Specifically, the bill requires the USPS to ensure that at least 75% of the total number of next generation delivery vehicles purchased using such funds are electric or zero-emission vehicles. The bill provides for a phase-out of medium- and heavy-duty vehicles that are not electric or zero-emission vehicles. The USPS must provide by January 1, 2026, at each postal facility accessible to the public, at least one electric vehicle charging station for use by the public or USPS officers and employees.

The bill requires the Office of Personnel Management to establish, within the Federal Employees Health Benefits Program, the Postal Service Health Benefits Program for USPS employees and retirees and provides for coordinated enrollment of retirees under this program and Medicare. The bill repeals the requirement that the USPS annually prepay future retirement health benefits. Additionally, the USPS may establish a program to enter into agreements with an agency of any state government, local government, or tribal government, and with other government agencies, to provide certain nonpostal products and services that reasonably contribute to the costs of the USPS and meet other specified criteria. The USPS must develop and maintain a publicly available dashboard to track service performance and must report regularly on its operations and financial condition. The bill requires mail delivery to occur at least six days a week. The Postal Regulatory Commission must annually submit to the USPS a budget of its expenses. It must also conduct a study to identify the causes and effects of postal inefficiencies relating to flats (e.g., large envelopes). The USPS Office of Inspector General shall perform oversight of the Postal Regulatory Commission.

The authorization applies to an entity (including a winery, brewery, beverage distilled spirits plant, or other wholesaler, distributer, importer, or retailer of alcoholic beverages) that has registered with, obtained a permit from, or obtained approval of an application from the Department of the Treasury. The bill directs the U.S. Postal Service (USPS) to prescribe regulations (1) requiring direct delivery to a duly authorized agent at a postal facility or to the addressee, who must be at least 21 years of age and present a valid, government-issued photo identification at the time of delivery; (2) prohibiting such alcoholic beverages from being for resale or any other commercial purpose; and (3) requiring such entity to certify that the mailing is not in violation of applicable laws or regulations and to provide other information as directed by the USPS. The U.S. district courts shall have jurisdiction to render judgment upon any claim brought by a state, local, or tribal government against the USPS of a violation of state, local, or tribal law regarding the sale, mailing, transportation, or importation of alcoholic beverages into any U.S. state, territory, or district. The USPS shall not be liable for interest prior to judgment or for punitive damages.

Postal Service Improvement Act This bill requires mail-in ballots for federal elections to meet certain design and tracking requirements and revises authority to provide parental leave to postal employees. Specifically, each mail-in ballot must be carried or delivered in an envelope that contains a USPS barcode that enables tracking of each individual ballot, satisfies USPS requirements for ballot envelope design and for machinable (i.e., able to be processed using USPS equipment) letters, and includes the official election mail logo. The federal government must reimburse each state (including the District of Columbia and any U.S. territory or possession) for the cost of using the barcode service. The bill also provides paid parental leave to officers and employees of the USPS and the Postal Regulatory Commission.

Ending the Fentanyl Crisis Act of 2021 This bill modifies the drug quantity thresholds that trigger a mandatory minimum prison term for a defendant who manufactures, distributes, imports, exports, or possesses with intent to distribute fentanyl. Specifically, the bill reduces from 400 to 20 grams the fentanyl quantity and from 100 to 5 grams the fentanyl analogue quantity that trigger a mandatory minimum prison term for high-level first-time or repeat offenders. It also reduces from 40 to 2 grams the fentanyl quantity and from 10 to 0.5 grams the fentanyl analogue quantity that trigger a mandatory minimum prison term for low-level first-time or repeat offenders. Additionally, the bill directs the U.S. Postal Service to increase the availability of chemical screening devices and dedicate the appropriate number of personnel to interdict fentanyl and other substances that are unlawfully imported into the United States.
