Education and Energy Act of 2018 This bill amends the Mineral Leasing Act to require excess revenue from new mineral and geothermal leases to be provided to the states in which the revenue is generated to supplement the education of students in kindergarten through grade 12 and to supplement public support of institutions of higher education. The bill applies to revenue from new leases that are in excess of the Congressional Budget Office's estimated revenue for the leases in the prior fiscal year.

Addiction Prevention and Responsible Opioid Practices Act This bill establishes a series of requirements relating to opioid regulation, prescribing, and monitoring, including licensure requirements for pharmaceutical representatives, a national opioid drug mapping tool to monitor prescribing practices of Medicaid providers, and an excise tax on opioid manufacturers.

Primary Care Patient Protection Act of 2018 This bill amends the Internal Revenue Code to modify the requirements for the high deductible health plans that are required for health savings accounts. The bill requires the plans to offer coverage with no deductible for primary care services provided during the first two visits during a year to an individual's designated primary care provider. The primary care provider must be a general practitioner, family practice practitioner, general internist, obstetrician, gynecologist, pediatrician, geriatric physician, or advanced practice registered nurse acting in accordance with state laws.

Good Samaritan Charitable Physicians' Services Act of 2018 This bill amends the Internal Revenue Code to allow a tax deduction for direct primary care physicians who provide charity care. The care must be provided without expectation of reimbursement and to an individual enrolled in Medicaid or the Children's Health Insurance Program (CHIP). A "direct primary care physician" is a physician who provides primary care: (1) to individuals who have paid a periodic subscription fee, and (2) in exchange for a fee that is published on a publicly available website of the physician. The bill also amends the Public Health Service Act to specify that a physician is not liable under federal or state law for harm caused by an act or omission of the physician, or attending medical personnel supporting the physician, if the act or omission: (1) occurs in the course of furnishing charity care, and (2) was not grossly negligent. The bill preempts laws of a state or a political subdivision of the state that are inconsistent with this provision, unless the laws provide greater protection from liability for a defendant.

Fair Trade with China Enforcement Act This bill revises trade, finance, and tax provisions with respect to China. The bill directs the Department of Commerce to prohibit the export of certain U.S. technology and intellectual property to China. The bill amends the Securities Exchange Act of 1934 to place a shareholder cap on Chinese investments in certain U.S. corporations. Federal agencies are prohibited from using or procuring telecommunications equipment or services from Huawei Technologies Company, ZTE Corporation, or any other entity reasonably believed to be owned or controlled by China. The bill amends the Trade Act of 1974 to require the U.S. Trade Representative to list certain Chinese products that receive support pursuant to China's Made in China 2025 policy. The bill amends the Tariff Act of 1930 to expedite the countervailing duty process (i.e., the imposition of duties to offset a subsidy by a foreign government) for products on such a list. The bill amends the Internal Revenue Code to: repeal certain reduced withholding rates for residents of China, tax income received by China from certain U.S. investments, and tax income derived from certain Chinese investments.

Repeal the Trump Tax Hike on Victims of Sexual Harassment Act of 2018 This bill amends the Internal Revenue Code to modify a provision that prohibits a tax deduction for: (1) a settlement or payment related to sexual harassment or sexual abuse if such settlement or payment is subject to a nondisclosure agreement, or (2) attorney's fees related to such a settlement or payment. The bill specifies that the limitation on the deductibility of attorney's fees applies only to the taxpayer who is prohibited from deducting the cost of the payment or settlement and not the taxpayer who is receiving the payment or settlement.

Prescription Drug and Medical Device Price Review Board Act of 2018 This bill establishes the Prescription Drug and Medical Device Price Review Board within the Food and Drug Administration. Each manufacturer of a prescription drug or medical device that is sold in the United States must submit to the board: each type of prescription drug and medical device that it sells in the United States, or in a country that is a member of the Organization for Economic Co-operation and Development; the price charged by the manufacturer for the drug or device; and the costs of the manufacturer to produce them. The board must establish a formula for determining whether the average manufacturer price of a prescription drug or medical device over an annual quarter is an excessive price. Manufacturers may not charge excessive prices. Individuals may petition the board to determine whether the price for a prescription drug or medical device is excessive. The board may subject violators to reduced patent terms, civil penalties, and increased Medicaid rebates payable to states. The bill amends the Internal Revenue Code to impose a tax on the sale of prescription drugs or medical devices that have excessive prices. The board must allow individuals to import from approved counties prescription drugs and devices that are comparable to prescription drugs and devices with excessive prices.

Nuclear Powers America Act of 2018 This bill amends the Internal Revenue Code to allow a tax credit for investments in qualified nuclear energy property placed in service before January 1, 2024. The credit applies to any amounts paid or incurred for refueling or other specified expenditures for a nuclear power plant for which an application for license renewal was or will be submitted to the Nuclear Regulatory Commission before January 1, 2024.

America's Water Infrastructure Act of 2018 This bill requires the U.S. Army Corps of Engineers, each fiscal year, to submit to Congress a five-year budget and work plan for projects of national significance. Each Corps of Engineers district, each fiscal year, must submit a five-year budget and work plan for projects under its jurisdiction. Projects must be carried out in a sustainable manner that focuses on water resource challenges and opportunities, promotes collaboration, and pursues integrated water resource management. The bill reauthorizes provisions of the Water Resources Reform and Development Act of 2014 pertaining to expedited consideration of water resources infrastructure through 2024. The bill provides for: (1) the establishment of a Corps of Engineers Board of Appeals; and (2) various studies, project modifications, and project authorizations and deauthorizations nationwide. The Environmental Protection Agency must: (1) establish a voluntary stormwater infrastructure funding task force to develop recommendations to improve the funding and financing of stormwater infrastructure, and (2) promote green infrastructure to reduce stormwater flows to sewers or surface waters. The Safe Drinking Water Act is amended to establish a voluntary WaterSense program to identify and promote water-efficient products, buildings, landscapes, facilities, processes, and services.

Responsible Additions and Increases to Sustain Employee Health Benefits Act of 201 8 This bill amends the Internal Revenue Code, with respect to the tax exclusion for distributions from health flexible spending arrangements provided under a cafeteria plan, to: (1) increase the annual limit on employee salary reduction contributions to $5,000, with an additional $500 for each additional employee dependent above two dependents that has not been taken into account by another person for the year; (2) revise the adjustment for inflation after 2018; and (3) allow a carryforward into the next year for unused amounts in such plans.

Permanently Amending Tax Cuts for our Heroes Act of 2018 or the PATCH Act This bill amends the Internal Revenue Code to make permanent for members of the Armed Forces several tax provisions that are scheduled to expire at the end of 2025. For individuals who are members of the Armed Forces at the end of the taxable year, the bill makes permanent provisions that: reduce individual tax rates, increase the standard deduction, increase and modify the child tax credit, and increase the limit for deducting certain charitable contributions.

Superfund Enhancement Act of 2018 This bill amends the Internal Revenue Code to: (1) reinstate the Hazardous Substance Superfund financing rate (the Superfund tax) beginning on January 1, 2018; and (2) allow certain small businesses to expense up to $10,000 of the costs for relocating a trade or business carried on in a location which is situated on, or adjacent to, a site which is on, or proposed for, the national priorities list under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980. The bill also makes small businesses and individuals that are relocating from a Superfund site eligible for certain Small Business Administration disaster loans.

Volunteer Driver Tax Appreciation Act of 2018 This bill amends the Internal Revenue Code to increase the standard mileage rate for the tax deduction for the charitable use of a passenger automobile. The bill increases the rate from the standard charitable rate of 14 cents per mile to the standard business mileage rate (54.5 cents per mile for 2018).

Puerto Rico Insurance Excise Tax Exemption Act of 2018 This bill amends the Internal Revenue Code to exempt from the foreign insurer excise tax certain insurance policies, indemnity bonds, annuity contracts, or reinsurance policies issued by partnerships or corporations created or organized under the laws of a U.S. territory or possession. The exemption applies unless any of the covered hazards, risks, losses, or liabilities are also covered by a reinsurance policy issued by a foreign insurer or reinsurer other than the partnership or corporation.
