Energy Permitting Reform Act of 2024

Energy Permitting Reform Act of 2024 This bill generally reduces restrictions on the federal permitting process for mineral and energy projects. The bill revises the judicial review process for these projects, including by setting a 150-day deadline for filing civil actions seeking judicial review of a federal agency decision to grant or deny authorization of energy or mineral projects. The bill establishes deadlines for acting on applications for various energy and mineral projects. For example, the bill sets deadlines for the review of (1) federal coal lease applications, and (2) right-of-way applications with respect to renewable energy projects on public land. From 2025 to 2029, the Department of the Interior must hold at least one offshore wind lease sale and at least one offshore oil and gas lease sale per year.  The bill also revises electric transmission requirements, including by (1) expanding the Federal Energy Regulatory Commission’s (FERC's) authority to include issuing a permit for the construction or modification of certain types of interstate electricity infrastructure without a specified Department of Energy (DOE) designation, and (2) requiring the assessment of the reliability impacts of certain proposed federal regulations. The bill also sets a deadline for DOE to approve or deny certain liquefied natural gas export applications. If DOE does not meet the deadline, applications will be deemed approved. The bill authorizes FERC to extend the deadline for beginning construction for certain hydropower projects that were licensed by FERC.

Energy and Water Development and Related Agencies Appropriations Act, 2025 This bill provides FY2025 appropriations for U.S. Army Corps of Engineers civil works projects, the Department of the Interior's Bureau of Reclamation, the Department of Energy (DOE), and several independent agencies. The bill provides appropriations for U.S. Army Corps of Engineers civil works projects, including for Investigations, Construction, Mississippi River and Tributaries, Operation and Maintenance, the Regulatory Program, the Formerly Utilized Sites Remedial Action Program, Flood Control and Coastal Emergencies, Expenses, the Office of the Assistant Secretary of the Army for Civil Works, and the Water Infrastructure Finance and Innovation Program. The bill provides appropriations to the Department of the Interior for the Central Utah Project and the Bureau of Reclamation. The bill provides appropriations to DOE for energy programs, including Energy Efficiency and Renewable Energy; Cybersecurity, Energy Security, and Emergency Response; Electricity; Grid Deployment; Nuclear Energy; Fossil Energy and Carbon Management; Naval Petroleum and Oil Shale Reserves; the Strategic Petroleum Reserve; the Northeast Home Heating Oil Reserve; the Energy Information Administration; Non-Defense Environmental Cleanup; the Uranium Enrichment Decontamination and Decommissioning Fund; Science; Nuclear Waste Disposal; Technology Transitions; Clean Energy Demonstrations; the Advanced Research Projects Agency—Energy; the Title 17 Innovative Technology Loan Guarantee Program; the Advanced Technology Vehicles Manufacturing Loan Program; the Tribal Energy Loan Guarantee Program; Indian Energy Policy and Programs; Departmental Administration; and the Office of the Inspector General. The bill also provides appropriations to DOE for Atomic Energy Defense Activities of the National Nuclear Security Administration, Environmental and Other Defense Activities, and the Power Marketing Administrations. The bill provides appropriations to several independent agencies, including the Federal Energy Regulatory Commission and the Nuclear Regulatory Commission. The bill also sets forth requirements and restrictions for using funds provided by this and other appropriations acts.

Extreme Weather and Heat Response Modernization Act This bill requires the Federal Emergency Management Agency (FEMA) to specifically address extreme heat in hazard mitigation and disaster recovery, including reviewing the time frame for when extreme weather is an emergency or major disaster. FEMA must issue guidance relating to hazard mitigation and disaster recovery for extreme heat or extreme temperature events. FEMA must also convene an advisory panel to review its process for determining when an emergency- or disaster-causing incident begins and ends. Additionally, FEMA must conduct a study on the impacts of extreme heat, recommend guidance on mitigating and responding to extreme heat, and submit a report to Congress on these actions. The bill also authorizes FEMA to consider extreme heat preparedness and mitigation projects eligible under its Building Resilient Infrastructure and Communities program and Hazard Mitigation Grant Program.

The Amtrak Transparency and Accountability for Passengers and Taxpayers Act This bill directs Amtrak to comply with federal open meeting requirements under the Government in the Sunshine Act (i.e., the Sunshine Act), with exceptions. Under the bill, certain open meeting requirements do not apply when a majority of the members of the Amtrak Board of Directors meet to discuss official business and (1) no formal or informal vote or other official action is taken at the meeting, and (2) those present at the meeting are board members or board employees. Under these circumstances, Amtrak must make publicly available a (1) list of the individuals present at the meeting; and (2) summary of the matters discussed at the meeting, including the key issues. The bill includes an exclusion from these requirements for any matter the board properly determines may be withheld from the public under provisions of the Sunshine Act. If the board properly determines a matter may be withheld from the public, the board must provide a public summary of the matter that includes as much general information as possible. Further, Amtrak must brief Congress annually on the board's activities.

Amtrak Executive Bonus Disclosure Act This bill requires Amtrak to publicly disclose any performance-based bonus compensation paid to an Amtrak executive. Specifically, at least 30 days before awarding performance-based bonus compensation to an Amtrak executive, Amtrak must brief Congress on (1) the proposed bonus, and (2) the criteria and metrics used to calculate the bonus. Further, Amtrak must publish in the Federal Register (1) a notice of any bonus compensation awarded to an executive (within 30 days after awarding the bonus), and (2) the criteria and metrics used to calculate the bonus.

Amtrak Transparency Act This bill increases Amtrak's open meeting and public disclosure requirements. Specifically, the Amtrak Board of Directors must comply with federal open meeting requirements under the Government in the Sunshine Act. In addition, at least 30 days prior to the board convening, the board must publicly post an announcement of the meeting and the anticipated meeting agenda. The board must also annually convene a meeting to which state departments of transportation with long-distance routes or state-supported routes are invited to participate. Further, Amtrak must publicly disclose the discretionary bonus compensation paid to an Amtrak officer or non-bargaining unit employee. Upon request, Amtrak must also disclose to a state or the State-Amtrak Intercity Passenger Rail Committee vendor agreements of $250,000 or more for certain services on state-supported routes.

Decoupling from Foreign Adversarial Battery Dependence Act of 2024 This bill prohibits the Department of Homeland Security (DHS) from using appropriated funds to procure a battery produced by certain Chinese entities. This prohibition begins on October 1, 2027. The bill allows DHS to waive the prohibition if DHS assesses in the affirmative all of the following: the batteries to be procured do not pose a risk to U.S. national security, data, or infrastructure; the entity that produced such batteries does not satisfy the criteria for listing under Section 1260H of the National Defense Authorization Act for Fiscal Year 2021 (i.e., designation as a Chinese military company) or Public Law 117-78 (i.e., goods produced using forced labor in China, especially the Xinjiang Uyghur Autonomous Region); and  there is no available alternative to procure batteries that are of similar or better cost and quality and that are produced by an entity not specified in this bill. DHS may also waive the prohibition upon a determination that the batteries to be procured are for the sole purpose of research, evaluation, training, testing, or analysis. The bill requires DHS to notify Congress within 15 days after granting a waiver under this bill.
