Klamath Basin Water Agreement Support Act of 2024

Klamath Basin Water Agreement Support Act of 2024 This act expands the Klamath Basin Water Supply Enhancement Act of 2000, including by authorizing the Bureau of Reclamation to implement restoration activities in the Klamath Basin watershed in Oregon and California. Specifically, Reclamation may plan, construct, operate, and maintain projects in the basin watershed, including facilities to reduce fish entrainment (i.e., the transport of fish along the flow of water, out of their normal habitat and into unnatural or harmful environments); projects that reduce or avoid impacts on aquatic resources caused by diversion of water for irrigation; and projects that restore basin watershed habitats, such as tribal fishery resources held in trust. Reclamation may also  undertake studies and improvements to implement restoration activities in the basin watershed; enter into contracts and agreements with state and local governments, tribes, and private parties to implement restoration activities; and accept and expend nonfederal funds in order to facilitate the activities. In addition, the act authorizes Reclamation to reimburse Tulelake Irrigation District for up to 69% of the costs for the operation and maintenance of the irrigation Pumping Plant D in Tulelake, California.  Further, the act provides statutory authorization for Reclamation to implement the 2016 Klamath Power and Facilities Agreement that directs Reclamation to take ownership and operation of the Keno Dam and operation of the Link River Dam.

This bill directs the Bureau of Reclamation and the Western Area Power Administration, in consultation with the Glen Canyon Dam Adaptive Management Work Group, to enter into a memorandum of understanding to explore and address the potential impact that the final Supplemental Environmental Impact Statement (SEIS) for the Glen Canyon Dam Long-Term Experimental and Management Plan (LTEMP) has on the Upper Colorado River Basin Fund. The memorandum of understanding must include a plan to (1) explore and address the effects that the decision may have on the contents of the fund, (2) analyze and address the long-term impact that the decision may have on hydropower production at Glen Canyon Dam, and (3) protect the Colorado River Basin and any threatened or endangered species in the basin from the effects of invasive species and sustained drought. By way of background, Reclamation published the SEIS under the National Environmental Policy Act of 1969 for the LTEMP in 2024. The SEIS revises the 2016 LTEMP Record of Decision to address two issues: (1) responding to the threat of the invasive smallmouth bass below Glen Canyon Dam, and (2) incorporating the latest sediment science to assess when high-flow experiments should be conducted in order to protect the endangered humpback chub.

Sacramento RIVER Act of 2024

Sacramento River Improvement and Vitality for Ecosystem Restoration Act of 2024 or the Sacramento RIVER Act of 2024 This bill authorizes a federal leadership committee to support habitat restoration projects. It also allows revenue from the sale of surplus water to be used for drought resilience investments, extraordinary maintenance activities, and dam safety investments. Specifically, the bill authorizes the Department of the Interior, upon the request of an eligible entity, to establish the Integrated Water Management Federal Leadership Committee. Eligible entity means an entity or qualified partner sponsoring a habitat restoration project in a watershed in which a Bureau of Reclamation project is located and that receives a grant, cooperative agreement, or other financial assistance agreement from Interior. Committee members must establish the duties and responsibilities of the committee, which must include facilitating communication and collaboration among federal agencies to support and advance any habitat restoration projects for which an eligible entity requests committee assistance. Additionally, under current law, revenue from the sale of surplus water must be deposited into the Reclamation Fund and credited to the capital repayment of the associated project. This bill allows revenue that would otherwise be deposited into this fund, upon completion of capital repayment, to be used for additional activities. Specifically, this revenue may be used for drought resilience investments, extraordinary maintenance activities, and dam safety investments.

This bill modifies the Aquifer Recharge Flexibility Act to expand provisions concerning authorizations (e.g., rights-of-way) to transport water across public land administered by the Bureau of Land Management (BLM) for aquifer recharge purposes. Under the Aquifer Recharge Flexibility Act, the holder of existing rights-of-way, easements, permits, or other authorizations to transport water across BLM land may transport the water for aquifer recharge purposes without additional authorization from the Department of the Interior so long as the use does not expand or modify the operation of such authorizations across public land. The bill allows the holders of such authorizations to act, not only on behalf of themselves, but also on behalf of third parties to use the existing authorizations for aquifer recharge without additional authorization from Interior.

Dakota Water Resources Act Amendments of 2024 This bill authorizes additional funding for municipal, rural, and industrial water supply projects in North Dakota and on tribal land in North Dakota. Specifically, the bill authorizes additional funding, as indexed, to complete the following projects in North Dakota: the Northwest Area Water Supply Biota Water Treatment Plant and Pump Station Project, the McClusky Canal and Missouri River North Alternative for the Eastern North Dakota Alternate Water Supply Project, specified activities (e.g., transmission line upgrades) for the Southwest Pipeline Project, and water treatment and rural distribution expansion for North Dakota rural water districts. Additionally, the bill authorizes additional funding, as indexed, to complete the following projects on tribal land: the Spirit Lake Rural Water System within the Fort Totten Indian Reservation, the Three Affiliated Tribes Rural Water System within the Fort Berthold Indian Reservation, the Standing Rock Rural Water System within the Standing Rock Indian Reservation, the Turtle Mountain Rural Water System within the Turtle Mountain Indian Reservation, and a feasibility study for the construction of a rural water system to meet the drinking water needs of the Lake Traverse Rural Water System within the Lake Traverse Indian Reservation. The bill also authorizes additional funding for the North Dakota Natural Resources Trust.

Swanson and Hugh Butler Reservoirs Land Conveyances Act This bill provides for the conveyance of certain federal lands located at the Swanson Reservoir and Hugh Butler Reservoir in Nebraska to Hitchcock County and Frontier County, respectively. The counties must manage the land for substantially the same purposes for which they are being used or for (1) certain public recreation purposes, (2) public access, (3) fish and wildlife habitat, or (4) the preservation of the natural character of the land. Within three years, the Bureau of Reclamation must enter into negotiations to transfer (1) the Swanson Permitted Cabin Land, the Swanson Permitted Concession Land, and the Lakeview Lodge Permitted Concession Land to Hitchcock County; and (2) the Red Willow Permitted Cabin Land and the Red Willow Permitted Concession Land to Frontier County. Reclamation must offer to convey the land as soon as practicable after the title transfer agreement is made. The land must be conveyed in whole and not subdivided. Additionally, the bill subjects the conveyances to certain existing rights and requirements. Further, the bill limits future conveyances of the land. Reclamation must enter into a memorandum of agreement with each county to establish and define the roles and responsibilities for actions required to convey the land. The counties must provide compensation to the Reclamation Fund in an amount equal to the fair market value of the land. The counties must also pay the conveyance costs in advance of the conveyance.

Urban Canal Modernization Act

Urban Canal Modernization Act This bill expands the Bureau of Reclamation's responsibility under the Omnibus Public Land Management Act of 2009 to address aging irrigation and water resources infrastructure in western states to include additional work for urban canals of concern. Specifically, the bill directs Reclamation or the operating entity of a transferred work (i.e., infrastructure owned by Reclamation, but maintained by a nonfederal entity) to carry out any necessary extraordinary operation and maintenance work for urban canals of concern, which are certain transferred works the failure of which would result in loss of life and property in the vicinity of the canal. Reclamation must also provide federal funds to transferred works on a nonreimbursable basis sufficient to cover 35% of the cost of extraordinary operation and maintenance work for (1) urban canals of concern, and (2) certain project facilities which are in proximity to urbanized areas and which could pose a risk to public safety or property if the facilities failed. The bill further specifies that any reimbursable funds provided under the bill must be considered a nonfederal source of funds for purposes of federal grant cost-sharing requirements.

Lake Access Keeping Economies Strong Act or the LAKES Act This bill modifies requirements relating to the collection and retention of user fees at certain recreation facilities. Specifically, the bill modifies requirements for a cost-sharing program for the management of recreation facilities established by the Water Resources Development Act of 1992. Currently, the U.S. Army Corps of Engineers may enter into cooperative agreements with nonfederal public and private entities to provide for operation and management of recreation facilities and natural resources at civil works projects. The bill requires private entities entering such agreements to be nonprofit. The bill requires the Corps, before entering into a cooperative agreement, to ensure that such entities have the authority and capability to (1) carry out the terms of the agreement, and (2) pay any damages in the event of a failure to perform. It also authorizes the Corps to allow private nonprofit entities to collect user fees. Currently, only nonfederal public entities may collect such fees. The bill also authorizes the Corps and other federal agencies to transfer to nonfederal public entities or private nonprofit entities user fees received by the Corps or another federal agency under a visitor reservation service for recreation facilities and natural resources managed by the nonfederal public entities or private nonprofit entities. In addition, the bill modifies requirements under the Flood Control Act of 1968 to direct the Corps to spend at least 80% of the fees collected at a recreational site for the operation and maintenance of that site.
