Summary

Amends the National Labor Relations Act to make decisions concerning plant closings (as defined by this Act) or permanent layoffs a mandatory subject of collective bargaining. Makes such closings or layoffs an unfair labor practice unless: (1) an employer gives written notice of such an order to the union and the Federal Mediation and Conciliation Service (FMCS); and (2) the employer bargains collectively over a 90-day period with the union (unless the FMCS determines that such bargaining would be futile).
