Summary

Department of Justice Litigation Improvement Act - Title I: Litigation Authority of the Attorney General - Directs the Attorney General to: (1) submit a copy of any agreement with another agency which affects the litigation authority of the Department to the Congressional judiciary committees 30 days before its effectiveness; (2) resolve all legal disputes between two or more agencies, absent other specific statutory authority; and (3) report to such committees at the beginning of each Congress on the status of litigation authority, coordinating efforts, and legislative proposals. Title II: Department of Justice Report on Federal Case Management - Directs the Attorney General to submit to the Congressional judiciary committees a systems development plan for the activation and coordination within the Department of compatible, comprehensive case management information and tracking systems for each judicial district and Department division. Authorizes appropriations for fiscal year 1981 for such purpose. Title III: Status of Cases Referred to the Department of Justice - Directs the Attorney General, until completion of the planned systems under title II, to include in the authorization request a report on the status of cases referred to the Department by the Inspector General of any agency. Title IV: Department of Justice Report to Congress - Directs the Attorney General to report to Congress within 30 days after determining that a provision of law is unconstitutional and: (1) will not be enforced by the Justice Department; or (2) will be contested or not defended by the Justice Department. Requires the Department's representative, at a legal or administrative proceeding at which the Department is contesting or refusing to defend a provision of law, to announce that the Department's position on the constitutionality of such provision is that of the executive branch.
