Summary
Education Regulatory Reform Act - Establishes in the Department of Health, Education, and Welfare the position of Under Secretary for Education to replace the offices of Assistant Secretary for Education and Commissioner of Education. Conditions the authority of the Secretary of Health, Education, and Welfare to issue regulations regarding elementary and secondary schools by: (1) requiring the Secretary to prepare an educational impact statement; (2) limiting the validity of regulations to five years; and (3) exempting local educational agencies receiving less than ten percent of their annual budget from Federal funds from being considered as receiving Federal funds for purposes of compliance with most Federal enforcement provisions.
