WP B87 und H06, Abschlußband S. 977 und 1056) Siehe auch B22 und B41 <br><br><b>Inhalt:</b> Zusammenfassung und Präzisierung der Rechtsgrundlagen über die Erhebung und Verarbeitung personenbezogener Daten in einem Artikelgesetz, besondere Berücksichtigung der Wahrung des Rechts auf informationelle Selbstbestimmung auf der Grundlage des Volkszählungsurteils des Bundesverfassungsgerichts vom 15.12.1983; Neufassung des Bundesdatenschutzgesetzes als Art. 1: Verstärkung der Zweckbindung bei der Verarbeitung und Nutzung personenbezogener Daten, Ausweitung der Rechte der Betroffenen, Zulässigkeitsvoraussetzungen für automatisierte Abrufverfahren, Ausweitung der Kontrollbefugnisse des Bundesbeauftragten für den Datenschutz, Einführung eines Zeugnisverweigerungsrechts für den Bundesbeauftragten und seine Mitarbeiter; Änderung der §§ 2, 3, 26 und 30 des Verwaltungsverfahrensgesetzes: Vorschriften über den Umgang mit personenbezogenen Informationen im Bereich der öffentlich- rechtlichen Verwaltung; Neufassung des Bundesverfassungsschutzgesetzes als Art. 3: Festlegung der Zulässigkeitsvoraussetzungen für das Errichten und Bereithalten gemeinsamer Datenbestände durch die Verfassungsschutzbehörden, Präzisierung der Vorschriften über die Erhebung und Übermittlung sowie die Berichtigung und Löschung personenbezogener Informationen, Schutzvorschriften für Minderjährige; MAD-Gesetz als Art. 4 und BND- Gesetz als Art. 5: Festlegung der Aufgaben und Befugnisse des Militärischen Abschirmdienstes und des Bundesnachrichtendienstes, datenschutzrechtliche Vorschriften für die Erhebung und Übermittlung von Informationen im Bereich der Sicherheitsdienste. Für den Bund entstehen voraussichtlich keine Mehrbelastungen, den Ländern können Mehrkosten entstehen. <br><br><b>Änderungen aufgrund der Ausschußempfehlung:</b> Änderungen des Bundesdatenschutzgesetzes: Erweiterung des Auskunftsrechts des Bürgers, Wahl des Bundesbeauftragten für den Datenschutz durch den Deutschen Bundestag, Ausdehnung der verschuldensunabhängigen Haftung im öffentlichen Bereich, Regelung von Schadenersatzansprüchen, Zulässigkeitskriterien für die Übermittlung von listenmäßig zusammengefaßten Daten; Änderungen des Bundesverfassungsschutzgesetzes: Konkretisierung des Begriffs der Bestrebungen gegen die freiheitliche demokratische Grundordnung, Zusammenfassung der vom BfV anzuwendenden Methoden in einer Dienstvorschrift, Regelungen für das Abhören und Aufzeichnen des nicht-öffentlichen Wortes sowie für heimliche Bildaufnahmen, Präzisierung der Bestimmungen zur Datenübermittlung und Auskunfterteilung, Nichtzulässigkeit der Speicherung und Übermittlung von Daten über Minderjährige. <br><br><b>Änderungen durch das Vermittlungsverfahren:</b> Bundesdatenschutzgesetz: Zweck und Anwendungsbereich des Gesetzes, Forschungsfreiheit und informationelle Selbstbestimmung; Bundesverfassungsschutzgesetz: Einfügung §§ 3a und 3b betr. Präzisierung der Aufgabenbeschreibung des Gesetzes und Aufgabenabgrenzung zwischen Bundesamt für Verfassungsschutz und Landesbehörden, Streichung des § 25; MAD-Gesetz: Aufgaben des MAD, Verfahren der Durchführung einer Sicherheitsüberprüfung; Änderung § 69 10.
