Summary
Eelnõuga ajakohastatakse isikunime andmise ja muutmise korda, et see vastaks tänapäevasele elukorraldusele. Nime andmise, vahetamise ja muutmise reeglid ning seaduse struktuur muutuvad selgemaks. Menetlus viiakse suuremas ulatuses e-rahvastikuregistrisse. E-avaldusi saavad menetleda nii kohalikud omavalitsused kui siseministeerium ning nõuetele vastavatel juhtudel saab otsuse teha automaatselt. Muudatustega vähendatakse identiteedivarguse võimalusi ja piiratakse raskete kuritegude toimepanijate võimalust oma minevikku nimevahetusega varjata. Vabalt valitud perekonnanime ja eesnime taotlemisel on piiranguks, et uus isikunimi ei või kokku langeda juba kasutusel oleva isikunimega, et vältida identiteedipettusi ja nimekaimude teket. Piirang ei puuduta perekondliku seose alusel saadavat nime, nt esivanema perekonnanime. Senisest liiga vähese või laialdase kasutusega perekonnanimede andmise piirangust loobutakse. Muud piirangud on sarnased kehtivale seadusele. Perekonnanime valikul arvestatakse senisest paremini seost rahvuse või keele nimetraditsiooniga. Põlvnemisest tuleneva seose korral saab teha erandi eesti õigekirjareeglitest, kui nimi vastab asjaomasele nimetraditsioonile. Lapse sünni registreerimisel teavitatakse vanemaid, kas ja mitu samasuguse isikunimega inimest Eestis juba elab ning mis on nende isikute vanus. Nime muutmisel lähtutakse edaspidi senisest enam inimese vajadusest loobuda oma praegusest nimest, mitte soovist võtta endale konkreetne juba kasutusel olev nimi. Olulise muudatusena piiratakse teatud kuritegudes süüdi mõistetud inimeste võimalust nime muuta. Vägistamise, kehalise väärkohtlemise, laste vastu suunatud kuritegude, rahapesu, narkokuritegude ja organiseeritud kuritegevuse jm puhul kehtib nime muutmise piirang kuni karistusandmete kustutamiseni. Raskemate kuritegude puhul kehtestatakse eluaegne nime muutmise keeld. See puudutab muu hulgas mõrva, riigireetmist, raskendavatel asjaoludel toime pandud vägistamist ja lastevastaseid kuritegusid, samuti sõjakuritegusid ja sõjapropagandat, salakuulamist ning inimkaubandust.
