Summary
Täpsustatakse võimalusi ametisaladustega kaetud teatud teabe saamiseks ja kasutamiseks kriminaalmenetluses. Luuakse mehhanismid, mis tagaksid, et kaitstav teave oleks kaitstud põhjendamatu ilmsikstuleku eest. Antakse võimalus kaasuspõhiselt tasakaalustada kriminaalmenetluse huvid ja inimeste õigus privaatsusele ning tagada usalduslik suhe reguleeritud ameti pidajate ja klientide vahel. Eelnõus loetletakse isikud, kellel on kriminaalmenetluses ametiprivileeg (advokaat, kaitsja, notar, patendivolinik, vaimulik, ajakirjanduslikul eesmärgil informatsiooni töötlev isik, tervishoiuteenuse osutaja ja tervishoiutöötaja, pankrotihaldur, haldusmenetluse (sh riikliku järelevalve) teostaja), ning sätestatakse, millistele andmetele ametiprivileeg kohaldub.
