Summary
Eelnõuga soovitakse täiendada lapse andmete registreerimise korda olukorras, kui laps sünnib kodus või teel tervishoiuteenuse osutaja juurde. Sellistel juhtudel väljastab eelnõu kohaselt vastava tõendi perearst. Praegu kehtiva seaduse tingimustes on paljudel kordadel leidnud kodus või teel haiglasse lapse sünnitanud vanemad end olukorrast, kus ainus võimalus lapse sünni registreerimiseks on viia läbi DNA ekspertiis emaduse tõendamiseks ja taotleda sellele tuginedes lapse sünni registreerimist kohtu kaudu. Seejuures ei ole seaduses üldse ette nähtud emaduse tuvastamise menetlust ning eelnevalt osutatud vajadus tõendada emadust DNA testiga on lihtsalt kohtupraktikas kasutusele võetud moodus.
