Summary
The bill transposes three European Union directives. These are the classic directive, the network directive and the concession directive, which modernize and make the organization of public procurement more flexible, and also reduce the time and money spent by both procurers and providers. The draft creates the foundations for the transition to paperless e-government procurement. The obligation to fully switch to e-government procurement will arise by October 18, 2018. During the transition period, suppliers to adapt to the new norms and to carry out information technology development work necessary for a smooth transition. The obligation to organize e-procurements to the extent of 70% of the procurements started in the register is from 2017 and to the extent of 100% from 2018. A new type of procurement procedure is added - innovation partnership, which can be used to develop and acquire an innovative product, service or construction work that is missing on the market. State procurement thresholds will be changed and simplified access to public procurement for small and medium-sized enterprises, and the possibilities to change the procurement contract become significantly more flexible. Small-scale (10% of the initial cost of goods and services or 15% of the original cost of the procurement contract for construction works) changes in the procurement contract are allowed in the future without additional substantiation. The regulation of value-based procurement will be updated and the reporting obligation of procurers will be reduced. Bids will be evaluated in the future, primarily on the basis of price and quality, but enabling environmental, social and innovative aspects to be better taken into account compared to the current law. An innovative approach to the evaluation criteria is that it is possible to determine the cost of the procurement contract in the basic documents of the public procurement and to evaluate the offers only based on qualitative, environmental or social criteria.
