Summary
Eelnõuga võetakse üle kolm Euroopa Liidu direktiivi. Need on klassikaline direktiiv, võrgustikudirektiiv ja kontsessioonidirektiiv, mis kaasajastavad ja muudavad paindlikumaks riigihangete korralduse ning ühtlasi vähendavad nii hankijate kui pakkujate aja- ja rahakulu. Eelnõuga luuakse alused üleminekuks paberivabale e-riigihangete korraldamisele. Kohustus tekib üle minna e-riigihangetele täielikult 18. oktoobriks 2018. Üleminekuajal saavad hankijad kohaneda uute normidega ning teha sujuvaks üleminekuks vajalikke infotehnoloogilisi arendustöid. Kohustuse korraldada e-hankeid 70% ulatuses registris alustatud hangetest on aastast 2017 ja 100% ulatuses aastast 2018. Lisandub uus hankemenetluse liik – innovatsioonipartnerlus, mida saab kasutada turul puuduva innovaatilise toote, teenuse või ehitustöö arendamiseks ja soetamiseks. Muudetakse riigihanke piirmäärasid, lihtsustatakse väikese ja keskmise suurusega ettevõtjatele riigihangetele juurdepääsu ning oluliselt paindlikumaks muutuvad hankelepingu muutmise võimalused. Väikesemahulised (10% asjade ja teenuste või 15% ehitustööde hankelepingu algsest maksumusest) muudatused hankelepingus on tulevikus lubatud täiendava põhjendamiskohustuseta. Ajakohastatakse väärtuspõhise hankimise regulatsiooni ning vähendatakse hankijate aruandluskohustust. Pakkumuste hindamine toimub ka edaspidi eelkõige hinna ja kvaliteedi alusel, kuid võimaldades kehtiva seadusega võrreldes paremini arvestada keskkonnahoidlikke, sotsiaalseid ja innovaatilisi aspekte. Innovaatiline lähenemine hindamiskriteeriumide juures on see, et võimalik on hankelepingu maksumus riigihanke alusdokumentides kindlaks määrata ning hinnata pakkumusi üksnes kvalitatiivsetest, keskkonnalastest või sotsiaalsetest kriteeriumidest lähtuvalt.
